Proposed Variance(s):
1. To permit a minimum interior side yard setback of 1.6 metres (northerly interior side yard), and 1.7 metres
(southerly interior side yard).
2. To permit the total of both interior side yards to be a minimum of 3.0 metres.
3. To permit a maximum building height of 10.5 metres.
4. To permit a maximum lot coverage of 25.64% (23.5% dwelling, 0.8% shed, 1.4% covered porches).
By-Law Requirement(s):
1. A minimum interior side yard setback of 2.5 metres is required.
2. The total of bother interior side yards shall not be less than 6.0 meters.
3. A maximum building height of 9.5 metres is permitted.
4. A maximum lot coverage of 20% is permitted.
Official Plan:
VOP 2010: "Low-Rise Residential". The proposal conforms to the Official Plan.
Comments:
The Owner is requesting permission to construct a 2-storey dwelling, and maintain an existing shed, with the
above-noted variances.
At the request of the Development Planning Department, the Owner has submitted a revised proposal
requesting a maximum coverage of 25.64% (23.5% dwelling, 0.8% shed, 1.4% covered porches), and
minimum interior side yard setbacks of 1.68 metres along the southerly side yard, and 1.7 metres along the
northerly side yard. The Development Planning Department is satisfied with the proposed changes and has
no objection to Variances #1 to #4. The lot coverage for the proposed dwelling is 23.5%, which is only a
minor increase above what is permitted, and previous Committee of Adjustment decisions have supported a
similar increase in lot coverage for a two-storey dwelling. The Development Planning Department has no
objection to the proposed height and interior side yard setbacks, which is consistent with previous approvals
in the immediate area.
The Owner has submitted an Arborist Report and Tree Inventory which inventoried a total of 31 trees, of
which 1 tree will be removed, and 3 will require a permit to injure. The Urban Design and Cultural Heritage
Division has reviewed the Arborist Report and concurs with the recommendations, subject to the conditions
noted below.
On this basis, the Development Planning Department is of the opinion the proposal is minor in nature, meets
the intent of the Zoning By-law, and is desirable for the appropriate development of the land.
Recommendation:
The Development Planning Department recommends approval of the application.
Conditions of Approval:
If the committee finds merit in the application, the following conditions of approval are recommended:
a) The Owner shall provide a Letter prepared by an ISA Certified Arborist indicating that the preconstruction, construction, and post-construction recommendations to minimize the damage of neighbor
trees are satisfactorily conducted by an ISA Certified Arborist and in accordance with industry standards, to
the satisfaction of the Development Planning Department.
b) Tree #6, Tree #8, Tree#9 is neighbor owned; therefore permission from the neighbouring property owner
is required before injuring these trees.
