OI by largest patent holders in industry.

Apparent Paradox
o First look at OI and IPR gives impression that
both are contradictory to each other.
o Regardless of that, world’s largest patent
holding firms (IBM, Philips) adopted OI visibly
o These firms released many patents in public
domain but also kept the patenting rate as
usual
o Obvious query: What IP strategy in OI
context?
IP Management
o Skeptic’s view – superficial OI adoption?
o Acknowledgment of OI background
 We don’t have all the talent in-house
 Interoperability of firm’s products with other
firms’ (OSS).
o IP Management Strategy
 Benchmarking patent’s language on OI contracts
 Defensive use of IPRs in cross licensing setup
 Customization of IP strategy on need basis
Technology Markets
o Growth of markets for technology drove some
firms (e.g. Semiconductor, Biotech) to adopt a
less vertically integrated model
o This evolution shows complimentary nature of
OI and IPR
o New business models like Web 2.0 are less
managed by IPRs management and more rely
on OI concepts of interoperability
