WESTERN LANDS (AMENDMENT)
ACT.
Act No. 19, 1937.
An Act to amend the Western Lands Act of 190 L,
• and the Wild Dog Destruction Act, 1921,
and certain other Acts in certain respects;
to validate certain matters; and for purposes connected therewith. [Assented to,
8th December, 1937.]

E it enacted by the King's Most Excellent Majesty,
by and with the advice and consent of the Legislative Council and Legislative Assembly of New South
Wales in Parliament assembled, and by the authority of
the same, as follows :—
1 . (1) This Act may be cited as the "Western Lands
(Amendment) Act, 1937."

(2) T h e W e s t e r n L a n d s Act of 1901, as a m e n d e d
b y subsequent A c t s , is in this Act r e f e r r e d to as the
P r i n c i p a l Act.
2 . T h e P r i n c i p a l A c t is a m e n d e d —
(a) by omitting from section twelve the w o r d s " h i m
or t h e m " a n d by i n s e r t i n g in lieu thereof t h e
w o r d s " t h e Minister, the Commissioner o r a
chairman'';
(b) (i) by o m i t t i n g from section 17A t h e w o r d
" G o v e r n o r " w h e r e v e r occurring a n d by
i n s e r t i n g in lieu thereof the w o r d " M i n i s ­
ter";
(ii) by o m i t t i n g from the same section the w o r d
" e i g h t y " a n d by i n s e r t i n g in lieu thereof
the w o r d s ' ' two h u n d r e d " ;
(c) by o m i t t i n g the proviso to section eighteen a n d
by i n s e r t i n g in lieu thereof the following
words:—
W h e n e v e r in p u r s u a n c e of the provisions of
this Act a n y holding or a n y r i g h t , title or i n t e r e s t
to or in a n y land, becomes liable to be forfeited,
such forfeiture m a y be declared by the M i n i s t e r
by notification in the Gazette.
W h e n e v e r in a n y i n s t r u m e n t of lease in force
a t the commencement of the W e s t e r n L a n d s
( A m e n d m e n t ) Act, 1937, or issued after such
. commencement, it is p r o v i d e d t h a t a n y lease
m a y be cancelled or cancelled a n d forfeited or
declared to have lapsed, such cancellation or
cancellation a n d forfeiture or l a p s i n g m a y be
declared by the Minister by notification in the
Gazette.
No forfeiture, cancellation or l a p s i n g shall
o p e r a t e to extinguish a n y debt to the Crown.

The Minister may, on the r e c o m m e n d a t i o n of
the Commissioner, waive or reverse, w h e t h e r
provisionally or otherwise, a n d on such con­
ditions as he m a y think fit, a n y such forfeiture,
cancellation, or lapsing. A n y r e v e r s a l shall be
notified in the Gazette.
(d)
(d) by o m i t t i n g from section 18c the w o r d s " a n d
such d e t e r m i n a t i o n shall in all cases be final a n d
c o n c l u s i v e " a n d by i n s e r t i n g in lieu thereof the
w o r d s " T h e provisions of subsection six of sec­
tion nine of this Act shall extend to a p p e a l s a n d
references to t h e L a n d a n d V a l u a t i o n C o u r t in
r e s p e c t of a n y such d e t e r m i n a t i o n a n d to the
r e t u r n of a n y such d e t e r m i n a t i o n to the local
land b o a r d . "
(e) (i) b y o m i t t i n g from subsection two of section
18G the w o r d s " t h e Minister shall n o t give
such consent unless the application for h i s
consent is accompanied b y " a n d by insert­
ing in lieu thereof the w o r d s " n o t r a n s f e r
(except a t r a n s f e r by w a y of d i s c h a r g e of
m o r t g a g e ) , conveyance, a s s i g n m e n t or m o r t ­
gage of, o r o t h e r such dealing with, a lease
applied for after the commencement of t h e
W e s t e r n L a n d s ( A m e n d m e n t ) Act, 1934,
or of a n y p o r t i o n thereof, shall be effected
unless or u n t i l " ;
(ii) b y i n s e r t i n g in the same subsection after tho
w o r d s " s u c h v a l u e " the w o r d s " i s lodged
with the C o m m i s s i o n e r " ;
(Ml) by o m i t t i n g f r o m the same subsection t h e
w o r d s " a p p l i c a t i o n for such consent m a y
be dealt with w i t h o u t recourse to this sub­
s e c t i o n " a n d by i n s e r t i n g in lieu thereof
t h e w o r d s " t r a n s f e r , conveyance, assign­
m e n t , m o r t g a g e or o t h e r d e a l i n g m a y be
effected w i t h o u t l o d g m e n t of such certifi­
cate";
(iv) b y i n s e r t i n g in subsection five of the s a m e
section a f t e r the w o r d " A c t " w h e r e firstly
o c c u r r i n g the w o r d s " O r of a n y holding into
which a n y such lease h a s been, or m a y be,
converted";
(v) b y i n s e r t i n g in the same subsection a f t e r
t h e w o r d " g r a n t e d " the w o r d s " o r con­
firmed a s the case m a y b e " ;
(f)
(f) (i) b y o m i t t i n g from subsection two of section
28B the w o r d s " a n d to holdings c o n v e r t e d " ;
(ii) b y i n s e r t i n g a t the end of subsection four
of the same section the following w o r d s : —
T h e r e n t of a homestead f a r m into which
a n y p o r t i o n of a lease u n d e r the W e s t e r n
L a n d s Acts h a s been converted shall be two
a n d one half p e r centum of the capital value
as d e t e r m i n e d by the local l a n d b o a r d .
The r e n t of a n y such conditional lease or
h o m e s t e a d f a r m shall be p a y a b l e a n n u a l l y
in advance on t h e r e c u r r i n g d a t e of the com­
mencement of title t h e r e t o .
T h e provision contained in subsection t w o
of section 19c allowing the holder of a lease
in lieu of p a y i n g r e n t to expend a s u m n o t
less t h a n the r e n t in effecting on the l a n d
i m p r o v e m e n t s of a p e r m a n e n t , fixed a n d
s u b s t a n t i a l c h a r a c t e r shall not be applicable
to a h o m e s t e a d f a r m into which a n y p o r t i o n
of the lease h a s been converted in a n y case
where the lease h a d been in existence for
five y e a r s , a n d w h e r e t h e lease h a d been in
existence for less t h a n five y e a r s the p r o v i ­
sion hereinbefore r e f e r r e d to shall cease to
be applicable to the h o m e s t e a d f a r m upon
the e x p i r a t i o n of five y e a r s after the com­
mencement of the lease.
(iii) b y omitting subsection seven of the same
section a n d by i n s e r t i n g in lieu thereof the

(10) A reference in a n y of the provisions
of the Crown L a n d s Consolidation Act, 1913,
as a m e n d e d by subsequent Acts, e n u m e r a t e d
in subsection seven, subsection eight or
subsection nine of this section to the U n d e r
S e c r e t a r y for L a n d s , the D e p a r t m e n t of
L a n d s or t h e L a n d s D e p a r t m e n t , shall be
r e a d a n d c o n s t r u e d as a reference to the
Commissioner a p p o i n t e d u n d e r this Act a n d
the W e s t e r n L a n d s Office respectively.
(g) by i n s e r t i n g next a f t e r section 35L the following
n e w section:—
35M. (1) A s u r r e n d e r u n d e r a n y of the p r o ­
visions of this A c t m a y be effected b y a t r u s t e e
in r e s p e c t of l a n d which he holds as a t r u s t e e as
if a p o w e r to t h a t effect were contained in the
will
will o r o t h e r i n s t r u m e n t c r e a t i n g the t r u s t , o r b y
a n executor o r a n a d m i n i s t r a t o r in respect of
l a n d held by h i m a s executor or a d m i n i s t r a t o r a s
t h e case m a y b e :
P r o v i d e d t h a t a n y l a n d a s s u r e d to a n y trustee^
executor, o r a d m i n i s t r a t o r u p o n conversion or
subdivision or b y w a y of exchange o r lease u n d e r
t h i s A c t shall be held by him, subject to the same
t r u s t s a s the l a n d s u r r e n d e r e d b y him.
(2) E v e r y s u r r e n d e r m a d e by a t r u s t e e ,
executor or a d m i n i s t r a t o r before the commence­
m e n t of the W e s t e r n L a n d s ( A m e n d m e n t ) Act,
1937, shall be a s valid as if subsection one of
this section h a d been in o p e r a t i o n when the
surrender was made.
(h) b y i n s e r t i n g in section t h i r t y - s i x a f t e r the w o r d s
" t e n p o u n d s " the w o r d s "Without p r e j u d i c e to
the g e n e r a l i t y of the foregoing p o w e r t h e
Governor m a y m a k e r e g u l a t i o n s a p p l y i n g a n y of

v e r t e d u n d e r t h i s Act. W h e r e v e r in a n y p r o v i ­
sion so applied, reference is m a d e to the U n d e r
S e c r e t a r y for L a n d s , the D e p a r t m e n t of L a n d s
o r t h e L a n d s D e p a r t m e n t , such reference shall,
for the p u r p o s e of the application of such p r o v i ­
sion, be r e a d a n d c o n s t r u e d a s a reference to t h e
Commissioner a p p o i n t e d u n d e r this A c t a n d the
W e s t e r n L a n d s Office r e s p e c t i v e l y " ;
(i) b y o m i t t i n g from section t h i r t y - s e v e n t h e w o r d s
" a p p l y as p r e s c r i b e d to s u r r e n d e r such lease to
the G o v e r n o r " a n d b y i n s e r t i n g in lieu thereof
the w o r d s " w i t h t h e consent of t h e Minister,
s u r r e n d e r such lease by a n i n s t r u m e n t in t h e
p r e s c r i b e d form. T h e M i n i s t e r m a y accept such
s u r r e n d e r on behalf of H i s M a j e s t y . "
3 . (1) T h e W i l d D o g D e s t r u c t i o n Act, 1921, a s
a m e n d e d by subsequent A c t s , is h e r e b y a m e n d e d b y in­
s e r t i n g a t the end of section t h i r t e e n the following
words:—
A rate-book m a y be constituted by a series of c a r d s
in a f o r m a p p r o v e d by the A u d i t o r - G e n e r a l .

(2) Subsection one of this section shall be deemed
to have commenced on the first day of January, one thousand nine hundred and twenty-two.
