JOB SPECIFIC REQUIREMENTS
1.
Scope of Works
1.1
General Requirement
CONTRACT NO RFQ17/016 CONSTRUCTION OF KERB & GUTTER IN
WALGETT
This Contract calls upon bidders to provide all Labour, Materials, plant and all
other resources necessary to complete the construction of the works as shown in
the drawings, as per specifications.
This contract shall be administered using AS 4000-1997 (Part A of the annexure is
attached).

1.3
Description of Works
The following is a non-limiting account of the tasks that will be carried out in
accordance with the Specifications and construction drawings as attached.
This Contract is to include;
 Removal and disposal of existing kerb and gutter, and
 The supply of labour, materials and plant to construct kerb & gutter on the
named streets within Walgett town. All works must be completed in
accordance to the Specifications and drawings.
1.3.1. Contractors Responsibilities and Conditions

The Contractor will be responsible for the construction of the kerb & Gutter
at the specified locations.

The Contractor will be responsible for the payment of all wages, overtime,
travelling expenses, workers compensation and insurances (including public
liability) incurred in the execution of the above Contract.

The Contractor will be required to make good any damage at his own
expense caused to both Walgett Shire Council and the landholder’s
property in the execution of this Contract.

The Contractor is required to report immediately to Walgett Shire Council,
any damage to Walgett Shire Council’s property caused by himself or any
persons under his employment.

This is a lump sum Contract.
Payment
At the progress completion of the works the Contractor will be required to lodge a
progress claim for work undertaken. An Inspecting Officer from Walgett Shire will
verify this claim and if satisfactory, payment will be made. The contractor to
provide the superintendent a statutory declaration stating that all workers who
have at any time been employed by the contractor on work under the contract
have at the date of the request been paid all moneys due and payable to them in
request of their employment on the work under the contract as stated in clause 38
of AS4000 - 1992.
3.
Requirements of Contract
3.1
Scope
The work to be executed under this Specification consists of the removal and
disposal of existing kerb and gutter to Council Stockpile Site, and the construction
of new kerb and gutter and associated works.
Requirements for quality control and testing, including maximum lot sizes and
minimum test frequencies, are cited in the Specification Part for Quality
Requirements.

3.2

3.3
Provision for Traffic
The Contractor shall construct the works with the least possible obstruction to
traffic, both vehicular and pedestrian.
The contractor shall submit a Traffic Guidance Scheme and carry out all actives for
controlling traffic, both vehicular and pedestrian, in accordance with the
specification for CONTROL OF TRAFFIC.
3.4
Proprietary Products
Unless shown on the drawings, proprietary products may only be used with the
approval of the superintendent. Where specified, they must be used strictly in
accordance with the manufacturer’s instructions.
3.5
Construction
3.5.1. Footpath and Road Pavement Preparation
Prior to the excavation and removal of existing kerb and gutter, the footpath,
driveways and road pavement shall be saw-cut where shown on the drawings or
as directed by the superintendent to provide a neat, straight, clean cut so as to
minimize damage and disturbance to the remainder of the footpath and road
pavement.
The Contractor shall carry out survey of existing kerb and gutter to determine
levels and natural flow, and to identify downpipe outlet and driveway locations and
dimensions.
Damage or disturbance to the footpath, driveways and/or road pavement resulting
from the work shall be restored by the contractor to the pre-construction condition
to the satisfaction of the superintendent. All costs associated with any restoration
work shall be borne by the contractor.
3.5.2. Removal and Disposal
The contractor shall demolish and remove the existing redundant kerb and gutter
and excavate to the level shown on the drawings in accordance with the
specification for MINOR CONCRETE WORKS.
The Contractor shall reinstate all downpipe outlets and replace kerb laybacks to
match existing.
Utmost care and controlled excavation shall be exercised in the vicinity of existing
services and structures. Dial Before You Dig (DBYD) is the responsibility of the
contractor.

Care shall be excised in the removal of kerb and gutter so as to prevent damage to
any existing services, including existing house storm water drainage pipes which
discharge into the gutter. Damage occurring to storm water drainage pipes and/or
other services shall be restored to the pre-construction condition to the satisfaction
of the superintendent. All costs associated with the restoration work shall be borne
by the contractor.
All excavated material and demolished kerb and gutter shall be removed from site
and legally disposed of by the contractor to a site approved by the superintendent.
Under no circumstances shall excavated material be disposed of privately to any
person or to any site not authorized by the superintendent.
3.5.3. Foundation
Before placing any kerb and/or gutter, the foundation materials shall be shaped
and compacted to a firm 200mm thick compacted gravel base. Other than kerb
and gutter constructed on pavement courses, the relative compaction shall be in
accordance with the requirements of AS 2876. Where placed on pavement
courses, the foundation shall be compacted to the requirements of the respective
pavement course. The foundation material in all cases will be subject to
superintendent’s approval. This action constitutes a HOLD POINT. The
superintendent’s approval of the foundation material is required prior to the release
of the hold point.
3.5.4. Kerb and Gutter (Channel)
Kerb and/or gutters,(channels) may be constructed in fixed forms, by extrusion or
by slip forming in accordance with AS2876.
All concrete used is to be of strength f’c = 32MPa with type D cement. (sulphate
resisting). A copy of the delivery document received from the concrete supplier
shall be given to the superintendent within 24 hours of each delivery.
The foundation, concrete quality, curing and testing details shall be in accordance
with AS 2876.
The top and face of the finished kerb and/or gutter shall be true to line and the top
surface shall be uniform width, free from humps, sags or other irregularities. Kerb
and gutter shall have a steel float finish.
The level at any point on the surface of the gutters shall be within ±10mm of
design levels. When a straight edge 3m long is laid on top of or along the face of
the kerb or on the surface of gutters, the surface shall not vary more than 5mm
from the edge of the straight edge, except at kerb laybacks, grade changes or
curves or at gully pits requiring gutter depression.
Concrete joints are to be mechanically scabbled, green cut or sand blasted such
that the aggregate is exposed. Scabbling will not be permitted at the time of
pouring
Unless shown otherwise on the drawings, contraction joints, shall be formed every
3m of gutter length for a minimum of 50 per cent of cross sectional area. The joint
shall be tolled 20mm in depth to form a neat groove of 5mm minimum width.

Unless shown otherwise on the drawings, expansion joints, 15mm in width for the
full depth of the kerb and gutter, shall be constructed at intervals not exceeding
15m and where the gutter abuts against pits, retaining walls, overbridged and at
both sides of kerb laybacks for vehicular or pedestrian access. Expansion joints
shall consist of a performed joint material of bituminous fiberboard or equivalent
approved by the superintendent.
Where kerbs and/or gutters are cast adjacent with a concrete pavement the same
type of contraction, construction and expansion joints specified in the concrete
base shall be continued across the kerb and/or gutter.
All existing house storm water outlets shall be reconnected and reconnected and
extended, to match the existing type and size pipe, where necessary through the
new kerb as shown on the drawings. Pipework shall be in accordance with the
requirements for UPVC pipes in the specification for PIPE DRAINAGE, or as
directed by the superintendent for other types of pipe.
Opposite all driveways, where shown on the drawings or where directed by the
superintendent, barrier kerb shall be discontinued to provide for vehicular or
pedestrian access. At such location, kerb layback shall be constructed in
accordance with the drawings. Footpath crossovers shall be constructed to meet
layback as shall on the drawings, or reinstated to match existing materials where
no otherwise shown.
Where applicable the top of gully pits shall be reconstructed, or precast units
adjusted, to suit new kerb and gutter profile in accordance with specification for
MINOR CONCRETE WORKS.
3.5.5. Backfilling and Restoration
Backfill material behind the kerb shall consist of granular material, free of organic
material, clay and rock in excess of 50mm diameter, or material as approved by
the superintendent.
After the new kerb and gutter has been constructed and not earlier than three days
after placing, the spaces on both sides of the kerb and/or gutter shall be backfilled
and reinstated in accordance with the drawings, or as instructed by the
superintendent.
Backfill materials behind the kerb shall be compacted in layers not greater than
150mm thick, to a relative compaction of 95% when tested in accordance with
AS1289.5.4.1, for standard compactive effort. The whole of the work shall be
finished in a neat and workmanlike manner, free draining and free from surface
undulation and trip hazards and in accordance with any surface treatment shown
on the drawings.
Pavement material adjacent to new gutter shall be backfilled in accordance with
the drawings or as directed by the superintendent.
3.5.6. Adjustment to Gully Pits
In the event that adjustment of line or level of the kerb and gutter requires
adjustments in gully pits the contractor shall undertake any necessary partial
demolition and shall re-construct such sections of the gully pits as are necessary
to match the design standard of the existing gully pit.

Any new wall sections in concrete or brick shall be securely fixed to the
retained wall section. The procedure shall be outlined in writing for
superintendent’s approval 24 hour prior to commencing of demolition work.
In all cases the hydraulic capacity of the original gully pit shall be retained or
improved. Cavity shapes shall be regular and oriented so as not to impede flow
into and out of the pit.

SPEC CLAUSES

Work Health & Safety
Work Health and Safety Regulations 2011 under the Work Health & Safety Act
2011 are to be complied with at all times. The Contractor shall provide a Site
specific Safety Management Plan conforming to the Work Health and Safety Act
2011 and Regulations 2011 for approval by Walgett Shire before commencement
of any work.
Each site shall have “Hard Hat Area” signs clearly displayed. The Contractor is
responsible for all people, including operators and visitors, for wearing a hard hat
at all times. Minimum penalty shall be $55 per person per incident. Repeated
incidents may cause people at fault being suspended from the site and or the
suspension of all works.
4.
General
4.1
As per AS 4000 – 1997 Clause 17 Alternative 1, before commencement of any
works, the Contractor shall take out Public Liability Insurance in the joint names

of the Principal, the Contractor, the Superintendent and all Sub Contractors
employed from time to time in relation to the work.
4.2
Before commencement of any works, the Contractor shall forward originals of
all Insurance policies relevant to the Contract to the Superintendent so that,
approval could be granted to commence work.
4.3
Walgett Shire Council does not accept responsibility for damage or loss to
privately owned equipment or tools.
4.4
Walgett Shire Council will accept no responsibility for injury incurred while
employed in this contract.
4.5
A working drawing will be provided for each installation site and tenders are to
be based on information given on these drawings and the field inspection.
4.6
Walgett Shire Council reserve the right to award parts of the contract to
different tenderers or to award the entire contract to one tenderer or not to
award the contract to any tenderer.
4.7
The successful tenderer must produce all insurance papers and
deposit before work can commence.
4.8
The successful tenderer must produce work as executed plan produced by a
qualified surveyor.
4.9
Tender Submission Requirements
Security
4.10 All documents included in Volume 1 – Tender Documents must be completed and
submitted on the original forms provided. The following additional information is
required:
 Proposed management structure;
 Details of proposed staff and their relevant experience;
 Names and contact details of Referees who can attest to recent works
4.11 Validity Period
Tender prices are to be valid for a period of 60 days from the advertised date of
lodgement.

4.13 Acceptance of Tenders
The Principal shall not be bound to accept the lowest or any tender.
A tender shall be accepted only by notice in writing, delivered to the address of the
Tenderer specified in the Tender Form.
The canvassing of Councillors at any time is respect of this tender will not be
permitted. Any firm or representative canvassing or approaching Councillors shall
be disqualified from the tender being considered.
Tenderers are to note that Contractors will only be engaged by Council for works
and services if they are a fully incorporated Company and hold appropriate NSW
Workers Compensation Insurance. This restriction does not apply to the engaging
of Contractors where they cannot become “deemed employees” under the
Workers Compensation Act 1987 and where Council would have no liability to pay
workers compensation claims by the Contractor or his employees.
It is the responsibility of the tendered to familiarise himself/herself with the
requirements of these Conditions and Tendering and to ensure that all of the
requirements are met. Failure to do so may result in the tender being rejected as
defined by the Local Government (General) Regulation 2005.
4.14 GST
Sales tax is not payable on materials incorporated in the Works.
4.15 NSW Government Code of Practice
All Tenderers must comply with the NSW Government Code of Practice for the
Construction Industry. Lodgement of a tender will be evidence of the Tenderer’s
agreement to comply with the Code for the duration of any contract that may be
awarded.
If any tenderer fails to comply with the Code, their failure may be taken into
account by the Principal when considering this or any subsequent tender and may
result in this or any subsequent tender being passed over.
4.16 Corrections of Tenders
At any time before a Council accepts any of the tenders that it has received for a
proposed contract, a person who has submitted a tender may, subject to the
following:


By providing Council with further information by way of explanation or
clarification; or
By correcting a mistake or anomaly in a tender.
Such a variation may be made either:


At the request of Council; or
With the consent of Council at the request of the tenderer, but only if, in
circumstances, it appears to Council reasonable to allow the tenderer to
provide the information or correct the mistake or anomaly.

If a tender is varied in accordance with this clause, Council must provide all
other tenderers whose tenders have the same or similar characteristics as that
tender with the opportunity of varying their tenders in a similar way.
Council will not consider a variation of a tender made under this clause if the
variation would substantially alter the original tender.
