WHEREAStheancestorsoftheChampagneandAishihikFirstNationshave,sincetime
immemorial,exercisedexclusivejurisdictionoverChampagneandAishihikFirstNations
Citizenship;
ANDWHEREAS,followingourtraditionofself-government,andthroughtheelected
FirstNationsCouncil,ChampagneandAishihikFirstNationscontinuestoexercise
exclusivejurisdictionoverChampagneandAshihikFirstNationsCitizenship;
ANDWHEREAS,ChampagneandAishihikFirstNationshasenteredintotheChampagne
andAishihikFirstNationsFinalAgreement(the“FinalAgreement”)withCanadaandthe
YukonGovernment,whichsetsouttreatyrightsforChampagneandAishihikdän
(person,orpersons)whoareenrolledundertheFinalAgreement;
ANDWHEREAS,allChampagneandAishihikdänwhoareenrolledundertheFinal
AgreementareeligibletobecomeCitizensofChampagneandAishihikFirstNations;
ANDWHEREAS,ChampagneandAishihikFirstNations,throughtheelectedFirstNations
Council,hasexclusivejurisdictionoverenrollmentundertheFinalAgreement;
ANDWHEREAS,theChampagneandAishihikFirstNationsCouncilrecognizesthatithas
aresponsibilitytoensurethatChampagneandAishihikFirstNationsresourcesare
protectedforfuturegenerationsofChampagneandAishihikFirstNationsdän;
ANDWHEREAS,theChampagneandAishihikFirstNationsCouncilwishestoensurethat
therulesaboutwhocanenrollundertheChampagneandAishihikFirstNationsFinal
AgreementandbecomeaChampagneandAishihikCitizenaresetoutclearlyandthat
decisionsonapplicationsforenrollmentundertheChampagneandAishihikFirst
NationsFinalAgreementaremadefairlyandconsistently;
NOWTHEREFORE,theChampagneandAishihikFirstNationsCouncil,byvirtueofthe
authorityvestedinthemundertheinherentrighttoself-governmentandthe
ChampagneandAishihikFirstNationsSelf-GovernmentAgreement,andasamatterof
cultureandtradition,enactsasfollows:

apersonwhomakesanapplicationforenrollmentortakes
anotherproceedingunderthisActontheirownbehalf;or

ChampagneandAishihikFirstNations(2012),andanyamendmentstoit;

“EnrollmentList”meansthelistofpersonswhoareenrolledandeligible
tobenefitundertheFinalAgreement,andwhichismaintainedand
administeredbyChampagneandAishihikFirstNations.TheEnrollment

CommissionMasterList”.TheEnrollmentListwillbeprintedonaset
datepriortotheEffectiveDateandusedtocreatethe“ShadhälaÄshèyi
Dän”;
“EnrollmentOfficer”meanstheEnrollmentOfficeroftheChampagne
andAishihikFirstNationsestablishedbytheChampagneandAishihik
FirstNationsCouncilunderthisActandtheRegulations;
“FinalAgreement”meanstheChampagneandAishihikFirstNationsFinal
AgreementbetweenthegovernmentofCanada,theChampagneand
AishihikFirstNationsandtheGovernmentofYukondatedthe29thDay
ofMay,1993,andincludesamendmentstoitmadeinaccordancewith
theprovisionsofthatagreement,exceptwherethewords“Final
Agreement”aredirectlyprecededbythewords“anotherYukonFirst
Nation”or“otherYukonFirstNation”orwherethecontextmakesitclear
thattheFinalAgreementbeingreferredtoisaFinalAgreementother
thantheChampagneandAishihikFirstNationsFinalAgreement;
“FirstNation”meanstheChampagneandAishihikFirstNations,unless
thecontextrequiresotherwise;
“FirstNationsCouncil”hasthesamemeaninginthisActasinthe
Constitution;
“Government”hasthesamemeaninginthisActasintheConstitution;
“linealdescendant”isabloodrelativeinthedirectlineofdescent-the
children,grandchildren,great-grandchildren,etc.ofapersonandon
forever;linealdescendantisdistinguishedfroma"collateral"descendant
whichwouldbefromthelineofabrother,sister,auntoruncle,andfor
greatercertainty,anAdoptedChildisnotalinealdescendantforthe
purposesofthisAct;
“Minor”meansapersonwhohasnotyetreachedtheageofmajorityas
determinedfromtimetotimebytheLawsoftheYukon;
“OfficialEnrollmentCommissionMasterList”meanstheapproved
beneficiariesofChampagneandAishihikFirstNationsforaYukonIndian
LandClaims,datedMay28,1991,referredtoasthe“OfficialEnrollment
List”intheFinalAgreementandlistingpersonsapprovedasbeneficiaries
oftheChampagneandAishihikFirstNations’foraYukonIndianLand

ClaimpursuanttoChapter3–EligibilityandEnrollment,section3.2.2.2,
subsections3.2.2.1,3.2.2.2,3.2.2.3and3.2.2.4oftheComprehensive
LandClaimsUmbrellaFinalAgreement,March30,1990,andwhich
formedthebasisoftheChampagneandAishihikFirstNations’Master
EnrollmentList;
"OrdinarilyResident"meansaPersonwholivedorhaslivedthemajority
ofhislifeintheYukon.Inmakingsuchdetermination,temporary
absencesfromtheYukonforreasonssuchastravel,education,medical
treatment,militaryservice,orincarceration,shallbeconsideredperiods
ofresidenceprovidedthePersonwasOrdinarilyResidentpriortosuch
temporaryabsences;
"OverlappingArea"isthatpartofaYukonFirstNation'sTraditional
TerritorywhichoverlapstheChampagneandAishihikFirstNations
TraditionalTerritory;
“person”or“persons”meansanaturalpersonorpersons;
“re-enrollment”meansenteredbynameintheEnrollmentListafter
beingdeletedbynamefromtheEnrollmentList;
“Registrar”meanstheofficeroftheFirstNationgovernmentwhois
responsibleformaintainingtheEnrollmentList;
“ShadhälaÄshèyiDän”or“ChampagneandAishihikFirstNation
Ancestors”istheofficiallistofAncestorsofChampagneandAishihikFirst
NationasdescribedinSections22to24;
“Self-GovernmentAgreement”meanstheChampagneandAishihikFirst
NationsSelf-GovernmentAgreementamongtheChampagneandAishihik
FirstNationsandtheGovernmentofCanadaandtheGovernmentofthe
Yukondatedthe29thdayofMay,1993,andanyamendmentstoit;
“Status”meansregistrationontheIndianRegisterundertheIndianAct
(R.S.C.,1985,c.I-5)andanyamendmentstoit;
“TraditionalTerritory”meansthegeographicareawithintheYukon
identifiedasChampagneandAishihikFirstNationsTraditionalTerritory

Chapter3oftheFinalAgreement,and:
(a)
isalinealdescendantofapersonontheShadhälaÄshèyiDän;or
(b) isofChampagneandAishihikFirstNationsancestry.
(2)
Apersonwhomeetstheeligibilitycriteriaundersubsection(1)(a)shall
applyundersubsection(1)(a);onlyapersonwhoisnoteligibletoenroll
undersubsection(1)(a)mayapplyundersubsection(1)(b).
WhoisapersonofChampagneandAishihikFirstNationsancestry?
6.ApersonisofChampagneandAishihikFirstNationsancestryforthepurposeof
Section5(1)(b),ifthatpersonisalinealdescendantofaChampagneandAishihikdän.

ApersonisaChampagneandAishihikdänifthatpersonwasOrdinarily
ResidentinChampagneandAishihikFirstNationsTraditionalTerritorybetween

IsanAdoptedChildeligibletoenroll?

Consistentwithsubsection3.2.2.3oftheFinalAgreement,anAdopted
ChildofapersonwhoiseligibletoenrollunderPartIIiseligibletoenroll.
(2) Forgreatercertainty,forthepurposesofthisAct,apersonadopted
“pursuanttoaboriginalcustoms”isonlyeligibletoenrollifthereisaChampagne
andAishihikFirstNationslawgoverningcustomadoptionandthatpersonmeets
thecriteriaforcustomadoptionsetoutinthatlaw.

HowdoIapplytoenroll?
9.
Apersonmayapplytoenrollbysubmittingtherequiredformsandsupporting
documentstotheEnrollmentOfficer.
Whowillreviewmyapplication(preliminaryreview)?
10. (1)
TheEnrollmentOfficershall,within30daysofreceivinganapplication,
conductapreliminaryreviewtoensurethattheapplication:
(a)
isintherequiredform;
(b)
iscomplete;and
(c)
includesallrequiredsupportingdocuments.
(2)
TheEnrollmentOfficershallreturnanapplicationtotheapplicantwithin
30daysofthepreliminaryreviewiftheapplicationis:
(a)
incomplete;
(b)
inthewrongform;or

missingsupportingdocuments.
(3)
WheretheEnrollmentOfficerreturnsanapplicationtoanapplicant
undersubsection(2),theEnrollmentOfficershallprovidetheapplicantwith

(a)
deficienciesintheapplication;and
(b)
instructionstotheapplicantonhowtofixthedeficienciesinthe
application.
(4)
Ifanapplicationisreturnedtoanapplicantundersubsection(2),the
applicantmayrepairthedeficienciesintheirapplicationandresubmitittothe
EnrollmentOfficerunderSection9.
Whathappensafterthepreliminaryreviewofmyapplication(substantivereview)?
11. (1)
IftheEnrollmentOfficerdecidesthatanapplicationmeetsthecriteria
underSection10(preliminaryreview),theEnrollmentOfficershall,within60
daysofreceivingtheapplication,conductasubstantivereviewoftheapplication
todeterminewhetherornottheapplicantmeetstheenrollmentcriteriainPart
II.
(2)
Basedonthesubstantivereviewundersubsection(1),theEnrollment
Officershall,within30daysofcompletingthesubstantivereview,andnotmore
than75daysfromthereceiptoftheapplicationunderSection9,recommendto
theFirstNationsCouncilthattheapplicationbe:
(a) approved;
(b) rejected;or
(c) conditionallyapproved.
(3)
TheEnrollmentOfficershallrecommendtotheFirstNationsCouncilthat
theapplicationbeapprovedif:
(a)
theapplicantmeetstheeligibilitycriteriainPartII;and
(b)
theapplicationmeetstherequirementsofthisActandthe
regulations.
(4)
TheEnrollmentOfficershallrecommendtotheFirstNationsCouncilthat
theapplicationberejectedif:
Äghàałān(“myrelatives”)/the“EnrollmentAct

(a)
theapplicantdoesnotmeettheeligibilitycriteriainPartII;or
(b)
theapplicationdoesnotmeettherequirementsofthisActand
theregulations.
(5)
TheEnrollmentOfficershallrecommendtotheFirstNationsCouncilthat
theapplicationbeconditionallyapprovedif:
(a) theapplicantmeetstheeligibilitycriteriainPartII;and
(b) theapplicationmeetstherequirementsofthisActandthe
regulations;but
(c) theapplicantis:
(i)
enrolledunderanothersettlementagreementinCanada;
(ii)
acitizenofanotherself-governingFirstNationinCanada;
or
(iii)
hasStatuswithanotherIndianBandorFirstNationin
Canada.
FinalApprovalofApplicationsforEnrollment
12. (1)
ArecommendationoftheEnrollmentOfficeronanapplicationissubject
tofinalapprovalbytheFirstNationsCouncil.
(2)
WhentheFirstNationsCouncilreceivesarecommendationonan
applicationforenrollmentfromtheEnrollmentOfficerunderSection11,the
FirstNationsCouncilmust,within60days:
(a)
approvetherecommendation;or
(b)
rejecttherecommendation.
(3)
IftheFirstNationsCouncilrejectstherecommendationoftheEnrollment
Officeronanapplicationundersubsection(2)(b),theFirstNationsCouncilshall
providewrittenreasonsforrejectiontotheEnrollmentOfficerwithin5daysof
therejection.
(4)
TheFirstNationsCouncilhastheexclusivejurisdictioninthefinal
determinationofeligibilityforenrollment.

WhenwillIknowifIhavebeenacceptedforenrollment?
13. TheEnrollmentOfficershallgiveeachapplicantawrittennoticeandreasonsfor
thedecisionoftheFirstNationsCouncilontheirapplication,within30daysof
thedecisionundersubsection12(2).
14. Ifanapplicantisacceptedforenrollment,theapplicant’snameshallbeaddedto
theEnrollmentListandtheCitizenshipListassoonasreasonablypracticable,
consistentwiththeRegulations.
15. IftheFirstNationsCouncilrejectedtherecommendationoftheEnrollment
Officeronanapplicationundersubsection12(2)(b),theEnrollmentOfficerwill
providethewrittenreasonsoftheFirstNationsCouncilunderSection12(3)to
theapplicant.
WhatifIamconditionallyacceptedforenrollment?
16. (1)
Aconditionalacceptanceforenrollmentundersubsection11(2)(c)will
providethefollowinginformationtotheapplicant:
(a)
theconditionsoftheiracceptance;
(b)
theactionsthatmustbetakenbytheconditionallyaccepted
applicanttosatisfytheconditionsoftheiracceptance;
(c)
theformofproofthatmustbeprovidedtotheEnrollmentOfficer
bytheconditionallyacceptedapplicanttosatisfytheconditionsof
theiracceptance;and
(d)
theexpirationdateoftheirconditionalacceptance.
(2) Ifanapplicantfailstosatisfytheconditionsoftheiracceptanceunder
subsection(1)beforetheexpirationdateinsubsection(1)(d),theEnrollment
Officershall:
(a)
revoketheapplicant’sconditionalacceptance;and
(b)
provideawrittennoticeandreasonsfortherevocationofthe
conditionalacceptancetotheapplicant.

Apersonwhoseconditionalacceptanceisrevokedundersubsection2

EnrollmentListontheEffectiveDate,includingpersonsontheEnrollmentList
whoaredeceased.
24. NotwithstandingSection23,personswhobecameeligibleforenrollmentunder
section3.2.2.3oftheFinalAgreement(anAdoptedChildofapersonlivingor
deceasedeligibleunder3.2.2.1or3.2.2.2oftheFinalAgreement)shallnotbe
addedtotheShadhälaÄshèyiDänunlesssuchpersonwouldhavemetthe
eligibilitycriteriainSections3.2.2.1(25percentormoreIndianancestryandwas
OrdinarilyResidentintheYukonbetweenJanuary1,1800andJanuary1,1940)
or3.2.2.2(aDescendantofaPersonlivingordeceasedeligibleunder3.2.2.1)of

TheEnrollmentOfficerisresponsibleforthefollowing:

FinalAgreement,andanyrelatedChampagneandAishihikFirst
Nationslaws,policiesandprocedures;
(b)
makingrecommendationstotheFirstNationsCouncilonwhether
anapplicantiseligibletobeenrolled;
(c)
keepingconfidentialallinformationprovidedbyandabout
Äghàałān(“myrelatives”)/the“EnrollmentAct

applicantsforenrollmentorre-enrollment,inaccordancewith
theregulationsunderthisActandanyrelatedlaws,policiesand
procedures;

and
whererequired,directingtheRegistrartoenternameson,or
removenamesfrom,theEnrollmentListandtheCitizenshipList.

Officer,foranythingdone,ornotdone,ingoodfaith,intheperformanceor
intendedperformanceofadutyunderthisAct. Amendment
38. ThisActmaybeamendedinaccordancewiththeConstitutionoftheChampagne
andAishihikFirstNations(2012)andanyamendmentstoit.

FINALPROVISIONS
ConflictsandInconsistencies
39. IfthereisaconflictbetweenthisActandanyotherActenactedbeforeorafter
thisActcomesintoforce,thisActprevails,unlesstheotherenactmentcontains
anexpressprovisionthatit,orarelevantprovisionofit,appliesnotwithstanding
thisAct.
40. WhereatermisdefineddifferentlyinthisActandintheFinalAgreement,the
definitionoftheterminthisActshallprevailinrelationtotheinterpretationof
