Upper East Side woman gets less in divorce
from lawyer ex because her public
accusations hurt his business: judge
Janice Schacter, 51, had complained about her now ex-husband, Ira Schacter, 54, which
in turned decreased the value of his partnership in a white-shoe law firm, a Manhattan
judge ruled.

An Upper East Side woman who went public with allegations of wrongdoing
against her Playboy model dating lawyer hubby has to pay for airing their dirty
laundry, a Manhattan judge has ruled.
Janice Schacter, 51, had complained over the course of her contentious yearslong divorce that her now ex-husband — a partner in a prestigious white shoe
law firm — was abusive, and had blown over $200,000 on an engagement ring
for his Playboy bunny galpal while stiffing his daughter out of hearing aid money.
Ira Schacter, 54, said the allegations hurt his business at at Cadwalader,
Wickersham and Taft, and lessened the value of his partnership.
In a ruling made public Tuesday, Justice Laura Drager agreed, and found that as
a result, Janice should only get 17% of the $5 million value of the partnership —
about $855,000.
She previously stood to collect about half, but “in essence, the wife chose to bite
the hand that fed her,” Drager wrote.

Drager agreed the economy was a factor - but so was Janice’s trash-talking.
“The court concludes that the wife contributed to the decline in value of the
husband’s law practice,” she wrote.
“The wife was well within her rights to publicly raise her concerns about
domestic violence. However, the wife’s incessant postings and discussions
about the husband went beyond any reasonable discussion of this very serious
issue.”

Despite the lower payout for her ex’s law practice, the ruling leaves Janice far
from broke.
Drager awarded her $15,000 a month in alimony, $3,000 a month in child
support, their 2003 Lexus, half the value of their $4.4 million townhouse, half the
value of their $4.5 million, and half of their $650,000 in jewelry, furniture and art.
Janice Schacter’s lawyer, Michael Joseph, declined comment on the ruling,
which was first reported by the New York Law Journal.
A spokeswoman for Ira Schacter, Marcia Horowitz, said he “has no comment
other than to say that he now has a wonderful close relationship with both his
daughter and son.” She said Schacter's lawyer is “digesting the opinion.”
Janice said Drager's comment was "offensive considering what transpired in this
case."

Unfortunately for her, the judges are lawyers and are acting out of professional courtesy. Getting 50% of
the reduced income is reasonable. Reducing her percentage to enhance the income of the shyster
husband is simply wrong.

but what If she is telling the Truth. His business is failing because of his actions. Running
around with a playboy bunny. I am sure that doesn't look good for his business. Spending his
money at the playboy mansion??? I am sure the wife was not the only one who saw this
behavior.
For instance, if I saw my minister hanging out at happy hours with a playboy bunny, and he is married, I
will not go to that church. Just like Tiger wood's wife finally found out about his 10-12 mistresses. If it
had been one, she would have stayed. There were just too many. Time to leave this sinking ship.

I read the whole story. The guy was cheating with the younger playboy bunny. His
wife found out about it. Naturally the wife got mad. Wouldn't you get mad if you
found out your wife was running around with a younger more attractive person?

Greed, falling out of love and a married man making a fool out of himself with a younger woman , a
bimbo at that . Many marriages, from the poor to the rich, have been destroyed not by cheating but by two
people falling out of love . The fire and desire is gone. The children are the sufferers . What amazes me is
how older men blow huge sums on these high priced hook*** , young or old. He should have just stayed
until the children were older and helped his wife find a real job , mean time find a nice woman with her
own means to have a meaningful truthful relationship.

So much of her story doesn't meet the smell test. It's SOP for bitter and vindictive ex-wives to claim the
fathers are neglecting the kids -- it's the ultimate trump card, along with claims of mental or physical
abuse--even in the absence of a scintilla of evidence.
This is the rare case, indeed, where an ex's big mouth actually cost her. Miracles DO happen! Rarely,
yes, but once in a blue moon ...

Dignity. All she needed to do was retain a little dignity. Anyone with half a brain knows that you don't bite
the hand that will be feeding you. Just take the high road and act like it doesn't bother you a bit. She is
still getting plenty of money and assets. People will figure out he is a fool on their own. Now you both look

Actually, guidlines for upport reuired from a non custodial parent in NYS is 17% of income. If she had a
chane to get 50% of the assets, it would have been an agreed to stipulation between parties. The fact that
she was a party to such a contentious hearing, probably influenced the judge to stick with the guidelines,
rather than reward the bad behavior by each of them. "It's cheaper to keep her" is the old addage.

wife (with custody of the kids) only $17,000 per year support. That doesn't
seem fair. There's no doubt both of them are bad news but much of Ira
Schacter's business woes are due to his own actions. Wife beating by a law
partner? Why didn't he just divorce her? I doubt his wife was the direct
source of the damaging news reports which were probably gleaned by the
media from legal filings which are not sealed. The tabloids routinely browse
such public legal documents looking for salacious news. A besotted partner in
a top US law firm giving a $215,000 engagement ring to a former Playboy
model half his age? That made news in legal blogs all over and caused him to
be the object of ridicule and jokes. No fool like an old fool.

My first sentence was cut off. What I was questioning was the 17% guideline. Based on
what you're saying, a non-custodial husband making $100,000 per year only has to pay
an ex-wife (with child custody) $17,000 per year. How can that be fair? The Schacters
were also married for 26 years. Surely that should have also been taken into account.
Maybe 50% would have been too much, but 17% seems way too little.

Karas, she is getting above the guidelines as far as child support. The oldest is 19
and unless certain provisions are made in the divorce decree that child is of age
and he doesn't have to pay support. She is getting $3,000 for their daughter per
month. She is 15 and will age out in 3 years unless again, provisions are made in
the divorce decree. She's receiving 15K a month for alimony and half of two
residents they own. What is in contention is her percentage in his law partnership
which has shown a decline. If you browse the web, he was much maligned as a
lawyer in differnt blogs. I don't know if all that was said was true, but it couldn't
have helped business.

What's not "fair" is the implication that she should not have to contribute dime one
to the support of the kid? How about she get a job and and an income. Kids
need to be financially supported by BOTH parents ... not only the father.
$17k/year is $1416/month just from him. That, COMBINED with HER income, is
ample to support one child.

if the income falls so does you spending. A divorce woman wants to continue to live as so was still
married. Don't know the case or care; but women need to get realistic in this day an age. Divorce means
she is having to go to work whether she worked before or not. You need to know the inside of how much
to give a woman but the man needs to be able to get a life also. Example give the house to her only or
divide it if it is very big with many rooms. She might have to downsize just like him.

Judge Drager described a choke restraint with red marks and a bump on my head and
years of abuse including rape threats, a knife pointed at me, being pushed and him
sitting on me as being “treated badly.” He chest bumped me in the court hallway in front
of attorneys. See the comments on the petition against her on change.org.
This was about protecting her career. I stood up to a Judge who wouldn’t enforce court
orders, follow state laws, ensure my family was safe, give me legal fees, proper
discovery, experts and then created a record to prevent an appeal.
