Tanker owners association In tertanko, which heads the coali tion, says the ECJ advocate-gener al is expected to deliver her opinion on the case on 20 No vember. A final court ruling is ex pected to follow within three months. Intertanko points out that a rul ing last week by the ECJ throwing out the so-called “directive on ship-source pollution” to be re drafted is not connected with the industry case. The ECJ ruling that the direc tive needed to be reworked was part of an internal case brought by the European Commission A report into a grounding off the island of Bornholm identifies fatigue and possible alcohol use as key factors. Adam Corbett London Fatigue and possible alcohol use has been found to be the cause of the grounding of a general cargoship off Denmark earlier this year. The case is another example of the familiar problems that have continually troubled Europe’s shortsea-shipping trades over recent years. A Danish probe into the grounding of the 4,500-dwt Skarpoe (built 2004) found that a tired chief mate was the lone watch when the ship hit the bottom at Hasle on the island of Bornholm in March. Investigators say the chief mate was fatigued by excess paperwork and had slept for two hours before the grounding. According to the probe, he had only had two-and-a-half hours off before taking over the watch. The use of a lone watch went against the company’s own safety procedure, which required another look-out. The Danish report points out that another person on the bridge may have prevented the accident. “The grounding could have been avoided if a dedicated lookout had been part of the bridge watch. He would have woken up the mate.” Among the other problems the authorities uncovered was that the chief mate was found by police to have some blood-alcohol content but he told them he had drunk some beer after the ship had grounded. The chief mate declined to explain what happened in the hour before the grounding. Another problem was that the key had also been left in the bridge-watch alarm, allowing it to be deactivated. The master did not report the accident immediately but waited while he attempted to refloat the ship. However, in doing so he risked serious pollution occurring. The grounding of the Skarpoe is listed in Denmark’s Division for the Investigation of Maritime Accidents (Dima) latest quarterly list of casualty reports. However, one of the most significant accidents has been excluded. There is no mention of the grounding of the fully loaded, 105,000-dwt aframax tanker Minerva Concert (built 2003) while under the control of a Danish pilot and a trainee pilot near the Great Belt bridge in May. The casualty is important because the Danish Maritime Authority (DMA) has been insisting ships use pilots when transiting the area as a safety measure. The ship’s operator says that at the time, only the tanker’s double hull prevented the cargo escaping. An official from Dima says it is conducting a separate probe into the Minerva Concert accident and will publish its findings when it is ready. The investigation unit adds that its works entirely independently from that of the DMA. UK agency uncovers Stena lifeboat mishap Adam Corbett London Another incident involving the unintended release of a lifeboat during a drill has been uncovered by UK maritime investigators. The Maritime Accident Investigation Bureau (Maib) has just released its findings into the incident, which occurred on the 55,000-gt ferry Stena Britannica (built 2002) during a lifeboat-familiarisation drill in August. No one was injured but the probe has led to the UK chief inspector of accidents ordering the ship’s manager, Stena Line, to conduct a full review. The Maib found the collapse was initially caused by the mechanical failure of the electrical motor on the number-one lifeboat during the drill. The lifeboat was left suspended some 2.4 metres above the water. The lifeboat was brought in manually but the final stages of the operation proved difficult and it was decided to replace the damaged motor. When the motor was released, however, the lifeboat fell into the water. The crew were unaware that by removing the motor they also activated the release mechanism for the lifeboat. Stena Line has since come up with an alternative method of retrieving lifeboats and has posted notices on its lifeboats of the dangers of removing the winch motor. The Maib instructed the company to “review the conduct and planning of lifeboat drills” to comply with international and its own requirements. The unexpected release of lifeboats during drills has caused fatal incidents in the past and is part of an industry-wide review. Overly complicated manuals, a lack of training, poor maintenance and the inherent problems of on-load release hooks have been blamed for the high incident count and fatality rate. Six trapped in capsize Cuban crewmen claim mistreatment London A US naval vessel has entered Somali territorial waters in pursuit of pirates who hijacked a Japanese chemical tanker. The guided-missile destroyer USS Arleigh Burke was given the nod by Somalia’s transitional government to enter its waters in an effort to rescue the 11,700dwt Golden Nori (built 1997) and its crew of 23. The vessel was captured off the Yemeni island of Socotra early on Sunday morning and is believed to have been taken to the fishing village of Bereda at the tip of the Horn of Africa. Sources tell TradeWinds that the navy ship is “engaging the pirates” but cannot disclose any specific details of the ongoing operation. The source confirms that the help of US naval forces had been sought by the Japanese owner of the tanker, Dorval Kaiun, as well as the transitional government. The Golden Nori is carrying a cargo of benzene. Eighteen divers attempted to access the accommodation unit of the 1,510-gt general cargoship Omer N (built 1984), which capsized 32 kilomtres (20 miles) off the coast of the island of Falster. A spokesman at the ship’s Istanbulbased operator, San-Mar Shipping, confirms that the chief engineer’s body has been recovered and three crew members rescued by a passing Russian vessel.The latest reports say the body of a woman has also been recovered from the submerged vessel. The ship was carrying ammonium nitrate and carrying out ballast operations when it ran into trouble. Four Cuban crew members have jumped ship in Canada claiming harsh working conditions, as their Greek-owned multipurpose (MPP) ship remains in detention, the Canadian Press reports. The 9,100-dwt Dimitra G (built 1984) is being held in the eastern port of St John, New Brunswick. The seafarers are said to have requested Canadian officials for refugee status. Koumpis Theo, who heads shipowner Galatia’s crewing department, denies there are problems with working conditions on the vessel. He suggest those involved might have made up the complaints “just to make a big story”. DNV in China coatings tie-up Officer’s “silence” in yacht tragedy A P&O ferry officer failed to stop or alert the coast guard after he had struck or swamped a yacht, which led to the deaths of three UK nationals, a court has heard. Sixty two-year-old Michael Hubble, who was in charge of the 38,000-gt Pride of Bilbao (built 1986) cross-Channel ferry at the time, denies three charges of manslaughter and of engaging in conduct as a seaman likely to cause death or serious injury to another. Yachtsmen James Meaby, James Down- China Classification Society (CCS) and Norway’s Det Norske Veritas (DNV) have jointly opened an institute to test coatings intended for seawater ballast tanks. The move is a response to the International Maritime Organisation (IMO)’s Performance Standards for Protective Coatings, which involves the pre-treatment and application of coatings.The institute is located in Fengxian on the outskirts of Shanghai. “The aim is to keep the standards in the hulls good for 15 years,” said a DNV official. Both the 43,800-dwt bulk carrier New Flame (built 1994), grounded off Gibraltar, and 4,277-teu containership MSC Napoli (built 1991), stranded at the entrance to the English Channel, are set to be dismantled using cutting wires. UK Secretary of State Representative (Sosrep) Robin Middleton says work has now begun on preparations to dismantle the remaining stern section of the MSC Napoli, which grounded nearly a year ago. He expects the job to be completed in 2008. Work will begin with the taking apart of the accommodation block and main engine in a few days’ time. The accommodation block will be removed with a cutting wire, which will also be used to carve up the remaining hull section. The final piece of salvage work, set to start in March, will involve the hull section being raised onto a floating barge for removal. Middleton says this should take two weeks but warns it does require “optimum weather conditions”. The salvage job has been awarded to Smit Salvage. Meanwhile, the Gibraltar government has given permission to Greece’s Tsavliris Salvage to start cutting up the New Flame after an initial delay. The ship, which grounded just over two months ago, will be chopped in two using a cutting wire. Following the separation, the plan is to take the vessel to Cammel Laird Gibraltar’s dry dock.
