Councilor Pottle made the motion to approve both sets of minutes. Clark seconded. Motion carried 6-0. B. Library Board Minutes – Information only PUBLIC COMMENT 1. Bob Oblack of 33125 S. Dickey Prairie Road in Molalla spoke in favor of the displaying the national motto of “In God We Trust”. He commended Councilor Griswold for his efforts of doing so. 2. Amber Gobey of 118 E Main Street in Molalla addressed the council regarding public parking in downtown Molalla during day time business hours. She is not opposed of people parking in the lot after business hours. It is a day care and they are concerned about child safety during the day because of the increased traffic. 3. Agustin Cuevas of El Charrito Mexican Resturant at 117 Main Street in Molalla. They recently did a large expensive expansion and they share a parking lot with Passadora’s Pizza. There have been complaints from customers that there is no parking because the White Horse patorns are taking the spaces. He is in support of customers parking in their lot and doing business at the White Horse to be towed because they are taking away business from them. Pottle asked how can they tell who’s cars belong to who and where they are doing business to identify if they should be towed. Cuevas stated if the parking lot is full and they have few customers, they look across the parking lot to see if the pizza parlor is full or empty. 4. Tim Bilyen of Passadora’s Pizza at 111 E Main Street in Molalla stated that he does share the parking lot with El Charritos and parking have become a serious issure since the White Horse has opened up. Before openning his business he did his due diligence and found a place that has parking within my lease. If another company comes in, they don’t do their due diligence they should not be able to over take parking at other businesses. Our land lord is protecting them under that lease for those paid spaces; otherwise that would be a breach. Bilyen asked if this is approved by council is this just a commercial downtown issue or does it apply to all residential and commercial properties inside the city limits? Rogge stated that the council has not discussed this issue in detail, they are still collecting information so they can make a well inform decision. Harold Hall of 35771 S Hwy 213 near Molalla is a barber in town. He too is effected by the downtown parking issue due to the increased traffic from the White Horse opening as well as from the other surrounding bars and businesses. He has a lot of customers who are in wheelchairs allowing them to park in front of his shop. If the council takes the right away to manage who parks in his lot, it would not be fair to his customers or too him as a business owner. Clark stated that he should have the right to tow vehicles that are not his customers and asked if there is a “No Parking” sign posted. Hall stated there is and in general states it’s “barber shop parking and no parking allowed by anyone between 6am and 8pm”. He has had issues with people parking in his spaces that ignore the sign and go to the bars. They come back hours later and in some cases the car gets left over night. Hall’s Barber Shop closes at 5pm. Pottle asked if the parking is shared with the Dry Cleaners. Hall said, yes. 6. Gary Deardorff of 115 E Main Street and property owner of discussed lots addressed the council regarding parking and towing. He thinks that this ordinance is a mix of practicality and personality. Public parking has always been an issue in downtown. It gets talked about but nothing gets done about it. Renters should not have to deal with parking issues which is why signs are up stating “customer parking only” and signs stating “Any car parked here after 8pm will be towed” to prevent the overnight parking that happens in certain lots he owns. He has dealt with all kind of issues from people doing drugs, using them as a restroom amung other problems. Rogge asked Deardorff “What would he like to see happen here?” He responded “Let people be towed away”. Pottle asked if Deardorff offered the White Horse owers a fee to use the lots. Deardorff stated, yes. He talked to the City Manager months before the White Horse opened and was told to see if he could work something out with the new owners. He waited for months and months and he finally went over to introduce himself and ask about the parking. The new owners told him that they don’t care where the customers park. Deardorff hired a tow company that will actually tow. Mr. Kelly will and there are a lot of people who are not happy with his methods. Thompson asked about the 2 signs at the barber shop. If there were 2 signs in a lot saying 2 different things, could it be confusing to someone looking for parking. Deardorff said it is very clear and there so people don’t park in his spots during business hours. The after 8pm sign is there because he has made a private arrangment with the dance studio across the street to use it until 8PM. Deardorff is willing to work with the businesses using his lots but it comes down to insurance, maintenance and cleaning. Rogge stated even business on 2nd street has parking issues as well unfortunatley his lots are not unique. There have been discssions regarding parking that involve cooperation and money. To date there is no “No towing action” being discussed by the council. Rogge did ask Mr. Kelly to come and speak to the council regarding the issues at the next meeting. Clark asked if he could let the towing of cars be monitored by the business owners instead of him. He stated the business owners don’t want to be the bad guys because it could impact their business. He went of record that he asked that this issue be brought up after a discussion with Councilor Clark over an issue that was posted on Facebook complaing about being towed over confusion of a sign. He has records showing the times of the tow and the situation that took place and it was very concerning to him. Thompson reached out to the City Manager coping Rogge and Pottle asking that the preditory towing ordinance be brought back to council. CONTINUING BUSINESS Library Board Job Description Huff stated that a cover letter and proposed “Job Description” provided by your Library Advisory Committee is included in the packet tonight. The Committee believes that their proposal that provides more specific tasks and responsibilities that better suit their needs as well as the Libraries. Also attached, is a redlined version of the same description that Staff has reviewed. It will effect Chapter 2.08 of the Molalla Municipal Code details current language for the Library Advisory Committee and their duties and responsibilities. Council has choices: 1. 2. 3. 4. Provide direction to amend the Code as presented by the Advisory Board Provide direction to amend the Code as redlined by Staff Provide direction to amend the Code with other language Move to not make a change Sandy Nelson President of the advisory board. The board reviewed initial suggestions and made some changes at that time. Huff sent other revisions and the board felt the version that they had was appropriate and in line with other libraries. Discussion about other library board and if the other boards have fiduciary responsibilites, it was found that they do not. Thompson stated that some of the items basically take authority that the council does not have and gives responsibilites to an advisory board that reports to council. He thinks the City Manager suggestions are approriate. Rogge noted that both the city and the library districts have the ability to give 6 month notice to change the current IGA allowing the board to go out on their own and take on the fiduciary responsibilites for the library as a separate entitiy of the City of Molalla if the county is willing to do that. She agrees with Huff’s redline revisions. Nelson asked for clarification regarding 4, 9 and 11. On 11 we were asked to participate in the hiring process of the Library Director. Thompson stated if the City Manager requests that the board take part in the hiring that is fine. If he does not request, than the board would not participate. After brief discussion regarding 4 and 9, Rogge stated the changes are approprate as well. REPORTS AND ANNOUNCEMENTS Thompson asked the Council to consider a student council liasion that would be a non-voting member. He was approched by the high school and there is expressed interest by a student who would like to participate. Clark stated that there were discussions in the past regarding legal issues and he is in support of having one but would like staff to verify there are no legal issues involved. SUBMITTED BY: Sadie Cramer, City Recorder APPROVED BY: Dan Huff, City Manager ORDINANCE 2016 - XX AN ORDINANCE RELATING TO TOWING FROM PRIVATE PROPERTY; AND AMENDING 10.70 OF THE MOLALLA MUNICIPAL CODE WHEREAS, the nonconsensual towing of motor vehicles from private property implicates the safety and welfare of the general public in that individuals who have their cars towed become stranded and have a lack of transportation for basic life necessities; and WHEREAS, additional safety concerns arise regarding nonconsensual towing of motor vehicles from private property when a vehicle owner returns to the motor vehicle while the tow company is still attaching equipment to the motor vehicle, or the motor vehicle is fully attached, but the tow driver has not yet engaged the tow truck's transmission to begin removing the motor vehicle and the owner of the vehicle engages in a confrontation with a tow company representative; and WHEREAS, Molalla police are often required to respond to calls related to stolen vehicles or requests for information when a nonconsensual tow occurs and there is a lack of information provided to the vehicle owner regarding where and how to retrieve their vehicle, thereby causing safety concerns for the community because the police are unable to respond to other calls; and WHEREAS, the nonconsensual towing of vehicles from private property without adequate regulation can divert police resources to an investigation into the propriety of a tow, thereby creating safety concerns because such resources cannot be used for other purposes; and WHEREAS, nationwide there are multiple reports of crimes such as the stealing of property or merchandise from towed vehicles and instances of physical or sexual assault by tow operators or their employees when nonconsensual tows occur, which create further safety concerns for the community; and WHEREAS all of these safety concerns are magnified when nonconsensual towing from private property occurs at night; and WHEREAS, the regulation of nonconsensual towing from private property will permit the City to keep tabs on tow drivers and companies who, otherwise, would be free to flout safety, insurance, or price requirements until and unless they were caught in some other improper act and ensure that tow drivers and tow companies report and refrain from criminal activity; and WHEREAS, that nonconsensual towing from private property affects vulnerable populations when people of limited economic means are required to pay hundreds of dollars to recover their vehicle, or are subjected to deficiency claims by collection agencies if they could not afford to pick up their vehicle even though the vehicle was illegally towed; and WHEREAS, the City of Molalla has a significant governmental interest in protecting the health, safety, and welfare of the general public and preserving the public order; and WHEREAS, the City Council desires to minimize and control the harmful and adverse effects that occur during the towing of motor vehicles from private property in order to address the safety concerns specifically listed above as wells as the myriad of other safety concerns inherent in nonconsensual towing of vehicles from private property; NOW THEREFORE, THE CITY OF MOLALLA ORDAINS AS FOLLOWS: Section 1. Chapter 10.70 of the Molalla Municipal Code is amended to read as follows: Purpose. The purpose of this Chapter is to address safety concerns related to the nonconsensual towing of vehicles from private property and to ensure that towing motor vehicles from private property facilities is performed safely, require private parking facilities to provide adequate notice of prohibited parking areas, and ensure that those whose motor vehicles have been towed can gain knowledge of the location of their motor vehicle. The provisions of this Chapter shall be construed in conformity with the laws and regulations of the State of Oregon regarding towing from private property. Nothing in this section creates, or is intended to create, a special relationship, as that term is defined under Oregon law, between any person and the City. Administrative Authority. The City Manager, or the City Manager's designee, is authorized to prescribe administrative rules and policies to implement the requirements of this Chapter. Definitions. (1) "Private parking facility" means any property used for motor vehicle parking at which the private parking facility owner restricts or reserves parking. (2) "Private parking facility owner'' means the owner, operator, lessee, manager, or designated agent of a private parking facility. (3) "Storage facility" means any property used for the storage of motor vehicles towed from a private parking facility. (4) "Tow" means to haul, carry, pull along, or otherwise transport or remove a motor vehicle by means of another motor vehicle. (5) "Tow company" means any person, firm, corporation, or other entity that engages in, or owns or operates a business which engages in, the towing or removal of motor vehicles for compensation. (6) "Vehicle owner" means the person registered with the Department of Motor Vehicles as the owner of the motor vehicle, or a person in lawful possession of the motor vehicle. Tow Company License. (1) A tow company must not, without the vehicle owner's consent, tow, cause to be towed, or store a motor vehicle towed from a private parking facility within the City of Molalla unless the tow company has a valid license issued by the City of Molalla. (2) The City shall grant a license to a tow company upon the tow company providing the following: (a) The legal business name, address, telephone number and fax number; (b) A list of all tow trucks used for tows from private property; (c) Addresses of all storage facilities utilized by the tow company to store Motor vehicles towed from within the City of Mol all a ; (d) a 24-hour contact telephone number; (e) The names of all owners of the tow company; (f) Other information the City Manager determines is necessary to carry out the requirements of this Chapter; and (g) Payment of a license fee, the amount of which is established by resolution of the City Council to administer the provisions of this Chapter. (3) The term of the license shall be for a period of one year. (4) The licensing requirements of this Chapter do not apply to tow companies that tow a motor vehicle with the prior consent or authorization of the vehicle owner. Towing Vehicles from Private Parking Facilities. (1) A tow company must not, without the vehicle owner's consent, tow, cause to be towed, or store a motor vehicle towed from a private parking facility unless: (a) The tow company has express written authorization from the private parking facility owner to tow motor vehicles from the private parking facility; (b) The private parking facility contains at least one sign at each entryway that prominently displays the following information: (i) A statement that parking is prohibited, reserved, or otherwise restricted; (ii) A statement of the hours the prohibition, reservation, or restriction applies; (iii) The name of the tow company or companies that patrols the private parking facility; and (iv) A 24-hour telephone number of the tow company or companies to call to obtain release of a motor vehicle towed. (c) If a private parking facility serves multiple businesses and restricts or reserves parking spaces for each business, each parking space must be clearly marked to indicate which spaces are restricted or reserved for each business; (d) The tow company photographs the motor vehicle to be towed and all signs posted prior to hookup; and (e) The tow company complies with all requirements of this Chapter and all administrative rules and policies. (2) It is unlawful for a tow company to do any of the following: (a) Park within 1,000 feet of a private parking facility for the purpose of monitoring motor vehicles to tow; (b) Post an observer at or near a private parking facility for the purpose of monitoring or ordering the towing of motor vehicles; and (c) Patrol a private parking facility for the purpose of monitoring motor vehicles to tow. Tow Requirements. A tow company must comply with the following requirements: (1) Perform tows in a safe and reasonable manner and not damage any person or property while towing or storing motor vehicles; (2) Fully cooperate with any police agency to facilitate processing of stolen motor vehicles; (3) Provide to the person seeking release of a towed motor vehicle a clearly legible receipt complete with all required information and with all fees and charges itemized; (4) Be considered to be in possession of a motor vehicle when the hookup is complete and the tow truck has begun towing the motor vehicle by engaging the tow truck's transmission and moving forward; (5) Offer to call for or provide transportation to the vehicle owner from within the immediate vicinity of the tow scene to the location of the towed motor vehicle storage; (6) Have staff available at all times to provide information about the location of the towed motor vehicle and information for obtaining release of the towed motor vehicle; (7) Accept as proof of motor vehicle ownership the vehicle's title or registration in addition to valid photo-identification of the person seeking the release; (8) Accept at least cash or valid credit card for payment for any fees or charges assessed; (9) Notify the City of Molalla Police Department of the location of any towed motor vehicle within one hour of the motor vehicle being placed in storage; and (10) Exercise reasonable care of any animal found to be in a towed motor vehicle. Storage of Towed Vehicles. (1) A tow company must not store a motor vehicle towed from a private parking facility within the City of Molalla at a storage facility located more than ten miles from the city limits of the City of Molalla. Release at Scene. (1) If a vehicle owner returns to the motor vehicle while the tow company is still attaching equipment to the motor vehicle, or the motor vehicle is fully attached, but the tow driver has not yet engaged the tow truck's transmission to begin removing the motor vehicle, the tow company must release the motor vehicle to the vehicle owner or operator at no charge. (2) If the vehicle owner stops the tow company when the hookup is complete and the tow truck is in motion with the motor vehicle, the tow company must immediate halt the tow and inform the vehicle owner that: (a) The motor vehicle will be released if the vehicle owner pays to the tow company the Release at Scene Fee; (b) The amount of the Release at Scene Fee; and (c) The vehicle owner has up to 15 minutes, without additional charge, to provide payment of the Release at Scene Fee. (3) If a tow company complies with subsection (2) of this section and the vehicle owner fails to provide payment within 15 minutes, the tow company may proceed to tow the motor vehicle to the storage facility. Towing and Storage Rates. A tow company must not charge more than the following amounts for motor vehicles towed from private property: (1) "After Hours Release Fee" of $25.00 for release of the motor vehicle between the hours of 6:00 p.m. and 8:00 a.m., Monday through Friday; and all hours on Saturday, Sunday, and City recognized holidays. (2) "Hookup Fee" of no more than the following fees, which includes: hookup, dollies, driveline or axle pull, 30 minutes of on-scene time, tower's dispatch, and photo fees and: (a) $175.00 for motor vehicles weighing less than 10,000 pounds gross vehicle weight; (b) $200.00 for motor vehicles weighing from 10,000 pounds gross vehicle weight to less than 20,000 pounds gross vehicle weight; and (c) $250.00 for motor vehicles more than 20,000 pounds gross vehicle weight; and (4) "Release at Scene Fee" of no more than the Hookup Fee. (5) "Storage Fee" per 24-hour period from completion of the tow of no more than: (a) $25.00 per day; or (b) $35.00 per day for motor vehicles over 20 feet long. Violation is Civil Infraction. (1) A tow company that violates or refuses to comply with this Chapter commits a civil infraction and shall be subject to a fine of up to $500. Each violation, and each day that a violation continues, constitutes a separate civil infraction. (2) In addition to any other remedy provided by law, a tow company that commits more than two violations of this Chapter within one year may have its license revoked for up to one year. Severability. Each section of this ordinance, and any part thereof, is severable. If any part of this ordinance is held invalid by a court of competent jurisdiction the remainder of this ordinance shall remain in full force. NOW, THEREFORE, THE CITY OF MOLALLA ORDAINS as follows: Section 1. This Ordinance is necessary for the immediate preservation of the public peace, health and safety, and, pursuant to section 18 of the Molalla City Charter, an emergency is declared to exist, and this Ordinance takes effect upon its passage. Goals from 2015/2016 were reviewed. Some of the 2015/2016 goals carried over and new goals added for 2016/2017. The 3 main existing goal categories were determined to still be relevant to the operational ideals City Council has for this community. In addition, the discussion determined a 4th category of developing a City of Molalla vision could help multiple entities prospers with a common understanding. Provide effective, efficient, and sustainable services while maintaining a healthy balanced budget. Provide a safe, livable community with a sense of pride and place. Actively engage in a community visioning process for the City of Molalla. Responsibly manage growth and economic development while maintaining effective relationships with local, state, and regional partners. 1. Provide a safe, livable community with a sense of pride and place. ‐ Increase public awareness of community safety needs. ‐ Improve Community Policing Efforts (More of a presence). ‐ Increase awareness and value of having neighborhood watches. ‐ Continue development of new website to promote community awareness and information provisions. ‐ Continue ongoing changes to the website to utilize to its fullest potential. ‐ Promote a Downtown Development/Main Street program, improvements, and events. ‐ Work with local events as partners through participation. ‐ Promote green space and park improvements. 2.
