BYLAW
NO. 10-68
A BYLAW OF THE CITY OF LLOYDMINSTER IN THE
PROVINCES OF ALBERTA AND SASKATCHEWAN TO
REGULATE AND CONTROL CEMETERIES.
THE COUNCIL OF THE CITY OF LLOYDMINSTER ENACTS AS FOLLOWS:
"Medical Health Officer" shall mean the Medical Health Officer
1. (a)
of the City of Lloydminster for the time being duly appointed and
anyone acting as such during his absence for any cause.
"Superintendent" shall mean the Superintendent of Parks and

Cemeteries for the City of Lloydminster for the time being duly appointed
or anyone acting as such during his absence for any cause.
"Cemetery" shall mean any Cemetery owned by the City of

Lloydminster.
(d)
"Council" shall mean the Council of the City of Lloydminster.
"City Treasurer" shall mean the Treasurer of the City of

Lloydminster for the time being duly appointed, or any person acting on
his behalf.
(f)
"Supervisor" shall mean a person duly appointed by the Council.
No person shall bury any body in the City of Lloydminster

until such person shall have complied with the provisions of the Public
Health Act and the Vital Statistics Act of the Province of Saskatchewan
and any regulations issued thereunder, and shall also have complied with
the provisions of this Bylaw and any amendments thereto,
The Citymay grant a licence to any person for the exclusive

use by him, his heirs, executors or administrators of any single grave,
plot or plots, such licence to be subject to all the provisions of this
Bylaw and any amendments thereto or regulations thereunder passed from
time to time by the Council of the City of Lloydminster.
The licence fee and all charges for work done at the Cemetery
shall be in accordance with the rates as set out in Schedule "A" to this
Bylaw, or as such Schedule may be amended from time to time by resolution
of the Council.

Any licensee of a single grave or plot may surrender his licence
to the City for any unused grave or part of a plot and in such case
the City will grant a licence as opportunity arises to some other person
and upon such grant being made will refund to the original licensee the
money paid by him less Five Dollars ($5.00) per grave or plot to cover
the registration fee. Where an exhumation has been made the license for
the used grave shall automatically revert to the City. No licence shall
be transferred or dealt with other than as provided herein.

6. Any licensee of any grave, plot or plots and who, having the necessary
authority, desires to have a grave dug therein, shall first pay to the
City Treasurer or licensed Funeral Home the fees for opening a grave in
accordance with the rates set out in Schedule "A" to this Bylaw and
obtain a receipt therefore which receipt shall be presented to the
Superintendent (or Supervisor) of the Cemetery as his authority to open
up the grave as set out in the said receipt.
7. Notice that an interment is to take place shall be given to the
Superintendent (or Supervisor) at least thirty-six (36) hours before
the interment is to take place. This provision shall not apply to
any person who has died of any communicable disease.
8, All applications for permits for the exhuming of a body shall be
made to the Medical Health Officer and/or the Director of Vital Statistics
for the Province of Saskatchewan,

Any person may have any grave, plot or plots cared for by making
-2payment to the City in accordance with the provisions of Schedule "A"
to this Bylaw.
10. No unauthorized person shall do work of any kind in the Cemetery
excepting it to be the planting of flowers upon or decorating a grave,
plot or plots.
11. One body only shall be interred in a grave excepting with the
permission of the Medical Health Officer.
12.. No grave for the burial of the body of an adult person shall be
less than six (6) feet in depth from the surface of the ground
surrounding the grave.
13,. After the passing of this Bylaw, no borders, fences, railings,
copings, trellises or hedges shall be constructed, placed or planted
in or around any grave, plot or plots unless with the permission of
the Superintendent first had and obtained. Posts of iron, concrete
or stone to mark corners shall be permitted but these must be placed
within the limits of the grave, plot or plots and must not project
above the surface of the ground. Borders, fences, railings, copings,
trellises or hedges in existence prior to the passing of this Bylaw
will be removed by the City free of charge at the request of the
licensee.
14. Borders, fences, railings, copings, trellises, hedges and other
enclosures heretofore erected may be removed by the City if by reason
of neglect or age they are in such a state of disrepair and the
licensee has neglected or refused to repair or remove the same after
a notice in writing requesting him so to do has been forwarded to him
by mail to his last known address,
15, No person shall place or erect in any Cemetery any tombstone,
marker, monument or any like structure or make alterations of any
kind to the same heretofore placed or erected until he shall have
furnished the Superintendent with all necessary information required
by him and shall have obtained a permit therefore.
16. All foundations and footings for the erection of tombstones, markers,
monuments and any like structures shall be constructed under the
direction and supervision of the Superintendent and all specifications
for any such structures shall be furnished by the said Superintendent
or approved by him.
17. If any tombstone, marker, monument or like structure placed or
erected in the Cemetery be in a state of disrepair the City may,
after forwarding the notice in writing to the licensee by mail to
his last known address requesting him to repair the same, cause the
same to be removed from the Cemetery if the said licensee does not
have the same repaired in accordance with the said notice.
(a) that no person shall be permitted to construct a curb made of
cement, metal or other material around any grave, cover any grave with
the said materials or erect or construct any stone memorial or monument
of any kind in the Cemetery Addition.
(b) Notwithstanding the provisions of Clause 17 (a) however, any person
may have a plaque placed on a grave in the Cemetery Addition, The
said plaque may be construced of cement, stone, or metal and shall be
inserted in the grave so that the surface of the plaque shall be level
with the surface of the grave. The size of a plaque for a single grave
or a double grave shall not exceed 11" x 28"

All funerals must reach the Cemetery not later than four o'clock
in the afternoon unless with the permission of the Superintendent
first had and obtained.

No person, other than a qualified, licensed undertaker shall

to remove the said trees, shrubs, plants or parts thereof.

No dog or other animal shall be allowed in the Cemetery.
No person shall destroy, mutilate, deface, injure or remove

coping or other work for the protection or ornamentation of the
Cemetery or of any tombstone, marker, monument or like structure except
as herein provided.
No person shall cut, break, trim, injure or destroy any tree,

shrub or plant excepting as herein provided.

delivered to the Cemetery unless with the permission of the Superintendent first had and obtained.

Vehicles shall keep to the roads provided for the same in the
Cemetery and shall not travel at a rate of speed greater than ten
miles per hour.
The Cemetery shall be closed to all vehicles from five

o'clock in the afternoon or sunset, whichever is later, until eight
o'clock in the morning of the next following day and to the public from
sunset until sunrise of the next following day unless with the permission
of the Superintendent first had and obtained.

The Superintendent may remove from any part of the Cemetery
any object, matter or thing left therein which he deems to be unsightly
or undesirable.
Any person who violates any of the provisions of this Bylaw

or any part or parts thereof shall be liable upon summary conviction
by a Police Magistrate or Justice of the Peace, the territorial limits
of whose jurisdiction include the place of the occurence of the breach,
to a fine not exceeding One Hundred ($100.00) Dollars and costs.

preceding clause hereof shall be liable in default of his payment of
of such fine and costs, to a sentence of imprisonment in a common
gaol for a period of not exceeding 30 days, with or without hard
labour, notwithstanding said liability of any convicted person to

Peace may in lieu of imposing such gaol sentence as aforesaid, by
warrant direct the recovery of any fine and costs imposed hereunder
by distress against and upon the goods, chattels and effects of
such convicted person.

A BYLAW OF THE CITY OF LLOYDMINSTER,
THE PROVINCES OF ALBERTA AND SASKATCHEWAN
UNDER THE LOCAL IMPROVEMENTS ACT, R.S.S.
1965, RESPECTING THE AUTHORIZATION OF THE
ISSUE OF DEBENTURES OF THE SAID CITY OF
LLOYDMINSTER IN THE AMOUNT OF THREE HUNDRED
AND SIXTY-THREE THOUSAND, FIVE HUNDRED AND
TWENTY-FIVE DOLLARS AND EIGHTY-SIX CENTS
($363,525.86) TO FINANCE THE CONSTRUCTION
OF PAVING, CURBS AND GUTTERS.
WHEREAS pursuant to notice of intention regularly
given by publication in the Lloydminster Times on the 31st day of May, 1967,
and the 7th day of June, 1967, and by virtue of the authorization contained
in Bylaw No 1211, paving, curbs and gutters have been constructed as shown
in Schedule "A" and the lifetime of the said work has been duly ascertained
and finally determined as Twenty (20) years; and
WHEREAS the special assessment for part of the cost
payable by special frontage assessment has been made and all appeals
therefrom have been duly heard and determined as provided by the Local
Improvements Act, and
WHEREAS the approval of the Local Government Board has been
obtained authorizing the City of Lloydminster to construct the said works
set out in Bylaw No 1211, and
WHEREAS the provisions of the Local Improvements Act,
R.S.S. 1965 have been complied with respecting the undertaking of the
construction of paving, curbs and gutters as a local improvement, and
WHEREAS the total cost of the said works so constructed
is Four Hundred and Twenty-four Thousand, Four Hundred and Eighty-three
Dollars and Thirteen Cents ($424,483.13) of which the sum of Three Hundred
and Sixty-three Thousand, Five Hundred and Twenty-five Dollars and Eightysix Cents ($363,525.86) is to be borrowed, the sum of Two Hundred Eightythree Thousand, One Hundred Dollars ($283,100.00) to be paid by the Owners
of the properties abutting on the streets whereon the said work is
constructed, and the sum of One Hundred and Forty-one Thousand, Three
Hundred Eighty-three Dollars and Thirteen Cents ($141,383.13) to be paid by
the City at large as set out in Schedule "A" to this bylaw, and

WHEREAS for the purpose of paying the cost to the
City of the said works set out in Schedule "A" it is necessary to borrow
the sum of Three Hundred and Sixty-three Thousand, Five Hundred and Twentyfive Dollars and Eighty-six Cents ($363,525.86) which is the amount of the
debt intended to be created by this Bylaw and to issue debentures therefore;
and
WHEREAS the Council of the City of Lloydminster has
been authorized by complimentary orders in council of the Provinces of
Saskatchewan and Alberta to borrow the sum of Three Hundred and Sixtythree Thousand, Five Hundred and Twenty-five Dollars and Eighty-six Cents
($363,525.86) for the purpose of financing the cost of constructing paving,
curbs and gutters and to
issue debentures for the said purpose in the sum
of Three Hundred and Sixty-three Thousand, Five Hundred and Twenty-five
Dollars and Eighty-six Cents ($363,525.86) to be payable over a period of
Twenty (20) years with interest at the rate not exceeding Eight per centum
(8%) per annum, and
WHEREAS it is expedient to make the principal of the
said debt repayable in Twenty (20) equal consecutive annual installments
in such manner that the amount of the annual installments of principal and
interest payable in each year shall be as nearly as possible equal to the
amount of the installments of principal and interest payable in each of the
other years of the said period of Twenty (20) years, and
WHEREAS the number of feet frontage of the land abutting
and assessable on the streets aforesaid; the cost per foot frontage
chargeable against the lands abutting on the said works; the rate per foot
frontage to be levied in each year for a period of Twenty (20) years on the
lands chargeable by the special frontage assessment are as set out in
Schedule "B" to this Bylaw, and
WHEREAS it will require a total amount of Thirty-five
Thousand Six Hundred and Fifty-six Dollars and Fifty-one Cents ($35,656.51)
to be raised annually for the said period of Twenty (20) years for the
payment of the debt and interest as set out in Schedule "C" and "El" to
this bylaw, and
WHEREAS the total value of the land upon which the
special assessment hereinafter provided for is to be levied according to the
last revised assessment roll is One Million, Five Hundred and Twenty-one
Thousand, Five Hundred and Thirty Dollars ($1,521,530.00), and
WHEREAS the amount of the whole rateable property in the
said City, according to the last revised assessment roll, namely, the
assessment roll for the City of Lloydminster for the year 1967, is Fourteen
Million, Two Hundred and Fifty-one Thousand, Four Hundred and Fifteen Dollars
($14,251,415.00) and whereas the total amount of the existing debenture debt
of the City, including debentures authorized and unsold, but exclusive of
local improvements secured by special assessments, debt incurred under The
Secondary Education Act, and securities held in the sinking fund to the
credit of remaining indebtedness is One Million, Six Hundred and Ninety-five
Thousand, Nine Hundred and Fifty Dollars and Eight Cents ($1,695,950.08),
and
WHEREAS no part of the above mentioned debenture debt is
in arrears;
NOW THEREFORE, the Council of the City of Lloydminster
enacts as follows:
1.
The sum of Three Hundred and Sixty-three Thousand, Five Hundred and
Twenty-five Dollars and Eighty-six Cents ($363,525.86) shall be borrowed
by the City of Lloydminster by way of debentures, for the purpose of
defraying the cost of the works authorized under Bylaw No 1211 and for the
said purpose there shall be borrowed upon the credit of the City at large
the sum of Three Hundred and Sixty-three Thousand Five Hundred and Twentyfive Dollars and Eighty-six Cents ($363,525.86) and one or more debentures
of the City shall be issued, bearing interest at the rate of Seven and
One-half per centum (71%) per annum, to be repaid in Twenty (20) equal
annual installments of principal and interest and having interest coupons
attached for the payment of interest due in each of the years of the
currency of the said debentures; and

The said debentures shall bear the date . of the 15th day of August,
1968. Such debentures and the interest coupons attached thereto shall
mature on the 15th day of August in each year during the currency of the
debentures, commencing with the year 1969. The debentures and interest
coupons shall be payable in lawful money of Canada, at the principal office
of The Canadian Imperial Bank of Commerce, in the City of
Lloydminster,
Saskatchewan, Canada.

The said debentures shall be sealed with the seal of the City and
shall be signed by the Mayor and Treasurer and the coupons attached to the
said debentures shall each bear the signatures of the Mayor and Treasurer.
With the exception of the signature of the Treasurer certifying to the
registration of the debentures in the debenture register of the City, the
signature of the Mayor and Treasurer of the said debentures, and on the
coupons attached thereto may be reproduced by lithographing or printing or
any other method of mechanical reproduction.

During the currency of the debentures, the sum of Thirty-five
Thousand, Six Hundred and Fifty-six Dollars and Fifty-one Cents ($35,656.51)
shall be raised annually for the payment of the debt and interest as follows
The sum of Fourteen Thousand Five Hundred and Forty-seven Dollars
and Eighty-seven Cents 014,547.87) shall be
for the payment of the City's portion of the cost and the interest thereon,
and the same shall be raised annually by a special rate sufficient therefor,
on all the rateable property of the City at the same time and in the same
manner as other rates; and in addition thereto, and for the payment of the
property owner's portion of the cost and interest thereon, the special
assessment hereinbefore mentioned is hereby imposed on the lands liable
therefor as therein set forth, which said special assessment with a sum
sufficient to cover interest thereon, making the sum of Twenty-one Thousand,
One Hundred and Eight Dollars and Sixty-four Cents ($21,108.64) shall be
raised annually by a special annual rate per foot frontage upon the lots
entered in the said special assessment roll according to the assessed
frontage thereof, over and above

all othglr rates and taxes and in addition thereto, and the said special
taxes shall be collected annually at the same time and in the same manner
as other rates, and for such purpose the special assessments,set forth in
Schedule "B" are hereby imposed in the manner and upon the lands liable
therefor as therein set forth.

The said debentures shall be issued on the credit and security of the
city at large, but as to the portion to be levied by special frontage
assessment on the lands abutting on the said works, the City shall collect
the same only by way of special frontage assessment as aforesaid.
6.
The debentures may contain any clause providing for the registration
thereof as authorized by The Lloydminster Charter in force at the time of
issue,
7.
This bylaw shall take effect on the day of final passing thereof.
8.
Schedules
"A"
and "B" attached hereto shall be read with and form a
part of this Bylaw.

The Council of the City of Lloydminster, in the
Provinces of Saskatchewan and Alberta hereby amends Bylaw No. 141
as follows:

BYLAW NO. 13-68
A BYLAW OF THE CITY OF LLOYDMINSTER,
IN THE PROVINCES OF SASKATCHEWAN AND
ALBERTA TO AUTHORIZE A LOAN OF
FIFTY THOUSAND DOLLARS ($50,000.00)
FROM THE CANADIAN IMPERIAL BANK OF
COMMERCE.
WHEREAS the City of Lloydminster is empowered by
Section 491 of the Lloydminster Charter to authorize the Mayor
and Treasurer to raise by way of a loan from any bank such sums
as the Council may deem necessary to meet the current expenditures
of the city for municipal purposes, until the taxes levied for
the year can be collected;
AND WHEREAS the city may give as security for such loan a
promissory note signed by the Mayor and Treasurer;
NOW THEREFORE, the Council of the City of Lloydminster
enacts as follows:
1.
That the Mayor and Treasurer of the City of Lloydminster be,
and are hereby authorized, to borrow from the Canadian Imperial Bank
of Commerce the sum of Fifty Thousand ($50,000.00) Dollars and to agree
to pay interest thereon either in advance or at maturity at the rate of
not more than (8%) eight per centum per annum.
2.
That the Mayor and Treasurer of the City of Lloydminster are
hereby authorized on behalf of the Council to execute under seal of the
city, a promissory note or notes in favor of the Canadian Bank of
Commerce for the amount of the said loan with interest as aforesaid
payable on demand.
Be it further resolved that the city pledge to the Canadian
Imperial Bank of Commerce, the City owned Dominion of Canada Bonds, in
the amount of Fifty Thousand ($50,000.00) Dollars.
