A hand-written outline on a Don Hall’s Restaurant napkin
on September 9, 1999, was the beginning of a business known as
Nierman Brothers Pools and Spas. The napkin hangs in a frame
on a wall as a reminder of the famous day when all three
brothers decided to go into business together.
Gary Nierman, the oldest brother, started working after high
school for a local pool company and he continued to work there
until the inception of Nierman Brothers. Lee Nierman, the
youngest brother, worked with concrete at a construction
company and joined Gary at the pool company, approximately
18 years later. After many years of working together, Lee had
the idea for the three brothers to join forces and start their own business constructing in-ground
concrete pools. When approached by Lee and Gary, Duane Nierman, the middle brother, agreed to
join them, and he sold his flooring store in Columbia City, to complete the trio.
At the beginning of their business, all three brothers were active in the construction projects. Lee,
along with Carl Walker, did the sales calls for the pools they built. Duane concentrated on business,
new builds, tiling, and remodel projects. Gary has continued to be a genius placing and plumbing all
the new pool equipment and automation. Gary’s son, Jason, leads the pool construction as Crew
Supervisor.
They have enjoyed building various shapes and sizes of pools. One of the most recent designs was an
8’ spa spilling over into the ball diamond, then spilling over into the outfield (spa & pool with an
endless edge basin), complete with fire and water pits, swim-up bar, and in-pool bar stools. In 2014,
Nierman Brothers, Inc. was inducted into the Master Pool Guild, an elite group by invitation only, and
became the first company to be inducted and win awards for excellence in the same year.

Approaching your Business & Partnerships Utilizing Seven Habits
We all strive for personal leadership and we have the freedom to choose our habits for
success. When you visualize your action plan it allows you to organize and execute
your priorities to allow you to plan effectively. Most importantly to finalize selfmanagement be sure to be open to communications, always listen and seek to
understand.
Habit 1: Be proactive: Are you taking the right actions to make this the cornerstone for your success? Do you ask the right
questions for planning and delivery not only in application processes but in materials and supplies? Are you setting Calendar
reminders for yourself to make sure you are giving adequate information to the proper individuals so they can be doing their
part for YOU in a timely manner?
Habit 2: Begin with the end in mind: Everyone gets caught up in the day to day operations so it is crucial to have a clear
visual path from project inception through completion. Most importantly what is the KEY goal that you want to accomplish?
Habit 3: Put first things first: Knowing how to classify your tasks are and priorities are key to success. Be sure to keep
balance in all areas in order to thrive and not be stagnate. If you’re focusing in quadrant 2 the majority of the time this
means you may be managing your schedule well!

2. Important but not Urgent-phone calls, maintenance, reading
3. Urgent but not Important-text messages, interruptions from others
4. Not urgent or Important-learning, relationship building
Habit 4: Think Win-Win: A positive attitude reaps positive results in all aspects. What you put out comes back to you 10
times fold!
Habit 5: Seek first to understand, then to be understood: There is a difference between hearing and listening. Allow
individuals to fully communicate their point of view then ask in your own words if you understood them correctly to make
sure you’re both on the same page. Always make sure to put yourself in the other person’s shoes worldview approach.
Habit 6: Synergize: Open yourself up to working with others. Teamwork is the best to get you emotionally charged up and
optimistic. It is amazing what working with a team how much you can accomplish. We work with multiple people every day
yet we try to take on the world by ourselves sometimes. Remember we have a whole team here at the HBA to work with!
Habit 7: Sharpen the pencil: Rejuvenate yourself for if you don’t take care of you how can you take care of your business?
• Body: Exercise for a sense of well-being.
• Mind: Exercise to sharpen the intellectual abilities.
• Spirit: Exercise with meditations and inner reflections.
• Heart: Exercise care for important relationships.

For May I have included the lock-out policy and the standard operating procedures I have
directed the staff to follow. This is probably more important to those on the remodeling
side as opposed to new construction. I have encouraged inspectors to use their County
issued phones on some easily resolved issues to prevent a failed inspection where it is
feasible. My goal is to increase customer service while still maintaining a high inspection
volume.
I have staff working weekends right now to alleviate the backlog in online permitting. This week I met with County IT staff to
have them modify certain permits to be “instant permits.” Through automation, certain permits such as stand-alone roofing,
siding, egress windows, water heater replacement, furnace replacements, etc. can be obtained online without any wait. This
means staff will not have to manually process each permit like they do currently. My goal is to have this in place June 1 st. I
will be updating the HBA office on my progress so they can spread the word once this happens.
I am hiring a residential inspector to replace Doug Krause, who has returned to the private sector with a local builder. ACBD
wishes him the best in this endeavor. I will give the HBA a name and photo of the new inspector once the position is filled.
Finally, I want to thank the HBA for sponsoring the 1st Annual Birdhouse Build on May 11th. I hope by doing this event, kids
see what FWCS offers for career training in construction and consider going into the building trades in the future. I agree that
kids need exposure to different careers at an early age. I hope the volunteers from the HBA have lots of fun on this day also.
Trip Charge/Lock-Out Policy
With the record high volume of 47,844 inspections in 2016, the Building Department strives to
improve efficiency without increasing staff size or permit fees. In order to meet this goal, we cannot
continue the practice of offering an additional inspection at no charge when an inspector does not
have access to a job site. If there is a lock box code or special instructions for entry, that information
must be submitted with each permit application regardless of the trade. Building Department Staff
unable to perform the inspection due to being unable to access the jobsite will leave a card indicating
they were locked out and unable to inspect. It is the responsibility of the permit holder to reschedule
the inspection, as the current inspection will be resulted as “locked out.” Occupied, private residences
must have a representative present over 18 years of age if the inspection is required on the interior of the occupied
residence per ACBD policy. Lock out re-inspection fee shall be $40.00 per occurrence starting with the first lock out.
Standard Operating Procedure: Lock Out Procedure
Inspectors: As stated in the lock-out policy above, inspectors unable to complete an inspection due to no lock box code, no
access to inspection area, inaccessible without special equipment (ladder, lift etc.) will result the inspection as “lock-out.”
The red door hanger shall be left with the inspector’s number affixed. The inspector should exhaust any reasonable means of
conducting the inspection. For example, phones are provided to inspectors and if a simple phone call can prevent another
trip, then it should be utilized. If a trip charge is desired, the inspector shall notify the senior inspector, explaining the
circumstances of the lockout. It is understood that the majority of the time this occurs with “selfer” permits and when it is an
occupied residence. It is the responsibility of the homeowner on a stand-alone permit to contact the inspector to arrange a
time for the inspector to return. Contractors are responsible when it is imperative for one inspection to be completed before
additional inspections can be completed. (i.e. remodels) Refusal of the owner to allow entry shall not result in a trip charge
to a contractor. The inspector shall arrange any return trips with the permit holder via telephone or e-mail. The front counter
will not schedule these inspections.

HIGH STORAGE LEVELS, LOW OIL PRICES
After almost reaching $55 per barrel (bbl), oil prices are again falling. What makes this decline particularly baffling
is that in late 2016, after seeing prices languish for two years, the Organization of Oil Producing Countries (OPEC)
announced that it, along with non-OPEC members such as Russia, would collectively reduce production by 1.8
million bbl/day, or 2% of global supply, starting January 1st. Many observers thought that removing that much
supply would stop inventory growth and put upward pressure on prices. After the decision to curtail pumping was
announced, oil prices, as expected, quickly jumped from about $43/bbl to close to $55/bbl. Recently, however, oil
prices have again started falling. The question is why, and is this decline more likely to be temporary or
permanent?
There are four main reasons why oil prices are again declining. Firstly, the decision to cut global production set off
a flurry of buying by hedge funds, which pushed up prices. However, the rise in prices also encouraged American
shale producers to ramp up drilling and production. To wit, the number of oil rigs in operation has more than
doubled in the past 12 months. Since OPEC announced that production cuts were coming, US production has
increased by almost 500,000 bbl/day. Moreover, the number of wells that are drilled but uncompleted (DUCs) has
risen from 1,250 to 1,750. As oil prices recover, DUCs, which can be quickly completed, are likely to flood the
market with yet more supply.
Second, several OPEC nations, including Iran, Libya, and Nigeria, were, for any number of reasons, not asked to cut
production and have instead all increased production dramatically. Further complicating matters is that many of
the nations that have been called upon to make cuts do not have a great history of compliance. In addition,
Canada and other non-OPEC nations that are in no way involved with OPEC are also increasing production.
The third factor is that in the months leading up to January 1, 2017, when the above-mentioned production cuts
were to commence, most OPEC nations sharply raised production levels and exports to maximize short-term
revenues. And, after weeks of transatlantic travel, this oil is now finally reaching US shores.
The final factor is the shape of the curve of futures prices, which is closely related to inventory levels. Inventory
levels continue to rise and are now at a record 540 million barrels. With inventories so large, near-term prices for
oil are lower than long-term prices, a relatively infrequent situation known as a contango. When the contango is
sufficiently large, such that storage costs are less than the long-term price of oil minus the short-term price, which
is currently the case, investors and speculators buy oil and store it. In the process, the near-term price of oil is
driven lower still.
To break this cycle, OPEC will have to convince markets that inventories will soon decline and thereby raise nearterm prices. The best way to do this would be to promise to extend the current production cuts that are set to
expire on June 30th and perhaps promise additional production cuts. The only problem is that as prices rise in
response those actions, American shale drillers will drill more wells and the cycle will continue.

The Allen County Building Department in conjunction with the Home Builders Association
and FWCS is hosting the 1st Annual Birdhouse Build Event on May 11, 2017. It is important
for a growing community such as the one we live in to have young people interested in
entering the construction industry. Through this event, we will introduce students to a
simple hands-on project as well as show off a great new FWCS facility for building trades.
Volunteers from the HBA, Allen County Building Department, and FWCS Building Trade
students will assist a 4th grade class from Forest Park Elementary with the project.
