The Chief of Police is responsible for the protection of lives and property in the Town and Village through the organization and direction of all police functions, including patrol, investigations and enforcement. The Chief of Police is the Internal Affairs Officer and Liaison to the District Attorney. The Chief of Police is the Public Relations Officer, Community Events Planner, and department’s Press Information Officer. The Chief of Police is responsible for the engineering, implementation, and fiscal austerity of the department’s operational budget. The Chief of Police is responsible for the security and disposition of all evidence secured / released by the department. Police Lieutenant (1) Police Lieutenant supervises all personnel engaged in traffic or patrol activities; makes assignments and communicates orders, policies, procedures and other administrative directives to subordinate personnel; inspects field operations; advises first line superiors in training methods and procedures. Develops improved methods and procedures relative to assigned functions; assists the Chief of Police in the formulation of policies, plans and programs; coordinates activities with other departmental units and other local, regional and state agencies. Assists in preparation of annual department budget proposal; is responsible for recommending all purchases, equipment replacement, and overtime associated with shift or unit operations. The Lieutenant also confers with the Chief of Police to improve the Department’s efficiency. (In the absence of the Deputy Chief, the Lieutenant is second in command assuming all the responsibilities of the Deputy Chief’s position) 5 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Police Sergeant (5) / Detective Sergeant (1) Observes, supervises and instructs subordinate officers; responds to in-progress and major incidents and directs or assists subordinates in difficult and unusual situations. Supervises and participate in general patrol, scheduling, traffic operations, and investigation or special duties. Recommends training programs and develops subordinate personnel; conducts periodic inspections of subordinates, and police vehicles and equipment; maintains disciplinary control of subordinates. May appear before citizens and community groups to explain and demonstrate Police Department policies, procedures and methods in order to cultivate favorable public relations. Police Officers Full Time (13) Part Time (11) Patrols a designated area in a radio-equipped patrol car, or assigned to walk a post (Village) to preserve law and order, prevent and discover the commission of crime, enforce motor vehicle operation, parking and traffic regulations, State statutes, County, Village and Town ordinances; answers calls and complaints involving automobile accidents, fires, nuisances, assaults, robberies and other felonies and misdemeanors; administers first aid; makes arrests and transports prisoners to jail; testifies as a witness in court; completes written reports on assigned calls for service, establishes traffic control and police protection at fires and other incidents which may attract crowds; performs police duties at parades, demonstrations and sporting events; check and reports of deficient street lights, signs, road services, or other facilities which serve the public, demonstrates good judgment during routine and non-routine situations, acts in accordance with department policies and procedures, and utilizes techniques in a safe manner in accordance with training. VIP (Volunteer in Policing) Reserve Officers (6) A non-compensated person; who has met all NYS certification requirements as prescribed under NYS DCJS Municipal Police Officer Training Council possessing the same law enforcement power of arrest as any other police officer, as prescribed under the pertinent sections of 1.20 of the NYS CPL and has successfully completed the department's Field Training Officer Program; and has been appointed by the Chief of Police and the Town Board to perform law enforcement duties. Reserve officers will be responsible for performing the same uniform patrol duties as all other police officers in the department. Reserve officers work in the company of a full time compensated police officer. This program was first rolled out in July 2013. 6 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Detectives (2) Detectives are responsible for handling a multitude of criminal investigations, including: Homicide, Sexual Assault, Robbery, Burglary, Economic Crimes, Unattended Deaths, and Thefts among others. The Detective Division has the sole responsibility for identifying and tracking Sexual Predators and Sexual Offenders. Crimes related to sensitive investigations and Narcotics also falls under their purview. Detectives work in conjunction with Federal, State and Local task forces to foster a combined effort in the fight against drugs. Detective must also photograph and video tape major crime scenes using video cameras, and digital camera imagery; develops and prepares photographic enlargements for latent prints, shoe impressions, etc. Collects, packages, transports and submits evidence within prescribed standard operating procedures; transports evidence to appropriate crime labs – New York State Police Crime Lab, or the Federal Bureau of Investigation, for scientific laboratory analysis; ensures that the necessary forms are prepared and processed. Attends and documents autopsies via photography/videotape; collects and packages evidence such as hairs, fibers, clothing, finger and palm prints, fingernails, and body fluids from decedent at autopsy to be placed into evidence. Produces crime scene drawings and sketches manually to record location of all evidence; utilizes computer software program for final drawing of crime scene. Prepares exhibits for case prosecution including photographs, crime scene diagrams, casts of impressions, etc. Dispatchers Full Time (3) Part Time (8) The ability to operate several computer systems consisting of police records, give information to the officer responding to a complaint, keep complete logs on various arrests, teletype entries and cancellations, the ability to operate a computer terminal connected to the NYS Department of Motor Vehicle, FBI, and the National Crime Information Center; process requests from officers regarding driver’s license checks, vehicle registration checks, criminal histories, various stolen and recovered items, warrant checks and broadcasts. The ability to operate a radio system to receive and transmit messages, dispatches emergency requests received through telephones; handle requests for service by telephone. 7 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Administrative Aide (1) Provides administrative and secretarial support to the Chief of Police, is responsible for the administrative work which includes billing for services rendered and contract services, works closely with Chief of Police in vetting the department’s budget and expenditures, is responsible for ensuring all orders are concluded and purchase orders are complete, responsible for general ledger balancing for Capital Projects; balances subsidiary ledgers including accounts receivable, assessment reports and reconciles ledgers by making adjusting entries as necessary, maintains disbursement accounts, including encumbering of purchases, auditing of invoices, posting, reconciling and preparing trial balances and other necessary reports, including control accounts and informs Chief of Police of budget balances, examines invoices and audit reports to determine their accuracy, and completeness, composes and types correspondences, reports, statements, manuscripts, letters, resolutions, proposals, forms and other department materials at the direction of the Chief of Police, prepares employee timesheets for appropriate supervisor's verification and checks verification for final entry into computer; updates personnel changes in computer payroll/personnel system, receives and records employee requests for vacation, compensatory and sick leave, reviews computer for accrual records; enters information into computer and additionally must keep some independent manual records, processes employee attendance and leave records to compute payroll, sending to Budget & Finance Department; maintains and prints records of earnings and leave time. The Administrative Aide is also the liaison to the County Civil Service Department, responsible for maintaining all personnel files in the department. Clerical VIP (1) (Volunteer in Policing) Non-compensated person who assist in the daily operation of the department assigned to the communication center performing task such as filing, purging sealed arrest records and aiding administration in photo copying and retrieving case information to complete FOIL request. This program was rolled out in June 2013 and is still in the developing stages. Chaplains Program (3) (Volunteer in Policing)The purpose of the Police Chaplain program is to provide confidential counseling or spiritual guidance to the members of the Saugerties Police Department, both sworn and civilian, as well as their families during their times of need. The Police Chaplain will be entrusted to provide guidance, counseling and 8 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” comfort during a variety of situations and be able to enlist the availability of appropriate services if such a need is realized; assisting in notifications and grieving counseling. School Crossing Guards (4) The police department is tasked with the responsibility of providing school crossing guards for the purpose of providing a safe environment for children to cross roadways and intersections at particular locations within the Saugerties School District. General Municipal Law § 208-a authorizes cities, villages, towns, and county and district police departments to provide for school crossing guards to control vehicular traffic in order to protect children going to and from school. Because schools do not have any power to designate, authorize or appoint school crossing guards, the New York State Office of the State Comptroller has opined that "[a] school district may neither employ school crossing guards nor contribute to the expense borne by a [municipality] which employs them." See Opns St Comp, 1981 No. 81-31; see also 1959 N.Y. Op. Atty. Gen. No. 228. School Crossing Guards are paid $12.25/hour and receive their training from the police department. Town crossing guards are Civilian Employees of the Police Department - Village Crossing Guards are part time police officers. College Intern Program The Saugerties Police Department enjoys a unique relationship with several colleges and universities through a college intern program that was established in 2012. Through this program college students concentrating in the area of criminal justice are given the opportunity to spend a semester at the police department working as an intern. This program provides the student with an overview of all aspects of modern day law enforcement methodologies, from communications through detectives. Students work alongside police officers, attend autopsies, firearms training, K9 patrol, RMP and records management data entry and retrieval. Some students may spend an entire semester working on just one particular project. These students earn three credits/semester, and have proven themselves to be true assets to the mission of the Saugerties Police and the community. To date students from Albany University, Ulster County Community College, Mount St. Mary’s College, and SUNY Canton have Interned through the Saugerties Police Department. 9 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” SERVICES Police Communication Center - is in operation 24 hours a day, seven days a week, with three full-time and nine part-time communication specialists. In addition to dispatching calls for service, the communication specialists are the initial point of contact at our 24 hour service window. They are also responsible for the majority of our data entry, receiving and directing administrative telephone calls. In 2014 the Saugerties Police Communication Center received 17,749 Emergency calls. The communication staff provided service to an estimated 9,950 individuals in the police station lobby. Officers are assigned throughout both zones, Town and Village, which allows officers to identify and quickly address problems in the area. Patrol provides around-the-clock service, seven days a week, 365 days a year. In 2014 the Department patrolled a total of 239,771 miles. The patrol area is 60 square miles. Med Return MVA Partition Street Crime Scene Investigation Marihuana Evidence The Detective Division consisting of a detective sergeant and two detectives handled 396 cases in 2014, closing 76 of them by arrest and 237 through investigation, leaving 82 cases still under investigation. Since the nature of the investigations assigned to this division require many hours, additional case closures and/or arrests open are typical and expected. Because of this, the statistics regarding case closures will change during the 2015 calendar year. 12 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” 2011 2012 2013 2014 Cases 374 447 414 396 Arrest 92 109 90 92 Open 45 60 65 82 In 2014, members of this division handled four robbery complaints. Of these four [4] complaints, two were closed by arrest and two were closed by investigation. In April of this year, the remaining open bank robbery from 2013 was closed by arrest when Collin Lambert was identified and located in the Tannersville Area of Greene County. Twenty-nine [29] investigations were conducted for sexual offenses, compared to seventeen the previous year, forty-three [43] for burglary, five [5] felony assaults, thirty-six [36] for larceny, nineteen [19] death investigations, fourteen [14] motor vehicle accidents including one [1] fatality, and sixteen suspicious fire investigations. Of the ninety-two arrests, seventy-nine [79] were adults and three [3] were juveniles. A breakdown of the area major crime occurs found that in 2014, two hundred eighty [280] investigations were conducted in the Township while one hundred sixteen [116] were within the Village limits. FILAK 2 CHIEF SINAGRA 2 13 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Significant Detective Cases In 2014 Fatal Motor Vehicle Accident, Intersections of Main & Partition Streets (2014-1547) Lead Investigator: Detective Sergeant Kenneth Swart, Jr. On January 30, 2014 pedestrian Robert Carlson was struck and killed by a commercial vehicle being driven by Elwood Hewitt in the heart of the Village. After the investigation was completed, it was shown that Robert Carlson improperly entered the roadway into the path of Elwood Hewitts’ vehicle when he was struck and killed. Donald McInnes, Rape 2nd, Village of Saugerties (2014-1870) Lead Investigator: Chief Joseph Sinagra & Detective Paul Gambino Following a complaint on February 5, 2014, Registered Sex Offender Donald McInnes was arrested for Rape in the second degree for engaging in sexual intercourse with a fifteen-year-old female in the Village of Saugerties. Further investigation revealed that Donald was living in the Village of Saugerties illegally and failed to register as a sex offender with the Saugerties Police Department. In April 2015, Donald plead guilty and is serving a seven year sentence for rape. Daniel Shockley, Theft from Police Station (2014-3477) Lead Investigator: Detective Sergeant Kenneth Swart, Jr. On March 10, 2014, following a motor vehicle accident where his vehicle became disabled leaving him stranded, Daniel Shockley of Clifton Park was transported back to the Saugerties Police Department to wait for his mother to come. During his time in the police lobby, a patrolman’s badge, police tie bar, and citations bars were taken off the mannequin on display. The police insignia and identification was recovered the next day after reviewing the security footage. Christopher Magee & Damian Ackert, Grand Larceny/CPSP (2014-11730) Lead Investigator: Detective Paul Gambino On July 28, 2014, following a complaint from a tourist at the Comfort Inn an investigation was initiated regarding a stolen Rolex watch from one of the hotel rooms. Resulting from this investigation, both Magee and Ackert were arrested for grand larceny and possession of stolen property. The Rolex watch valued in excess of $10,000 was recovered and returned to the victim. 14 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Damian Ackert & Francis Ackert, Robbery 2nd, Ulster Avenue (2014-12145) Lead Investigator: Detective Henry Mirabella On July 31, 2014, and investigation into strong-arm robbery that occurred at Lucky’s Food Mart resulted in the arrest of the father and son duo of Francis and Damian Ackert. Following the investigation, both Ackerts approached a male within the store in an attempt to take keys to a motor vehicle from him when that was unsuccessful; they removed cigarettes and a lighter. William Waldron, Internet Threats, Saugerties School District (2014-20950) Lead Investigator: Detective Paul Gambino December 20, 2014: Following a complaint of an Instagram post, an investigation revealed that William Waldron, age 17, had posted picture of a handgun in a book bag, Molotov cocktail and referenced the Columbine School shooters. Resulting from this investigation, it was revealed that William possessed a journal which contained various websites that permit discussions on weapons and explosives as well as an image depicting the nomenclature of a common pipe bomb. William’s case is still pending in Saugerties Town Court. Case Adoption The policy shift in mid-2013, addressing detective case adoption of seven low level felony investigations, keeping these suspect apparent investigations at the Patrol Division level continued through 2014. This policy continued to allow detectives to spend more time managing those cases that necessitate greater investigative time and effort. This policy further reduces overtime call out of police detectives, having a significant impact on reducing overall spending. This policy further categorizes the type of incident permitting for follow up by detectives to occur during routine business hours, thus alleviating the need to bring a detective in on overtime during off hours. 15 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Personnel In January, Lieutenant Stephen Filak, Detective Sergeant Swart, Detective Mirabella and Detective Gambino attended the DCJS Evidence Custodian/Property Manager Course and successfully received certifications. After unsuccessfully locating a photography course, we organized and hosted the DCJS certified 5-day Basic Investigative Photography Couse which was held at the local U.S. Army Reserve Center on Kings Highway; the training certified Detective Mirabella, Detective Gambino and Patrolman Loertscher in crime scene photography. This training is a prerequisite to attending and receiving a certification as a crime scene technician, a 2015 goal. Detective Sergeant Swart, and Lt. Filak attended a 3-day Concerns of Police Survivors course put on at the New York State Police Academy, which provided training in the handling of in-theline-of-duty deaths. Both Detective Sergeant Swart and Detective Gambino attended Undercover Operations School through the New York State Police, laying the foundation for future drug operations. In September, Detective Gambino attended the Col. Henry F. William Homicide Seminar is an international Law Enforcement summit held in Albany. In an attempt to provide additional training while keeping costs at a minimum, the Detective Division began attending webinars during their normal work hours. These webinars were put on by Sirchie, the premier evidence collection, development and identification manufacturer, and focused on the latest latent fingerprint development and collection techniques. 16 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Looking Forward In 2015, the Detective Division will be adding a new detective, training this detective to become an active, self-reliant investigator. At the end of 2014, the Detective Division only had one certified evidence collection specialist. With three additional personnel completing the prerequisite training it will be a 2015 priority to ensure that two additional personnel attend evidence technician school. Throughout 2014 the evidence system became barcoded and the processing room overhaul began. During 2015, we hope to complete the processing room upgrades, adding a latent development station and a drying chamber (typically used for drying of bodily fluids present in assault and sexual offense investigations). 17 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Volunteers are an important part of any organization and are proven to be a valuable asset to law enforcement agencies. Volunteers help to increase police responsiveness, service delivery, and information input, and they provide new program opportunities. In addition, volunteers can bring new skills and expertise to the job and prompt new enthusiasm. It is the policy of the Saugerties Police Department to use qualified volunteers for specified tasks and duties that can create efficiencies for the department and improve services to the community. Volunteers are intended to supplement and support, rather than supplant, sworn officers and civilian personnel. The Saugerties Police Reserve Police Officer Program is an essential part of the Volunteers in Police Service Program we have embraced here in Saugerties. Our program began in April 2013 and since has grown greater than we had anticipated. Reserve police officers are fully sworn police academy graduates who work alongside full time police officers. Since the conception of this program we have had fourteen reserve offices go through our program. Upon completion of their 320 hours of field training we hired several of the reserve officers as part time officers and two were hired as Full Time Police Officers, one female and one male. Today our program consist of six administrators who work alongside the of this program. reserve police officers and two volunteer police chief in the administration and oversight Officer Hastings (FTO) and Reserve Officer Downes 18 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” Crime Trends Major crime trends from 2013 to 2014 showed a dramatic decrease in the overall trend of burglary. As a largely populated residential community, this trend signifies the hard work and dedication of the Patrol Division’s proactive approach and community policing. For the first time in several years, there were no current or outstanding robberies of any financial institutions; we saw an overall decrease in the violent felony offense of robbery. They respond to calls for service when requested. When not engaged in Police action requiring the use of their K9 partner, the handler carries out the regular duties of patrol officer. K-9 Units assist whenever possible in arrest situations, search and rescue details, search of escaped prisoners or fleeing felons, search for missing persons, crowd control, explosives detection and building searches. ERT members are also assigned to the County of Ulster Emergency Response Team which is a multidisciplinary law enforcement tactical response team. ERT members play a vital role toward ensuring our capability of adequately responding to crises involving weapons, hostage situations, and incidents involving an active shooter. In 2014 the department spent $2,278,700. In 2012, the Police administration began an aggressive campaign of back charging for services rendered that were outside of the scope of normal policing, and further created several new revenue streams through charging for such things as impound storage fees, nuisance alarms, records request, FOILS, and providing other untraditional police services. As a result, the police department has achieved revenues that have negated over expenditures, providing a surplus returnable to the town’s general fund each year. Total 2014 revenues amounted to $173,738.26, providing a surplus of $107,847.03 or 4.85 % in the black at year’s end. 25 SAUGERTIES POLICE DEPARTMENT 2014-YEAR END REPORT “Dedicated to the Community” In the Fall of 2014 local artist Adrian Hirsch and Ze’ev Willy Neuman collaborated on a 911 Memorial which is displayed on the main wall at Police Headquarters. The mural was sparked after a comment by Police Chief Joseph Sinagra that he would hope to see graffiti artists working with the town to display their art rather than defacing town or private property.
