MINUTES ARCHER LODGE TOWN COUNCIL April 13, 2015 7:00 PM Town Hall 14094 Buffalo Road Clayton, NC 27527 PRESENT: Mike Gordon, Mayor; Matt Mulhollem, Councilman; Mark Wilson, Councilman; Mark Jackson, Councilman; Clyde Castleberry, Councilman and Carlton Vinson, Mayor Pro-Tem ALSO PRESENT: C. L. Gobble, Administrative Consultant; Town Attorney Chip Hewett, and Jean Overton, Town Clerk 1. WELCOME AND CALL TO ORDER: a. Call to Order: At 7:00 p.m., Mayor Gordon called the meeting to order. b. Invocation: Given by Councilman Mulhollem c. Pledge of Allegiance: Led by Mayor Gordon 2. PUBLIC COMMENT PERIOD (Maximum of 30 Minutes Allowed, 3 Minutes Per Person): Neal Brantley of 4796 Covered Bridge Rd, Clayton, NC, appeared before the Town Council and stated that the U. S. Government was a republic based on the Constitution. He stated that the Constitution included checks and balances designed to protect the liberty and freedoms of individuals and the rights of the minorities. He further stated that a republic was not a democracy, which was governed by strict majority rule. He added that if our government was a democracy, then it could threaten the rights and liberties of those who are in the minority because majority rules. He also stated that a government based on strict democracy could lead to tyranny. Eddie Boyce of 168 Carrie Drive, Wyndfall Subdivision, Clayton, NC appeared before the Town Council with concerns about the use of firearms and explosives in his neighborhood. He stated that the use of tannerite should be banned in all forms especially from subdivisions. He further stated that the noise from the gunfire and explosives violate the Johnston County Noise Ordinance. Upon discussion, Mayor Gordon suggested that more research be performed on the topic of concern. Doug Long of 201 Barrette Lane, Tafton Subdivision, Clayton, NC appeared before the Town Council and reminded the Town Council that he had made an earlier complaint regarding trash piled up at a house located on Covered Bridge Road. He wanted to know if there was any type of Code Enforcement that would address this trash issue. He also stated that there was a resident in his neighborhood that was running a business in his home and wanted to know if the Town could do anything about businesses being run in residential areas. In addition, he stated his concern about the neighbors’ cats hanging out in his yard. He wanted to know if the Town could assist with the cat problem at his home. Mayor Gordon asked Mr. Long to contact Bob Clark regarding the cat problem and the business in the home issue. 3. CONSENT AGENDA: a. Approval of the March 9, 2015 Town Council Meeting Minutes A motion was made by Mayor Pro Tem Vinson to approve the consent agenda as presented. The motion was seconded by Councilman Mulhollem. All were in favor. 4. PUBLIC HEARINGS: There were no public hearings at this time. 5. KIMBERLY DEANS BRANTLEY, PRESIDENT ARCHER LODGE MIDDLE SCHOOL BAND BOOSTERS Kimberly Brantley appeared before the Town Council to request the Town’s assistance regarding an upcoming new activity for the Archer Lodge Middle School. She stated that the Archer Lodge Middle School Band Boosters would be sponsoring Cow Patty Bingo as a fundraiser for their band and asked the Town to help promote and support the event. After discussion, Mayor Gordon stated that the Town would support and promote the event for the band members. 6. MONTHLY ACTIVITY REPORT – PLANNING ADMINISTRATOR, BOB CLARK: At this time, Bob Clark presented a brief summary of events for the month of March. He also provided updates regarding Heritage Subdivision plans and Cooper Farms proposed subdivision. He reminded everyone of a quasi judicial hearing that would be required in the near future on a commercial vehicle case. 7. TOWN ATTORNEY’S REPORT: The Town Attorney stated that he would have a Closed Session item later on the agenda. 8. FINANCIAL REPORT/TOWN CLERK REPORTS: The Town Clerk reminded everyone to review the financial statements for the month ended February 28, 2015 and to address any additional questions to the Clerk. At this time, Mayor Gordon reminded everyone to review the new budget proposed for FY 2015-2016 and to be prepared to finalize the budget at the May, 2015 meeting. 9. MAYOR’S REPORTS AND UPDATES: a. Veterans Committee Update Mayor Gordon stated that the Veterans Groundbreaking Ceremony went very well and provided a great kick-off for the brick fundraiser. Councilman Wilson congratulated the Veterans Committee on a job well done and that the committee sold approximately $3,400.00 worth of bricks. b. Farmers Market Update Mayor Gordon stated that the Farmers Market Committee had their ribbon cutting and kickoff on Saturday, April 11, 2015. He stated that they had several vendors participating in the kick-off and had many other fun activities happening on Saturday. He further added that the event was well attended. c. Town Server Update Mayor Gordon stated that Tracy Pedigo had linked the Town up with the server to provide secure back-up for Town files and that Mr. Pedigo’s work was still ongoing as he was still working to accomplish a few more accessible features for the Town. d. Animal Control Mayor Gordon stated that the Town had already sought assistance from the Town of Clayton for animal control services and that the Town of Clayton would meet on April 20, 2015 to discuss any plans to assist the Town of Archer Lodge. Mayor Gordon stated that it was the Town’s hope that a contract could be entered into with the Town of Clayton for some of the animal control services. He further stated that he hoped to have a response from Clayton within the next thirty days. 10. ACTION ITEMS: There were no action items at this time. 11. DISCUSSION AND POSSIBLE ACTION ITEMS: There were no additional discussions or action items at this time. 12. SPECIAL EVENTS AND ANNOUNCEMENTS: a. 13. Mayor Gordon reminded everyone that Town Hall would be closed on Monday, May 25, 2015 in observance of Memorial Day POSSIBLE CLOSED SESSION: At this time, the Town Attorney announced that a Closed Session would be necessary pursuant to G. S. 143-318.11 (5) regarding a land acquisition matter for purposes of parks and recreation land. A motion was made by Councilman Wilson to recuse Councilman Vinson from the meeting. The motion was seconded by Councilman Mulhollem. All present in favor. A motion was made by Councilman Wilson to enter into Closed Session pursuant to G.S. 143-318.11 (5) regarding a land acquisition matter. The motion was seconded by Councilman Mulhollem. All present in favor. CLOSED SESSION (CLOSED SESSION MINUTES FILED SEPARATELY) 14. ADJOURNMENT: After all discussions ended, a motion was made by Councilman Mulhollem to adjourn the regular meeting. The motion was seconded by Councilman Jackson.
