This is to inform you that I have signed into law Senate Bill No. 630, S.D,I, the Tinian Agricultural Homestead Act of 1988.
I have signed this bill in order to allow ample time for the Marianas
Public Land Corporation to proceed with whatever preparation or
request it needs in order to implement the Agriculture Homestead
Program for the island of Tinian.
Although the purpose of this bill is understood, I urge the
Legislature to review the concerns that have been provided to the
members o f the Legislature, and to expedite the necessary
amendments.
This bill becomes Public Law No. 6-15. Copies bearing my signature
are forwarded for your ready reference.

AN ACT
To establish an a g r i c u l t u r a l homestead program f o r the island of
Tinian, and for other purposes.
BE IT ENACTED BY THE NORTHERN MARIANAS COMMONWEYLTH LEGISLATURE:

Section 1. Short T i t l e .

Agricultural Homestead A c t of 1988.
Section 2 .
T h i s A c t may be cited a s the Tinian
Designation of H m s t e a d Areas.
Such areas of public
l a n d on the island'of T i n i a n as may be s u i t a b l e for a g r i c u l t u r a l
purposes, and which a r e not required for government use or reserved for

other p u r p s e s by any provision of law, and a r e i n accordance w i t h the
MPKComprehensive Land Use Plan, s h a l l be designated by the Marianas

P u b l i c Land Corporation on behalf of the comrmnwealth Government for

agricultural homesteading purposes.
Such areas may, i n accordance w i t h

applicable provisions of law, be a l l o t t e d t o qualified persons for t h e
11
purpose of farming w i t h t h e r i g h t t o receive a freehold i n t e r e s t i n the
12
homstead a f t e r three years a f t e r t h e homestead is granted and t o
13
transfer a freehold i n t e r e s t i n the homestead a f t e r ten years a f t e r t h e
14
freehold i n t e r e s t is received.

Section 3 ,
Establishment of Area; Requirements for Use of
Propertx. '
( a ) Subject t o Article X I , Section 5 of the Constitution of

the Northern Mariana Islands, the Marianas P u b l i c I,and Corporation s h a l l
19
require and establish the following:

(1) Subject t o the a v a i l a b i l i t y of public land

for agricultural. homesteading p u r p s e s , the maximum

area of land allowable for each agricultural t r a c t
4
that may be made available t o each qualified person
5
under t h i s Act s h a l l be one hectare;

(2)
Standards and requirements for the use,
7
occupation and development of t h e homestead t r a c t s
8
granted under t h i s A c t consistent w i t h applicable
9
provisions of law;

Section 4. E l i g i b i l i t y t o EIomestead.
E l i g i b i l i t y t o enter upon

or acquire rights t o public land under t h i s A c t s h a l l be determined i n
12
accordance w i t h 2 c%K: section 4303; provided t h a t no person, clan,
13
lineage, family or group of persons may be permitted t o enter upon or
14
acquire rights under t h i s A c t unless t h a t person, or persons, have been
15
d m i c i l i a r i e s of t h e island of Tinian for not l e s s than f i v e ( 5 ) years,

Section 5 .
Application for Homestead Land; Conditions of

Occupancy; Deeds of Conveyance and C e r t i f i c a t e s of Compliance.

which a person, or persons, may enter u p n and ccmmence the use and

improvement of the land, the e l i g i b i l i t y for receipt of deeds of

conveyance and for c e r t i f i c a t e s of compliance s h a l l be governed by the

General Provisions of the Homestead Law ( 2 CMC 4301 e t . s e q . ) , provided
24
that before the issuance of a c e r t i f i c a t e of compliance a p r s o n , clan,
25
lineage, family or group of persons m u s t have resided on the island of

Tinian for three ( 3 ) years from the date of entry upon the homestead
2
l a n d and must have-complied w i t h a l l rules, regulations and requirements
3
concerning the use, occupation and developnent of the land for
4
agricultural or grazing purposes as established under Section 3 ( a ) ( 2 )
5
of this Act.

Section 6 .
Severability.
I f any provision of t h i s A c t is h e l d
7
invalid, the v a l i d i t y of t h e remainder of t h e a c t or any such provisions
8
s h a l l not be affected thereby,
9
Section 7 , Effective Date.
T h i s Act shall become law u p n its
10
approval by the Governor, or upon its becoming law without such
11
approval and s h a l l take e f f e c t upon the a v a i l a b i l i t y of the homestead
12
development f u n d s identified i n the s e r i e s bonds issued by t h e
13
omrranwealth Development Authority.
