THE PROPOSAL
The proposal is for Shropshire Council to use the land as a temporary
overspill staff car park (156 spaces on 0.55ha) in connection with its use
of the Mount McKinley Building adjacent and the Ptarmigan Building,
also located on the business park. The use proposed is temporary for
three years.

SITE LOCATION/DESCRIPTION
The car park would be accessed through the Mount McKinley Building
site and would have tarmac roads and gravel car parking spaces. There
would be external lighting and extended landscaping around the site
perimeter. The site is currently undeveloped employment land, largely
under grass.

REASON FOR COMMITTEE DETERMINATION OF APPLICATION
The scheme does not comply with the delegation to officers as set out in
Part 8 on the Shropshire Council Constitution as it is a Council.
Application not in line with statutory functions.

10.1
Principle of Development
10.1.1 The site is an allocated employment site and loss of employment land is
only permitted (Policy EM2) where there are no suitable alternative
brownfield sites or there is an appropriate range of sites available and
there is no conflict with neighbouring land uses. The use of land for car
parking is not generally acceptable unless it serves the needs of
employment uses on the site in accordance with normal car parking
standards.
10.1.2 The proposed use is temporary only for a period of three years. There
remains other land adjacent still available for business use, if required.
The applicant states that the parking needs and travel patterns / options
for staff will be reviewed during the temporary period. The existing Mount
McKinley building already has 74 parking spaces for approximately
1,830 sq m ( The local plan office parking standards of one space per 25
sq m would require 73 spaces for this floor area, so this requirement is
theoretically met by the existing parking). The Ptarmigan building has an
existing 54 spaces for 1,830 sq m (and also requires 73 spaces
according to the standards and is therefore 19 spaces short of
requirement). Overall the two buildings are around 19 spaces short of
the local plan parking standards, whereas it is proposed to provide 156
additional temporary spaces on the proposed site.

Design, Scale and Character
10.2.1 Additional landscaping is proposed and, given its employment site
location, the appearance would be acceptable in relation to its impact on
its surroundings.
10.3
Impact on neighbours/residential amenity
10.3.1 The site is on the southern side of the site and has no impact on
residential amenity. The land to the West of the site is still undeveloped
employment land.

CONCLUSION
The proposal is acceptable only as a temporary use as the car parking is
above the normally accepted requirements and would sterilise
employment land in the longer term. It is therefore recommended that
the permission should be granted for a temporary period of 3 years,
during which time the applicant will review the travel and parking
situation.

Article 8 give the right to respect for private and family life and First
Protocol Article 1 allows for the peaceful enjoyment of possessions.
These have to be balanced against the rights and freedoms of others
and the orderly development of the County in the interests of the
Community.
First Protocol Article 1 requires that the desires of landowners must be
balanced against the impact on residents.
This legislation has been taken into account in arriving at the above
recommendation.

Reason for Approval
A temporary short term use of the site for car parking is acceptable given that
other employment land is currently available but long term use for car parking is
not acceptable as the site is allocated for employment use, in accordance with
Policies EM1 and EM2 of the Shrewsbury and Atcham Local Plan. The site's use
for car parking is acceptable in amenity terms in accordance with Policy GP1 of
the Local Plan.
Conditions
1.
The development hereby permitted shall be begun before the expiration of
three years from the date of this permission.
Reason: To comply with Section 91(1) of the Town and Country Planning
Act, 1990 (As amended).
2.
The development shall be carried out strictly in accordance with the
approved plans and drawings.
Reason: For the avoidance of doubt and to ensure that the development
is carried out in accordance with the approved plans and details.
3.
This permission shall be for a period of 3 years, by which date the use
hereby permitted shall cease, and the site reinstated to its previous
condition in accordance with a scheme of work submitted to and approved
by the Local Planning Authority. The scheme shall be approved prior to
the commencement of any works to reinstate the land.
Reason - The site is allocated for employment use and the long term use
for car parking is not considered appropriate.
4.
All existing trees, shrubs and hedgerows within and bordering the site
shall be protected, retained and maintained to the satisfaction of the local
planning authority for the duration of any development works and for 5
years thereafter.
Reason: To safeguard the visual amenities of the area.
