The picture on the front is that of two unidentified couples. They are assumed in both cases to be husband
and wife. This picture was part of the personal effects passed down to me by a member of my Grandfather’s
family through his second marriage.
After the death of my Grandmother - Melissa Jane (Renfro) Franklin in 1917; he married #2 Mrs. Anna
(Huffman) Burkhalter. It was one of the Burkhalter children that was kind enough to see that a Franklin descendent was in possession of this picture as well as others that I have not been able to identify.
The only identification on the back of the picture is written “All Franklin’s”[sic]. I am not sure that this information is correct as there were other inconsistencies concerning information about my Grandfather that
was the result of the persons giving the information not knowing the correct facts. For example his death
certificate on file at the Hemphill County Courthouse, Sabine County, Texas, states that his mother was a
“Cobb.” This is incorrect - his first wife’s mother was a “Cobb”. The death certificate further states that he
was born in 1864. This is incorrect as he is recorded on the 1860 Trinity County, Texas census as 1 year old.
This picture was once identified by an elderly aunt of mine who seemed unsure at the time; said the younger
couple in the back was that of my grandfather and his first wife. I know from fact that my grandfather would
not allow anyone to take his picture, so this leaves me with questions.
If this is my Grandfather is it possible that the older couple seated could be that of my Great grandfather and
his wife?? According to my father, his parents were married at the home of William Plumer and Lovina
(John’s parents). Please, can anyone help??

Washington, St. Laundry Parish, Louisiana). Their daughter: Elaine Franklin
married Louie E. Giddens.

because these papers are so extensive
I felt that it would be best to include them as a separate publication a few pages with each quarterly. If you
will get a 3 ring binder and insert these pages as you receive them, hopefully, you will eventually have the
entire collection. I will even punch the 3 ring holes for you. The final pages will include an full name index.

for her children and grandchildren when she was 81 years old that “Papa was a Civil War
Veteran in 16th Georgia Cavalry Thomas R. Cobb’s Company.” She states that: “he did not
do much fighting. He went into the service young and had yellow fever. He was proud of
his cross of honor. He loved Civil War history and would spend a lot of time trying to tell
me about Gettysburg and all other battles he fought. I was too young to try to understand
what he tried to tell me. I wish I had listened more. He never told us what company he was
in. We found that out from others who were with him in service. He never asked for a
pension. My youngest sister (marie) got a pension for Mama about five years before her
death in 1930.”

1879-1960 Confederate Soldiers received pensions for military service beginning in 1879. The law establishing pension payment was changed in 1891 to include widows of soldiers. There are also cards for the
witnesses of these soldiers and widows attesting to the service of each soldier.
The arrangement is alphabetical by the name of the pensioner and included on the card are: notations concerning the county of residence, unit designation, and husband’s name in the case of widow cards.
Note: All information given on the cards, including spelling of names and designations of military units is
as shown on the pension application. This will often differ from other references to the same person or unit.

In Georgia, one method in tracing ancestors is to become familiar with the tax laws of the state and their
usage. Often, you can use tax lists to find an obscure ancestor or with the tax records you can prove that he
lived or owned land in a certain area.
A tax is compulsory contribution from the person to a government to defray the expenses incurred in the
common interest of all. Various methods have been used throughout the history of Georgia to lay and collect
these taxes.
During the American Revolution, there were no state tax laws; even through there were twelve parishes, and
the ceded lands that made up Georgia at this time. The last colonial tax law had been passed in Georgia in
1773. It had imposed a tax on every one hundred acres of land without regard to quality. Town lots, buildings and other improvements were taxed. This law included a tax on imported merchandise, and on exported
deer and beaver skins. It also included a tax on slaves and free persons of color. The property evaluations
were made by tax assessors, and the taxes were received by collectors, all were appointed and named within
the act itself. The act specified how much money was to be raised by the taxes and how it was to be spent.
But, the Revolution put an end to the colonial government, so with the Constitution of 1777 there were 8
counties established. Wilkes from the ceded land of 1773 came into existence at that time. Then Richmond,
Burke, Effingham, Chatham, Liberty, Glynn and Camden became counties instead of parishes.
After the writing of the Georgia Constitution, an act for taxes were passed in 1778. This, along with the Tax
Act of 1783, laid the basis for Georgia Tax laws through 1851. The 1778 Act was similar to the Act of 1773,
but there were some exceptions. This act included a poll tax on white males between 15 and 60 years of age,
but his was reduced for anyone serving in the upcoming Georgia campaign against the British in East Flordia. This act placed a tax on professionals, excluding ministers. There was a tax on politicians, state employees, money loaned on interest, and wheeled vehicles.

In 1783 Washington and Franklin counties were made from new territory, and another tax law was passed.
Not only was it based on the quantity, but also on the quality of the land. Pine land was the least valuable.
Oak and hickory land was the most heavily taxed. Tax rates were adjusted to reflect the closeness of the land
to navigable waterways, swamps, or the sea. Certain property had a special tax. By 1783, each militia district
within each county had to have a tax receiver appointed locally to make a district tax return. Then, a tax
collector for the county was appointed by the state, and he collected taxes and determined defaulters. Other
things taxed were wheeled vehicles, white males of 21, town lots, slaves and free persons of color, buildings
and improvements, merchandise, lawyers and doctors and a double tax was imposed on uncultivated land
that was left abandoned for a year or more by a man over 21. This stressed the importance of cultivable land
at the time.
After 1789, Georgia required voters to have paid all taxes levied in the year preceding the election. So taxes
and elections were tied together before a man could vote.
Between the time of the American Revolution and 1800 there are fifty-one tax digests available at the Georgia Archives. The majority of the early material covers Greene, Jefferson, Wilkes, Oglethorpe, Lincoln,
Tattnall and Clarke Counties. From 1800 to 1809 there are 101 tax digest from various Georgia Counties at
the George archives and 126 digests from 1810-1819.
The tax law of 1802 based land taxes on a millage rate instead of a specific amount listed in the law. This
was reflected in the Tax Digests of 1805.
By 1820 there were 50 counties that had been created in the state of Georgia and 47 were still in existence.
Houston, Bourbon and Walton were outside the present boundaries of Georgia. Houston and Walton should
not be confused with the Houston and Walton of Today. Franklin, Twiggs and Rabun are not in the 1820
US Georgia Census, but there were tax digests.
After 1842, white male citizens 60 and above in age were exempt from poll tax. By 1851, this was only a
25 cents tax per poll.
In 1852, the ad valorem system for land tax was used for the first time in the state. This based on tax on the
percentage of property values and is still used today.
Ad valorem tax is a tax according to the market value of the property. Before 1852, the principal reliance of
the state for revenue had been a specific tax upon real estate without particular reference to value.
The Tax Act of 1852 placed a one mill tax upon all real and personal property. There was a slave tax of
$1.50 on all slaves not over 60 years of age or infirm.
This act included a tax on money, railroad stock tax, and a pony homestead tax. A five dollar tax on free
persons of color was also levied.
By 1880, the millage rate on property had increased to three and one-half mills. The property tax yielded
83% of the tax in Georgia. This was 80 cents per capita.
By 1900, the millage rate was 5 mills on property. Poll taxes brought in $250,000, and 70% of the general
tax came from property.
The poll tax was abolished by the General Assembly in 1945. Property taxes are still collected and as of
1988, only about 2.7% of general Georgia taxes came from property.

The Creek Indians of Georgia

The Creeks were one of the Five Civilized Tribes of Indians which also included the Cherokee, Chickasaw,
Choctaw and the Seminole.
When Georgia became a colony, the Creek Indians were on lands that now form the states of Georgia and
Alabama. They were not a unified group of Indians, but they were one of the most powerful tribes in North
America. At one time they included more than 50 towns. A group of these people lived throughout the south
Georgia area. They were originally of the Muskogee stock, and were so called. They lived along creeks and
rivers when the English arrived. So, the English labeled them as the Creeks.
The Confederacy was divided into two groups, the Upper and Lower Creeks. The Lower Creeks lived on
the Flint, the Ocmulgee and the Chattahoochee Rivers in Georgia. The Upper Creeks lived along the Coosa,
Tallopoosa and Alabama Rivers in Alabama.
The basic tribal unit of the Creeks was the town which they called the idalwa. The oldest Georgia towns
were probably Cusseta and Coweta. The town people would refer to themselves as Cowetas or Cussetas, by
the name of the town. The micco was the chief of the town elected for life by the council. The town’s name
was used as the name of the micco.
The towns were divided into white towns and red towns. The white towns were the peace-loving towns. The
red towns were the warring towns. The General Council of all the confederacy decided on war, but they met
in a red town. The war chief was always a member of a red town who led the whites and reds in battle. Peace
talks were always held in a white town.
The Tribes in the confederacy were based on the clan system. Clans were held together by strong bonds.
They maintained control of the individuals. The same clans were found in most of the towns. Clans such as
the Alligator, Bear or Beaver were clans. The most important Creek clan was the Wind Clan. Creeks traced
their family tree only through their mother. Children were part of their mother’s clan and were considered
to be related to all her relatives, but not to their father’s relatives. Marriage within a clan was viewed as incest and therefore not allowed. When a marriage took place the male moved from the household of his mother into the household of his wife’s mother. He moved physically, but his allegiance was still to the household
of his mother. He had learned his skills from his mother’s brothers or their uncles. The father was responsible for teaching the boy children of his sisters.
The Creeks believed the universe was made up of three worlds: this world, the upper world and the lower
world. The Master of Breath or Esaugeta Emissee was the spirit who watched over the Creeks. The wolf and
the rattlesnake occupied positions of deference among the Creeks. Magic was important. Each town had
priests.
The Creek Indian was primarily agricultural, supplemented by hunting and fishing. The labor of the town
was divided between the sexes except for the communal work in the fields.
From the earliest days, the Creeks formed strong alliances with the English. They established trade connections with the English. They traded with the English and received guns, whiskey, steel, knives, iron pots,
cotton cloth and etcetera. The deer skin was important in trade for the Creek Indian. They were paid well
by the Englishman. This caused deer to become scarce and the hunter had to go further and further from his

town to secure the skins. The middle man usually lived among the Indians and often intermarried with them.
By 1800, names such as McGillivray, McIntosh, Weatherford, McPherson, Matthews, Carr and Hawkins
were familiar to the Creeks.
Mixed bloods among the Creeks, especially of British descendants, assumed positions of leadership. The
children of such unions played important roles for both the Englishman and the Creeks.
The Red Sticks wanted all Creeks to return to traditional ways and stop following the white man by buying
goods, selling their crops, living in non-Indian houses, and being non-Indian farmers.

First I give and bequeath to my beloved wife Jane, all my plantation and tract of land containing one hundred
acres lying on Gwnells Creek, likewise all my cattle, hogs, horses and all household goods and chattells to
belong to Gilles Franklin, my youngest brother.

page 181: Personally appeared Edmond Franklin before John McKinney, J. Q. of Fairfield County, and declared under oath that he was present and saw Obrion Riley sign, seal and deliver to John Franklin a lease
and release of a certain tract of land which Phillip Riley now lives on and also saw Daniel Wootan sign as
witness. Dated 15 Jan 1793. Recorded 6 March 1793
page 185: 13 May 1793 - An account of the Stock of cattle and a mare, the lawful property of John Richardson, Lewis Richardson and Dolly Wallis. Nine cattle and the mare described.
page 185-186: Richland County - Personally appeared Charity Foot and testified under oath that she never
had any right or claim to the above listed cattle and mare, no further than the care and use of them to help
raise the above children. She further said that a horse was a gift from John Richardson to his Eldest child
and that she gave the horse to her father Thomas Franklin for two cows and calves, the original of the above
stock, and that she purchased the mare with some of the increase of the above stock that she swapped for
the mare.
Edmond (X) Franklin appeared at the same time and swore that he was personally along with the said John
Richardson who told him that he gave the said Charity Foot’s oldest child a horse as above mentioned; he
further said that his father Thomas Franklin told him that he had given the said child a young heifer, one of
the original of the above stock. Dated 13 May 1793. Signed before John Wilson, J.Q. Recorded 14 May
1793.

A G. W. Franklin is buried in McElvain Cemetery 1 1/2 miles west of Du Quoin, Perry County, Illinois on
Rt #152. He died 31 Dec 1880. He was 54 years, 1 month and 176 days old when he died.

Does anyone have the correct information on the two men named William Franklin of Massachusetts. One
man lived in Roxbury, Massachusetts and died in 1644. The other lived in Boston and died 1658 in London,

This is not correct. There were many sons. Only two served in the North Carolina Legislature,
One of these was Governor Jesse Franklin. Meshack served in the State legislature. I do not have

takes this Higginbotham family back to Thomas Graves an original settler of Jamestown, for the benefit of
other members who may be interested.
