CONSTITUTION of SPIRIT EXPRESS OF INDUSTRIAL HIGH SCHOOL Preamble We the students of Industrial High School Spirit Express have formed under the purposes of: Showing school & district pride Practicing servant-leadership Article I: Membership and Eligibility 1.1 This organization of students shall be known as Spirit Express of Industrial High School. 1.2 All students at IHS shall be eligible to participate in Spirit Express. One shall be noted as an official member after they have attended three Spirit Express meetings. Their membership is valid until graduation or until one misses three consecutive meetings and has not arranged for make-up assignments. One is not eligible to become a member again until the following year. A member may be dismissed under the following conditions: Participating in actions leading to the suffering of severe consequences by school (such as ISS, AEP, expulsion) or law Repetitive failure to participate in committees or tasks one has volunteered for or has been assigned Missing three consecutive meetings (without arranging for make-up). Not attending football games or other organized events. Failure to maintain passing grades during the year. Members and officers will be placed on probation after failing a six weeks and dismissed after failing a six weeks for the second time in one calendar year. Students are eligible to become members again at the beginning of a new school year. Regular members (not officers) may obtain a onetime waiver for Pre-AP and AP classes with teacher and Principal approval. Officers who are dismissed for poor grades are eligible to become regular members again at the beginning of the next school year, but are not eligible to run for office again. Attempts to cause excessive complications (drama) in the group, bullying, harassment in person or using electronic or other media such as Facebook. 1.3 All members of the student body not on scholastic or disciplinary probation shall be eligible to campaign for and hold elective office within Spirit Express, with the exception of the President and Vice President, who must also have an overall grade point average above 2.5 (75). Dismissal of an officer from their office follows member dismissal. Article II: The Executive Board 2.1 The executive power of Spirit Express shall be vested in the President, the Vice President, Treasurer, Secretary, Sponsor and Principal. 2.2 The executive officers shall all serve (but are not limited to) one-year terms, beginning at graduation of the past year. 2.3 The President of Spirit Express � Members of Spirit Express shall elect the President during elections at the end of the year. � Duties of the President a. The President shall faithfully execute all acts of the Organization meeting. b. The President shall be the representative of the students to Spirit Express Sponsor, the Principal and to faculty. c. The President shall serve on, or send a representative to, the committees, and boards, of which the President is a member. d. The President shall, with advice of the sponsor and consent of the officers, nominate or appoint, as appropriate, students to serve on committees and boards. e. The President shall, at each meeting of the Organization, give information on the state of Spirit Express, and recommend to their consideration such measures judged necessary and expedient. The President has no vote unless there is a tie. f. The President shall have the power to, on extraordinary occasions; convene the organization giving notice to all representatives at least forty-eight (48) hours prior to the special meeting. . 2.4 The Vice President of Spirit Express � The Vice President shall be elected by the members of Spirit Express during elections at the end of the year. � Duties of the Vice President a. The Vice President shall preside over the organization in the absence of President, and likewise shall have no vote unless they be equally divided. b. The Vice President shall serve on the committees and boards of which the Vice President is a member. c. The Vice President shall assist the President with assigned responsibilities. e. The Vice President shall succeed to the Presidency in the event that the President is unavailable to fulfill the duties of the office. f. The Vice President shall ensure the enforcement of the rules of Spirit Express, and of the Bylaws, and Internal Rules of the organization 2.5 The Treasurer of Spirit Express � The Treasurer shall be voted in by the members of the organization during elections at the end of the year. � Duties of the Treasurer a. The Treasurer shall manage the finances of Spirit Express. b. The Treasurer shall assist the President in developing the annual budget and fiscal reports. c. The Treasurer shall present to the Organization a report and recommendation based on the fiscal impact of all bills with the appropriations of funds. 2.6 The Secretary of Spirit Express � The Secretary shall be voted in by the members of the organization during elections at the end of the year. � Duties of the Secretary a. The Secretary shall manage the sign in sheets and meeting minutes of Spirit Express. b. The Secretary shall assist in keeping photos, historical records, etc. Article III: Appointed Officers/ Committee Leaders 3.1 Appointed Officers/ Committee Leaders will be selected by the Executive Officers and sponsors when the time arises. For example – Yell Leader Article IV: The Organization 4.1 Duties and Powers of the Organization � The Organization shall be responsible for the creating spirit banners, posters, etc. Members will attend football and other athletics events to help cheer. � The budget of Spirit Express must be approved by the Organization. � All appointments by the President of Spirit Express must be approved the sponsor and by the Organization, unless specified otherwise. Any appointment may be reversed by a twothirds majority of the Organization. � No formal action can be taken by the Organization without a quorum present, which shall consist of two-thirds (2/3) of the total Representatives. � The Organization shall meet on days and times to be set by the President, Vice President, and sponsor. � The Organization shall abide by Robert’s Rule of Order during Organization Meetings with President and sponsor have complete order. � Bylaws of this Constitution regarding the entire Spirit Express must be enacted by a twothirds (2/3) majority of the Representatives. � Each Representative shall have one vote. Article V: Elections 5.1 General elections shall be held yearly in May. 5.2 Each student may cast one (1) vote for president, one (1) vote for vice president, one (1) vote for secretary, and one (1) vote for treasurer. 5.3 The candidates receiving the highest number of votes from the Organization shall hold that particular office and all responsibilities that come with the position. 5.4 Runoff Elections If the top candidates receive a tie vote, a runoff election will occur. A candidate for President or Vice President must receive a majority of the votes cast in his or her respective race to be certified. If no candidate for President or Vice President receives a majority of the votes, the two candidates receiving the highest number of votes for the respective position shall have a runoff election. The candidate receiving the highest number of votes in the runoff shall be certified in the position. In the case of a tie in the runoff for President, Vice President or any other office the current office holders shall cast the deciding votes. 5.10 There shall be no constitutional provision requiring a minimum number of voters participating in any general election in order to validate that election. 5.11 Officers of Spirit Express, before entering the execution of his or her office, shall take Spirit Express, Oath of Office. The Oath of Office shall read, “I do solemnly swear (or affirm) that I will faithfully execute the office of Spirit Express, of Industrial High School and will to the best of my ability preserve, protect, and defend the Constitution of Spirit Express. 5.12.1 The President and Vice President can only be challenged, in an election, by a non-elected member in an election, if the current officer is graduating. 5.12.2 Only a officer with one year or more of experience can run for the office of president. 5.12.3 Only a current member will be allowed to nominate a candidate for an elected office. Article VI: Removal 6.1 Executive officers may be impeached and removed from office for failure to fulfill the duties and responsibilities mandated in this Constitution of Spirit Express. 6.2 Impeachment legislation must be sponsored by an executive officer on Spirit Express. 6.3 In the event of impeachment, removal hearings shall take place in the next meeting of the Organization as the first order of business. The Principal shall preside at such hearings. A three-fourths (3/4) majority of Organization Member shall be necessary for removal. 6.4 The candidate for impeachment shall be informed of their misconduct and place on probation for thirty (30) days. 6.5 If misconduct proceeds, the impeachment process shall be enforced. 6.6 Executive officers shall be removed from the Organization after failing for the second time in a one-year period. This includes regular classes, AP classes, and Pre-AP classes. 6.7 Executive officers who have been dismissed from the Organization because of 6.6 shall be eligible to return to the Organization the next school year as regular member but may not be eligible to run for office again. 6.8 Executive officers, who do not attend football games and other Spirit Express activities regular basis, will be removed from office and will become a regular member. Article X: General Provisions 10.1 No expenditures shall be allowed that would result in a deficit in any Spirit Express account. 10.2 Two elective offices shall not be held simultaneously by the same person, nor shall two persons simultaneously hold the same elective office. 10.3 Spirit Express may not make any endorsements in any elections. 10.4 This Constitution supersedes all previous constitutions of Spirit Express, and its ratification nullifies all pending amendments to the current constitution. This Constitution shall take immediate effect when it shall have been ratified by a majority of ballots cast in an election by the members of the student body and approved in accordance with Section 10.5 All officials elected under the requirements of the previous constitution shall remain in their corresponding offices if they do exist and shall exercise their corresponding duties and responsibilities as set forth in this Constitution until their terms of office have expired. Any new offices shall be filled at the soonest possible time. 10.6 This Constitution and its associated rules and regulations, and amendments there to are subject to provisions of the Rules and Regulations of the administrators of Industrial High School. 9/5/12
