325 Kenya Gazette Sup plement No. 65 19th July 1966 (Legislative Supplement No. 39) LEGAL NoncE No. 204 THE PUBLIC ARCHIVES ACT 1965 (No. 32 of 1965) IN EXERCISE of the powers conferred by sections 14 (l) and 15 of the Public Archives Act 1965, the Vice-President hereby makes the following Regulations:THE PUBLIC ARCHiVES (ADVISORY COUNCIL) REGULATIONS 1966 I. These Regulations may be cited as the Public Archives (Advisory Council) Regulations 1966. Citation. 2. There is hereby established a Council to be known as the Public Archives Advisory Council (hereinafter referred to as "the Council"). Establishment of Council. 3. The Council shall consist of the following members(a) the Chief Archivist; and (b) eight o,ther members appointed by the Minister, of whom one shall be a member of the staff of the History Department of the University College, Nairobi, appointed to represent research interest, and the other seven shall be appointed to represent the interests of owners of records. 4.- (1) Each appointed member of the Council shall hold office for a term of three years, unless his appointment is earlier revoked by' the Minister, and at the end of that term shall be eligible for reappointment. Membership of Council. Tenure of office of members_ (2) Where the Minister terminates an appointment, or an appointed member dies, the member appointed by the Minister in his place shall hold office for the unexpired residue of the period of office of the member replaced. 5. (1) The chairman and .the vice-chairman shall each be elected by the members of the Council from among their number, and shall hold office at the pleasure of the Council. Chairman and vice-chairman. (2) The chairman shall preside over all meetings of the Council, and in the event ,of his being incapacitated by illness, absence or other cause ,the vice-chairman shall preside. 6. (1) The decision of ,the majority of .the members present and voting at a meeting of the Council shall be deemed to be the decision of the Council. ' (2) The quorum ,of .the Council shall be ,the chairman (or vicechairman as the case may be) and four other members. Decisions of Council, and quorum. 326 Temporary incapacity of member. Meetings. If any member ·of the Council is .temporarily incapacitated by illness, absence abroad or other cause from performing the duties of his otiice, the Minister may appoint another person to act in his place, and such person shall be deemed .to be a member of the Council until the member is again able to perform those duties or ceases to hold office as a member. 8. (1) The Council shall hold ordinary meetings not less than three times in each year, and may hold additional ordinary meetings whenever the chairman ,thinks fit, and such meetings shall be convcned by the chairman, or where the chairman is not available the vice-chairman. (2) The chairman, or where the chairman is not available, the vice-chairman, may at any time convene a special meeting of the Council. and shall in any case do so within a month of his receiving a written request signed by at least ,two other members. (3) Where a meeting is convened, notice specifying the place. day and hour of the meeting shall be given to each member by being delivered at, or sent by post to, his usual place of business or residence or postal address, aJt least fourteen days before the date of the meeting. Procedure. Secretary. 9. Subject as herein provided the Council shall have power to regulate its own procedure. 10. The Chief Archivist shall be the secretary of the Council.
