$350,000 REWARD
The co-operation of the public is sought to
establish the identity of the person or persons
responsible for the home invasion and serious
assault of Stjepan Kos in Delburn on 11 January
2015.
A reward of up to $350,000 will be paid at the
discretion of the Chief Commissioner of Police
for information leading to the apprehension and
subsequent conviction of the person or persons
responsible for the assault of Stjepan Kos.
In appropriate cases, the Director of
Public Prosecutions may consider, according
to established guidelines, the granting of
indemnification from prosecution to any person
who provides information as to the identity of
the principal offender or offenders in this matter.
Any information given will be treated as
confidential and may be given at any time to
Crime Stoppers on 1800 333 000.
Any payment will be subject to the applicant
signing a deed of confidentiality prior to
payment.

Part 1 of the draft Local Law No. 2 outlines the objectives of the Local Law, which are to:

provide for the orderly conduct of Council meetings, Special Committee meetings and other
meetings conducted by, or on behalf of, the Council where Council has resolved that the
provisions of the Local Law are to apply;
b)
provide procedures for efficient, fair and open decision making;
c)
promote and encourage community participation in the system of local government by
providing mechanisms for the Council to ascertain the community’s views and expectations;
d)
regulate and govern the:

meetings conducted by or on behalf of the Council. It includes provisions around the achievement
of a quorum at meetings and leave of absence requirements.
PART 4 – BUSINESS – DESCRIPTION AND PROCEDURES
Provides for the business to be conducted at an Ordinary meeting or Special Committee meeting.
The Order of Business includes items such as:
Confirmation of the Minutes of a Meeting;

PART 6 – VOTING AT MEETINGS
Outlines how voting on motions is to be conducted, which must be by hand, and details how
and when a Division may be called.
PART 7 – ADDRESSING THE MEETING
Outlines how participants in meetings are to conduct themselves, including how to address the
Chair and those present at the meeting. Provisions around the Chair addressing abusive, defamatory
or insulting or other such inappropriate behaviour are also included. The ability to suspend Standing
Orders is also included to allow a free flowing discussion at appropriate times during a meeting.

Outlines procedures for other matters and issues that may arise during an Ordinary meeting or

Schedule 2 provides a standard form for the lodgement of a Rescission Motion by a
Councillor(s).

Any person may make a written submission on the proposed Local Law to Council. The written
submission may also include a request for an opportunity to make a verbal submission to the
Committee of Council appointed to hear all submissions. This will entitle the submitter to appear
in person or to nominate someone to act on their behalf. The Committee meeting will be held at
2.00 pm on Tuesday 5 April 2016 the Council Chamber, 33 Highett Street, Mansfield.
All submissions received by Council on or before 5.00 pm on Friday 25 March 2016 will be
considered in accordance with section 223 of the Local Government Act 1989.

EXEMPTION
Application No. H246/2015
The Victorian Civil and Administrative
Tribunal has considered an application pursuant
to section 89 of the Equal Opportunity Act
2010 (the Act) by Mansfield Bowling Club (the
applicant). The application for exemption is to
enable the applicant to organise and operate a
men only one day lawn bowls tournament and
advertise that matter (the exempt conduct).
Upon reading the material filed in support
of this application, including the affidavit of
Graham Smith, the Tribunal is satisfied that it is
appropriate to grant an exemption from sections
44, 71, 107 and 182 of the Act to enable the
applicant to engage in the exempt conduct.
In granting this exemption the Tribunal
noted:
A copy of the application was sent by the
Tribunal to the Victorian Equal Opportunity
and Human Rights Commission (the
Commission). The Commission did not seek
leave to intervene in the proceeding.
The one day men only tournament is held
on the Saturday of the Labour Day long
weekend. It has been running for around
26 years. The men play pairs and triples on
the Saturday and on the Sunday there are

mixed fours. The purpose of the tournament is to increase the number of men playing bowls
and to increase the profitability of the tournament. The tournament attracts players from the
surrounding region and is an important source of income for local businesses.
The arrangements at the applicant club for bowls allow for a number of mixed events including
mixed pennant twice a week. This is a women only pennant competition on Tuesdays and men’s
events on Sundays. There is an annual women only open fours competition each year. From
mid-April this year a mixed social bowls will operate. The applicant has received no complaints
about the men only day of the Labour Day long weekend tournament.
I am not satisfied that one of the exceptions contained in the Act applies to the conduct and there
is no current exemption which applies to the exempt conduct. In the absence of an exemption,
the exempt conduct would amount to prohibited discrimination.
When making decisions about exemptions, the Tribunal is required to give proper consideration
to relevant human rights as set out in the Charter of Human Rights and Responsibilities Act
2006 (Charter). Arguably, this exemption limits the right to equality and in particular the right
to equal and effective protection against discrimination of women who would wish to play in
the first day of the long weekend tournament. I am satisfied that, in the circumstances discussed
above, the limit imposed by this exemption is reasonable and justified under the Charter.
The Tribunal hereby grants an exemption from the operation of sections 44, 71, 107 and 182 of
the Act to enable the applicant to engage in the exempt conduct.
This exemption is to remain in force from the day on which notice of the exemption is published
in the Government Gazette until 24 February 2021.

DETERMINATION OF FIREWOOD COLLECTION AREAS
I, Graeme Baxter, District Manager South Gippsland, Parks Victoria, make the following
determination under section 21P of the Crown Land (Reserves) Act 1978.
Definitions
In this determination and with reference to a numbered item in the table in the determination:
(a) closing date, being the date of revocation of the determination of a firewood collection area,
means the date specified in column 6 of the item;
(b) opening date, being the date on which the determination of a firewood collection area comes
into operation, means the date specified in column 5 of the item or, if no date is specified,
the date on which this determination is published in the Government Gazette.
Determination
Each area of land shown hatched on a plan lodged in the Central Plan Office of the Department
of Environment, Land, Water and Planning, the number of which is shown in column 1 of an item
in the table in this determination, is a firewood collection area for the purposes of section 21P of the
Crown Land (Reserves) Act 1978, effective from the opening date for that area until the closing
date for that area (inclusive).

operators holding gaming machine entitlements for the 2014–15 financial year commencing 1 July
2014 and ending on 30 June 2015 as follows:
a) The value of the per entitlement unit charge is $20.44; and
b) The value of the per operating gaming machine charge is $177.77.
The 2014–15 supervision charge should be paid as a single instalment, no later than 6 May 2016.

Gannawarra Shire Council, as the declared waterway manager for the waters of Gunbower
Creek, hereby gives notice under section 208(2) of the Marine Safety Act 2010 that all persons
and vessels not registered to take part in the 2016 Cohuna Bridge to Bridge Challenge by Cohuna
Lions Club are prohibited from entering and remaining in the waters of Gunbower Creek as detailed
below.
The exclusion zones take effect from:
4.00 pm to 7.00 pm on Saturday 5 March 2016 from Cohuna township bridge (-35.80977,
144.222) to the Goulburn Murray Water Weir (located in the Cohuna township, -35.808,

REGULATORY IMPACT STATEMENT
Fee Schedule for Meat Processing Facilities and Meat Transport Vehicles (2016–17)
Notice is given in accordance with section 11 of the Subordinate Legislation Act 1994 that
a Regulatory Impact Statement has been prepared in relation to proposed changes to some of
PrimeSafe’s licence categories and fees.
The objectives of the proposed fee changes are to:
Ensure that PrimeSafe will have the resources to meet the efficient costs of acquitting its
regulatory obligations for 2016–17 and beyond, while ensuring that:
–
fees remain affordable for licensed entities; and
–
public confidence in the safety of meat, seafood and poultry and the maintenance of
animal welfare standards are maintained; and
Remove unused licence categories and improve equity between regulated entities by
achieving a better alignment between regulatory costs and fees paid across different licence
categories.
The Regulatory Impact Statement assesses the costs and benefits of the proposed new licence
categories and fees and possible alternative means of achieving the stated objectives, and explains
why the proposed option is the best means of achieving the stated objectives.
Public comments are invited on the Regulatory Impact Statement and proposed fee schedule.

ORDER CONCERNING THE REMOVAL OF ASBESTOS FROM PREMISES
DAMAGED IN THE 2015 VICTORIAN BUSHFIRES
Preamble
The removal of asbestos at workplaces is regulated by the Occupational Health and Safety
Regulations 2007 (the OHS Regulations). The OHS Regulations describe the circumstances
in which asbestos may be removed by an employer or self-employed person who holds
a Class A or Class B asbestos removal licence under the OHS Regulations, and the
circumstances in which an unlicensed employer or self-employed person may conduct a
limited amount of asbestos removal work.
The provisions of the OHS Regulations that regulate the removal of asbestos, including
asbestos-containing material, expressly apply to asbestos that is fixed to or installed in a
building, structure, ship or plant. They do not apply to the removal of asbestos that is not so
fixed or installed.
An Order Prohibiting the Removal of Certain Asbestos at Workplaces (the 2007 Asbestos
Order) was published in the Government Gazette on 28 June 2007 (see General Gazette
G 26, 28 June 2007). It came into effect on 1 July 2007. The 2007 Asbestos Order, subject
to conditions and restrictions, prohibits the removal of asbestos that is not fixed or installed.
In December 2015, areas in Victoria including Wye River, Separation Creek, Scotsburn and
Barnawartha, experienced bushfires which destroyed over a hundred premises. Many of
those premises were constructed, at least in part, with asbestos-containing materials such as
asbestos cement sheeting.
Only Class A asbestos removal licence holders are permitted to undertake the clean-up of
hazardous friable asbestos.
To assist with the clean-up and rebuilding of those towns and premises damaged or destroyed
by the 2015 Victorian bushfires it is in the interest of public safety to make an Order that
enables the expeditious removal of any asbestos from such premises while maintaining
appropriate standards of safety. This clean-up work needs to occur quickly to prevent
exposure to asbestos-containing material which may pose a risk to local residents and/or
members of the public.

As there is only a limited number of Class A asbestos removal licence holders in Victoria,
this Order permits Class B asbestos removal licence holders to assist in the clean-up,
provided they adhere to strict safety standards.
Order
Being of the opinion that it is expedient for the public safety to do so, the Governor, with the
advice of the Executive Council, under section 55 of the Dangerous Goods Act 1985, makes the
following Order –
1.
The removal of asbestos from any premises that have been damaged or destroyed in the
2015 Victorian bushfires, whether or not that asbestos is fixed to or installed in a building,
structure, ship or plant at those premises (‘asbestos removal’), and that is a workplace, is
prohibited.
2.
Subject to clause 3, the prohibition under clause 1 does not apply in relation to asbestos
removal from a workplace by –
(a) an employer or self-employed person who is the holder of a Class A asbestos removal
licence or by an employee of a licence holder; and
(b) an employer or self-employed person who is the holder of a Class B asbestos removal
licence or by an employee of a licence-holder.
3.
An asbestos licence holder described in clause 2 must ensure that the following conditions
are complied with –
(a) before any asbestos removal occurs, the asbestos licence holder –
(i)
reviews the asbestos register (if any) for the premises; and
(ii) prepares an asbestos control plan to a standard equivalent to that set out in
regulation 4.3.69 of the OHS Regulations that is available and accessible at the
removal site in accordance with regulation 4.3.70 of the OHS Regulations;
(iii) uses signs and barricades in accordance with regulation 4.3.74 of the OHS
Regulations;
(iv) trains and instructs the employees who will be carrying out the asbestos
removal on job specific safe work methods and procedures; and
(v) provides the employees who will be carrying out the removal of asbestos with
appropriate personal protective clothing and equipment, such as Australian
Standard approved respiratory protection and disposable coveralls, and
instructs those persons on the proper use of that clothing and equipment;
(b) any asbestos removal proposed under this Order is notified to the Authority at least
24 hours before the asbestos removal commences;
(c) decontamination facilities are provided in accordance with regulation 4.3.75 of the
OHS Regulations;
(d) the asbestos removal (including the collection and disposal of asbestos waste) is
carried out in accordance with regulation 4.3.71 of the OHS Regulations;
(e) water run-off of asbestos-contaminated water is prevented so far as is reasonably
practicable;
(f)
asbestos waste is contained in accordance with regulation 4.3.76 and disposed of in
accordance with regulation 4.3.77 of the OHS Regulations, or as otherwise permitted
by the Environment Protection Authority;
(g) laundering of personal protective clothing is provided in accordance with regulation
4.3.78 of the OHS Regulations;
(h) on completion of the asbestos removal, must arrange for –
(i)
asbestos paraoccupational air monitoring to be conducted to verify that the
airborne asbestos fibre level is less than 0.01 f/ml; and

(ii)

a visual inspection to be carried out by an independent person to ensure that
there is no visible asbestos residue remaining; and
(iii) a clearance certificate that complies with regulation 4.3.96(3) of the OHS
Regulations to be issued by an independent person.
4.
In the event of an inconsistency between this Order and the 2007 Asbestos Order, or between
this Order and the OHS Regulations, this Order prevails to the extent of that inconsistency.
5.
This Order comes into operation on the date it is published in the Government Gazette and
expires 6 months after that date.
6.
In this Order –
‘asbestos’ has the same meaning as in the OHS Regulations;
‘asbestos licence holder’ has the same meaning as in the OHS Regulations;
‘asbestos removal supervisor’ has the same meaning as in the OHS Regulations;
‘asbestos waste’ means asbestos removed and disposable items used during the removal
work, including plastic sheeting, disposable personal protective clothing and disposable
protective equipment including tools;
‘asbestos-containing material’ has the same meaning as in the OHS Regulations;
‘Authority’ has the same meaning as in the OHS Act;
‘Class A asbestos removal licence’ has the same meaning as in the OHS Regulations;
‘Class B asbestos removal licence’ has the same meaning as in the OHS Regulations;
‘employer’ has the same meaning as in section 5 of the OHS Act;
‘employee’ has the same meaning as in section 5 the OHS Act;
‘friable’ has the same meaning as in the OHS Regulations;
‘independent person’ has the same meaning as in the OHS Act;
‘OHS Act’ means the Victorian Occupational Health and Safety Act 2004;
‘OHS Regulations’ means the Victorian Occupational Health and Safety Regulations 2007;
‘plant’ has the same meaning as in the OHS Act;
‘removal’ includes transfer for the purpose of subsequent disposal;
‘self-employed person’ has the same meaning as in the OHS Act;
‘the 2015 Victorian bushfires’ means the bushfires that were ignited in areas of Wye River,
Separation Creek, Scotsburn and Barnawartha in December 2015;
‘workplace’ has the same meaning as in the OHS Act.
