Taipoilo, aged 3:5, attempted to kill

their home in the Italian colony in
the south end of the city. He made,
his escape only to return to end his
own life by shotting Wmself in the

serious condition suffering from bullet and stabbing wounds.
After being informed last night by
the father of the girl that he could
not marry his daughter, Del Tapolo
returned to the house early this
morning and asked to see her. When
informed by 'Mrs. Destafauio that she
was still in bed and could net be
seen he went away but returned a
few minutes later and demanded that
he be permitted to see Tonyea. Words
passed between t h e mother and Del
Tapolo when t h e girl appeared at the
front door and attempted to act as
peacemaker. After talking to her. a
short time the man suddenly pulled
a thirty-two caliber revolver from hiapocket and fired twice at the girl, one

the body. She staggered and then
tumbled over the railing of .the stoop
into the basement.

assistance and was attacked by Del
Tapolo, who used a game knife, with

New York, J u n e 24.—Katherine
Clemmons Gould was called back to
the stand today for a final ordeal to
explain away, if possible, the damaging testimony given by the witnesses
for her husband in her suit for separation and alimony of $250,000 a
year.
It was a day of denials, beginning
with the reading of the deposition of
Dustin Farnum, the actor, who denied in toto all allegations of improper conduct with Mrs. Gould and
ending with Mrs. Gould's repeated
denials of practically everything in
word, or action attributed to her by
the witnesses for the other side.
For two warm hours Mrs. Gould]
answered the questions of her counsel, repudiating with a monotonous
flat denial all testimony and insinuations charging her with excessive
drinking, profanity or other impropriety. She never drank to excess,
never used profane language, never
forgot her dignity as mistress of Castle Gould and never overstepped the
bounds of propriety, she declared in
substance,

of dishes and food thrown from her

discharged an employe in anger, never became intoxicated aboard the
yacht Niagara and never consumed
two quarts of cocktails in two days.

of her time today. Whatever intimacy there had been between her and/
the.actor she said was accounted for
by her desire to have his advice regarding her plans to return to t h e

Mrs. Gould said t h a t Mr. F a r n u m
had never been in her parlor at t h e
St. Regis except on the August afternoon in 1904 when they lunched together with several others, and o n
the occasion of t h e automobile accident on Long Island, when they returned there to arrange for bail for
the chauffeur. She had never ad>dressed Mr. Farnum by any endearing names, she said, and had never
permuted any improper familiarity
on his part.

Justice Dowling said late this afternoon that he wanted to look later
at Mrs. Gould's now famous dinner

next fall there will be no child criminals in this state, in the eye of the
law. That is to say, no child who

law which goes into effect on Sept.
1st. Under this law no child in this'
state under the age of 10 can be a

juvenile reformatories and charitable
