VERŻJONI ELETTRONIKA B 13 B 13 L.N. 5 of 2017 EMPLOYMENT AND INDUSTRIAL RELATIONS ACT (CAP. 452) Wholesale and Retail Trades Wages Council Wage Regulation (Amendment) Order, 2017 IN exercise of the powers conferred by articles 4 and 48 (2) of the Employment and Industrial Relations Act, 2002, the Minister for Social Dialogue, Consumer Affairs and Civil Liberties has made the following Order – 1. The title of this Order is the Wholesale and Retail Trades Wages Council Wage Regulation (Amendment) Order, 2017 and it shall be read and construed as one with the Wholesale and Retail Trades Wages Council Wage Regulation Order, hereinafter referred to as "the principal Order". Title. 2. In paragraph 1 of the Schedule to the principal Order, the definition "half day" shall be deleted. Amends paragraph 1 of the Schedule to the principal Order. 3. Paragraph 2 of the Schedule to the principal Order shall be substituted by the following: Amends paragraph 2 of the Schedule to the principal Order. "2. The minimum weekly remuneration payable to whole-time employees shall be related to a week of not more than forty hours spread over six days: S.L. 452.63 Provided that the hours of work of watchmen shall be related to a week of not more than sixty hours spread over six days.". 4. Paragraph 5 of the Schedule to the principal Order shall be amended as follows: (a) subparagraph (1) thereof shall be deleted; and (b) subparagraph (2) thereof shall be substituted by the following: "(2) All whole time employees shall be entitled to at least one day of rest in every calendar week.". Amends paragraph 5 of the Schedule to the principal Order. VERŻJONI ELETTRONIKA B 14 B 14 Amends paragraph 6 of the Schedule to the principal Order. 5. Subparagraphs (b) and (c) of paragraph 6 of the Schedule to the principal Order and paragraphs (d), (e) and (f) shall be renumbered as paragraphs (b), (c) and (d) accordingly. Adds new paragraph 6A to the principal Order. 6. Immediately after paragraph 6 of the Schedule to the principal Order, there shall be inserted a new paragraph 6A as follows: "6A. (1) Employees in respect of whom this Order applies shall only be obliged to work on Sundays if they give their written consent to work on Sundays to their employer. (2) Only those employees who give their consent in terms of this paragraph shall be obliged to work on Sundays. These employees shall be paid in accordance with paragraph 6 of this schedule. (3) No employee shall be subject to any disadvantage, threat or actual dismissal by his employer on account that he is not willing to give his consent to work on Sundays in terms of this paragraph. (4) This paragraph shall not apply to those employees who are obliged to work on Sundays by virtue of a pre requisite in their contract of employment or in the written statement which must be drawn up in terms of the Act and its subsidiary legislation." Amends paragraph 7 of the Schedule to the principal Order. 7.
