Non‐representative Flat Fee Listing Agreement Board of County Commissioners of Alachua County, herein known as seller, and _____________________________________, herein known as listing agent, agree to the following: 1. Seller hereby hires listing agent to offer seller’s property located at ________________________________________________________ for sale in the Gainesville Multiple Listing Service (MLS) for the next _________days. For and in consideration of this agreement and the payment of __________(flat fee listing fee), listing agent agrees to provide the following services: A. Listing agent agrees to create a property listing sheet describing property details, including pictures of the property, meeting all requirements of the Gainesville MLS, and being acceptable to the seller. B. Listing agent will enter the listing into the MLS database and keep the listing up to date during the listing period, including making any changes to the property details, listing price, or commission changes that the seller desires during the listing period. C. Listing agent will also install a keysafe or lockbox on the property, which lockbox shall provide access to any member of the Gainesville MLS or any licensed real estate broker or Realtor. D. Listing agent and seller agree that the seller will provide a sign to be placed on the property that will indicate to buyers that they can Call Any Realtor for information about purchasing the property. E. Listing agent and seller agree that the MLS listing sheet shall include any offer to pay a buyer’s broker, buyer’s Realtor, or transaction broker a commission of 3.5% of the selling price for assisting a buyer who actually purchases seller’s property during the listing period. 2. Seller and listing agent agree that listing agent has no obligation to find a buyer for seller’s property, will not be obligated to represent seller as a seller’s agent, and will not be required to provide any other services than those listed in this agreement. 3. Seller and listing agent agree that listing agent is not the agent of the seller and that nothing in this agreement should be construed to indicate that the listing agent is the agent of the seller. However, seller understands that listing agent may find a buyer who purchases seller’s property and seller and listing agent agree that listing agent will act as a buyer’s agent in that case, will make the proper agency disclosure to the buyer, and will be entitled to the commission listed, above in addition to the flat fee listing fee paid upon execution of this agreement. _______________________________________________ ___________ Richard Drummond, County Manager Date ________________________________________________ ___________ Listing Agent Date
