PREAMBLE
1.
All Election Committee members and candidates will receive a copy of the
election rules.
These rules will also be posted on the Local 521 website:
www.seiu521.org.
2.
These election rules and procedures were approved by the SEIU 521 Executive
Board Officers on July 28, 2015, and must be followed by candidates, members,
and staff.
3.
Candidates should be aware that Department of Labor election guidelines forbid
the use of union or employer resources in election campaigns. Campaigning at
worksites during work hours and use of employer or Local 521 email is a violation
under Department of Labor guidelines (see "Campaigning" and "Union/Employer
Resources" listed in this document).
4.
These election rules and procedures are in effect for the 2015 - 2016 election of
Officers, Executive Board Delegates, and Trustees to serve for the Executive
Board term of March 1, 2016 - February 28, 2019.
SECTION 1: NOTICE OF ELECTION
All members shall be notified of an election not less than 90 days prior to the
commencement of voting, and notified of nominations no less than 30 days before their
close [521CBL VIII.4].
a. The notice of election will be sent to all members during September 2015 via
bulk mail; 90 days to the commencement date is October 4, 2015. The
commencement date is January 4, 2016. Notices will be sent to members’
last known address on file with Local 521. Local 521 will work to contact
members whose notice was returned due to an undeliverable address.

SECTION 2: NOMINATION PERIOD
The nomination period opens on Monday, October 26, 2015, and will close on Monday,
November 23, 2015, at 5:00 p.m. All original nomination petitions (original signatures
only; no copies) may be sent by U.S. Mail (delivery confirmation service recommended)
and postmarked by Wednesday, November 18, 2015; or, may be delivered in person to
one of the staffed Local Union offices listed by 5:00 p.m. Monday, November 23, 2015.
a. Nominating petitions cannot be scanned, emailed or faxed. Photocopies will
not be accepted. Original forms with original signatures only.
b. It is the candidate’s responsibility to meet the deadline.
Any nomination
petitions delivered by hand after 5:00 p.m. Monday, November 23, 2015, will
not be considered.
c. Staffed
offices:
Bakersfield,
Fresno,
San Jose, Santa Cruz, and Visalia.
Redwood
City,
Salinas,
Hanford is a non-staffed office.
Nominating petitions delivered to non-staffed offices will not be accepted
without prior arrangements made with Pam Rodgers - 408-678-3300.
Arrangements for documents to be delivered at non-staffed office must be
requested no later than November 13, 2015.
SECTION 3: NOMINATION PETITIONS
Petition forms are available for download from Local 521 website: www.seiu521.org.
They may also be picked up at your Local Union office (or from your worksite organizer
when available).
a. Localwide & Regional positions:
Nomination petitions require signatures
from 25 members in good standing eligible to vote for the office nominated.

b. A member may nominate her/himself and sign her/his own petition.
Signatures may be collected on more than one petition form. [521CBL VIII.1]

SECTION 4: NOMINATION MEETING
A nomination meeting is scheduled for Thursday, November 12, 2015 at 5:30 p.m.,
via video conference in the San Jose, Fresno, Salinas, Bakersfield and Visalia offices.
At this meeting, a nomination and the required second may be made by members in
good standing eligible to vote for the office nominated.
a. Membership eligibility will be checked at the door by administrative staff.
Fee payers must sign a membership card to enter into meeting.
b. Members working in areas receiving a mail ballot (see Section 18.c) whose
work location has fewer than 25 members can mail their nomination petition
to SEIU Local 521’s San Jose office to be submitted to the nomination
meeting.
Petitions must be postmarked by November 5, 2015. Notices
explaining the process were sent to members in September 2015.
SECTION 5: ELECTION COMMITTEE
A three-member committee with two alternates were appointed by the President and
approved by the Executive Board at the June 26, 2015 meeting.
a. The Election Committee will not be candidates for, nor actively campaign for,
any Local or Chapter elected position during the term of their appointment.
b. The Election Committee will establish rules and procedures for fair and
democratic elections in accordance with the local bylaws, the bylaws of the
International Union and labor law, including method of balloting, overseeing
tabulation of results and certifying of election results. [521CBL VIII.9]
c. The Election Committee may, as appropriate, be assisted by Local Union
staff in performing administrative and clerical functions, although at all times
the Election Committee should be responsible for the conduct of the election.

d. The committee may select a chair and keep a record of all its decisions.
Candidates or campaigns found to be in violation of the election rules face
the possibility of being declared ineligible by the Election Committee.

SECTION 6: ELECTION ADMINISTRATOR
The Local 521 Election Committee has authorized the contracting of the services of an
Election Administrator who is responsible for the conduct of the election in accordance
with these rules, and in consultation with the Election Committee as appropriate. The
American Arbitration Association (AAA) has been selected by the Executive Board at
the June 2015 meeting. The Election Administrator’s duties will include:
a. Prepare ballot types for the various voting locations; numerically coding the
membership list and preparing the ballot packets.
b. Local Union administrative staff will work with the Election Administrator to
verify union membership and ID ballot type for voting purposes.
c. The Election Administrator is responsible for receiving and securing ballots
during the entire voting process from January 4, 2016 to January 14, 2016.
d. Vote Count: The vote count is scheduled for January 14, 2016 at 5:00 pm.
The vote count will be conducted by AAA at Local 521 San Jose office
located at 2302 Zanker Road, San Jose 95131. Offices with video
conference will be able to see the vote count live. The process will consist of
the Election Administrator scanning the ballots under the observation of the
Election Committee members, providing the certification of results within
at the end of the vote count, and retaining all ballots and related files for a
one-year period.
SECTION 7: QUALIFICATION OF CANDIDATES
A person is eligible to be a candidate for office of the Local Union if they have been
a member in good standing of the Local Union. The candidate must be in
continuous good standing in the Local Union for at least two years immediately
preceding nominations and have, during all of that time, paid the full dues required
for working members of the Local Union within each month when due. (Effective
October 1, 2015 thru October 31, 2015.) [SEIUCB Article VX, Section 2]
a. The two-year requirement is waived if the candidate has been a full duespaying member in good standing since the time of affiliation of their chapter.
i.
Definition of “Continuous Good Standing”: "Continuous good standing"
means that the member has paid all dues and other financial
obligations on or before the last day of each month when due.

ii.
A member who falls behind in his or her dues and then makes
retroactive dues payments does not satisfy this requirement. See
2012 International Union Constitution and Bylaws, Article XIII, Section
2.
iii.
The good standing of a member should be determined by using the
most recent records reflecting the payment of dues.
Because
nominations may be conducted in the middle of a month and members
have until the end of the month to pay their dues, good standing
should be determined based upon the last complete month for which
the Local Union has records. [SEIUCB]
b. No person will be eligible to be a candidate for more than one office of the
Local Union simultaneously. For purposes of this section, Chapter officers
shall not be considered Local officers. [521CBL VIII.3]
c. In accordance with International Union Bylaws, a member who wishes to be
a candidate for any office of the Local Union shall not have been convicted of
an applicable felony (see Section 504, Labor Management Reporting and
Disclosure Act - LMRDA). [521CBL VIII.3]
d. Eligibility of Local Union employees to be candidates for office shall be
limited to the positions of Chief Elected Officer and Delegate to regional,
national and international conventions.
If a member of the union has
previously been an employee, time spent as an employee shall be counted
toward the two year membership requirement if the person was a member of
the Local Union when employed by the Local Union and was paying full
dues. [521CBL VIII.3]
e. Write-in candidates and proxy voting shall not be permitted in any Local
Union election. [521CBL VIII.6]
f. If only one (1) eligible candidate is nominated for an office they shall be
deemed duly elected.

SECTION 8: ACCEPTANCE OF NOMINATION
A candidate who has been properly nominated must sign and submit the Acceptance of
Nomination form no later than 5:00 p.m., Monday, November 30, 2015, according to
election rules, in order to have her/his name placed on the ballot. A candidate is
considered bona fide upon signing and completing said form.
SECTION 9: ELECTION CHALLENGES DURING NOMINATION PERIOD
Any challenge or protest concerning the conduct of the nomination and campaigning
period must
be
submitted
in
writing
within
48
hours of
the incident to
[email protected]. The Elections Committee will respond to the protest within 48
hours of receiving it.
SECTION 10: CANDIDATE STATEMENTS
a. Candidate statements are optional. A candidate may submit a statement of
up to 75 words in length that will be included in the candidate booklet. It is
the candidate’s responsibility to submit their candidate statement by the
deadline. Candidates must provide a soft copy via email. Statements sent
only as hard copies (typed or handwritten; via U.S. mail, fax or hand delivery)
will be photocopied and added into the booklet as is. Candidates may email
their statements to [email protected]. MS Word format is preferred.
b. Local 521 will include the candidate's full name, job classification,
chapter/employer, and years of service with Local 521; this information is not
part of the 75-word count.
c. Candidate statements will be published exactly how they were provided by
the candidate. Local 521 will NOT edit, clarify, spell-check or correct any
statement. Statements exceeding 75 words will be cut off at the 75-word limit
for the booklet. It is the candidate’s responsibility to make sure everything is
worded and spelled correctly, and the word limit is adhered to.
d. A candidate may also electronically submit a statement of up to 500 words in
length that will be posted in the elections area of the Local 521 website. 500word statements must meet the statement deadline of December 7, 2015.
 If the candidate statement exceeds the 500 word limit, it will be
cut off at 500 words.

 A candidate who wishes to have her/his statement translated into
another language must provide their own translated version at
their expense.
e. Candidate Statement Booklets: Candidates will be provided 10 candidate
booklets (one commemorative color copy and 9 black/white copies).
Booklets will also be posted on Local 521 website, and mailed to members
who receive a mail ballot.

needed. Allow 24 hours for each request. Local 521 will invoice candidate
for copying and labor. Payment of additional booklets must be made at time
of request.
SECTION 11: CANDIDATE PHOTOS
Candidates are welcome to submit headshots (electronic files only). Photos must be
submitted electronically via email to [email protected]. Submission of headshot
must also meet the candidate statement deadline of Monday, December 7, 2015 by 5:00
pm. Full body shots are not allowed. Acceptable electronic photo formats: JPEG, GIF,
and TIFF. Local Union staff will be available to take a photo of any candidate at a
STAFFED Local Union office Monday thru Friday, 9:00 to 3:00, from October 26, 2015
thru December 4, 2015 (excluding weekends and holidays) BY APPOINTMENT ONLY.
SECTION 12: CANDIDATE LISTING
Eligible candidates will be listed on the ballot in ALPHABETICAL ORDER by their last
name.
SECTION 13: UNION/EMPLOYER RESOURCES
Section 401(g) of the LMRDA prohibits the use of any employer or union funds to
promote the candidacy of any person to union office. This prohibition applies to in-kind
contributions, as well as cash contributions and expenditures. It applies to indirect as
well as direct expenditures and contributions. The monetary value of the union or
employer funds or resources involved is not significant. Any expenditure on behalf of a
candidate, even if the amount is small, is a violation and constitutes grounds to set
aside an election. [SEIUEG: pg. 18]

a. The use of union and employer funds (including cash, facilities, employer
email, equipment, supplies, and campaigning on time paid for by the union or
employer) to support any candidate is prohibited.
b. No candidate or prospective candidate may solicit or accept financial support
or any other direct or indirect support of any kind from any non-member of
Service Employees International Union.
c. Chapter/bargaining unit newsletters and publications cannot feature or
provide unusual coverage of candidates during the election period, but
chapters/bargaining units are encouraged to remind members to vote and
publish the election schedule in newsletters.
SECTION 14: INSPECTION OF VOTER LIST
A bona fide candidate has a right to inspect (but not photograph or copy in any manner)
the list of members eligible to vote for that office once within 30 days prior to the
commencement of voting, between November 16, 2015 and December 4, 2015.
Requests to review the list must be made by Appointment Only. [LMRDA Sec.401(c)]

SECTION 15: CAMPAIGN LITERATURE / ROBOCALLS
A candidate has the right to mail campaign literature to members eligible to vote for that
office entirely at the candidate's expense. [521CBL VIII.8] To exercise this right, a
candidate must use a mailing house approved by the Election Committee.
Upon
payment by the candidate in advance, the mailing house will order lists from the Local
Union office.
a. The cost of a list and Robocalls will be a $50 setup fee and $.02 per name
for each type of request. All such campaign materials must state that they
are solely paid for by the candidate. For Robocalls we will work with the
candidate to get the message uploaded. A disclaimer will be required to
indicate which candidate has paid for the call. (Refer to Section 13 – Union
Resources in this document for further explanation on union resources.)

SECTION 16: CAMPAIGNING – CANDIDATES
Local 521 will not discriminate in favor of or against any candidate in any Local or
Chapter election. Union staff will not be involved in campaigning in any chapter
elections. [521CBL VIII.8]. For example, if a candidate is invited to speak at a union
meeting, all candidates for the same position should be invited to speak at the same
meeting.
a. Candidates must campaign on their own time, which may include paid
vacation time.
b. Candidates must limit their campaigning to the non-work time of the
members; for example, breaks or lunches, before or after work.
c. Candidates cannot use any SEIU/Local 521/Community First logos or Local
521 letterhead for their campaign materials.
SECTION 17: CAMPAINING – UNION STAFF
While performing their duties, all Local Union staff must remain uninvolved and neutral
in relation to candidate endorsements and campaign activities.
a. To balance the rights of Union staff who are Local Union members, to run for
office and participate in local wide elections with the potentially unfair
advantage they may have by virtue of their temporary or permanent role as
staff in the union, there must be strict adherence to the DOL Rules.
b. The appearance of violations must be strictly avoided. Therefore, the Local
Union has established strict rules and policies to monitor and to implement
the Department of Labor laws as they pertain to staff participation in Local
wide elections.
c. Staff must be on pre-approved time off for campaigning.
They will be
required to sign a document stating that they understand the rules and will
abide by the rules. Violation of the campaign election rules could leave to
possible discipline up to and including termination.
d. Any activities they perform on behalf of themselves or another candidate
must be clearly understood as their own position, not that of the Local Union.
e. During the election cycle, the Election Committee and Trustees will be
available to answer questions, complaints and concerns about any such
possible infractions and will take immediate action where necessary.

SECTION 18: BALLOT PROCEDURES FOR ON-SITE AND MAIL BALLOT
a. On-Site Voting Method
Balloting for Local Union Offices will be held at Local Union offices and/or worksite
polling stations, in such a manner that facilitates the widest practicable participation
by members. [521CBL VIII.7]
 Voter Identification: Members will be verified to confirm their membership
eligibility and ballot type prior to receiving an actual ballot. [SEIUEG: pg. 24]
 Multiple voting sites: With the implementation of Local 521 database (Ulink),
a member may vote outside their assigned region however there will be a
limited amount of ballot types available. All records are updated immediately
at each voting location. There may be cases whereby member voting out of
their assigned region will be provided with a challenged ballot to be
reconciled and verified as valid or invalid at the vote count on January 14,
2016 by the Election Committee. It is based on the circumstances of the
membership verification. The Election Committee will review the membership
reports to determine if the ballot is valid or invalid and that no one was able
to vote more than once. [SEIUEG: pg. 25]
a. Polling Stations
Scheduled voting times will be strictly adhered to, except that anyone waiting in line
at the polling place at the end of the voting period will be allowed to vote. No
campaigning is allowed within 25 feet of a polling station in operation. [SEIUEG
p.27]
 Where elections are being held at a library or courthouse, no
campaigning is allowed in the building whatsoever. All campaigning must
be done outside of the facility.
b. Election Observers
A candidate may designate one or more persons to observe of all phases of the
election process. A designee need not be a Union member or may be the
candidate her/himself. [LMRDA Sec. 401 (e)]
c. Double Voting
In the event that more than one vote has been cast by a voter, none of the ballots of
that voter shall be counted.

d. Mail-In Ballots
Members who work greater than 60 minutes away, or retired members living more
than 60 minutes from their nearest voting location, will be mailed ballots with a
return mail envelope. Mailed-in ballots must be received by 5:00pm on January
13, 2016 to be included in the vote count. Mail ballots will be sent to:

e. Mail Ballot & Duplicate Ballot requests: AAA has provided a toll-free phone number
for ballot resolution which is available Monday through Friday, from 9 a.m. to 5 p.m.
(PST). If a member requires a duplicate ballot they should contact AAA at 800-2730726 for further assistance.

SECTION 19: BALLOT PROCEDURES FOR CERTIFICATION
a) Certification of Election
The candidate for each office receiving the most votes shall be certified by the Election
Committee as the winner. [521CBL VIII.9]
b) Runoff Election
If it is necessary to have a runoff election, it is not required for the local to have a new
notice of the runoff election mailed to each member, provided its original notice stated
the required information (date, time and place) regarding a possible runoff election, and
some form of notice of the runoff election (such as posting at worksites) is given.

Otherwise, a notice of runoff election must be mailed to each member at least 15 days
prior to the runoff election.
i.
A runoff election will be required for the seats of Chief Elected Officer, President,
1st VP, Treasurer, Secretary and Regional VP.
ii.
A tie vote shall be decided by a flip of a coin for Executive Board delegates,
alternates and trustees. [SEIUEG pg.27]
iii.
Election results will be posted to the membership on the Local 521 website and
via email blast on the next business day and published in the current
newsletters.
SECTION 20: BALLOT COUNT
All ballots will be delivered to the Local 521 office at 2302 Zanker Road, San Jose CA
95131 in time for the vote count to be held on January 14, 2016 at 5:00pm. The ballots will
be opened and counted by the Election Administrator in consultation with Election
Committee. Candidates, members, Local 521 staff and approved Election Administrator
are permitted in the vote count room.
a. Candidates may also send an observer to witness the count on their behalf.
SECTION 21: CHALLENGED BALLOTS
In the event any ballots are challenged by candidates or observers or the Election
Committee at the counting of ballots, said challenged ballots shall be set aside prior to
opening and counting of unchallenged ballots, and the Election Administrator in
consultation with the Election Committee shall determine the validity of the challenges.
Unresolved challenged ballots insufficient in number to affect the election results shall not
be counted.
SECTION 22: ELECTION PROTESTS – POST-ELECTION
Any challenge or protest concerning the conduct of the election must be submitted in
writing within (5) five calendar days of the election results.
a. Election challenges should cite specific facts setting forth of the challenge or protest.
b. Election challenges must be received by the Election Committee c/o SEIU Local
521, 2302 Zanker Road, San Jose CA 95131 no later than 5:00 p.m. on January 19,
2016.

c. Untimely challenges or protests will not be considered. Challenges to the election
will be considered only if they cite specific violations of election rules and
procedures and/or the Local 521 bylaws, and if the alleged violation may have
affected the outcome of the election.
d. The committee will investigate challenges and issue a report no later than January
24, 2016.
e. The officers who are elected will be sworn in and take office at the time provided for
in the local 521 bylaws even when a protest has been filed over the election. The
filing of a protest does not stay the normal process for certifying the election results
and for swearing in new officers. If the protest is ultimately sustained, the final
decision will dictate whether a new election should be held or whether different
individuals should assume office. If a new election is ordered, the officers who won
the contested election will continue in office until the rerun election has been
completed, at which time the winners in the re-run election, if different, should be
sworn in and assume office.
SECTION 23: TRUSTEES - ELECTION OVERSIGHT FOR ELECTIONS AND APPEALS
The Trustees of the Local Union shall act as judge in all matters arising from the election
procedures of the Local Union and shall hear all protests of an election.
a. Members not satisfied with a ruling of the Trustees on an election matter may
appeal such ruling to the SEIU International President within fifteen (15) calendar
days of the ruling. [521CBL VIII.10]
SECTION 24: ADDITIONAL RULES AND PROVISIONS
The Election Committee and the Election Administrator may establish other procedural
provisions as may be necessary for the proper conduct of this election. Candidates and
their supporters are urged to adhere to these rules and procedures, as proven violations
may cause election results to be set aside.
