Declaration on the Principles of Affiliation of Student Organizations
Preamble
It is a natural and undeniable right for all students studying in any curriculum in our
Faculty to associate with their schoolmates pursuing the same curriculum. They
may form student bodies representing their respective interests in relation to their
curriculum.
It is a unanimous consensus of our fellow schoolmates that all the student bodies
serving in our Faculty, disregarding the size of population they represent, are equal in
status, as long as is reasonably possible. Excluding the necessary and fair
supervisory measures, all the student bodies should be allowed to perform their own
function freely with minimal interference from the other student bodies, including the
Medical Society HKUSU (hereafter also as ‘the Medical Society’) itself.
The Medical Society is a sub-organization of the Hong Kong University Students’
Union (hereafter also as ‘the Union’). As a result, the Medical Society is given a
special constitutional status unparalleled by all other student bodies in our Faculty.
All the student bodies in our Faculty are required by the Union to affiliate with the
Medical Society in order to be recognized as an official student organization of the
University. The Medical Society, being the representative body of all the students in
our Faculty, may act upon any issues in relation to the students pursuing any
curriculum of this faculty, without consulting the related affiliated sub-organizations.
This may limit the freedom the student bodies other than the Medical Society are
entitled to, in the pursuit of welfare of their representing parties.
In the autumn of the year Two Thousand and Two, in order to better serve themselves,
nursing students in our Faculty established the Nursing Society. The Nursing
Society applied to the Medical Society for affiliation. In addition, the nursing
students wished that the Nursing Society is equal as the Medical Society, as long as is
possible. With the advancement in medical and life sciences, it is practical and
reasonable to expect an increasing number of student bodies to be established in our
Faculty in the future. It is necessary for the Medical Society to undergo legal
adaptation, so that the equity among student bodies in our Faculty may be maximally
maintained, while the constitutional role of the Medical Society in the supervision of
its affiliated societies may be preserved.
Therefore, the General Meeting of the Medical Society hereby proclaims this
Declaration, prescribing the principle of affiliation of sub-organization, as well as the
system in relation to the practice of these principles; in order to provide the legal basis
for the student bodies in our Faculty to apply for affiliation to the Medical Society, to
limit the power of the Medical Society in the management of these student bodies,
and to ensure that the constitutional responsibility of the Medical Society in the
supervision of these student bodies is fulfilled
PART I
PRELIMINARY
1.
Interpretation of Words and Expressions
In this Declaration, unless the context otherwise requires, –
(a) “Constitution” (憲章) means the Constitution of the Medical Society;
“Council” (評議會) means the Medical Students’ Council of the Medical
Society;
“Executive Committee” (幹事會) means the Executive Committee of the
Medical Society;
“Faculty” (醫學院) means the Faculty of Medicine of the University of
Hong Kong;
“General Meeting” (全民大會) and “General Polling” (全民投票) means
the general meeting and general polling of the Medical Society;
“Medical Society” (醫學會) means the Medical Society HKUSU, which is
an affiliated sub-organization of the Hong Kong University Students’ Union;
“Member” (醫學會會員) means the ordinary member of the Medical
Society, as what its Constitution refers;
“Standing Committee” (常設委員會) means the division (except the
Executive Committee) of the Medical Society dedicated for certain function
as what the Constitution and the Schedule III of this Declaration refers;
“Union” (學生會) means the Hong Kong University Students’ Union.
(b) Words and expressions importing the masculine gender include the feminine
and neuter genders.
(c) Words and expressions in the singular include the plural and words and
expressions in the plural include the singular.

GENERAL PRINCIPLES
Affiliation of Student Organizations
Every student organization in the Faculty has the right to be affiliated with the
Medical Society, as long as such affiliation is legitimate.
The right referred in subsection (1) can be limited only if that student
organization is proved to be unsuitable for affiliation with the Medical Society.
Promise of Equity
Every affiliated sub-organization enjoys a constitutional status equal to that of
the Executive Committee and the standing committees.

Every affiliated sub-organization is allowed to operate independently with
minimal degree of interference, and is responsible only to the Council and the
bodies supervising the Council.

Specialization in Principal Representative Body
The Medical Society represents all the students in the Faculty who are also
member of the Union. Every affiliated sub-organization represents and only
represents all the Members enrolled in its designated curriculum.
Every affiliated sub-organization, once affiliated with the Medical Society, is
appointed to be the principal representative body of all those Members who are
as well as members of the that organization.
Once affiliated with the Medical Society, the Executive Committee cease to be
the principal representative body of the Members referred in subsection (2). It
remains as the principal representative body of those Members who are

unrepresented by any affiliated sub-organization.
The standing committees and the ad hoc committees with the purpose of serving
all the Members shall not be limited by this section.
Restriction to Ultra Vires Conduct
The Executive Committee and the affiliated sub-organizations shall not interfere
in those matters related with the Members already principally represented by
other parties as set out in section 4, unless –
(a) it is explicitly consented by the respective representing party, or;
(b) it is ordered by the Council in the form of resolution.
The Executive Committee and the affiliated sub-organizations may lay a
petition to the Council for any conduct suspected of breaching subsection (1).
In case the petition is proved in the Council to be sustained ipso facto in
accordance to Schedule II, the conduct against which petition was laid shall be
void ab initio.
Principle of Collective Responsibility
The Executive Committee and the affiliated sub-organizations shall bear the
collective responsibility to serve all the Members out of good faith, and shall
safeguard their interest as a whole.
It is the responsibility of the principal representing bodies to cooperate with one
another upon matter simultaneously affecting the Members principally
represented by them, in order to reach a proper settlement.

Rights of Affiliated Sub-organizations
Every affiliated sub-organization is recognized as official student organization
of the University.
Every affiliated sub-organization enjoys independent executive, legislative and
judicial power, and shall practice a high degree of autonomy, in accordance
with the provisions of this Declaration.
Every affiliated sub-organization is entitled to a fair hearing in the General
Meeting, before any change to its status of affiliation is made.
Responsibilities of Affiliated Sub-organizations
The membership of every affiliated sub-organization shall be all of the
Members enrolled in its designated curriculum;
Every affiliated sub-organization shall serve its respective members out of good
faith and shall safeguard their interests;
Every affiliated sub-organization shall be financially independent;
Every affiliated sub-organization shall advice the Council upon matters in
relation to the members it is representing;
Every affiliated sub-organization shall be supervised by the Council. It shall
also abide by the decision of the Council.
Naming of the Affiliated Sub-organizations
The affiliated sub-organizations may choose their own name, as long as the
name reasonably signifies their designated curriculum.
Every affiliated sub-organization shall bear the initials of the Hong Kong
University Students’ Union in its name.
When the affiliation status of the affiliated sub-organization is required to be
expressed, the organization shall bear the initials of the Medical Society in its
name.
Subsection 31(2) shall not apply to this section.
PART III

PROCEDURE FOR AFFILIATION APPLICATION
Submission of Application
Every student organization applying for affiliation shall submit to the Council –
(a) a memorandum detailing its name, nature, purpose, date of establishment,
membership, and the name of its officer-bearers upon application, and;
(b) a copy of the formal decision made by its members upon their wish to get

their organization affiliated with the Medical Society, and;
(c) a copy of its constitution, and;
(d) a copy of its books of account if any, or a statement signed by its
office-bearer in financial matters declaring the financial status of that
organization, and;
(e) a statement signed by an office-bearer of that organization, declaring that
it will be compliant to this Declaration after affiliated with the Medical
Society.
The application for affiliation of student organization shall be submitted to the
Honorary Secretary of the Council.
11.

Consideration of Application
For every application for affiliation, the legitimacy and suitability of affiliation
shall be considered.
(2)
The affiliation of a student organization with the Medical Society is legitimate if
and only if –
(a) the applying student organization serves as a representative body of all
those Members enrolled in certain approved curriculum provided by the
Faculty or by a department of the Faculty, and ;
(b) there is no existing affiliated sub-organization in the Medical Society
representing the same group of Members as the applying student
organization represent.
It is assumed that the affiliation of any student organization with the Medical
Society is suitable, unless it is proved that the applying student organization is –
(a) not financially independent or not sound in financial status, or;
(b) in substantial and unresolved dispute at the time of application, or;
(c) incompatible with this Declaration in any term.
The application for affiliation of every student organization shall be sustained if
the affiliation concerned is both legitimate and suitable in accordance with
subsections (2) and (3).

12. Endorsement of Sustained Application
Every application for affiliation shall be endorsed in a General Meeting once it is
proved to be sustained. The student organization is partially affiliated with the
Medical Society once its application is endorsed.

Partial Affiliation
Every student organization has to be partially affiliated with the Medical

Society for a period before it is duly affiliated with the Medical Society. The
partially affiliated sub-organization shall be considered the same as if it is
already duly affiliated, except that –
(a) the representatives in the Council of that organization is not entitled to
vote in the Council, and;
(b) the representatives of that organization have to attend a defence before its
due affiliation is considered.
In all circumstances, the period of partial affiliation referred in subsection (1)
shall not be less than 1 year and shall not be more than 3 years. This period
shall be recommended by the Council to the General Meeting.
Any endorsement of application for affiliation has to be attached with a period
for partial affiliation, as recommended by the Council.
The list in subsection (2) of Schedule V shall be updated by the Honorary
Secretary of the Council whenever the application for affiliation of a student
organization is endorsed by the General Meeting.

Due Affiliation
Within 1 month before a partial affiliation of an affiliated sub-organization
expires, a General Meeting shall be convened, in order to reconsider the status
of affiliation concerned.
A due affiliation shall be granted to a partially affiliated sub-organization,
provided that it –
(a) is proved to be operating satisfactorily and completely for at least 1 whole
session, and;
(b) has demonstrated its ability to operate independently, and;
(c) has demonstrated that it had served its members out of good faith, and;
(d) has demonstrated that it had safeguarded the interests of their members.
All due affiliation shall be upon an indefinite period.
Subject to section 13(2), one extension of partial affiliation over a certain period
may be granted to a partially affiliated sub-organization, in case it fails to
acquire the due affiliation in accordance with subsection (2).
A partially affiliated sub-organization, when its partial affiliation has already
expired without any extension of partial affiliation or grant to be duly affiliated,
after given the chance of defence in the General Meeting, shall be considered
disaffiliated.
PART IV
EFFECT ON THE MEDICAL SOCIETY AFTER
AFFILIATION OF STUDENT ORGANIZATIONS

Changes in the Principal Representative Body
Once a student organization is affiliated with the Medical Society, –
(a) the Executive Committee shall cease to be the principal representative
body of those Members who are also members of that organization.
(b) that organization shall be authorized to practise high degree of autonomy,
and to be the principal representative body of the Members referred in
paragraph (a), under the supervision of the Council.
(c) The Medical Society may exercise its authority as the representative of the
Members referred in paragraph (a) only after consulting that organization.
The Executive Committee continues to be the principal representative body for
the Members unrepresented by any of the affiliated sub-organization.
For the avoidance of doubt, it is hereby declared that –

the Medical Society remains to be the representative body of all the
students in the Faculty who are also members of the Union.
any change in the principal representative body shall not deprive the
Members any right in the Council, or in any body supervising the Council.
any change in the principal representative body has no effect on the
standing committees and the ad hoc committees with the purpose of
serving all the Members.
Changes to the Council
Every affiliated sub-organization is granted the number of seats in the Council
equal to that possessed by the Executive Committee and the other affiliated
sub-organizations in the Council.
The number of seats referred in subsection (1) shall not be less than 3.
The number of seats in the Council granted to the Executive Committee and
each of the affiliated sub-organizations shall be entered into subsection (1) of
Schedule IV of this Declaration, and shall be amended in accordance with
subsection (6).
The representatives of the affiliated sub-organizations taking seats in the
Council shall be appointed by those organizations among their respective
popularly elected office-bearers.
The list of members of the Council shall be entered into Schedule IV of this
Declaration. The Honorary Secretary of the Council is authorized to update
the list at the beginning of each session.
The number of seats granted to the Executive Committee and the affiliated
sub-organizations may be amended by a motion carried in simple majority in
the General Meeting or General Polling, upon the recommendation of the
Council in accordance with the Constitution.

Changes in the Terms of Reference of the Executive Committee
The Executive Committee continues to be the executive body of the Members
unrepresented by any affiliated sub-organization. The Executive Committee
shall continue to serve these Members out of good faith, as if it had always been
before the affiliation of any student organization.
Any matter not directly related with the Members unrepresented by affiliated
sub-organizations lay outside the terms of reference of the Executive
Committee.
The Executive Committee shall be responsible for the coordination of the
executive bodies of the affiliated sub-organizations upon any matter
simultaneously related with the Members in two or more principal representing
bodies.

Changes in the Election of the Executive Committee
The election of Executive Committee shall open only for the Members
principally represented by the Executive Committee to participate, in
accordance with subsection 15(2).
The Members concurrently holding membership of any one of the affiliated
sub-organization shall not nominate, be nominated, second, and vote in the
election of the Executive Committee.
Advisory Board
In accordance with section 6, there shall be established within the Medical
Society an advisory body to be called the Advisory Board.
The Advisory Board shall consist of –
(a) 3 members to be elected by the Executive Committee from among its own
members of the Executive Committee;
(b) 3 members to be elected by each of the executive bodies of the affiliated
sub-organizations from among their respective members of the executive
bodies;
(c) any number of the other Members not less than 1 and not exceeding the
total number in paragraphs (a) and (b), to be nominated by the Advisory
Board and to be appointed by the Council.
The Advisory Board is a standing consultative organization of the Executive

Committee and executive bodies of the affiliated sub-organizations. It aims at
fostering the cooperation among them, in order to ensure that they work
together to serve all the Members as a whole.
The Chairman of the Advisory Board shall be elected by the members of the
Advisory Board from among the members of the Advisory Board appointed
under paragraph (2)(c).
The Advisory Board shall meet at least once every semester.
Subject to this Declaration and the order of the Council, the Advisory Board
may determine its own procedures at its meetings.
20. Representative of the Medical Society in Union Council
Representative of the Medical Society in Union Council shall be nominated by the
Council from among the members of the Executive Committee and office-bearers of
the affiliated sub-organizations, and shall be appointed by the General Meeting or
General Polling.

FINANCE AND RESOURCES
Financial Settlement upon and after Affiliation
Upon the establishment of the affiliation status, each affiliated sub-organization
is entitled a refund. This refund is equal to the subscriptions collected from the
Members who are also the members of that organization, after the reduction of
an amount equitable to the Medical Society (for the funding of those services
already provided to these Members before that organization was affiliated).
The amount equitable to the Medical Society shall not be less than that the
amount estimated by the following formula:
summation of ‘subscription paid x number of years as a Member before the
affiliation / estimated number of years for completion of curriculum’ for all
members of the affiliated sub-organization concerned
At the beginning of each session, every affiliated sub-organization, on behalf of
its respective members, shall pay to the Medical Society a contributory fund
covering the costs of services provided by the standing committees and the ad
hoc committees with the purpose of serving all the Members to its respective
members in the previous session. Subject to subsection (1) of Schedule V, this
contributory fund shall be the amount calculated by the following formula:

Report) in the standing committees and the ad hoc committees with the purpose

of serving all the Members x total number of members of the affiliated
sub-organization concerned / total number of Members
The Executive Committee reserves the right to levy other payments on the
Members concurrently holding membership of any one of the affiliated
sub-organization in order to cover the cost of the services provided to them.
Membership Fee of Medical Society and its Affiliated Sub-organizations
On the entrance to the Medical Society, the Members shall pay the subscription
to the Medical Society and, as the case requires, to the affiliated
sub-organizations. Medical Society shall collect the above subscriptions paid
by the Members. After reserving an amount equal to the subscription of the
Members to the Medical Society, this sum of collected money shall be credited
to the affiliated sub-organizations respectively as what is due to them.
For those Members who are also member of an affiliated sub-organization, their
subscription to the Medical Society is HKD$1.
No subsequent subscription to the Medical Society is collected from the
members referred in subsection (1) after they have paid the subscription referred
in subsection (2).
23.
Definition of Resources
(1)
For the purpose of this section and sections 24 and 25, “resources” (資源)
means –
(a) the belongings and the properties of the Medical Society, and;
(b) the rights and interests held in the name of the Medical Society, and;
(c) the new resources acquired through the utilization of the resources
referred in paragraphs (a) and (b),
that is in the possession of the Medical Society for the purpose of serving the
Members.
The resources referred in subsection (1) shall be classified as follows:–
(a) Type I resources, defined as all kinds of resources which would be
consumed or devalued in addition to the depreciation upon their use by the
Medical Society. They include but do not only include –
(i) money as a form of petty cash or bank deposit in any currency or
monetary unit, and;
(ii) stocks, including shares, debentures, loan stocks, funds, bonds, notes,
any other securities issued by any registered company, and;
(iii)goods for sale or distribution and other non-durables.
(b) Type II resources, defined as all kinds of resources which would be

retained in intrinsic value upon their use by the Medical Society. They
include but do not only include –
(i) properties of a tangible nature, whether real or personal, or the right of
access to them, and;
(ii) office facilities which are durables, furniture, motor vehicles, computer
equipment and other equipment which are durables, and;
(iii)data, information, records or programs held in a storage medium or
computer, whether or not they are tangible or not, and;
(iv) copyright and its related rights upon production, works or creation.
Type III resources, defined as all kinds of resources which are not type I
or type II resources and are not exchangeable into type I resources in the
market. They include but do not only include –
(i) reputation, status and image, and;
(ii) relationship with other external organizations, and;
(iii)organization system and culture.

Resources of the Medical Society before and after Affiliation
All types of resources referred in subsection 23(1) that belonged to the Medical
Society before the affiliation of any student organization, except the refund
referred in subsection 21(1), shall continue to be owned by the Medical Society.
The Medical Society has –
(a) the right of holding these resources in its custody and control, and;
(b) all the propriety right or interest in these resources.
The acquisition of new resources through the utilization of any of resources
referred in subsection 23(1) shall continue to be conducted in the name of the
Medical Society after the affiliation of any student organization.
All the donations and gifts to the Medical Society after the affiliation of a
student organization shall be assumed to be the shared resources of the Medical
Society and this affiliated sub-organization whenever the beneficiary of such
donations or gifts is not specified by the sponsor or donor.
All the resources jointly acquired by the Executive Committee and the
participating affiliated sub-organization shall be shared among them.
Beneficial Interests of Indirect Members
Subject to subsection (3), the Members concurrently holding membership of any
one of the affiliated sub-organization shall enjoy beneficial interest only upon
the type II and type III resources of the Medical Society –
(a) that had already been owned by the Medical Society before the affiliation

of this sub-organization, and;
(b) that are acquired by the standing committees and the other ad hoc
committees with the purpose of serving all the Members after the
affiliation of this sub-organization.
The Executive Committee shall bear the fiduciary duty for the Members
referred in subsection (1) in order to secure their beneficial interest.
The beneficial interest referred in subsection (1) only means the right of
acquiring utilization from the type II and type III resources referred in
subsection (1), excluding the utilization that would lead to the conversion or
creation of type I resources.

ASSESSMENT OF AFFILIATION STATUS AFTER DUE
Criteria of Assessment
Every affiliated sub-organization shall always be –
(a) bearing its responsibilities in accordance with section 8, and;
(b) just, equitable and reasonable when serving its members, and;
(c) compliant with the other requirement of this Declaration and the decision
of the Council.
For the affiliated sub-organizations without a standing body for self-supervision,
they shall also abide by the other requirements as stated in Schedule I.
Assessment
Every affiliated sub-organization is required to –
(a) submit its year plan and year budget to the Council within the first 6
weeks of their every session for adoption, and;
(b) submit a half-year working report to the Council on its work done upon
the first half of their session, within 6 weeks after the first half of their
session has expired for adoption, and;
(c) submit its annual report and annual financial report to the Council on its
work done in the previous session, within the first 6 weeks of their every
session for adoption, and;
(d) submit a report to the Council for adoption, on an issue designated by the
Council in related with it, and;
(e) invite a member of the Council without conflict of interest to act as the
returning officer of the Council, and to attend its general assembly or

referendum for all members, and;
(f) report to the Council for adoption, upon the conclusion of its general
assembly or referendum for all members, on the resolution its members
have made.
Any affiliated sub-organization incompliant with the requirement in subsection
(1) shall be considered as infringing this Declaration.
For the purpose of the paragraphs in subsection (1) except (1)(e), –
(a) an adoption shall not be granted by the Council only if the paper
concerned contravenes section 26. Any affiliated sub-organization failed
in getting the paper concerned for adoption is considered failed in
assessment;
(b) an adoption shall be granted if the paper concerned has already been
assessed by one standing self-supervisory body of the affiliated
sub-organization referred in subsection (3) of Schedule I, unless a
miscarriage of justice of this body is noted by the Council during the
assessment of the paper concerned.

Reconsideration by the Council
Every affiliated sub-organization shall re-submit the paper referred in
subsection 26(3) within 4 weeks after the failure of assessment, for the
reconsideration of the Council.
When reconsidering the paper referred in subsection (1), an adoption shall not
be granted by the Council only if it contravenes section 26.
Disaffiliation
If and only if the Council notes that an affiliated sub-organization has
repeatedly –
(a) infringe this Declaration, or;
(b) failed in assessment, even after reconsiderations,
the Council may recommend disaffiliation of that organization to the General
Meeting.
A General Meeting shall be convened, upon the recommendation of the Council,
for the consideration of disaffiliation of an affiliated sub-organization. In the
General Meeting held for this purpose, a defence from that organization shall be
allowed.
A motion requesting to the disaffiliation of an affiliated sub-organization shall
be carried only by more than one-half of the Members present going for it.
30. Right to Defend in General Meeting before Disaffiliation
For the purpose of sections 12, 13, 14 and 29, a decision made by General Polling
upon any change in the status of affiliation is void.
PART VII
INTERPRETATION AND AMENDMENT

Interpretation
The power of interpretation of this Declaration shall be vested upon the Council.
Save where expressly provided to the contrary in this Declaration, whenever
there is any conflict or variance between the English and the Chinese version
during interpretation of this Declaration, the English version shall prevail.

Amendment
(1)
The power of amendment of this Declaration shall be vested upon the General
Meeting and General Polling.
The power to propose bills of amendment to this Declaration shall be vested
upon the Council.
Before the bill of amendment referred in subsection (2) is proposed by the
Council, every affiliated sub-organization shall be first consulted.
A motion requesting the adoption of the bill of amendment referred in
subsection (3), unless for the amendment of subsection 21(3) or subsection (1)
of Schedule IV, shall be carried only if –
(a) more than one tenth of the Members principally represented by affiliated
sub-organization going for it, and;
(b) more than one tenth of the Members unrepresented by any affiliated
sub-organization going for it.
For the avoidance of doubt, it is hereby declared that –
(a) the voting method as set out in the Constitution is not applicable for the
purpose of amendment of this Declaration;
(b) the list of members of the Council in Schedule IV may be updated by the
Honorary Secretary, in accordance with subsection 16(5);
(c) the subsection (1) of Schedule IV may be amended in accordance with
subsection 16(6);
(d) subsection 21(3) may be amended in accordance with subsection 21(4);
(e) the list of standing committees of the Medical Society in Schedule III may
be updated by the Honorary Secretary, in accordance with subsection (3)
of Schedule III.

the list of affiliated sub-organizations of the Medical Society in Schedule
V may be updated by the Honorary Secretary, in accordance with 13(3).
Status and Procedural Entrenchment
This Declaration enjoys the legal status equal to the Constitution. It shall be
regarded as a complementary document to the Constitution.
In order to maintain the constitutional superiority of this Declaration, any bill of
amendment with the effect of changing the voting method referred in subsection
32(4) shall be first adopted by the Union Council.
Schedule I
Assessment of Affiliated Sub-organization without a
Standing Self-supervisory Body
[section 26, 27]
(1) An affiliated sub-organization shall be under the direct supervision of the
Council if there is no self-supervisory body recognized by the Council.
(2) A direct supervision referred in subsection (1) means that all the papers referred
in all of the paragraphs in subsection 27(1) except 27(1)(e) shall be scrutinized
by the Council, in the same manner as if they are submitted by the Executive
Committee, a standing committee or an ad hoc committee, in addition to the
requirement set out in section 26.
(3) The self-supervisory body referred in subsection (1) shall be
(a) a standing internal body of the affiliated sub-organization, and;
(b) independent from the executive body of the affiliated sub-organization
when making decisions, and;
(c)
(d)
pursuing the natural justice, i.e., it shall hear all the parties and allows the
directly involved parties to defend before making final decisions, and;
in operation for at least three consecutive years, in accordance with
paragraphs (a), (b) and (c).
Schedule II
Handling of Petitions
[section 5]
(1) The objective of the Council in handling petitions referred in subsection 5(2) is
to –
(a) ensure the parties involved be given the chance of defence in the Council
or a judicial committee of the Council dedicated to the case, and;
(b) ensure the evidence submitted by the parties involved is true and
complete;
(c) rule that the petition is sustained or not, based on the evidence referred in
paragraph (b).
(2) The petitions referred in subsection 5(2) shall be heard, handled and adjudicated
in the Council or a judicial committee of the Council dedicated for the case in
the presence of a returning officer from the Union Council.
(3) The members of the Council directly involved in the petition is not be entitled to
vote in any matter in relation to the petition.
(4) When the Council needs to make a ruling in accordance to paragraph (1)(c), if a
unanimous consent cannot be reached, the case shall be ruled in the Union
Council.
(5) The ruling made by the Union Council upon the question that whether the
petition in referred in subsection 5(2) is sustained or not shall be final. This
ruling shall have binding effect to the General Meeting and the General Polling.
Schedule III
List of the Standing Committees of the Medical Society
[section 1]
(1) Only those divisions of the Medical Society dedicated for certain function
(except the Executive Committee) as what the Constitution refers shall be
entered in the list of this Schedule.
(2) The divisions of the Medical Society listed below shall be asterisked if they
serve all the Members as the Constitution refers.
(3) The list in this Schedule shall be updated by the Honorary Secretary of the
Council whenever there is any change in the divisions of the Medical Society.

The maximum amount of contributory fund payable by each affiliated
sub-organization within the first five years of establishment shall be the
percentage of the annual income of the affiliated sub-organization concerned as
stated in the third column in subsection (2). There shall be no restriction upon
the maximum amount of contributory fund after the first five years of
establishment of the affiliated sub-organization.
