Well it’s been a while since my last column
and there’s something we can all be grateful
for. So I guess it’s only fitting that I start out
with - Happy New Year!! What does the start
of a new year mean to you? I like to wish
people a happy new year so here are a few
wishes for all of you:
• May your hair, your teeth, your
face-lift, your abs and your stocks

• May you get a clean bill of health from your dentist, your cardiologist, your gastroenterologist, your urologist, your proctologist, your podiatrist, your psychiatrist, your plumber and the

• May you remember to say, “I love you” at least once a day to
your spouse, your child, your parent, and your siblings, but not
to your secretary, your nurse, your masseuse, your boss or your
trainer.
But seriously, I hope you will have many blessings this year and
remember, a new year is like a blank book and the pen is in your hands.
Write a fantastic story for yourself.
The holidays are over and now we are looking forward to spring.
We’ve been fortunate throughout most of Indiana with a mild winter.
That’s good for all of our budgets.

Spring is a time for new beginnings. What does it mean to you?
Spring cleaning – that can wait. Spring Break – you’re either on one
now or getting ready. Spring Training – for all the baseball fans. Longer
days or more daylight – time to do something after you get home from
work. Enjoying time with friends, outside, and wearing shorts.
Spring also means the end of the latest session with our beloved
General Assembly. I’ll leave it at that! No I won’t, they say the farmers
in Indiana are quaking in their boots when the General Assembly is in
session. I guess we all know why. Speaking of farming, can you believe
this year’s crop of Presidential candidates? WOW!!
Spring also means it’s time for the IASBO Annual Meeting. This
year’s meeting is in French Lick on May 11, 12 & 13. You’ll want to
make your hotel reservations now. Hotels are already full or filling up
quickly. There will be many outstanding professional development opportunities for you to enjoy. Please see the Annual Meeting Agenda in
this edition of the InterCom. Hope to see you there.
If you’re going away for Spring Break, have a fantastic time and safe
travels.

The 2016 session of the Indiana
General Assembly concluded on
the night of March 10 with time to
spare and no gun to their head. The
session started off in early January
with three main issues: road funding, ISTEP scores, and religious
freedom/civil rights (LGBT) issues.
The ISTEP situation of holding
school corporations, schools and
teachers harmless because of inaccurate test scores moved through
the General Assembly quickly. Two
bills, SB 200 and HB 1003, were
signed by the Governor in January.
The road funding bill (HB 1001)
was decided on the next to last
day of the session with no new tax
increases. The elephant in the room
(LGBT) was heard in the Senate,
but no final vote was taken. This issue will be a focus in the upcoming
Governor’s election.
For Indiana ASBO, we focused
on protected taxes/circuit breaker
waivers, Dark Sales assessment,
referendum ballot language, CPF
for utilities and property insurance
expiration date change, farm land
assessed valuation, voucher expansion, and local government budgeting. When the smoke cleared on
March 10, IASBO was successful
on many fronts. One very positive outcome was the deletion of
the non-binding budget review by
county fiscal bodies. The following is a summary of several bills
that IASBO followed during the
2016 session:
SB 93, Various education matters
• Provides that every public
school building shall be supplied with safe, potable water
as approved by the Commis-

Environmental Management
Adds 12 months to the time
the financial specialist appointed for the Gary Community School Corporation may
perform the duties authorized
under the statute.
Provides for staggered terms
for the members of the East
Chicago school board.
If a school corporation does
not pay FICA taxes within
30 days of the due date, the
school business official or
financial officer shall report
the failure to pay the taxes to
the school board. The school
board shall report at the next
school board meeting on the
failure to pay taxes.
Adds an additional measure
by which the depth perception
of a school bus driver may be
determined.
Asks for a study committee
related to the establishment
of special education choice
scholarship (vouchers) accounts.
Provides that the DOE may
revoke a certificate of completion of a school bus driver
safety education due to a
misdemeanor or infraction
that endangers the safety of a
student.
SB 96, Curricular materials
• A school corporation may
issue notes to buy curricular
materials (including devices)
maturing in four years (current
law is three years).
SB 147, School emergency
response systems
• The Department of Homeland Security shall establish
and maintain guidelines for
emergency response systems
(systems designed to improve
technology and infrastructure
on school property).
SB 279, Referendum tax levy
ballot language
• 500 owners of property (rather
than 100) or 5% of the registered voters residing within
a school corporation (current law) may sign a petition
requesting a building project
referendum.
• The question for the extension of a referendum operating levy can now include that
the original referendum was
previously approved by the
voters. The tax rate may not
exceed the current referendum
tax rate to use this new provision. Therefore, the voters will
know they are not voting for
an additional levy.
SB 308, Property tax matters
• Revises the agricultural land
assessment rate. Without
this revision, the farm land
assessed valuation will not
increase substantially in 2017
or 2018. The AV will decline
in 2019. This issue will be
reviewed in the next two sessions of the General Assembly.
SB 321, Local government
budgeting
• After the 2018 budget year,
the DLGF shall certify a

school corporation’s budget,
tax rate and tax levy not later
than December 31.
• After 2017, the county auditor shall provide before June 1
an initial estimate of assessed
valuation to school corporations.
• After 2017, the DLGF shall
before July 15 shall provide
an estimate of the maximum
property tax levies and the impact of circuit breaker credits
on the tax levies.
• Repeals the statutes concerning county fiscal body
nonbinding review of local
budgets, tax levies and tax
rates. The county fiscal body
is required to hold a public
meeting regarding the estimated levy limits provided by
the DLGF and the estimated
circuit breaker impact on taxing units. After the meeting,
the county fiscal body may
prepare and distribute a written recommendation for the
taxing units in the county.
HB 1001, Road Funding
• The road funding bill was
amended at the end of the session to include a $10 million
state appropriation for teacher
scholarships (HB 1002).
• HB 1161, pension 13th check,
appropriation was added to
HB 1001. This is a $29 million appropriation.
HB 1005, Various education
matters
• SB 334 language was added
to HB 1005. This includes the
voucher eligibility expansion
for second semester students.
Also, new procedures for
background checks regarding
sexual misconduct. Further, a
second count date for special
education students will begin
in 2017 for informational purposes only.
• Adds the following new
language to IC 20-28-9-1.5, a
school corporation may provide a supplemental payment
to a teacher in excess of the
salary specified in the school
corporation’s compensation
plan if the teacher “teaches an
advanced placement course
or” has earned a master’s
degree from an accredited
postsecondary educational
institution…
HB 1109, School funding and
performance grants
• Extends the waiver for protected taxes to 2018.
• The waiver qualification
continues to by a loss of 10%
in total circuit breaker credits.
Currently, 90 corporations
qualify at 10%.
• Creates new requirements to
receive the waiver. If a corporation in 2017 or 2018 issues
new bonds or enters into a
new lease rental agreement
imposing a debt service levy
(excluding refinancing or a
successful referendum) AND
the total debt service levy in
2017 or 2018 is greater than
the 2016 debt service levy,
then the corporation is not
eligible for the waiver. This
does not include increases in
Common School Loans, tax
anticipation warrants interest
and loans from banks.
• The date to use CPF monies
for utilities and property insurance was extended to January
1, 2018.
• Before April 1 of each year,
each school corporation shall
provide the DOE with an estimate of the next year’s ADM.
• The performance grant calculation is revised for 2017.
HB 1290, Assessment of real
property
• Deletes the statute passed last
year regarding the big box
retail buildings.
• The DLGF shall provide for
the classification of improvements on the basis of market
segmentation. This process
does not utilize empty buildings in the assessment process
and eliminates the Dark Stores
or Big Box Store issue. Market segmentation uses similar
sub groups to determine the
assessment amount (large
retail stores with groceries
would be compared with like
stores).
HB 1372, Public personnel bonds
• Original bill stated that
anyone who handles $100 or
more would need to be bonded. IASBO asked that amount
be increased to $5.000 which
was approved.
IASBO’s legislative resolutions
were met with HB 1109 (protected
taxes), HB 1290 (Dark Sales assessment alleviated), HB 1109 (CPF
date extension), SB 321 (budgeting
advertising), SB 321 (non-binding
county council budget review),
and SB 279 (operating referendum
question).
Now, we will begin to prepare for
the 2017 long session of the General
Assembly when a new state budget
will be created. The fun never ends.

An in-depth look at school governance and the interactions between
various school corporation departments will be the focus of the course.
Governance topics will include: the legal powers of the state vs. the local
school board; board policy vs. administrative procedures, and legal and
interpersonal relationships between school board members, the
superintendent, the staff, and the public. The course will also explore
the formal and informal interactions that exist between the administrative
and operational offices within a school corporation (school principal,
business office, personnel office, transportation, school nutrition
program, buildings and grounds, and the technology department).

ANNUAL MEETING SCHOLARSHIP PROGRAM
The Indiana ASBO Foundation Board of Directors have created a scholarship program for
the IASBO Annual Meeting. A total of 15 scholarships worth $500 each will be awarded.
To apply for the scholarship, an individual must be an IASBO member and never attended
an IASBO Annual Meeting. Further, the applicant had to write a brief description why they
should be awarded the scholarship. Over 15 applications were received, so the Annual Meeting Scholarship Committee determined that the following individuals will be the recipients
for 2016:

 Internal Control Standards: School Corporations Over 2,000 ADM
Indiana statute states that the State Board of Accounts shall define the acceptable minimum level of
internal control standards for school corporations. The standards shall include the following: (1) Control
Environment; (2) Risk Assessment; (3) Control Activities; (4) Information and Communication;
(5) Monitoring. After June 30, 2016, the school board of each school corporation must define minimum
internal control standards as defined by the State Board of Accounts. This session will present the various
aspects of the internal control standards and their implementation. Since this issue impacts school
corporations differently based on the size of the office staff, this particular workshop will speak to
corporations with over 2,000 students.
 Retaining/Recruiting Certified & Non-Certified Employees: Competitive &
Sustainable Solutions
One of the most serious issues facing our public schools is the recruitment and retention of excellent
teachers and classified staff. There is no single “magic bullet” that will solve the problem, but the
workshop will review various approaches to deal with this issue. This session will focus on the successes of
several school corporations in finding competitive and sustainable solutions. Techniques used for
recruiting and retaining teachers, school bus drivers, food service employees, custodians, etc. will
presented at this session. The use of technology and social media will be presented and demonstrated
during the workshop.
 Employee Handbooks: A Complete Review
This session will focus on: (1) handbook policies that are legally essential for school corporations; (2) how
to structure your reduction in force policy applicable to your teachers in light of the Madison Consolidated
decision; and (3) pitfalls and mistakes to avoid when developing and implementing handbooks.
Certification Courses
 Accrual Accounting (A114)
The course will compare and contrast cash and accrual accounting and explore strengths and weaknesses
in each method. Students will learn to read, understand, and explain the difference between Income
Statements and Balance Statements prepared under the accrual-basis vs. the same types of reports
prepared under the cash-basis accounting. Students will discover why the terms Owner’s Equity, Retained
Earnings, Profit, Prepaid Expenses, Accounts Receivable, Accounts Payable, Capital, Net Fixed Assets and
the relationship between Assets, Liabilities and Owner’s Equity are important to the businesses who use

accrual accounting. Students will learn how revenue and expenditures are recorded in accrual-based
accounting vs. cash-basis accounting and the importance of recognizing the value of fixed assets and real
property. This course will help participants to be able to communicate with various organizations such as
the community, the school board, and Chamber of Commerce.
 Collective Bargaining Strategy & Law (HR114)
The course will review Indiana law associated with collective bargaining, the role of IEERB and its rules and
procedures, collaborative bargaining, mediation, fact-finding, strike plans, bargaining strategy, grievance
procedures, and current issues. In addition, the goal of the course will be to review Indiana law and court
cases regarding bargaining and/or meet-and-confer agreements related to classified staff. Participants will
learn which employees are covered by rights under the law, and the appropriate employment and
dismissal procedures. The course will demonstrate how to appropriately structure employee handbooks,
job descriptions and letters of employment. Fair Labor Standards and unemployment rules and
regulations will be studied.

Database and network infrastructure breaches continue to threaten all organizations, while at the same
time school information technology systems are increasing in number and scope. This session will arm
school officials with the best and latest information available on how to protect your student and staff
data, control access to your school's network and systems, and maintain compliance with the myriad laws
