TheUniversityofTennessee CountyTechnicalAssistance Service _______________________ CountyOfficials SalarySchedule FY2017-2018 TO: CountyOfficials FROM: RobinRoberts,ExecutiveDirector DATE: January18,2016 SUBJECT: CountyOfficials’CompensationFY2017-2018 COUNTYOFFICIALS.CompensationformostcountyofficialsisgovernedbyT.C.A.§8-24-102, whichestablishestheminimumcompensationforassessorsofproperty,countyclerks,clerksof court,trustees,registersofdeeds,countymayors,sheriffs,andhighwayofficials.Thislaw providesforanautomaticincreaseintheminimumsalaryeachyearbasedonthepercentage increasegiventostateemployeesforthepreviousfiscalyear.Itrequiresthecommissionerof financeandadministrationtocertifytothecomptrollerofthetreasurytheaverageannualized increaseinstateemployees’compensationonorbeforeMay1ofeachyear.Thecommissioner certifiedonOctober6,2016,thatstateemployeesreceivedanaverageincreaseof6.38percent forthefiscalyear2017-2018. ThecertificationprovisionandotherrequirementsarecontainedinT.C.A.§8-24-102(d)as follows: OnJuly1,2002,andeachJulythereafter,theminimumcompensationforcounty officials,asprovidedbythissection,shallbeincreasedbyadollaramountequaltothe averageannualizedgeneralincreaseinstateemployees’compensation,includingthe equivalentpercentageincreaseinaveragestateemployees’salariesrepresentedby appropriatedfundsmadeavailabletoaddressclassificationcompensationissues,during thepriorfiscalyearmultipliedbythecompensationestablishedhereinforthecounty officialsofthecountywiththemedianpopulationofallcounties;provided,however, thattheannualizedgeneralincreasetiedtotheincreaseinstateemployees’ compensationshallnotexceedfivepercent(5%)inanygivenyear.Providedfurther, notwithstandingthedollaramountprovidedherein,thepercentageincreaseprovided forcountyofficialsbythissubsectionshallnotbelessthanthepercentageincrease establishedforcountyofficialsofthecountywiththemedianpopulationofallcounties. OnorbeforeMay1ofeachyear,thecommissioneroffinanceandadministrationshall certifytothecomptrollerofthetreasurytheaverageannualizedgeneralincreasein stateemployee’scompensationduringthatfiscalyear.“Averageannualizedgeneral increaseinstateemployee’scompensation”meanstheaveragepercentageincreasein basesalariesforstateemployees,plustheequivalentpercentageincreaseinaverage stateemployees’salariesrepresentedbyrecurringappropriationamountsprovidedto improvethelevelofretirementbenefits,longevitybenefits,anddeferredcompensation benefitsorothersimilarbenefitsthataremadeavailabletostateemployees,not includinghealthinsurancebenefits. Thetablesonthefollowingpagescontainourcalculationsoftheminimumsalaryforeach official,accordingtothestatutorypopulationclasses,forthe2017-2018fiscalyear.Notethat allsalariesdonotincreaseby5.0percent.Instead,inaccordancewiththestatuteasamended, theminimumsalariesofofficialsinthosecountieswithpopulationsequaltoorabovethe countywiththemedianpopulationwillincreaseby5.0percent.Theincreaseforthosecounties belowthecountywiththemedianpopulationisadollaramountthatisequaltothedollar amountoftheincreaseintheminimumsalaryinthecountywiththemedianpopulation.The countywiththemedianpopulationasofthe2010censusisObionCountywithapopulationof 31,807whichiswithinthe23,000to34,999range. Otherrequirementsregardingsalariesareasfollows: ADMINISTRATORSOFELECTIONS.Separatelegislation(T.C.A.§2-12-208)providesfor minimumsalariesfortheadministratorsofelections.Thesesalariesarebasedupon percentagesoftheassessor’scompensation.Aswiththestatutediscussedabove,thislaw providesforyearlysalaryincreasesbaseduponincreasesforstateemployeesduringtheprior fiscalyearandcalculatedinthesamemanner. GENERALSESSIONSCOURTJUDGES.Salariesofgeneralsessionscourtjudgesaretobe increasedannuallyinthesamemannerasstatecourtjudges,whichistheactualpercentage changeintheconsumerpriceindexbetweentheprevioustwocalendaryears(T.C.A.§§16-155003and8-23-103).TheCPIchangebetween2016and2017hasnotbeencalculatedatthe timeoftheissueofthisdocument(January2017).Whenthisinformationisreleased,this sectionwillbeupdatedtoreflecttheincreaseinsalaryforgeneralsessionscourtjudgesforthe comingfiscalyear.Notwithstandinganyotherlawtothecontrary,ageneralsessionscourt judge’ssalarymaynotexceedthatofacircuitcourtjudge. CTASdoesnotpreparesalaryschedulesforgeneralsessionscourtjudgesbecausethesalariesin eachcountyarebasedontheprivateactsandgenerallawsthatapplyineachparticularcounty andonsalarycalculationsmadebytheAdministrativeOfficeoftheCourtspursuanttoT.C.A.§ 16-15-5003(i)(7). Clerksofcourtthatservemorethanonecourtmay,atthediscretionofthecountylegislative body,bepaidadditionalcompensationintheamountoftenpercentoftheclerk’sbase compensation.Increasespaidtocourtclerksunderthisprovisionwillresultinanincreaseinthe minimumsalaryforthesheriff,highwaysuperintendent,andcountymayor.(T.C.A.§8-24102(j)(2)).
