Gerald Schneider, Ph.D., facilitates the discussion of healthy lifestyles and how we measure up based on two articles: Understanding Risk: What Do Those Headlines Really Mean?” and Healthy Aging: Lessons from the Baltimore Longitudinal Study of Aging.” One goal of the National Institutes on Aging research is to help us understand medical problems that are common in older people. The NIA supports the Baltimore Longitudinal Study of Aging. BLSA scientists are learning what happens as people age and how to sort out changes due to aging from those due to disease or other causes. Emerging from the accumulating BLSA data are two major conclusions: one is “normal” aging can be differentiated from disease. The second is no single, chronological timetable of human aging exists. The “normal” aging research also takes a look at sex and race differences in aging. Share your thoughts after reading these articles. Eyelid surgery, or blepharoplasty (BLEF-uh-ro-plas-te), usually done on an outpatient basis, repairs droopy eyelids by removing excess skin, muscle and fat. Conflict should not have to mean the end, with respect to a conversation, a relationship, or getting our needs met. How we view conflict and what we choose to do about it, can make a difference. Mergner and St. Clair will have us consider possible win-win situations to conflict. Provided the Trust is a “revocable” trust (which is usually the case), the Trust can be revoked and/or revised at any time while you are still living. You must also still have legal capacity to revise or revoke the Trust. You can, however, give to your Attorney-in-Fact your durable financial Power of Attorney, the authority to revise or revoke your Trust if you lose capacity to do so yourself. This authority must be given carefully and thoughtfully, so be sure to consult your good estate planning and elder law attorney on this point. If parents are divorced, are all of their gifting to their child totally independent exemptions? If a former husband and wife are divorced and not remarried to a different spouse, then each person is a single person for purposes of annual exclusion gifts, which during 2009 are capped at $13,000 per year per donor per donee. This means that any one person can give $13,000 each to as many other people as the generous person wants to benefit, without being required to file a gift tax return. Annual exclusion gifts are simply irrelevant to the Internal Revenue Service for any tax purpose. By definition, a single person cannot file a gift tax return jointly with a spouse for the spouse to join in making the gifts, so if a single person gives more than $13,000 per person, then a gift tax return must be filed. When the first spouse of a married couple dies, if the couple owned their house jointly (as tenants by the entirety or as joint tenants with right of survivorship), then the surviving spouse automatically owns the entire house immediately upon the death of the first spouse. The “basis” in a capital asset is the value at which one acquired the asset. Often this is the price paid for the asset. For example, if a house is bought for $300,000 then that is the “basis” for purposes of calculating capital gain when the house is sold. The “step up in basis” is the new basis in an asset, when one acquires an asset because of the death of the previous owner of the asset. So, when the first spouse dies, the surviving spouse “acquires” the half-interest of the deceased spouse in their formerly jointly titled house.
