1. CompositionofBill
TheSenateRAAisastandalonebillthatcodifieslongstanding,bipartisanexecutiveordersthathave
governedtheregulatoryprocessfordecades.Itistheresultofsignificantbipartisannegotiations
thathavefocusedonensuringthattheregulatoryprocessproducessmartrulesthatreduce
burdensonbusinesseswhileprotectingpublichealth,safety,theenvironment.
TheHouseversionoftheRAA,H.R.5,incorporatessixseparatebillsandoneHouseResolution.
2. SelectionofFinalRule
TheSenateRAArequiresagenciestoconsiderreasonablealternativestothemostexpensiverules,
withtheconsiderationofthreesuchalternativespresumedtobeareasonablenumber.Itthen
requiresagenciesselectthe“mostcost‐effectiverule,”unlesstheagencyprovidesadetailed
explanationofwhyitchosealesscost‐effectiverule.
H.R.5requiresagenciestoconsiderallreasonablealternativestoaruleandtochoosethe“least
costly”alternative,unlesstheagencycanexplainhowtheadditionalbenefitsofamoreexpensive
rulejustifytheadditionalcosts,andthosebenefitsmustfallwithinthescopeofthestatutory
authorizationfortherule.
3. JudicialReview
TheSenateRAAallowscourtstoreviewagencies’compliancewithrulewritingprocedural
requirements.Italsoallowscourtstoremandrulestoagencieswhereappropriate.Itrequires
courtstoreviewfactualdeterminationsunderlyinghigh‐impactrules($1b+annually)usingthe
substantialevidencestandard.ItreplacesAuerdeferencewithSkidmoredeference,butitdoesnot
affectChevrondeference.
H.R.5alsoallowscourtstoreviewagencies’compliancewithrulewritingproceduralrequirements,
butdoesnotincludeaprovisionexplicitlyallowingcourtstoremandrulestoagencies.Itrequires
courtstodecidealltermsofanagencyactionandallrelevantquestionsoflawdenovo,including
