TRINDLE SPRING HEIGHTS, A FLEXIBLE TOWNHOME CONDOMINIUM

THIS TWENTY-FIRST AMENDMENT is entered this _day
the authorized representative of SILVER CREEK DEVELOPMENT COMPANY LIMITED
PARTNERSHIP, a Pennsylvania Limited Partnership, ("Successor Declarant").
WHEREAS, Trindle Spring Heights, a flexible townhome condominium, was formed by
the recording of the Declaration of Condominium recorded at Record Book 734, Page 3083, in
the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania on February
22, 2007 (as amended from time to time, the "Declaration"); and
WHEREAS, Trindle Springs, Inc. (the "Original Declarant") submitted to the provisions
of the Pennsylvania Uniform Condominium Act, 68 Pa.C.S. §3101, et seq., as amended (the
"Act"), certain real estate situated in Hampden Township, Cumberland County, Pennsylvania as
described in Exhibit "A" to the Declaration, and created a flexible condominium known as
Trindle Spring Heights, a Townhorne Condominium (the "Condominium") initially having 38
Units; and
WHEREAS pursuant to Article XXI of the Declaration, Original Declarant reserved an
option to add all or any portion of the Additional Real Estate described in Exhibit "D" to the
Declaration at any time, from time to time, in any order, without limitation and without any
requirement that any other real estate be added, converted or withdrawn; and
WHEREAS, pursuant to that certain First Amendment to the Declaration, executed by
Original Declarant and recorded as Cumberland County Instrument No. 200837342, Original
Declarant added all of the Additional Real Estate to the Condominium as Convertible Real
Estate; and
WHEREAS, Pursuant to that certain Partial Assignment of Special Declarant Rights
recorded as Cumberland County Instrument No. 200837343, Original Declarant granted and
conveyed unto Successor Declarant certain Special Declarant Rights in and to that portion of the
Condominium described therein, it being the Additional Real Estate added to the Condominium
as Convertible Real Estate, labeled as "Tract 2" on Exhibit "A" attached hereto; and
WHEREAS, Pursuant to certain Amendments to the Declaration executed by Original
Declarant and/or Successor Declarant and recorded as Cumberland County Instrument Nos.
200914754, 200934545, 200937461, 201011108, 201033559, 201108153, 201113061,
201125443, 201214433, 201234173, 201309122, 201319143; 201327488;
201333519;201338143; 201401852; and 201413449 Original Declarant and/or Successor
Declarant created additional Units and Limited Common Elements appurtenant thereto, bringing
the total number of Units in the Condominium to one hundred thirty-six(136); and
WHEREAS, pursuant to that certain Ninth Amendment to the Declaration recorded as
Cumberland County Instrument No. 201120471 (the "Ninth Amendment"), Original Declarant,
Successor Declarant and Trindle Spring Heights Townhome Condominium Association, Inc. (the
"Association") amended certain provisions of the Declaration as described therein. No additional
Units or Limited Common Elements were created by the filing of the Ninth Amendment; and
WHEREAS, pursuant to that certain Sixteenth Amendment to Declaration recorded as
Cumberland County Instrument No. 201331174 (the "Sixteenth Amendment"), Original
Declarant, Successor Declarant and Trindle Spring Heights Townhome Condominium
Association, Inc. (the "Association") amended certain provisions of the Declaration as described
therein. No additional Units or Limited Common Elements were created by the filing of the
Sixteenth Amendment; and
WHEREAS, Successor Declarant now desires to create additional Units and Limited
Common Elements as hereinafter provided, thus increasing the total number of Units in the
Condominium from one hundred thirty-six (136) to one hundred forty-three (143); and
WHEREAS, all capitalized terms used herein which are not defmed herein shall have the
meanings specified in the Declaration.
NOW THEREFORE, Original Declarant and Successor Declarant hereby amend the
Declaration as follows:
1.
Successor Declarant hereby converts a portion of Convertible Real Estate within
Tract 2, as shown on the Plats and Plans of Phase 19 attached as Exhibit "A"
hereto, and creates Units 101 through 103, inclusive, and Units 79 through 82,
inclusive, and all Limited Common Elements appurtenant thereto.

The Plats and Plans are amended
3.
Pursuant to Section 3211 of the Act, Successor Declarant hereby assigns an
identifying number to each Unit hereby formed and reapportion the Percentage
Interest, votes in the Association and Common Expense Liabilities as shown on
Exhibit "B" attached hereto and made a part hereof.
4.
The attached Exhibit "B" assigning percentage interests to the units shall be
substituted for Exhibit "B" which currently forms a part of the Declaration, as
amended.

5.
Except as modified by this Amendment, all of the terms and provisions of the
Community Documents are hereby expressly ratified and confirmed, shall remain
in full force and effect and shall apply to the Units and Limited Common
Elements hereby created.
IN WITNESS WHEREOF, the Original Declarant and Successor Declarant have caused
their names to be signed to these presents on this VI day of July, 2014.
