2017 Compound Lease/Application Agreement Package
Below is a check list of items that must be submitted as a package at the time of renewal or new agreements
for storage space at the compound. Also, we have attached, for your convenience all the required
documentation and compound rules. Packets will be available at the office or can be downloaded off our

payment will be accepted - check only.
 Boat Storage: Proof of insurance and boat registration
 Trailer Storage: Clearly labeled with owner's name on port side of trailer tongue, has an
operable front jack and is in road worthy condition
 Submitted to be received no later than December 1st (for annual renewal)

LEASE \ APPLICATION FOR STORAGE SPACE
Spring Creek Village Amenities Corporation, Inc.
This lease for storage space ("Lease") is dated ____ day of ___________, 20___ and entered into by and between
SPRING CREEK VILLAGE AMENITIES CORPORATION, INC. a Florida not-for-profit corporation (the "Landlord"), and
______________________________________________ (the "Tenant") for storage space for a boat/trailer (the
“Space”).No vehicle or object other than a Boat/Trailer (and grandfathered motor homes) may be stored in the
Compound. Lessee must either be a residing owner or tenant of a lot within Spring Creek Village. No Homeowner
or tenant may store a Boat or Trailer owned by an individual not residing in Spring Creek Village. Proof of
residency, current boat registration and boat insurance are required with this signed document.
1. Leased Premises. Landlord hereby leases to Tenant, and Tenant hereby leases from Landlord the Space
located in the Landlord's storage compound at Windward Blvd. Bonita Springs, Florida (the "Premises") in its
current "AS IS" condition on the terms and conditions set forth below.
2 Term. This Lease will be for a term of 12 months, commencing on January 1, 20___ and terminating on
December 31, 20___(“Term”). This Lease shall not automatically renew.
3. Rent. As rent for the Premises, Tenant will pay the Landlord in advance the amount of 150.00 per year ($250.00
for RVs ) (the "Rent"). For Boat Type__________________ Boat Size_____________ Trailer Size_____________

4. Proof of Ownership If resident changes vessels, they must notify the compound chairperson and provide
all credentials as listed in the rules and regulations.
5. Use. Unless authorized by Landlord in writing, Tenant shall use the Space only for storage of Tenant's boat
and/or its trailer and for no other purpose. Tenant will use the Premises in compliance with all applicable laws.
Tenant shall keep the stored boat and/or its trailer within the confines of the Space and shall not use the Space in a
manner that interferes with the occupancy rights of any other tenant. Further, Tenant expressly agrees to abide by
the provisions of this Lease and the attached Compound Rules and Regulations (the “Rules”), which are hereby
acknowledged and agreed-upon to be material terms and conditions of this Lease. Failure to strictly abide by the
provisions of this Lease and the Rules shall be considered a material default and grounds for termination of this
Lease. The Landlord reserves the right to make additions to and deletions from the Rules from time to time. The
Tenant assumes full responsibility for providing adequate covering, if applicable, to protect the Vessel from any and
all perils and for proper maintenance of such covering while the Vessel is on or in the Premises of the Landlord.
6. Indemnity. Tenant agrees to indemnify and hold Landlord harmless from and against any and all claims for
damages to property or persons arising from Tenant's use of the Space and Premises, or for any activity, work
performed, permitted, or suffered by Tenant in or about the Space and Premises. The Landlord shall not be liable
for any claims resulting from personal injury, damages, or any loss of Tenant from theft, vandalism, fire, water,
rainstorms, smoke, acts of God, acts of other persons, strikes, insurrections, riots, embargoes, shortages, delays in
transportation, mechanical delays, or requirement of any civil or military authority.
7. Insurance. Before occupying the space, Tenant shall obtain and maintain liability insurance, notwithstanding
any other insurance already obtained, during the Term of this Lease. Tenants owning boats must show proof of
insurance at the time of execution of this Lease. Further, the Tenant must provide a copy of such liability insurance
to the Landlord for its records. Liability insurance must be valid during the Term of this lease. It is the Tenant’s
responsibility to ensure that the Landlord has a valid copy of such liability insurance.
8. Subleasing. Tenant may only sublease their space to another SCV resident during the off season when spaces
are empty. Any change in home ownership will require a new Application to be submitted and approved.
Depending upon availability of space, it may be necessary for the new applicant to be placed on a waiting list.

9. Rate Changes. The Landlord reserves the right to amend, make additions to, or deletions from this Lease
from time to time. Notice of said changes shall be made by mailing a copy via Certified U.S. Mail, return receipt
requested, to the Tenant at the address provided in this Lease.
10. Notice not to Renew Lease. Tenant shall provide the Landlord with a written notice of his intention not
to renew the Lease at least thirty (60) days prior to the end of the Lease Term.
11. Automatic Termination of Lease. Tenant agrees that any violation of City Ordinance, Florida law, or
Federal law or any regulations of City, Federal, or State agencies, failure to pay rent and/or any other charges, or
failure to abide by the Landlord’s Rules, shall be cause for the Landlord to terminate this Lease without notice.
12.Failure to Remove upon Termination of Lease. If Tenant fails to remove the Vessel and any
equipment from the Space within five (5) days of termination of the Lease, upon written notice from either party,
the Space rental shall accrue at the rate of $25.00/day, and in that event the Landlord is authorized to move the
Vessel and equipment to another location and re-let the Space or pursue any other remedy available under Florida
law.
13. Entire Agreement. The Tenant and Landlord agree that this Lease and any attachments hereto contains the
entire understanding between the parties and no other representations or inducement, verbal or written, has been
made which is not contained in the Lease. The parties agree that if any provision violates the law and is
unenforceable, the rest of the Lease is valid
14. Governing Law. The Tenant and Landlord agree that time is of the essence and any action arising out of
this Lease shall be governed by the laws of the State of Florida, Lee County
15. Attorney’s Fees and Costs. In the event that the Landlord is forced to retain an attorney to represent its
interests or assist in enforcing the terms of this Lease, the Tenant shall reimburse the Landlord for any and all
changes incurred, including, but not limited to, attorney’s fees and costs, including any attorney’s fees and costs
that may be incurred with the Tenant is in bankruptcy. For purposes of this Lease, attorney’s fees and costs shall
be deemed as additional rent, and shall be due to the Landlord on the first day of the month after the fees and
costs were incurred by the Landlord. Such attorney’s fees and costs shall be secured by a lien upon the Tenant’s
Vessel and any other personal property.
16. Authority to Execute. Each party executing this Lease represents and warrants that he or she has the
authority to execute this Lease. Further, the Tenant certifies that the information, terms, provisions of this Lease
and the Rules, as may be amended from time to time, have been reviewed and is fully understood and agreed.
Tenant acknowledges receipt of this Lease and any attachments hereto, including, but not limited to, the Rules.

Spring Creek Village Amenities Corporation, Inc. Compound Rules for 2017
Compound storage is available for Boats and Boat Trailers. One space per house is allowed. All attempts will
be made to have a space for residents to park the above mentioned items, but space will be on a first come
first serve basis. No Cars, Trucks Vans, Utility or Storage Trailers are allowed to be stored in the compound.
The Compound is a storage area and will not be available to individuals or workers hired by individuals for any
repair or maintenance, except where noted below. Hours of operation will be posted near the entrance gate.
By virtue of being allotted a space, each resident will comply with the following rules and regulations:
1. Fees are set by the Board of Directors and there are no refunds (Example: one (1) month, twelve (12)
months or one (1) year. Not prorated)
2. Prior a space has been allocated; the resident must complete and sign a LEASE \ APPLICATION FOR
STORAGE SPACE. All boats and trailers in the compound must be mobile, licensed, registered with applicable
governmental authorities, in operational condition and registered to the Tenant. If storing a boat, a copy of
the boat registration and insurance must accompany the LEASE \ APPLICATION FOR STORAGE. If storing a
trailer only, no insurance or registration is needed.
3. Landlord will appoint a compound chairperson who will designate where the equipment may be parked at
his or her sole absolute discretion. Moving a registered boat (with or without its trailer) or recreational vehicle
to an unauthorized location is strictly prohibited. Moving empty trailers without permission is also prohibited.
4. All boat trailers must have front operational jack and be mobile.
5. All boat trailers must be clearly labeled with Tenant's name on the port side of the trailer tongue.
6. Residents shall keep their space free of trash and debris. The Compound does not provide any trash
services so trash must be taken off site.
7. All boat trailers will be left unlocked while in the compound in case the Compound Committee must move
the items. If RV units need to be moved the owner or their designee will be contacted to move the unit.
8. Should residents need assistance to park or move a unit, please contact the Compound Committee.
9. When the compound is full, residents will need to find other storage until a space becomes available.
Names will be placed on a waiting list in order of receipt. Fill out a Compound Waiting List Application and
submit to the Compound Chairperson. Once your space becomes available, you have 15 days to submit your
paperwork and payment. The waiting list is displayed on the SCV website so you can see where you are on the
list.
10. Each lease is limited to one storage space, on a first come first served basis. Tenant may only sublease their
space to another SCV resident during the off season when spaces are empty. Any other assignments or subleases
are strictly prohibited.

11. There is only one unit per space. No trailer-on-trailer stacking is allowed for safety reasons. Management
must be able to move the trailer.
12. Storage areas in the compound are for the convenience of the residents of Spring Creek Village
13 Authorized Vehicles Only – SCV lease is required prior to the placement of any item within the Compound.
14 Unauthorized items are subject to towing at the Owner’s expense.
15 SCVAC has the authority to assign, re-assign and/or move items within the Compound as needed.
16 SCVAC is not responsible for damage to any items stored within the Compound.
17 Renewed Lease and other required Documents and fees must be submitted annually.
18. Non-submission of documents and non-payments will result in the removal of item from the Compound
19. All items must be road worthy and properly maintained.
20. Motor/engine work where environmental fluids are involved is strictly prohibited on Compound property.
Only general trailer & boat maintenance is allowed. Contact the Compound Chairperson for specifications.
