Introduction & Background
This is an application to transfer a passenger transportation licence from LECOUFFE, Leona
Rose to Cobble Hill Taxi 2016 Ltd.

PDV Decision
The transferor, Leona Rose Lecouffe dba Cobble Hill Taxi, was approved for a Special
Authorization licence through the expedited licencing process in 2004.
Currently, PT licence 70142 authorizes the licensee to operate 5 taxis, each with a seating
capacity of 2-7 passengers. The originating area is any point on Vancouver Island bounded
on the north by the City of Duncan but excluding the City of Duncan, on the west by
Shawnigan Lake and on the south by the intersection of Shawnigan Lake Road and the
Malahat Highway. The destination area is any point on Vancouver Island.
In support of this application, Cobble Hill Taxi 2016 Ltd. provided the following documents.

Division 3 of the Passenger Transportation Act (the “Act”) applies to this application.
The Act requires the Registrar of Passenger Transportation to forward applications for
Special Authorization licences to the Passenger Transportation Board (Board). Section
28(1) of the Act says that the Board may approve a transfer application if the Board
considers that the applicant is a fit and proper person to provide that service and is capable
of providing that service.
III.
Reasons for the Board’s Decision
(a) Is the applicant a fit and proper person to provide that service and is the applicant
capable of providing that service?
The Board looks at fitness in two parts:
(i)
is the applicant a “fit and proper person” to provide the proposed service; and
(ii)
is the applicant capable of providing that service?

Cobble Hill Taxi 2016 Ltd., the transferee, was incorporated on November 16, 2016. This
new company has 3 principals/directors: Alice Faye Baal, Christopher George Baal and
James Andrew Buchan. Christopher Baal will be the CEO responsible for vehicles and
drivers, while Alice Baal will look after the operations and the call center.
The application material included a business plan that outlined the company strategy,
marketing plan, maintenance/repair procedures, planned technology and management.
The transferee plans to continue operating in Cobble Hill, Mill Bay, Shawnigan Lake and
Cowichan Valley and intends to operate 24/7.
Financial information included profit and loss projections for March 2017 to February
2020 on behalf of the transferee. Balance sheets and income statements from the
transferor were submitted for 2014 and 2015.
The required disclosure forms were completed with no discrepancies indicated.
The principals of Cobble Hill Taxi 2016 Ltd. would seem to have the skills and resources to
provide this taxi service. I find that the transferee is a fit and proper person and capable of
providing this taxi service.
IV.
Rates
The rates are the same as the rates approved for the licence transferor.
V.
Conclusion
For the reasons above, this application is approved.
I establish the activation requirements and terms and conditions of licence that are
attached to this decision as Appendix I. I establish the rates as set out in Appendix II, which
are the same as those currently approved by the Board. These form an integral part of the
decision.

Licence Required
to Operate
Vehicles
The Registrar of Passenger Transportation must issue the applicant a
licence before the applicant can operate any vehicles approved in this
decision.
Approval of
application may
expire
1. The applicant must activate at least 50% of the vehicles within 6
months of the date of this decision.
2. If the applicant does not meet the requirements set out in 1 above,
this Special Authorization expires.
3. The Passenger Transportation Board may vary the requirements
set out in 1 above, if circumstances warrant it.
4. If an applicant needs more time to activate its vehicles, then the
applicant must make a request to the Board before the end of the 6
month activation period.
(Note: “activate” means that the applicant has submitted the documents
required to obtain a Special Authorization Vehicle Identifier to the Registrar
of Passenger Transportation.)
Notice to Registrar
The Registrar must not, without direction from the Board, issue the
applicant a licence or any Special Authorization Vehicle Identifiers if the
applicant has not activated at least 50% of the vehicles within 6 months of
the date of this decision.
(Note: activated means that the applicant has submitted to the Registrar of
Passenger Transportation the documents required to obtain a Special
Authorization Vehicle Identifier.)

Vehicles:
Maximum Fleet Size: 5 vehicles
Vehicle Capacity (T): Vehicles can accommodate a driver and not less than 2 and not more
than 7 passengers.
Services:
Originating Area: Transportation of passengers may only originate from any point within
the portion of Vancouver Island bounded on the north by the City of
Duncan (excluding the City of Duncan), on the west by Shawnigan
Lake, and on the south by the intersection of Shawnigan Lake Road
and Malahat Highway.

Destination Area: Transportation of passengers may only terminate at any point on
Vancouver Island.
Return Trips: The same passengers may only be returned from where their trip
terminates in the destination area to any point in the originating area if
the return trip is arranged by the time the originating trip terminates.
Reverse Trips: Transportation of passengers may only originate in the destination
area if the transportation terminates in the originating area and the
cost of the trip is billed to an active account held by the licence holder
that was established before the trip was arranged.
Express Authorizations: (i) Vehicles must be equipped with a meter that calculates fares on
a time and distance basis.
(ii) Vehicles may be equipped with a top light.
(iii) The operator of the vehicle may, from within the originating area
only, pick up passengers who hail or flag the motor vehicle from
the street.
Taxi Cameras: Taxi camera equipment may only be installed and operated in
vehicles when the licensee is in compliance with applicable taxi
camera rules, standards and orders of the Passenger Transportation
Board.
Taxi Bill of Rights: A taxi bill of rights may only be displayed in vehicles when the
licensee (a) has received written approval of the Board to operate a
taxi bill of rights program, and (b) is in compliance with applicable taxi
bill of rights rules, standards and orders of the Passenger
Transportation Board.
Transfer of a licence: This special authorization may not be assigned or transferred
except with the approval of the Board pursuant to section 30 of
the Passenger Transportation Act.
