Thispanelwilldiscusstheconceptofproceduraljusticegenerallyandthendialogwhetherthe
useofguidelinesassistorhindertheactualdeliveryofproceduraljustice.Inparticular,this
panelwilldialoguethequestionofwhethertheexistenceofguidelinescreateuniformity,
consistency,andbasicexpectationsforsentencing;orwhetherguidelinesareformulaic,rigid,
andencouragelessindividualizedsentencing?Variousjurisdictions’guidelinesandtheir
practicalimpactincourtproceedingswillbediscussedfromdifferentperspectiveswithinthe
criminaljusticesystem

Commissionsfrom2012to2014.AsGeneralCounseltotheGovernor,sheisthelegaladvisortotheGovernor,his
staff,andhisCabinet.InadditionaltoherroleasGeneralCounsel,sheisalsotheLegislativeDirectorforGovernor
Herbert.InthisrolesheoverseesthelegislativecoordinationoftheGovernor’sOfficeandhisCabinetaswellas
theGovernor’sbillreviewandsigningprocess.SheisamemberoftheUtahSupremeCourt’sAdvisoryCommittee
ontheRulesofEvidenceandtheUtahOfficeofGuardianAdLitem’sAdvisoryCommittee.Priortoworkingwith
theUtahSentencingCommissionshewasanAssistantDistrictAttorneywiththeSaltLakeCountyDistrict
Attorney’sOffice.JaceyreceivedherBachelor’sdegreefromUtahStateUniversityandherJurisDoctordegree
fromtheJ.ReubenClarkLawSchoolatBrighamYoungUniversity.InhersparetimeJaceyenjoysphotography,
gardening,andbuildingfurniture.
PaulCassell,RonaldN.BoycePresidentialProfessorofCriminalLawandDistinguishedUniversityProfessorof
LawattheS.J.QuinneyCollegeofLawattheUniversityofUtah.ProfessorCassellreceivedaB.A.fromStanford
Universityin1981.HethengraduatedOrderoftheCoiffromStanfordLawSchoolin1984,servingasPresidentof
theStanfordLawReview.In1984-85,heclerkedforthen-JudgeAntoninScaliawhenScaliawasontheU.S.Court
ofAppealsfortheD.C.CircuitandthefollowingyearforChiefJusticeWarrenE.BurgerontheU.S.SupremeCourt.
From1986to1988,ProfessorCassellservedasanAssociateDeputyAttorneyGeneralintheU.S.Departmentof
Justice.From1988to1991,heservedasanAssistantU.S.AttorneyintheEasternDistrictofVirginia,prosecuting
manyfelonycriminalcases.In1992,ProfessorCassellbeganteachingattheS.J.QuinneyCollegeofLaw,
publishingwidelyinleadingacademicjournalsoncrimejusticeissues.Hehasfiledbriefsandorallyarguedon
behalfofcrimevictimsandcriminaljusticereformandalliedorganizationsintheUnitedStatesSupremeCourtand
otherfederalandstatecourtsaroundthecountry.In2002,ProfessorCassellwasconfirmedbytheU.S.Senateto
serveasaU.S.DistrictCourtJudgefortheDistrictofUtah.WhileontheDistrictCourt,ProfessorCassellwrote
manyopinionsthatattractedsignificantattention,includingthefirstopinioninthecountryfindingthefederal
sentencingguidelinesunconstitutionalfortheirfailuretoprotectjurytrialrights.In2007,Cassellresignedhis
judgeshiptoreturntolawteaching.ProfessorCassellcurrentlyteachescriminalprocedure,criminallaw,andother
coursesattheCollegeofLawattheUniversityofUtah.Hehaspublishednumerousarticlesonsentencing,
includingarticlesintheStanfordLawReviewandtheFederalSentencingReporter.
JudgeMichaelD.DiReda,SecondDistrictCourtJudge,appointedbyGov.JonM.Huntsman,Jr.,inDecember2008.
HeservesDavis,Morgan,andWebercounties.JudgeDiRedareceivedaBachelor'sofArtsdegreeinPsychology
fromPepperdineUniversityin1990andaJurisDoctordegreefromPepperdineUniversityin1993.Heworkedasa
judiciallawclerkintheSecondDistrictCourtfrom1994through1995beforejoiningtheDavisCountyAttorney's

OfficeasaDeputyCountyAttorneywhereheworkedasaprosecutor,servingastheleadattorneyoverdomestic
violence,juvenileandadultdrugcourts,assectionchiefovertheNarcoticsDivisionandasthelitigationsection

Prosecutor.HealsoworksasanAdjunctProfessorofLawattheS.J.QuinneySchoolofLawattheUniversityof
UtahintheTrialAdvocacyDepartment.HeisamemberoftheNationalAssociationofDrugCourtProfessionals,a
memberandpastchairmanoftheDisproportionateMinorityContactSubcommitteeoftheUtahBoardofJuvenile
Justice,andapastExecutiveBoardmemberoftheUtahBoardofJuvenileJustice.JudgeDiRedacurrentlyserveson

RichardS.Frase,BenjaminN.BergerProfessorofCriminalLawattheUniversityofMinnesotaLawSchool.
Heteachescriminallaw,criminalprocedure,andthefederaldefenseclinic.Hehasalsotaughtthe
MisdemeanorandtheFederalProsecutionclinics.Hisseminarsincludecomparativecriminalprocedure,
sentencingguidelines,andsentencingpolicy.HewastheJuliusE.DavisProfessorofLawfor1988-89andbecame
theBenjaminN.BergerProfessorofCriminalLawin1991.HisscholarshipexaminesMinnesotaandotherstate
sentencingguidelines,punishmentandproportionalitytheories,criminalprocedureintheU.S.andabroad,and
comparisonofsentencinglawandpracticeintheUnitedStatesandinothernations.Heistheauthororco-author

HethenacceptedapositionasatrialattorneywiththeSaltLakeLegalDefenderAssociation.WhileattheLegal
DefenderOffice,hewasthemisdemeanorchieffortwoyears,whichconsistedofsupervisingthemisdemeanor
lawyers,coordinatingnewlawyertraining,andconductingyearlyattorneyevaluations.Hewasalsoafelonytrial
attorneyandhandledanumberofseriouscasesincludingminimummandatorysexcases,violentfelonies,and
homicides.In1997,helefttheLegalDefenderOfficetoopenaprivatelawpractice.Hehandlescriminaldefense
casesinbothstateandfederalcourt.Heisqualifiedtorepresentpersonschargedwithcapitalmurderpursuantto
UtahRuleofCriminalProcedure8,andhasbeenappointedtoseveralcapitalcasesinstateandfederalcourt.He
taughttrialadvocacyattheUniversityofUtahCollegeofLawfortenyears,andservedasafoundingmemberon
theIndigentDefenseFundBoard,whichoverseestheappointment,payment,andcoordinationofcapital
defendersappointedbythestatecourts.Mostrecently,heservedontheUtahSupremeCourtTaskForceon
IndigentDefenseServiceswhichwaschargedwithevaluatingandmakingrecommendationsforimprovementsto
Utah’sindigentdefensesystem.HealsoservesastheUtahStateBarrepresentativeontheUtahSentencing
Commission.
