STATE OF TEXAS § § COUNTIES OF BtR, § KENDALL, COMA ,BANDERA § § BLANCO, HAYG, ERR, MEDINA, AND T VIS § RESOLUTION No. 20111003 RDINATING COMMITTEE OF GROUNDWATER MANAGEMENT AREA 9 A RESOLUTION CCEPTING THE REDESIGNATING OF TERRITORY OF HAYS TRIN TY GROUNDW ATER CONSERVATION DISTRICT FROM G OUNDWATER MANAGEMENT AREA TEN WHEREAS, the Joint C ordinating Committee of Groundwater Management Area 9 (GMA 9) comprises delegates des·gnated by the following Groundwater Conservation Districts (GCDs) located wholly or parti lIy within GMA 9: Barton Springs/Edwards Aquifer Conservation District; Edwards Aquife Authority; Kendall County GCD; Hays Trinity GCD; Bandera County GCD; Medina County I CD, Blanco Pedemales CD; Trinity Glen Rose GCD, and Blanco County GCD; and; WHEREAS, Chapter 3 .108 of the Texas Water Code, Joint Planning in Management Area, requires that the GCDs in GMA 9 perfOllll joint plarming necessary to consider and adopt Desired Future Conditio s for all relevant aquifers in the GMA for a fifty-year plarming period; and WHEREAS, the GCD oard Presidents or their designated District Representatives of the GCDs in GMA 9 have et as a committee in various meetings and conducted joint plarming in accordance with Chapter 6.1 08 of the Texas Water Code; and WHEREAS, the territo of the Hays Trinity GCD that is primarily located in GMA 9 with 7,104 acres located in GAl 0 and accordingly the use of its groundwater resources is not likely to be effectively plarmed s part of GMA 10; and WHEREAS, most of th , territory (236,800 acres) of Hays Trinity GCD is located in GMA 9, and all groundwater reso rces in Hays Trinity GCD, including those currently in GMA 10, are more likely to be effectively plarmed and managed as part of GMA 9; and WHEREAS, the Ha.vs T 1inity Groundwater Conservation District (District) desires to participate fully in the joint plarmin being conducted by GMA 9 for developing appropriate desired future conditions for the aquife s common to all GCDs in GMA 9, and has approved a resolution that requests GMA 10 to ap ove the re-designation of that part of the District currently mapped as part of GMA 10 into G 9; and WHEREAS, GMA 9 ha expressed willingness to favorably consider re-designating the territory of the District currently i GMA 10 to its GMA; and WHEREAS, the Texas ater Development Board requires that requests for transfers of land between adjacent GMAs be approved by resolution of both the GMA in which the territory is currently located and the MA in which the territory would be located if approved by TWDB:; NOW, THEREFORE, E IT RESOLVED that the Joint Planning Committee ofGMA 9: 1. approves and aC~fts the addition of all of that part of the Hays Trinity GeD that is now in Groundwater l~ianagement Area 10; 2. endorses the incl sion of that same territory in the joint planning area of Groundwater Management Are 9; and 3. requests the Texa Water Development Board to approve that transfer as soon as feasible.
