THIS PROMOTION
1. Promotion Period: The Colorado Springs Utilities (“CSU”) Change the Current Pledge
Giveaway (the "Promotion") begins at 12:00:01 a.m. Mountain Time ("MT") on February
27, 2017 and ends at 11:59:59 p.m. MT on December 31, 2017 (the "Promotion Period").
The final drawing and prize distribution, as discussed below will occur in January 2018
to allow enrollment throughout the Promotion Period. CSU's computer is the official timekeeping device for the Promotion.
2. Promotion Scope: CSU will randomly select one (1) winning Participant (as defined
below) per quarter and each quarterly winning Participant will receive one (1) Prize, as
stated below. Drawings will be held during the first weeks of April, July and October 2017,
and the first week of January 2018 to select the winning Participants. The drawings will
include eligible Participants who have Pledged to Change the Current at
changethecurrent.com (the “Pledge”) between February 27, 2017 and the end of the prior
quarter (March 31, 2017 for the first drawing, June 30, 2017 for the second drawing, Sept.
20, 2017 for the third drawing, and Dec. 31, 2017 for the fourth drawing).
3. Eligibility: This Promotion is open only to legal residents of the United States (excluding
Puerto Rico, Guam and the U.S. Virgin Islands), who are 18 years or older at the time of
entry, are a Colorado Springs Utilities customer, who have taken the Pledge at
changethecurrent.com and have not won a Prize through this Promotion. Employees of
CSU (permanent or temporary), their immediate families (spouse, parents, children and
siblings and their respective spouses) and individuals living in the same households of
such employees are ineligible to participate. Non-winning customers taking the Pledge
will remain eligible for prize drawings through the Promotion Period. Void where
prohibited by law and subject to all federal, state and local laws.
4. How to Enter the Promotion: A “Participant” is entered into the Promotion by Pledging
to Change the Current at changethecurrent.com during the Promotion Period and
remaining enrolled in the program through the Promotion Period. CSU customers with
more than one account may Pledge to Change the Current for each account. All entries
must be completed and received by December 31, 2017 by 11:59:59 p.m. to be eligible to
win. If applicable, normal internet access and usage charges imposed by Participants’
online service provider will apply.
5. Determination of the gift card winners: The winning Participants will be chosen at
random. After selecting the winning entry, CSU will contact the winning Participant using
the email address or mailing address listed on the winning Participant’s Change the
Current pledge form. If unable to contact winning a Participant by email, a certified letter
will be sent to the mailing address provided on the pledge form. Entries are declared
made by the authorized CSU account holder at the time of Pledge submission. A
Participant claiming a potentially winning entry may be required to provide CSU with
proof the Participant is the authorized CSU account holder for the address associated
with the potentially winning entry. The odds of winning the Promotion depend on the
number of Participants who enter.
6. Prizes and Approximate Retail Values ("ARV"): A total of one (1) $500 gift card to
Home Depot or Lowe’s Home Improvement store (“Prize”) will be awarded per quarter
(as defined above), to the one (1) winning Participant per quarter who has validly
pledged to Change the Current during the promotional period. Winning Participants may
choose a gift card from The Home Depot or Lowe’s Home Improvement. The Approximate
Retail Value for the Prize is $500 (U.S. Dollars). Taxes, as applicable, related to all prizes
including income taxes are the responsibility of the individual winners.
7. Claiming of gift card: The winning Participants must claim the Prize in person at CSU’s
Conservation and Environmental Center located at 2855 Mesa Rd., Colorado Springs, CO,
80904, by appointment between the hours of 8 a.m. and 5 p.m. Monday through Friday.
The winning Participant may be required to verify ownership of a winning entry through
presentment of CSU’s notification of winning entry and valid photo identification. The
Prize will be forfeited if a winning Participant is in non-compliance with these Official
Rules, cannot be contacted, provides incorrect email or mailing addresses, is ineligible,
and/or fails to claim the Prize within 10 calendar days after being notified of selection as
the winning Participant. In the event of such forfeiture, CSU will choose a new winning
entry from the pool of validly submitted entries, through an additional random drawing
performed in the same manner as the other drawing. Acceptance of a Prize constitutes
permission for CSU to use the winning Participant’s name and image; and the right to use
any statements made or attributed to such winner (collectively, the “Attributes”) in any
and all media, unless prohibited by law. This includes, but is not limited to, media now
known or hereafter devised, without notice, review or approval, in perpetuity and
throughout the country for advertising and promotional purposes in connection with this
promotion without further compensation, and releases CSU from all claims arising out of
the use of such Attributes.
8. General Rules: By participating in the Promotion, Participants agree to be bound by
these Official Rules and the decisions of CSU. CSU and its agencies are not responsible for
technical, hardware, software or telephone malfunctions of any kind, lost or unavailable
network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed
electronic communications caused by the user or by any of the equipment or
programming associated with or utilized in the Promotion or by any human error which
may occur in the processing of the entries in the Promotion or for any liability for damage
to any computer system resulting from participation in, accessing or downloading
information in connection with the Promotion. CSU reserves the right at its sole
discretion to disqualify any individual who tampers or attempts to tamper with the entry
process or the operation of the Promotion; violates the Official Rules; or acts in an
unsportsmanlike or disruptive manner, or with intent to abuse, threaten or harass any
other person. Any attempt by any person to deliberately undermine the legitimate
operation of the Promotion may be a violation of criminal and civil law, and, should such
an attempt be made, CSU reserves the right to seek damages from any such person to the
fullest extent permitted by law. CSU's failure to enforce any term of these Official Rules
shall not constitute a waiver of provision. The Promotion shall be subject to the laws of
the State of Colorado without reference to conflicts of laws and the Colorado Springs City
Charter. Nothing in these Official Rules shall be interpreted to limit or prevent the
protections afforded to CSU under the Colorado Governmental Immunity Act, C.R.S. § 2410-101, et seq.
9. Data Protection/Privacy Policy: Information collected by CSU in connection with this
Promotion may be used by CSU in accordance with CSU’s standard practices, the online
Privacy Policy posted on http://www.csu.org, and data protection laws. The Participant
agrees to the collection, processing and storage of his/her personal data by CSU for
purposes of the Promotion and taking the Change the Current Pledge.
