MINUTES OF WILLINGTON PARISH COUNCIL MEETING HELD ON TUES 9.11.10 IN THE OLD SCHOOL, CASTLEWAY, WILLINGTON PRESENT: Mr A. Bamford (Chair), Mr K. England, Mrs C. Carter, Mrs F. Crocker, Mr M. Ford. 4 Members of the public. 1031 APOLOGIES: Nil. 1032 DECLARATION OF INTEREST: Nil. 1033 POLICE BUSINESS: Pc McGee has advised the Clerk that the mobile safety camera will be used on the main roads into Willington when it is available. 1034 MINUTES OF MEETING HELD 12.10.10: RESOLVE: That the Minutes of the meeting held on 12.10.10 were approved and signed by the Chairman. 1035 DISTRICT COUNCIL MATTERS: It has been noted that a mobile fish & chip van parks on the footway outside the former electrical shop on The Green on some weekday evenings. It was queried whether this was permitted. Cllr Ford asked for more details, including dates and times etc. ACTION: WPC 1036 COUNTY COUNCIL MATTERS: A request for repainting of the zebra crossing is unlikely to be granted. A request has also been submitted for cleaning of the belisha beacon spheres which would improve illumination. It was noted that the work to the footways/kerbing/and white lining of Hall Lane is complete and appreciation was expressed for the end result. At 7.15pm the meeting closed to allow members of the public present the opportunity to speak on various matters. A parishioner referred to a request some six months ago for Twyford Road playing field to be nominated as a Queen Elizabeth playing field and that it did not appear to have been discussed by the Parish Council since the request. The Chairman said this would be discussed by the Council at a future meeting. A parishioner referred to a recent request to use the playing field for a carnival and emphasised that it was a request from a parishioner and not the Playing Field Protection Group. The parishioner asked if the Parish Council would be willing to appoint a representative for the carnival committee. The Chairman said this would be discussed by the Council. At 7.18pm the meeting continued. -2- 1037 PICNIC SITE CAR PARK: Cllr Ford reported that a decision on the proposed car parking charges has been deferred until next month – December. Discussion took place about the possibility of acquiring the whole of the site (picnic site and car park) for the benefit of the parish. It was agreed that a letter be sent to Cllr Jackson, DCC, expressing the Council’s interest in taking over the whole of the site. ACTION: CLERK 1038 MINUTES/REPORTS FROM SUB COMMITTEES/OTHER GROUPS: (a) Finance Notes from the meeting held on 19.10.10 were discussed and the following resolutions made: RESOLVE: That the Football Club rent remain at £80 per senior team for 2011. It was noted that this reduced rent allows for a saving in cleaning costs brought about by Football Club carrying out the bulk of the cleaning. RESOLVE: That the Bowls Club rent remain at £140 per year for the next three years (2011 being year 1 of 3). RESOLVE: That the rent of £10 per plot continues for 2011. RESOLVE: That all charges for burials and memorials be increased by 5%, rounded to the nearest pound, w.e.f. 1.4.11. RESOLVE: That the Clerk be paid 40 hours overtime for work during the period 14.6.1030.9.10. RESOLVE: That the FAX machine purchased in 1998 be written-off and disposed of. RESOLVE: Clerk/RFO Vacancy. That an interview panel consisting of Chair, Vice Chair and one Parish Councillor be formed. (b) Youth Service Mr Evans and Mrs Carter have met with Rebecca Perkins, DCC Youth Service and Mr Macpherson who is keen to be involved with the formation of youth clubs in Willington. A further meeting is to be held later in the month, volunteer parishioners will also be invited. (c) Recreation & Amenities A request has been received to plant a memorial tree on Twyford Road playing field. RAC Group to discuss and report back. ACTION: RAC Christmas tree – Mr Gibbs to purchase two new sets of lights and baubles. The tree will be delivered on Monday 29th November. -31039 PLANNING MATTERS: (a) Planning applications received and dealt with as follows: 9 2010 0970 FM The erection of a four bedroom detached dwelling in substitution for that submitted under planning permission 9/2009/0758 at 21 Beech Avenue Willington (White) Comments: 1. The proposed driveway entrance is too close to the existing junctions of both North Close and St Michael's Close. 2. The statement says there is parking provision for three cars. However, the sketch shows one car plus a space. The total space looks too small for the parking of three cars. 3. Insufficient parking space will result in cars parking on the road causing problems for the public bus service and emergency vehicles. 9 2010 1006 FH Erection of extensions at 17 Saxon Grove Willington (Phillips) ‘No comments’. (b) Planning matters (i) Building Design Group – Town & Country Planning Act (Development Management Procedure), Notice of Application, The Green Dragon Public House and adjacent land, Willington. Notice No. 1 re Application being made by Bespoke Inns Ltd – Extensions/alterations to existing public house including new external seating area. (ii) DCC – Submission of details under Conditions 2, 4, 7, 15, 16, 25,27, 29, 31 & 32 of Planning permission CM9/695/28 at Potlocks House Farm, Twyford Road, Willington. Application to be considered at the meeting of the Regulatory Planning Committee on 25.10.10, site visit 11.10 am. 1040 CLERK’S REPORT/CORRESPONDENCE: The Chairman requested that item 10, Report, be discussed under Agenda item 14, Exempt items (Data Protection) and items 5 and 6, Correspondence be discussed under Agenda item 14 - Exempt items (Client Confidentiality i.e. Legal professional privilege). This was agreed by the Council. Report: 1. Meadow Lane – lockable post. DCC Rights of Way Section confirm they were not consulted about the post and will speak to Derbyshire Wildlife Trust about its removal. Derbyshire Wildlife Trust say the post was erected to prevent fly tipping and as the path is too narrow for an ambulance to negotiate, Derby Mountain Rescue should be contacted in an emergency. Email received from DWT 9.11.10 to be circulated and discussed at the December meeting. DCC to be asked to refrain from any action until this has been discussed. 2. Trees - Oaks Road and allotments path. Order placed for work. 3. BW 11 – Derbyshire Wildlife Trust. Advice offered some years ago still stands. If circumstances have changed they will provide further advice. 4. New play equipment – SDDC confirm there is no money available for new equipment. 5. British Waterways – waste bin. Letter sent, reply awaited. 6. Trent Avenue play area - order placed for new bench. -47. Derbyshire Constabulary – safety camera route. Letter passed to Casualty Reduction Enforcement Support Team (CREST) who have replied advising that Willington roads do not meet the criteria in relation to injury collisions. They have limited funds and priority is given to the worst roads with serious injury collisions. 8. The Green – parked van. DCC advised of WPC investigations. Van no longer on site. 9. Trent Avenue Bus Stop clearway – DCC anticipate that the Clearway will be in place within the next three months. 10. Clerk vacancy – short listing of applicants. 11. Picnic Site – new litter bin liner is removed from its housing on a weekly basis, on one occasion being damaged beyond repair. Situation to be monitored for one month. SDDC to be advised. ACTION: CLERK Correspondence: 1. DCC – Site meeting 24.9.10, updates. (a) Castleway, canal bridge area – double white line system to be installed within approx. three months. (b) Vehicle Activated Signs (VAS) – DCC do not fund such signs, in other areas of the County where they have been erected they have been funded by Parish Councils. Cost is approximately £4,000 per sign, plus provision of a commuted sum of money for future maintenance. (c) Safety camera route – speeding enforceable only by the Police who should be contacted for assistance. (d) Warning sign for Pre-school. No provisions within the ‘Traffic Signs Regs and Directions 2002’ that would allow DCC to erect such a sign. 2. Willington Scout Group, Fireworks Display, Twyford Road playing field Sat 6.11.10. Completed Hire Form, SDDC Firework Display and Bonfire Voluntary Registration Scheme details and Public Liability Insurance letter. 3. Relocation of Surgery (1) Mr J. New Clerk to commence in January 2011, subject to commitments, and work alongside the current Clerk for three months. 1045 PANNONE LLP: Following a recent statement by a member of the public that should a Village Green be approved then this would not change the use nor ability to improve the existing facilities, and a request by the Playing Field Protection Group to withdraw our objection, clarification from our Solicitors was sought. The Chairman confirmed the following. Should a village green application be accepted, then the Parish Council would retain ownership, however, they would lose control over the use, and ability to make improvements. The application has been made under The Commons Act 2006, based upon a significant number of inhabitants of the locality indulging as of right in lawful sports and pastimes. Therefore, this may put into jeopardy the ability for away teams to play football on the land, and even home team players if they are from outside of the parish. Also, if a village green was granted, then, there would be nothing to stop persons disrupting official football matches, firework displays and summer sports-mobile activities, should they wish to use any part of the land to indulge in lawful sports and pastimes. To improve the existing facilities, including increasing the size and changing the layout and position of the changing facilities and car park, would be very difficult to achieve, and may be even impossible, due to the restrictions contained with the Commons Act 2006. RESOLVE: That the original £5000 limit be exceeded and that invoices be paid in full, rather than monthly instalments under the power of Section 111 Local Government Act 1972.
