CINEMATOGRAPH FILMS (AUSTRALIAN QUOTA) ACT.
Act No. 41, 1935.
An Act for securing the exhibition of a certain
proportion of Australian cinematograph
films; and for purposes connected therewith. [Assented to, 11th April, 1935.]

E it enacted by the King's Most Excellent Majesty,
by and with the advice and consent of the Legislative Council and Legislative Assembly of New South
Wales in Parliament assembled, and by the authority of
the same, as follows :—
1 . (1) This Act may be cited as the " Cinematograph
Films (Australian Quota) Act, 1935."
(2) This Act shall, save as otherwise expressly provided therein, commence upon a date to be appointed by
the Governor and notified by proclamation published in
the Gazette. The date so appointed is in this Act referred
to as the commencement of this Act.

2. I n this Act, unless the context or
otherwise indicates or r e q u i r e s —
subject-matter
" A c q u i r e , " in r e l a t i o n to a d i s t r i b u t o r , includes the
p r o d u c t i o n or o b t a i n i n g possession of films for
the p u r p o s e of h i r i n g or selling them.
" A u s t r a l i a n film " m e a n s a film—
(a) which h a s been wholly or mainly p r o d u c e d
in A u s t r a l i a ;
(b) all the studio scenes depicted in which
h a v e been p h o t o g r a p h e d in A u s t r a l i a ; a n d
(c) (where the film is p r o d u c e d by a com­
p a n y ) which h a s been p r o d u c e d by a com­
p a n y i n c o r p o r a t e d in A u s t r a l i a .
" B r i t i s h films " m e a n s films which a r e deemed to
be B r i t i s h films for the p u r p o s e s of the I m ­
p e r i a l Act, the C i n e m a t o g r a p h F i l m s Act, 1927.
" C i n e m a t o g r a p h " includes c i n e m a t o g r a p h a n d a n y
o t h e r similar a p p a r a t u s for the exhibition of
moving p i c t u r e s .
" C i n e m a t o g r a p h film " m e a n s a film u s e d or p r o ­
posed to be u s e d for the p u r p o s e of exhibiting
a cinematograph picture.
" C i n e m a t o g r a p h p i c t u r e " m e a n s a p i c t u r e or o t h e r
optical effect exhibited or p r o p o s e d to be
exhibited by m e a n s of a c i n e m a t o g r a p h .
" Committee " m e a n s the F i l m s A d v i s o r y
mittee constituted u n d e r this Act.
Com­
" D i s t r i b u t o r , " in r e l a t i o n to films, m e a n s a p e r s o n
for the time being e n g a g e d in the business of
h i r i n g or selling films.
" D i s t r i b u t o r ' s q u o t a , " in r e l a t i o n to the films
acquired by a d i s t r i b u t o r for the p u r p o s e s of
his business in a n y period, m e a n s the p r o p o r t i o n
of A u s t r a l i a n films which he is r e q u i r e d by this
A c t to a c q u i r e d u r i n g t h a t period, computed in
accordance w i t h this Act.
" E x h i b i t o r , " in relation to films, includes every person who exhibits a n y film in a t h e a t r e , a n d " to
exhibit " h a s a c o r r e s p o n d i n g i n t e r p r e t a t i o n .
" Exhibitors'
" E x h i b i t o r ' s q u o t a , " in r e l a t i o n to films exhibited
by a n y exhibitor in a n y period, m e a n s the p r o ­
p o r t i o n of A u s t r a l i a n films which he is r e q u i r e d
by this A c t to exhibit d u r i n g t h a t period, com­
p u t e d in accordance w i t h this Act.
" F i l m " m e a n s c i n e m a t o g r a p h film.
" F o r e i g n films " m e a n s all films which a r e n e i t h e r
B r i t i s h films n o r A u s t r a l i a n films.
" H i r i n g , " in relation to films, m e a n s h i r i n g or
otherwise i s s u i n g or d i s t r i b u t i n g films to a n
exhibitor a t a r e n t or for o t h e r consideration
or m a k i n g o t h e r a r r a n g e m e n t s w i t h exhibitors
for the exhibition thereof.
L e n g t h , " in r e l a t i o n to films, m e a n s the total
length of film which m a y lawfully be exhibited.
" P r e s c r i b e d " m e a n s p r e s c r i b e d by this A c t or b y
regulations made thereunder.
" P r o d u c e r , " in r e l a t i o n to a n y film, m e a n s the
p e r s o n m a k i n g the a r r a n g e m e n t s n e c e s s a r y for
the p r o d u c t i o n of the film a n d for the o r g a n i s a ­
tion a n d direction of the scenes to be depicted in
the film.
" Schedule " m e a n s Schedule to this Act.
' ' T h e a t r e ' ' includes a n y house, room, building, g a r ­
den or place w h e r e i n a n y c i n e m a t o g r a p h picture
is exhibited a n d to which admission is or m a y be
p r o c u r e d by p a y m e n t of money or by ticket or
by a n y o t h e r means, token or consideration as
the price, h i r e or r e n t of admission.
3. (1) T h i s Act shall a p p l y to all films except films of
t h e following classes, n a m e l y : —
(a)
films depicting wholly or mainly news a n d
current events;
(b) films depicting wholly or m a i n l y n a t u r a l s c e n e r y ;
(c) films being wholly or m a i n l y commercial a d v e r ­
tisements ;
(d) films used wholly or m a i n l y by educational insti­
tutions for educational p u r p o s e s ;
(e)
(e) films depicting wholly or mainly i n d u s t r i a l or
manufacturing processes;
(f) scientific films, including n a t u r a l h i s t o r y films;
(g) A u s t r a l i a n films in respect of which the Minister
upon the r e c o m m e n d a t i o n of t h e F i l m s A d v i s o r y
Committee constituted u n d e r t h i s Act h a s
directed t h a t this Act shall n o t a p p l y on the
g r o u n d t h a t t h e i r a r t i s t i c or p h o t o g r a p h i c merit,
or t h e i r a p p e a l to the i n t e r e s t of the public
generally, or t h e i r g e n e r a l quality is not
sufficient to w a r r a n t t h e i r being taken into
account for the p u r p o s e s of computing the dis­
t r i b u t o r ' s q u o t a or the e x h i b i t o r ' s quota in
accordance with this A c t ;
(h) films not exceeding five t h o u s a n d feet in l e n g t h ;
or
(i) A u s t r a l i a n films t h e p r o d u c t i o n of which w a s
commenced before the first d a y of J a n u a r y ,
one t h o u s a n d nine h u n d r e d a n d t h i r t y - f o u r .
(2) N o t w i t h s t a n d i n g a n y t h i n g in subsection one of
this section, the Minister m a y at a n y time u p o n the recom­
m e n d a t i o n of the F i l m s A d v i s o r y Committee constituted
u n d e r this Act, direct t h a t this Act shall a p p l y to a n y
specified A u s t r a l i a n film of a n y of the classes m e n t i o n e d
in t h a t subsection: P r o v i d e d t h a t no such direction shall
be m a d e in respect of a n y film less t h a n t h r e e t h o u s a n d
feet in length.
(3) F i l m s to which this Act applies a r e in this Act
r e f e r r e d to as " q u o t a " films.
4. (1) Of the total n u m b e r of " quota " films o t h e r
t h a n B r i t i s h films acquired by a d i s t r i b u t o r for the p u r ­
poses of his business in a n y of the y e a r s m e n t i o n e d in
the F i r s t Schedule it shall be his d u t y to acquire a n d
m a k e available for d i s t r i b u t i o n in t h a t y e a r n o t less
t h a n the p r o p o r t i o n of A u s t r a l i a n " quota " films speci­
fied in the said Schedule. W h e r e such p r o p o r t i o n is not
a whole n u m b e r a n y fraction exceeding one-half shall be
deemed to be a whole n u m b e r .
For the p u r p o s e of calculating such p r o p o r t i o n , no
A u s t r a l i a n " quota " film shall be counted m o r e t h a n
once, n o r shall a n y such film be counted by m o r e t h a n
one d i s t r i b u t o r .

(2) If the Minister is satisfied t h a t in a n y y e a r com­
p l i a n c e with the r e q u i r e m e n t s of this Act by a n y
d i s t r i b u t o r or by d i s t r i b u t o r s g e n e r a l l y is n o t or w a s
n o t commercially practicable by r e a s o n of the q u a n t i t y ,
c h a r a c t e r or exhibition value of A u s t r a l i a n films avail­
a b l e o r the excessive cost of such films in r e l a t i o n to
B r i t i s h films or foreign films he m a y modify those
r e q u i r e m e n t s or exempt such d i s t r i b u t o r or d i s t r i b u t o r s
t h e r e f r o m to such extent as in the circumstances he
c o n s i d e r s reasonable.
T h e p o w e r conferred on t h e Minister b y t h i s sub­
section shall not be exercised except upon the recom­
m e n d a t i o n of the F i l m s A d v i s o r y Committee constituted
u n d e r this Act.
(3) A notification of every modification a n d exemp­
t i o n m a d e or g r a n t e d by the Minister p u r s u a n t to sub­
section two of this section shall be published in the
Gazette.
(4) F o r the p u r p o s e of enabling the Minister to
exercise the p o w e r s conferred upon him by the provisions
of this section every d i s t r i b u t o r shall not l a t e r t h a n a
p r e s c r i b e d d a y in each y e a r furnish to the M i n i s t e r a
s t a t e m e n t in w r i t i n g in the prescribed form of the n u m b e r
of " quota " films which he p r o p o s e s to acquire a n d
d i s t r i b u t e d u r i n g the next succeeding year.
( 5 ) If in a n y of t h e y e a r s specified in the F i r s t
Schedule a d i s t r i b u t o r fails to comply with the require­
m e n t s of this Act or with those r e q u i r e m e n t s as modified
in accordance with subsection two of this section he shall
b e liable to a p e n a l t y not exceeding one h u n d r e d p o u n d s
unless he p r o v e s to the satisfaction of the court t h a t the
r e a s o n s for non-compliance were beyond his control. I n
a d d i t i o n to a n y p e n a l t y t h a t m a y be imposed as aforesaid,
t h e court convicting such d i s t r i b u t o r m a y in a n y case
if it is of opinion t h a t the offence w a s committed with the
intent to defeat the p u r p o s e s of this Act m a k e an o r d e r
f o r the cancellation or suspension of the r e g i s t r a t i o n of
such d i s t r i b u t o r u n d e r this Act, and such o r d e r shall t a k e
effect as from a d a t e to be therein specified in t h a t behalf.
(6)
(6) T h i s section shall commence u p o n a d a t e being
three m o n t h s a f t e r the commencement of this Act, a n d
the first y e a r r e f e r r e d to in the F i r s t Schedule shall
commence on the date on which this section commences.
5 . A n y two or m o r e d i s t r i b u t o r s each of whom satisfies
t h e Minister t h a t , in a n y of the y e a r s specified in the F i r s t
Schedule, he will not acquire or h a s n o t acquired for t h e
p u r p o s e s of his business m o r e t h a n six " quota " films,
m a y with the consent of the Minister combine for
t h e p u r p o s e of satisfying the quota r e q u i r e m e n t s of t h i s
A c t for t h a t year, a n d in a n y such case all the d i s t r i b u t o r s
who h a v e so combined shall for the said p u r p o s e be r e ­
g a r d e d as one d i s t r i b u t o r only a n d shall accordingly b e
deemed t o h a v e complied w i t h the r e q u i r e m e n t s a f o r e s a i d
to the same extent as one d i s t r i b u t o r in such circum­
stances would h a v e complied with those r e q u i r e m e n t s .
6. (1) Of t h e t o t a l n u m b e r of " quota " films exhibited
b y a n y exhibitor in a n y of the y e a r s m e n t i o n e d in t h e
Second Schedule it shall be his d u t y to exhibit in each
t h e a t r e in which he exhibits films n o t less t h a n the p r o ­
p o r t i o n of A u s t r a l i a n " quota " films specified in t h e
said Schedule. W h e r e such p r o p o r t i o n is not a w h o l e
n u m b e r , a n y fraction exceeding one-half shall be d e e m e d
to be a whole number.
(2) I n c o m p u t i n g for the p u r p o s e s of this section
the p r o p o r t i o n of A u s t r a l i a n " q u o t a " films exhibited b y
a n y exhibitor in a n y t h e a t r e in a n y y e a r e v e r y exhibition
of a " quota " film (whether A u s t r a l i a n or o t h e r w i s e )
shall be deemed to be the exhibition of a s e p a r a t e film.
(3) I f the M i n i s t e r is satisfied t h a t in a n y y e a r
compliance w i t h the p r o v i s i o n s of this Act b y a n y exhibi­
t o r or by exhibitors g e n e r a l l y is n o t or w a s not com­
mercially practicable b y r e a s o n of the q u a n t i t y , c h a r a c ­
t e r or exhibition value of A u s t r a l i a n films available, o r
the excessive cost of such films in r e l a t i o n to B r i t i s h or
foreign films, he m a y modify those r e q u i r e m e n t s o r
e x e m p t such exhibitor or exhibitors t h e r e f r o m to such
extent as in the circumstances he considers reasonable.
T h e p o w e r conferred on the Minister by this subsec­
tion shall n o t be exercised except u p o n the r e c o m m e n d a tion of t h e F i l m s A d v i s o r y Committee constituted u n d e r
t h i s Act.
(4)
(4) A notification of every modification a n d
e x e m p t i o n m a d e or g r a n t e d by the Minister p u r s u a n t
t o subsection t h r e e of this section shall be published in
t h e Gazette.
( 5 ) If in any of the y e a r s specified in the Second
Schedule an exhibitor fails to comply with the r e q u i r e ­
m e n t s of this Act or with those r e q u i r e m e n t s as modified
in accordance with subsection t h r e e of this section he
s h a l l be liable to a p e n a l t y not exceeding one h u n d r e d
p o u n d s unless he p r o v e s to the satisfaction of the court
t h a t the r e a s o n s for non-compliance were beyond his
control. I n addition to a n y p e n a l t y a s aforesaid t h e
court convicting such exhibitor m a y in a n y case if it is
of opinion t h a t the offence w a s committed with intent to
defeat the p u r p o s e s of this Act make an o r d e r for the
cancellation or suspension of the r e g i s t r a t i o n of such
exhibitor u n d e r this Act, a n d such o r d e r shall take effect
f r o m a date to be t h e r e i n specified in t h a t behalf.
(6) This section shall commence u p o n a date being
n i n e m o n t h s after the commencement of t h i s Act, a n d
t h e first y e a r r e f e r r e d to in the Second Schedule shall
commence on the d a t e on which this section commences,
7. (1) I n o r d e r to comply with the r e q u i r e m e n t s of
section six of this Act, a n y exhibitor m a y (notwithstand­
i n g a n y t h i n g in a n y a g r e e m e n t w h e t h e r entered into
before or after the commencement of this Act) w i t h o u t
i n c u r r i n g a n y liability for b r e a c h of contract, reject a n y
n u m b e r of films (other t h a n A u s t r a l i a n films a n d B r i t i s h
films), which he h a s contracted to accept for p u r p o s e s
of exhibition.
(2) Notice of his intention to reject a n y n u m b e r
of films p u r s u a n t to subsection one of this section shall
be given in w r i t i n g b y the exhibitor to the d i s t r i b u t o r
concerned not less t h a n twenty-eight d a y s before the d a y
o n which the exhibitor p r o p o s e s first to exhibit t h e
A u s t r a l i a n " q u o t a " film in respect of which such r i g h t
of rejection is exercised.
( 3 ) This section shall not be construed to entitle
a n exhibitor to reject d u r i n g a n y y e a r a g r e a t e r n u m b e r
of films t h a n the n u m b e r which r e p r e s e n t s the p r o p o r t i o n
of
of A u s t r a l i a n " q u o t a " films r e q u i r e d by section six of
this Act to be exhibited by such exhibitor d u r i n g t h a t
year.
8. (1) ( a ) A n y a g r e e m e n t which r e q u i r e s or p u r ­
p o r t s to r e q u i r e or can be construed a s r e q u i r i n g a n y
exhibitor who p u r c h a s e s or takes on h i r e a n y A u s t r a l i a n
" q u o t a " film to p u r c h a s e or take on h i r e a n y film o r
films o t h e r t h a n t h a t A u s t r a l i a n " q u o t a " film, a s a con­
dition of the p u r c h a s e or t a k i n g on h i r e of t h a t A u s t r a l i a n
" q u o t a " film, shall be absolutely void.
(b) T h i s subsection shall commence u p o n a
date being nine m o n t h s after the commencement of t h i s
Act.
(2) Subsection one of this section shall extend t o
a n y a g r e e m e n t w h e t h e r the same w a s m a d e before t h e
commencement of this Act, or either before or after t h e
d a t e of commencement of t h a t subsection.
9. Subject to the provisions of section ten of this A c t ,
a n y A u s t r a l i a n film which the M i n i s t e r is satisfied h a s
been a p p r o v e d as a " q u o t a " film in a n y o t h e r S t a t e
shall unless the M i n i s t e r otherwise directs be deemed
to be a n A u s t r a l i a n " quota " film for the p u r p o s e s of
this Act.
10. (1) E v e r y p r o d u c e r of a n y A u s t r a l i a n film which
i s m o r e t h a n five t h o u s a n d feet in l e n g t h or of a n A u s ­
t r a l i a n film to which the Minister h a s p u r s u a n t to t h i s
Act directed t h a t t h i s Act shall a p p l y , shall before dis­
t r i b u t i n g or exhibiting such film in New S o u t h W a l e s o r
selling or s u p p l y i n g the same for d i s t r i b u t i o n or exhibi­
tion in New S o u t h W a l e s , furnish to the Minister a r e t u r n
in the p r e s c r i b e d form t o g e t h e r with such fee (not
exceeding five p o u n d s ) a s is p r e s c r i b e d .
(2) A n y p r o d u c e r of such a n A u s t r a l i a n film w h o
fails to comply with the r e q u i r e m e n t s of subsection one
of this section shall be liable to a p e n a l t y n o t exceeding
fifty p o u n d s .
1 1 . (1) T h e r e shall be a F i l m s A d v i s o r y Committee,
which shall consider such m a t t e r s a r i s i n g in connection
w i t h the a d m i n i s t r a t i o n of this Act as m a y be r e f e r r e d
to it b y the Minister.

T h e F i l m s Advisory. Committee m a y m a k e such
r e c o m m e n d a t i o n or r e p o r t to the Minister on a n y m a t t e r
so r e f e r r e d to it as it thinks fit,
(2) T h e F i l m s A d v i s o r y Committee shall b e
a p p o i n t e d by the Governor a n d shall consist of t h r e e
p e r s o n s h a v i n g no p e c u n i a r y i n t e r e s t in a n y b r a n c h of
the film i n d u s t r y . One of such p e r s o n s shall in a n d b y
his a p p o i n t m e n t be the c h a i r m a n of the committee, a n d
a n o t h e r of such persona shall in a n d b y his a p p o i n t m e n t
be the d e p u t y - c h a i r m a n of the committee.
T h e provisions of the Public Service Act, 1902, o r
a n y A c t a m e n d i n g t h a t Act, shall n o t a p p l y to t h e
a p p o i n t m e n t of m e m b e r s of the c o m m i t t e e ; a n d such
m e m b e r s shall not be subject to the provisions of a n y
such A c t d u r i n g t h e i r t e r m of office.
(3) The Governor m a y remove a n y m e m b e r so
appointed.
(4) T h e m e m b e r s of the committee shall, subject
to this Act, hold office for a t e r m of t h r e e y e a r s f r o m
the d a t e of t h e i r a p p o i n t m e n t a n d be eligible for r e ­
a p p o i n t m e n t from time to time for a like t e r m .
(5) If a n y of such m e m b e r s —
(a) d i e s ; or
(b) resigns his office b y -writing u n d e r his hands
a d d r e s s e d to the G o v e r n o r ; or
(c) is absent from t h r e e consecutive meetings of the
committee except with leave g r a n t e d b y the
c o m m i t t e e ; or
(d) is removed by t h e Governor,
his office shall t h e r e u p o n become v a c a n t a n d the G o v e r n o r
m a y , subject to this Act, a p p o i n t a p e r s o n to take t h e
place of the m e m b e r whose office h a s become vacant.
(6) A n y p e r s o n so a p p o i n t e d to t a k e the p l a c e
of a m e m b e r whose office h a s become v a c a n t shall hold
office for the r e m a i n d e r of the t e r m for which his p r e ­
decessor w a s appointed.
(7) I n case of the illness, suspension, or a b s e n c e
of the c h a i r m a n of the committee the p o w e r s a n d
a u t h o r i t i e s of such c h a i r m a n shall be exercised d u r i n g
such illness, suspension o r absence by the d e p u t y
chairman.
(8)
(8) No act or proceeding of the committee shall
be invalidated or prejudiced b y r e a s o n only of the fact
t h a t a t the time when such act or p r o c e e d i n g w a s done,
taken, or commenced t h e r e w a s a vacancy in the office
of a n y one m e m b e r .
(9) T h e p r o c e d u r e for the calling of meetings
of the committee, a n d the conduct of business a t such
m e e t i n g s , a n d the times a t which such m e e t i n g s shall be
held, shall, subject to a n y r e g u l a t i o n s which m a y be
m a d e by t h e G o v e r n o r in r e l a t i o n t h e r e t o , be a s deter­
mined by the committee.
(10) A n y two m e m b e r s of the committee shall
form a q u o r u m for the p u r p o s e of t r a n s a c t i n g a n y busi­
ness of the committee.
(11) A n y duly convened m e e t i n g of the committee
a t which a q u o r u m is p r e s e n t shall be competent to
t r a n s a c t a n y business of the committee. A t any such
m e e t i n g the c h a i r m a n , or in his absence the d e p u t y c h a i r m a n , shall, in the event of a n equal division of votes
on a n y question, h a v e a second or c a s t i n g vote.
(12) T h e m e m b e r s of the committee o t h e r t h a n
t h o s e employed b y or on behalf of t h e Crown in r i g h t of
t h e S t a t e of New S o u t h Wales shall be entitled to receive
in t h e i r capacity as m e m b e r s of the committee such fees
a s m a y be fixed b y the Governor.
12. (1) No p e r s o n shall—
(a) c a r r y on the business of exhibiting cinemato­
g r a p h p i c t u r e s in a n y t h e a t r e ; or
(b) c a r r y on the business of selling, leasing, dis­
t r i b u t i n g or otherwise d i s p o s i n g of cinemato­
g r a p h films or the r i g h t to use such films for
the
exhibition
of
cinematograph
pictures
t h e r e f r o m in a n y t h e a t r e ; or
(c) act as a p r o d u c e r of a n y c i n e m a t o g r a p h film,
unless he h a s r e g i s t e r e d his n a m e a n d a d d r e s s a n d such
p a r t i c u l a r s as a r e p r e s c r i b e d in such m a n n e r a n d w i t h
such p e r s o n a n d a t such times as is or a r e prescribed.
(2) T h e G o v e r n o r m a y b y r e g u l a t i o n s u n d e r t h i s
A c t exempt from the provisions of subsection one of this
section any p e r s o n or class of p e r s o n s specified in t h e
regulations.
(3)
(3) The prescribed fee shall be p a i d in respect of
each r e g i s t r a t i o n u n d e r this section.
(4) A n y p e r s o n who c o n t r a v e n e s the provisions
of this section shall be liable to a p e n a l t y not exceeding
one h u n d r e d pounds with a n additional p e n a l t y in the
case of a continuing offence n o t exceeding ten p o u n d s for
each d a y upon which the contravention continues.
(5) This section shall commence upon a d a t e t o
be a p p o i n t e d by the Governor a n d notified by procla­
m a t i o n published in the Gazette.
13. (1) A n y p e n a l t y imposed by this Act or by a n y
r e g u l a t i o n m a d e t h e r e u n d e r m a y be recovered in a
summary manner.
(2) P r o c e e d i n g s for or in respect of the recovery
of a n y such p e n a l t y m a y be i n s t i t u t e d a t any time within
two y e a r s after the d a t e upon which the offence in respect
of which such p e n a l t y is imposed was committed.
14. (1) T h e G o v e r n o r m a y make r e g u l a t i o n s for or
with respect t o —
( a ) p r e s c r i b i n g a n n u a l fees to be p a i d —
(i) b y p e r s o n s r e g i s t e r e d u n d e r t h i s Act who
c a r r y on the business of exhibiting cine­
m a t o g r a p h p i c t u r e s in a n y t h e a t r e — n o t
exceeding in a n y case in respect of a n y
t h e a t r e the s u m of one p o u n d ; and
(ii) by p e r s o n s r e g i s t e r e d u n d e r this Act w h o
c a r r y on the business of selling, leasing,
d i s t r i b u t i n g or otherwise disposing of

films—not exceeding in a n y case the s u m
of one p o u n d ;
(b) books a n d r e c o r d s to be k e p t a n d r e t u r n s to b e
f u r n i s h e d to the M i n i s t e r b y p r o d u c e r s , d i s ­
t r i b u t o r s a n d exhibitors of films;
(c)
(c) i m p o s i n g penalties n o t exceeding t e n p o u n d s
for a n y breach of a n y regulation, with a n addi­
tional p e n a l t y in the case of a continuing offence
n o t exceeding one p o u n d for each d a y on which
the breach c o n t i n u e s ; a n d
( d ) generally, a n y m a t t e r or t h i n g a u t h o r i s e d or
r e q u i r e d to be p r e s c r i b e d or n e c e s s a r y or ex­
pedient to be p r e s c r i b e d for c a r r y i n g this Act
into effect.
(2) T h e r e g u l a t i o n s shall—
be published in the G a z e t t e ;
take effect from the d a t e of such publication or
from a l a t e r d a t e to be specified i n the regula­
tions ; a n d
(c) be laid before both H o u s e s of P a r l i a m e n t within
fourteen s i t t i n g d a y s a f t e r the publication
thereof if P a r l i a m e n t is then in session, a n d if
not, then within fourteen s i t t i n g d a y s after the
commencement of the next session.

(3) If either H o u s e of P a r l i a m e n t passes a reso­
lution of which notice h a s been given a t a n y time within
fifteen s i t t i n g d a y s a f t e r such r e g u l a t i o n s have been laid
before such H o u s e disallowing a n y regulation or p a r t
thereof, such regulation or p a r t shall thereupon cease to
have effect.
