All wood species undergo a gradual aging process that will enhance the texture, color, and grain patterns in the wood. The pronounced features of each wood species give a uniqueness and timeless appeal that can only be found in nature. These characteristics are particularly evident with our Natural wood finishes. While we make every effort to ensure that all of our finishes are consistent with our samples, variations in graining, knots, mineral deposits, and color are inherent in wood and are considered acceptable. According to the Architectural Woodwork Institute, “Wood is a hygroscopic material, and under normal use conditions all wood products contain some moisture. Wood readily exchanges this molecular moisture with the water vapor in the surrounding atmosphere according to the existing relative humidity. In high humidity, wood picks up moisture and swells; in low humidity wood releases moisture and shrinks. As normal minor fluctuations in humidity occur, the resulting dimensional response in properly designed construction will be insignificant. To avoid problems, it is recommended that relative humidity be maintained within the range of 25 - 55%. Uncontrolled extremes - below 20% or above 80% relative humidity - can likely cause problems.” warranty www.nickelscabinets.com |2 Nickels takes great care to maintain an environment that falls within the acceptable range for wood products. As such, any problems that occur after the product has left our facility will not be covered by our warranty, but will become the responsibility of the storage company prior to installation, the general contractor during site storage and installation, or the homeowner after occupancy. paint disclaimer Nickels typically applies paint onto one-piece MDF doors in order to avoid the problem of cracks developing on the door faces. When a 5-piece door is painted, the joint will inevitably telegraph through the painted finish. On some occasions, this joint will open up, thereby developing a hairline crack on the door face. These cracks in the joints are considered normal and acceptable, and are therefore not covered as a warranty issue. warping Nickels Cabinets have been certified by the CKCA, and as such, the standards set by the CKCA shall determine the maximum warp for doors. Any warp within these tolerances will be considered normal and acceptable, and therefore not covered as a warranty issue. CKCA 4.2.5 Doors - Maximum warp - Doors less than 32” (812mm) in height shall have a maximum deflection of 3/32” (2.5mm). Any door greater than 32” in height shall have a maximum deflection of 3/16” (5mm). 5-piece wood doors 50” (1270mm) or greater in height should have a mid-rail. Doors shall also be installed and aligned so that they are square with the cabinet and can operate freely without excessive looseness or binding. Installed doors shall have a device sufficient to hold the door closed. warranty www.nickelscabinets.com |3 defective materials Cabinets or parts will be replaced on a ‘Quick Ship’ basis. Replacement materials will be invoiced according to their market price. Credit will be issued after the defective material has been returned and an inspection by Nickels deems the material to be defective. responsibility Cabinets and parts must be inspected prior to installation as Nickels Cabinets will not cover any expense involved in removing or reinstalling the product. All products will undergo a quality inspection at our plant prior to shipping in an effort to ensure satisfactory receipt of goods. Nickels will not be responsible for any freight damage or lost product. Claims for such problems must be made directly to the carrier involved. filing a claim To file a warranty claim, the purchaser should contact the local authorized Nickels Cabinets Dealer who will assist in servicing the claim. warranty www.nickelscabinets.com |4 thermofoil warranty Thermofoil Doors, drawer fronts, and moldings are warranted by our supplier to the customer against defects occurring in the manufacturing process, suject to the terms and conditions as stated in the following warranty certificate. These products are guaranteed against delamination, irregular surface discoloration, warping or twisting for a period of five (5) years from the date of purchase. The warranty only covers defects as specified herein and does not include defects or damages attributable to misuse, normal surface wear, accidents, fire, acts of God, or any other casualties, causes or occurrence beyond the manufacturer’s control. The exclusive remedial action provided for the customer hereunder shall be repair, restoration, replacement or return and refund of the products manufactured by our supplier. found to be defective. The replacement of new materials for those as may be defective may result in a color variance in comparison to the originally installed Thermofoil products due to style and color changes by RTF (Rigid Thermo Foil) manufacturers and is not indicative of a defect. The manufacturer reserves the right to substitute such RTF colors as are then being manufactured and is only obligated to match color and quality with such products as it is manufacturing at the time of replacement. If the manufacturing of Thermofoil products by our supplier causes product delamination, yellowing, discoloration, warping or twisting under ordinary wear and conditions (and is not otherwise excluded from coverage), our supplier will repair or replace the warranted components at the net invoice price of the doors as sold by Nickels Cabinets. warranty www.nickelscabinets.com |5 exclusions & conditions This is an important part of your Warranty. Please read carefully: 1. This warranty specifically excludes the following: ▫▫ Damage resulting from product being installed in areas subject to abnormal heat, ultraviolet rays, cold, dryness, humidity, direct sunlight, fire, collision with foreign objects, corrosive atmospheres, hail, ice, or any other acts of God or occurrences beyond the control of Nickels Cabinets. ▫▫ Damage resulting from extreme moisture (bleaching, etc.) condensation and moisture formation where condensation is caused by excessive in-house relative humidity or by appliances generating steam vapors. ▫▫ Damage resulting from impairment of structural strength or damage when cutting to fit, applying hardware, mounting or affixing objects to the surface of any products such as the mounting of suspension devices, curtain rods or holiday decorations. ▫▫ Fading, discoloration, scratches or dents as a result of abuse. ▫▫ Products installed in any area where temperatures will exceed 150 degrees Fahrenheit(66ºC). It is recommended to use melamine filler between all heat sources and the cabinet. ▫▫ Damage as a result of using cleaning products containing ammonia or acetone. ▫▫ Products made at the request of the customer, which varies, from our normal construction specifications (e.g. reducing thickness of a panel, doors made larger than the maximum guaranteed size or in excess of width & height limitations). ▫▫ Fading or oxidation of finishes due to atmospheric changes and normal weathering. ▫▫ Damage resulting from installation, repair or any other labor performed by installers of the product. ▫▫ A warp or twist of 3/16” or less (based upon a typical upper door i.e.; 30”- 31” x 15” door) e.g., 3/16” measured on a 30” tall door at center is allowable. ▫▫ Flat panel doors in excess of 18” in width and/or 36” in height are not war ranted for warp. Warping is measured with the door standing vertical, using a straight edge span the ver tical length measuring the warping gap in the center of the vertical height. Twists are measured by placing the face of the door against a true plane surface (as above) and measuring the gap at the twist. warranty www.nickelscabinets.com |6 2. With respect to any and all Thermofoil products manufactured by Nickels supplier, the following stipulations will be in force and are acknowledged to be part of this warranty ▫▫ Unacceptable discoloration and yellowing are considered a change in color greater than 3.0 DE on the Cielab Scale. ▫▫ Any claimed manufacturing defect is subject to inspection by Nickels Cabinets to make final determination of the cause of such defects. ▫▫ Any repair or replacement shall be performed by our supplier within a reasonable period of time, not to exceed ninety (90) days following determination that a condition of defective manufacture exists. ▫▫ In the event that any component part or product covered by this Warranty is not available, Nickels and our supplier has the right to substitute part(s) or product(s) of equal grade and quality. 3. The warranty period on any part or parts of the Thermofoil products, which are replaced or repaired pursuant to this Warranty, shall be for the remainder of the original Warranty period applicable to the part(s) or the product(s) as provided in this certificate. 4. Nickels Thermofoil supplier warrants that the products sold are fit for the particular purpose for which they are intended, PROVIDED THAT THIS LIMITED WARRANTY SHALL BECOME NULL AND VOID IF THE PRODUCTS ARE USED FOR PURPOSES OTHER THAN THOSE FOR WHICH THEY ARE INTENDED AT THE TIME OF PURCHASE OR PRODUCTS ARE OTHERWISE MISUSED. 5. Nickels will not be held responsible for delays caused by factors beyond our control (e.g., Obstruction to or blockage of usual routes of transportation, unavoidable accidents, riots, natural disasters, vehicle shortages, prevention of labor, power shortages or lack of materials). Our liability under this warranty is limited to the net invoice price of the products as sold by Nickels Cabinets. THERE ARE NO OTHER WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED,AND THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. 6. The Warranty statements contained in this limited warranty are the only express warranties extended by Nickels Thermofoil supplier. for the product sold. It is the expressly agreed that the customers exclusive and sole remedies for breach of any warranty provided in this limited warranty are limited to return of the products purchased and repayment of the purchase price or repair and replacement of nonconforming products. Nickels shall not be liable for incidental and consequential damages occurring to the purchaser or end users property or business. The price stated for the products is a consideration in limiting sellers’ liability.
