ATTRIBUTION OF ITALIAN CITIZENSHIP BY BIRTH
A person is an Italian citizen if:
1. He/she is born by an Italian father or mother anywhere the birth is happened. If at least one of the
parents is Italian, in any case, the child will be an Italian citizen.
2. He/she is born in the Italian territory. Only in the following cases:
a. Child of an unknown person;
b. Stateless child (without any citizenship). In this case, parents have to prove their status of
Stateless;
c.
Foreigner child that do not have the parent’s citizenship because of the State of belonging’s
laws, according as it is provided by the art. 2 of DPR 572/93.
P.S: The foreigner citizen, who is born in Italy, acquires the Italian citizenship only in the cases previously
mentioned.
ACQUIRE OF ITALIAN CITIZENSHIP
1_ Automatic acquire
A foreigner citizen by birth acquires the Italian citizenship in the following cases:

The underage foreigner who is recognized by the father or the mother of Italian citizenship acquires the
Italian citizenship since the birth, as long as the parent was Italian in that date.

The underage foreigner adopted by an Italian father or mother acquires the Italian citizenship through
the transcript of the adoption’s measure in the Stato Civile’s registers of the district.

The underage child of a foreigner who acquires the Italian citizenship, become Italian if he/she live with
this parent at the moment of the acquire. Also in this case, the citizenship acquire of the underage child
is an automatism that is certificated by the Mayor.
2_ Acquire following a declaration
A foreigner citizen by birth who is in possession of specific requirements, or in case of some conditions, give a
declaration with whom shows the wish of acquire the citizenship.

WHAT IS IT
The grant of citizenship is possible for foreigner citizens married with an Italian citizen, without legal
punishments which could damage the Republic security.
The foreigner spouse of an Italian citizen acquire the Italian citizenship if he/she legally lives in Italy from at least
2 years ( 1 year in case of the presence of children born by the marriage or adopted) or, if he/she live abroad,
after 3 years since the marriage’s date.
WHERE
The citizenship is award after the request of the applicant, with the Decreto del Ministro dell’Interno that
become effective after the oath, in front of the Stato Civile Official of the district where the applicant resides, or
in front of the diplomatic-consular authority. The applicant becomes an Italian citizen the day after the oath.
HOW
After the time lapse (1, 2 , 3 years previously mentioned) it is possible to forward the application to the Ministro
dell’Interno for the acquire of the Italian citizenship.
The forms are distributed by the URP (people who live abroad find them at the consulate) and have to be
delivered to the Prefect (consular authority in case of living abroad) of the place the applicant belongs with. The
form must be equipped with the certification that proves the requirements - self-certifications won’t be
accepted.
The request is subject to the payment of a contribution of 200€ (the deposit must be carry out on Post Office).

The Prefecture sends the citizenship’s Decreto to the Stato Civile Official of the district where the applicant lives.
It is notified to the interested, who has 6 months to give the prescribe oath in front of the Stato Civile Official
(the diplomatic-consular authority if he/she lives abroad) of the district where he/she lives.

Ordinary Naturalisation
WHAT IS IT
According to the law some classes of foreign people can ask for the concession of the Italian citizenship. To these
people are required periods of legal residence on Italian territories with different length. The residence is legal
when the foreign is in possession of a valid residence permit and he/she is enrolled in the civil registry (in Italy
called Anagrafe).

WHERE
The citizenship is award by request of the applicant through the Decreto del Presidente della Repubblica.

RECOGNIZED ITALIAN CITIZENSHIP TO CITIZENS OF ITALIAN DESCENT STRAIN (IURE SANGUINIS)
WHAT IS IT
The foreign descendant’s citizens of Italian emigrants abroad, and who have never renounced to the Italian
citizenship, they can get the recognition of Italian citizenship iure sanguinis.
WHERE
The Mayor of the district where the applicant lives has the skill to carry out the Italian citizenship recognition.
The Mayor of the district of Pisa delegates the Stato Civile Official (the diplomatic-consular authority if he/she
lives abroad).
HOW
The Italian iure sanguinis citizenship is linked to the fact that the Italian ancestor descendants, including the
applicant, do not ever lost the Italian citizenship.
In the following:
1. Registration to the Civil registry (Anagrafe)
The applicant has to ask for the registration to the civil registry (Anagrafe) of the district where he/she
lives in, with the following documents:

Passport, for people who came from a Country which do not belong to the Schengen Area.
Passport and the presence declaration, given by the Central Police Station within 8 day since the entry in
Italy, for who come from a country which do not belong to the Schengen Area.
2. Request
After the registration to the Civil Registry (Anagrafe), the foreigner has to present the form to the
Mayor.
Documents to be submitted
The possession of the Italian citizenship has to be shown attaching the form the following deeds:
-
Extract Birth deed of the Italian ancestor who emigrated issued by the Italian district of birth
Translated and legalized birth certificates of all descendants in line straight, including the one of the
applicant.
Italian ancestor’s Marriage deed emigrated abroad - deed has to be translated and legalized if it is done
abroad.
Descendents Marriage deed, in line straight, including the one of applicant’s parent.
Certificate issued by the Italian authorities of the foreign State of emigration, which guarantee that the
Italian ancestor does not acquire the foreign State of emigration’s citizenship, before the born of the
interested descendent.
3. The Stato Civile Official acquires from the Italian authorities the certificate which guarantees
neither the applicant nor the line straight ancestor never renounced to the Italian citizenship.

4. After the check of the possession of requirements, the Official will close the procedure attesting the
possession of the Italian citizenship and registering the Stato Civile deeds that concerns the person to whom the
Italian citizenship is approved.
Information
Mother’s lineage
Also mother’s lineage passed down; however the mother imparts the Italian citizenship only to the children born
after the 1st of January of 1948, the date in which the italian Constitution become law.
Underage children
Underage children of Italian parents acquire the Italian citizenship from the birth without additional procedures.
It is not necessary that the child lives in the Italian country.
Explanations
The original documents produced abroad by foreign authorities must be:
- Legalized by the diplomatic Italian competent authority;
- Translate in Italian language. The translation have to be suitable with the foreign test by the Italian
diplomatic authority, or by an Italian translator who given with an oath his/her official translation in
front of the Cancelleria del Tribunale.



