The Sales Contract will define contract number, customer reference, product, total quantity, pricing, despatch location, payment terms etc. Sales Contracts are considered to be legally binding contracts between the customer and Wengfu Australia for the supply of product by Wengfu Australia and purchase of the product by the customer on the terms stated in the contract. A Sales Contract can be arranged by contacting a member of our Sales Team or the Customer Service Team. The customer will be required to check, sign and return the Sales Contract prior to the offer expiry date. An issued Sales Contract by Wengfu Australia allocates the pricing and tonnes to the customer. A verbal quote of price and tonne availability does not secure the allocation from Wengfu Australia. Wengfu Australia’s Terms and Conditions BAGGED PRODUCT CONTRACTS If you are requesting a sales contract for bagged product the following minimum tonnage levels apply: • • Straight bagged product minimum 1t = 1t per bag Blended bagged product minimum 4t per blend = 1t per bag Bag Quantities Geelong: Portland: Adelaide: Newcastle: 1 tonne bags available 1 tonne bags available 1 tonne bags available 1 tonne bags and 500kg bags available Please note: Wengfu will not under fill or over fill bulk bags, If a request is received outside of the multiples of 1t or if ex Newcastle 0.5t we will phone to determine if the order is to be rounded up or down. PALLETS All bagged product will be out loaded on pallets: • • Geelong, Portland and Adelaide o All Sales Contracts for bags will include a charge for the supply of pallets. o At the time of requesting a booking the customer Is to advise if swap pallets will be supplied when bagged product collected Newcastle o All Sales Contract for bags will include an Item for Chep Pallet Swap o At the time of requesting a booking the customer to advise if Chep pallets will be swapped or transferred Page 7 of 29 V2.6 Dealer Manual Please note Wengfu no longer offer the service of Lift on / Lift Off. All bags will be out loaded on pallets. Despatch can be arranged at the time of placing a Sales Contract, or on an ongoing basis as long as the entire contracted tonnage of product is collected within the contracted timeframe. A booking will not be released until the Sales Contract is signed. CHANGING A SALES CONTRACT To change the details of a Sales Contract the customer must contact our Customer Service Team, and quote the Sales Contract number. A Sales Contract may be changed providing that the product can be supplied with no effect on another customer. If the changes are acceptable, the details will be confirmed in writing. RESTRICTIONS TO SUPPLYING AN ORDER Product Availability – Wengfu Australia makes every endeavour to have sufficient stock to meet customer requirements. To ensure reliability of supply the customer is requested to advise our Sales Team of any changes to their market. Product Unavailable – If a required product is not available at the time of ordering, the Sales Team or Customer Service Team will advise the customer. The customer’s Regional Sales Manager will provide regular updates on product availability. From time to time during peak demand periods product availability may be subject to allocation among customers. At the discretion of Wengfu Australia some orders may be temporarily restricted. The customer’s Regional Sales Manager will advise affected customers of any changes or restrictions. CONDITIONS OF CREDIT AND TRADE To view Wengfu’s Conditions of Credit and Trade click on the link below or copy into your web browser http://www.wengfuaustralia.com/customer-log-in.html ARRANGING A COLLECTION MAKING A BOOKING The customer can make a booking for collection of the product at the same time as arranging the Sales Contract – particularly for single truck orders, or alternatively, this may be done at some point after the Sales Contract has been arranged (but still within the contracted timeframe). It is the responsibility of the customer to contact the Customer Service Team and book in the date and time for collection of the order. It is recommended that this is used as all the required information is included. A copy of the Wengfu Australia Booking Sheet is included with this Dealer Manual, and is also available in an electronic format upon request. Please see Appendix 1 for a copy of Wengfu Australia’s Booking Sheet. Once the booking has been loaded into our system, a confirmation will be emailed or faxed to the customer, verifying the booking details, including the booking number and timeslot. Customers are requested to check that the confirmation details are correct, and if not to immediately contact Customer Service. ORDER CUT OFF TIMES Please contact our Customer Service team no later than 5.45pm the day before you would like to collect your booking. All bags will be out loaded on pallets. TRACE ELEMENTS If your booking includes Trace Elements, 48 hours’ notice is required TIME SLOTS Wengfu Australia works on a time slot system of bookings. Bookings will be made up to 120 minutes either side of the customers requested time. If no booking slots are available within 120 minutes of the requested time, a member of our Customer Service Team will contact the customer to arrange an alternative time for collection. It is very important that the booking number, product detail, address and timeslot information is passed onto your carrier and they endeavour to arrive on site accordingly. This process is in place to avoid lengthy delays. Page 10 of 29 V2.6 Dealer Manual CHANGING BOOKING DETAILS If a booking needs to be changed, the customer should contact Customer Service on 1300 WENGFU (1300 936 438). Provided the changes are allowable under the Sales Contract, the changes will be made and a new confirmation sent. If the changes are outside the Sales Contract, the request will be reviewed by the Customer Service Team and/or the customer’s Regional Sales Manager, and the customer contacted to discuss the options. RESTRICTIONS TO COLLECTION Product unavailable - If a product is not available at the time of booking Customer Service will advise the customer and discuss alternative arrangements. Site unable to load a vehicle - if for any reason Wengfu Australia is unable to load a vehicle Customer Service will contact the customer and discuss any adjustment to the loading schedule. Wengfu Australia will endeavour at all times to keep any inconvenience to the customer to a minimum. Allocation of product - from time to time during peak demand periods, product availability and despatch capacity may be affected. As a result some bookings may be temporarily restricted. Customer Service or the customer's Sales Manager will advise affected customers. CARRIER PICKUP On arrival at the Wengfu Australia store the carrier will need to advise the Store personnel of the following: • Customer booking number • Product to be collected • Quantity required All drivers are required to wear personal safety equipment including safety glasses, safety vest and enclosed footwear while on site. Store personnel will acknowledge the carrier’s arrival, and direct them to either a waiting area, or the loading area. Wengfu Australia’s site rules (see below) are to be adhered to at all times. BULK LOADING The carrier must present their vehicle in clean condition for loading of bulk fertilisers. Cleaning out of vehicles on site prior to loading is not permitted. Convertible trucks present an OH&S risk, and will not be loaded. The carrier will position their vehicle as instructed by Store personnel; the carrier is to advise of any special requirements regarding loading their vehicle. Bulk fertilisers will be supplied in quantities as close as possible to the weight on the booking. The customer will be invoiced for the final weight recorded on the weighbridge ticket. VEHICLE LOAD RESTRICTIONS, WEIGHT LIMITS AND COMPLIANCE Wengfu Australia is committed to safety and legal compliance in all its operations, for its employees, customers and the general public. Wengfu Australia’s Duty of Care requires that all trucks leaving their sites comply with current State regulations. All vehicles will be loaded to within the legal mass limit of the vehicle. In the event that a truck is overloaded, the carrier must tip off the excess product before leaving the site. Page 11 of 29 V2.6 Dealer Manual WORK HEALTH AND SAFETY The health and safety of ourselves, our colleagues and all who come into contact with Wengfu Australia is always our first priority. Wengfu Australia acknowledges the importance of a preventative approach to Work Health and Safety and is committed to providing as far as practicable, a safe and healthy work environment for all employees, contractors and visitors. ALL VISITORS All contractors and visitors to the sites must report to the site office on arrival and must sign the Site Rules and Entry Record (Visitors Register). Visitors who have not been fully inducted must be accompanied by a staff member on site (other than in the office area). VEHICLES ON SITE Only authorised vehicles may enter the site. Respective speed limits across sites and inside sheds must be adhered to at all times. These are displayed at gate entry and on shed walls prior to entering sheds. No truck is permitted to enter the shed until advised to do so by a staff member. Truck washing and clean out of load compartments is prohibited on site. Be aware that mobile plant or other maintenance equipment may be operating in sheds. PERSONAL PROTECTIVE EQUIPMENT Eye protection and high-vis safety vest (Australian Standards approved) must be worn at all times on site. Safety footwear must be worn if working in operational areas. Supervised visitors must be suitably attired in operations areas with eye protection and safety vest. Flat soled and enclosed sturdy footwear must be worn. INCIDENT AND HAZARD REPORTING Any injury, incident, or hazard must be reported to Wengfu Australia personnel, as soon as it is identified. RESTRICTED BEHAVIOURS There are certain behaviours that may result in summary dismissal or banning from the site, these include: • Consuming alcohol on site (including car park), or being in an intoxicated state • Possession or use of illegal drugs on site or appearing affected by such drugs • Vandalising/sabotaging company property • Fighting or abusive behaviour • Deliberate failure to comply with statutory or safety regulations • Unauthorised use of access keys for entry into the gates/doors on the site • Theft of property SMOKING Smoking is not permitted in the office, sheds or near to any flammable fuel source and is only permitted in designated areas. Butts are to be disposed of in receptacles provided. Smoking is not permitted on site at Kooragang Island, Raven St. Page 12 of 29 V2.6 Dealer Manual SECURITY Each person on site is responsible for maintaining security vigilance, reporting anything suspicious to site management. CHILDREN Children coming on to site must remain in the vehicle. If on site, they must be accompanied by and in the control of a responsible adult at all times. PRODUCT SPILLS Any spill of product, regardless of magnitude, must be contained and appropriate recovery action taken. All spills must be reported to site Management. A library of Safety Data Sheets for all products stored on site is located in the Administration office. AWARENESS OF SITE VEHICLE MOVEMENTS When on site: • Always be aware of mobile plant such as Front End Loaders, Trucks, Forklifts or Bobcats. • Enter the shed or surrounding area with caution and survey for vehicle movements or other machinery movements. • Give way to mobile equipment at all times • Never walk behind reversing mobile equipment or vehicle • Communication via UHF between mobile plant operators & trucks to give warning to whereabouts is mandatory for sites with UHF. • Additional to UHF communication for sites with UHF, and for all other sites - eye contact & acknowledgement must be made with drivers of mobile equipment/vehicles to ensure they are aware of, and have acknowledged your presence before proceeding further • Always walk in open areas where practical to give warning to others of your whereabouts. • Use caution when walking on slippery surfaces. • Never run whilst on site EMERGENCY PROCEDURES Report any emergency to the Site Manager. In the event of evacuation, proceed as instructed to the designated evacuation point. FIRST AID Trained First Aid personnel and First Aid Kits are available on site. PROHIBITED ARTICLES The following articles are prohibited on site: • Alcohol • Illegal drugs such as cannabis, heroin, non-prescribed amphetamines, hallucinogens and cocaine • Firearms • Pets • Pornographic material You must comply with any other site rules as specified. Page 13 of 29 V2.6 Dealer Manual MAKING PAYMENTS ELECTRONIC FUNDS TRANSFER (EFT) OR DIRECT DEPOSIT PAYMENTS To make an Electronic Funds Transfer or Direct Deposit payment to Wengfu Australia, you will need to have our BSB and Account details. These can be sourced from your invoice, the monthly statement or by calling our Accounts team for the details. Please use your Customer Account Number as the reference on any payments. To ensure that payments are allocated against the correct invoice, it would be appreciated if you would send a remittance advice by fax to 03 9863 9747 or via email to [email protected]. Where a remittance advice is not received, payments will be allocated against the oldest invoices due for payment first. Visitor Induction (no cost) - Valid for 3 months. This enables your driver to come to the wharf and be escorted by someone with a full induction. Some of your drivers that come irregularly can avail themselves of this option. The only difficulty here for your driver is that they have to wait in the parking lot near the gate for one of the wharf operators or Wengfu staff to come over and escort them to the load area. Note also that the Visitor Induction is available to drivers that have previously had a Full Induction. 2. Full Induction (cost $38.50 inc GST) - Valid for 12 months. This induction requires approximately 45-60 minutes to do and can be either be undertaken at the security office or on the Geelong Port Page 21 of 29 V2.6 Dealer Manual website (www.geelongport.com.au). Inductions can be arranged through the security office on 03 5247 0366. This induction allows the driver to come into the port at any time without an escort. To undertake a full induction the driver must have a Geelong Port Work Permit prior to undertaking the induction. To obtain a Work Permit, a form must be completed in full with special attention to the need for all personnel undertaking the Ports safety rules and the need to provide a Job Safety Analysis. For a full induction, the Port will also require a copy of your driver's current Public Liability and Work Cover insurance certificate. Please note that a minimum of $10 million is required for Public Liability. On arrival to site all inducted visitors must sign in by entering their Personal Registration code into the computer, persons will receive a printed ticket that is used for identification whilst on site. Prior to leaving the site visitors are to sigh out by re-entering their Personal Registration Code into the computer.
