Safety and Publicity Release and Waiver
The undersigned certifies as follows:

I wish to enter and participate in the Capture the Capital Scavenger Hunt Event (“Capture”) on
August 24, 2013 to be conducted by The Federal Reserve Bank of Richmond (“Sponsor”). I agree
that my participation is completely voluntary.

I am at least eighteen years of age, or I have obtained the permission of my parent or legal
guardian to participate in the Capture, as acknowledged by my parent’s or guardian’s signature
below. Parent’s or guardian’s signature below indicates that they agree to all provisions in this
Release and Waiver on behalf of the minor. Parent or guardian must participate in the Capture
with minor children and sign waivers also.

I understand that my participation in the Capture involves using a personal smartphone with
data capabilities. I understand that individual text messaging and data plans/rates apply to
participation in the Capture and all charges are my responsibility.

I understand the Capture involves physical activity. I understand my physical limitations and am
sufficiently self-aware to stop physical activity before I become ill or injured.

I am aware that there is no set race course for the Capture, that no water stations will be
provided, and that no aid stations will be provided.

I am aware that all streets that I might encounter during the Capture are open to regular
vehicular traffic during the Capture. I will obey all traffic laws, state and local laws and
regulations. I understand that any team or member of a team that violates state or local laws,
including, but not limited to traffic laws, is subject to immediate disqualification.

Unless otherwise required by medical necessity, I understand that the participants must
complete the Capture on foot without the aid of transportation or transportation vehicles
(bicycles, cars, buses, etc.).

I will carry a telecommunications device to alert emergency personnel if I become hurt or
incapacitated.

If I will be driving during any portion of the Capture, I possess a valid driver's license.

I acknowledge that I may be photographed, filmed, or otherwise recorded while participating in
the Capture. I grant the Federal Reserve Bank of Richmond and its designees the right to use my
name, likeness, image, voice, appearance, and performance (“Production Materials”) for
publicity purposes relating to the Capture or future similar events, without notice or
compensation. I irrevocably release the Federal Reserve Bank of Richmond from any and all
claims in connection with use of these Production Materials.

I agree to abide and be bound by the Official Rules of the Capture and decisions of the Sponsor,
which are final and binding on all matters relating to the Capture.

I acknowledge that any documents and other materials provided to me for use during the
Capture are the intellectual property of The Federal Reserve Bank of Richmond. Although I
receive a license to use such materials to participate in the Capture, I acknowledge that I may
not copy or distribute the materials, repackage or redistribute them for my financial benefit, and
I may not display them publicly, such as by posting them on the Internet.

I understand that by signing below, I am waiving my right to assert any claim or cause of action,
including but not limited to any and all liability for loss, harm, damage, injury, cost or expense
whatsoever, for property damage, personal injury and/or death which may occur in connection
with, preparation for, travel to, or participation in the Capture, or possession, acceptance
and/or use or misuse of prize or participation in any Capture related activity and claims based
on publicity rights, defamation or invasion of privacy and merchandise delivery, against the
Federal Reserve Bank of Richmond, any other sponsor of the Capture, and such companies’
parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors,
retailers, agents, assignees, and advertising agencies in exchange for my participation in the
Capture.

I do hereby, for myself, and my heirs, executors, and administrators, waive, release and forever
discharge any and all rights or claims for damages that may have or that hereafter accrue to me
against any and all persons, organizations, and legal entities affiliated with the Capture for any
and all damages that may be sustained or suffered by me in conjunction with my entry in,
and/or arising out of my travel to, participation in, or returning from the Capture.

I affirm that I am at least eighteen years of age and I freely sign this Release. Alternatively, if I
am under eighteen years of age, my parent(s) or legal guardian(s) and I freely sign this Release.
By signing this Release I affirm that I am a legal resident of the United States of America. I have
read this Release in its entirety and fully understand that by signing this Release, I am giving up
my legal rights and remedies, which may otherwise be available to me.
