An Act to amend the Law of Victoria in consequence of
the Adoption of Decimal Currency in Australia,
to make Provision for carrying the Adoption
thereof into effect in Victoria, and for other
purposes.

1. This Act may be cited as the Decimal Currency Act
1965.
2. In this Act unless inconsistent with the context or
subject-matter—
"Appointed day" means the 14th day of February, 1966.
"Commonwealth Currency Act" means the Act of the
Parliament of the Commonwealth of Australia known
as the Currency Act 1965, and includes any amendment
of that Act.
" Law of the State " means—
(a) an Act; and
(b) a statutory instrument.
" New currency " means the currency provided for by the
Commonwealth Currency Act.

"Old currency" means the currency provided for by the "ou

or made pursuant to the provisions of the
Arbitration Act 1958 or any other Act or Act NO. 5200.

(c) a determination of a Wages Board or the
Industrial Appeals Court made pursuant to
the provisions of the Labour mid Industry ActNo.«283.

(d) a determination of the Fair Rents Board ^or a
notice or agreement fixing the fair rent of
any prescribed premises made pursuant to the
provisions of the Landlord and Tenant Act Act NO. 6285.

provisions of the Workers Compensation Act Act NO. 6419.

(/) any instrument which the Governor in Council
by Order published in the Government Gazette
declares (either specifically or by reference
to the class to wluch the instrument belongs)
is not a statutory instrument.
Amendment of Acts.
3. On the appointed day the provisions referred to in Parts ^ 5 ^ , of
A, B and C of Schedule 1 shall be amended to the extent to which ^nfemd'
they are expressed to be amended in the said Parts.

4. The following provisions relating to money in the old
Mntn^ed by currcncy shall not be amended by this Act:—
(a) The provisions referred to in Schedule 2 ;
(b) Any provision not referred to in Schedule 2 but
which—
(i) refers to a payment loan bequest or transaction
which has been completed before the
appointed day and which on and after
that day has no continuing operative effect;
or
(ii) refers to a reference.in terms of money which
by virtue of this Act remains a reference
expressed in the old currency ; or
(iii) the Governor in Council by Order published
in the Government Gazette declares is not
amended by this Act.

5. (1) Except as to the provisions referred to in sections 3 and
4 and Schedules 1 and 2, on the appointed day in any provision
of any Act passed before that day for any words figures or symbols
or any combination of words figures and symbols representing
an amount of money in the old ciurency there shall by force of
this section be substituted a combination of the symbol and the
figure or figures which represent the equivalent amoimt of money
in the new currency.
(2) For the purposes of sub-section (1) of this section the
equivalent amount of money in the new currency shall be
ascertained by reference to the equivalents referred to in sub-section
(4) of section 8 of the Commonwealth Currency Act, and subject
to the next succeeding sub-section, the amount so ascertained
shall be expressed by a symbol and a figure or figures in the
manner indicated by such one of the examples in Item "A" of
Schedule 3 as is appropriate in the particular case.
(3) Notwithstanding any manner of expression referred to in
the last preceding sub-section on and after the appointed day—
{a) where pursuant to sub-section (1) of this section the
equivalent amount of money in the new currency
is less than One dollar when expressed in that currency
the whole expression in respect of that amount shall
be expressed in such manner indicated in Part
A of Schedule 1 as is appropriate in the particular
case ;
(6) where a reference in an Act expressed in terms of
money in the old currency—
(i) is to a percentage, there shall be substituted
a reference to the equivalent percentage in

the manner, where applicable, indicated by
such one of the examples in Item " B " of
Schedule 3 as is appropriate in the particular schedule 3.

(4) The Acts amended pursuant to the foregoing provisions of Appiicauon of
this Act shall be regarded as directly amended and the provisions in respect of
of the Amendments Incorporation Act 1958 shall apply to those ^S^SSuant
Acts accordingly.

(b) for any purpose ancillary to or consequent upon any
such substitution.
(2) Every such amendment shall take or be deemed to have
taken eifect on a day specified in the Order (not being a day
earUer than the appointed day), but if no such day is specified
shall take effect on the day on which publication or notification
of the Order appears in the Government Gazette.
(3) Any such Order may be made without regard to any method
prescribed by. law for the amendment of statutory instruments of
the kind in question or to the fact that any such instruments may
be incapable of amendment apart from this section, and any
amendment made pursuant to this section shall not affect the
scope or the period of operation of the statutory instrument
amended thereby or be the subject of any appeal or disallowance
or similar procedure, but every instrument so amended shall in
all other respects take effect, as amended, from the day on which
the Order takes effect.
(4) The Governor in Council may in Uke manner amend vary
or revoke any such Order.
(5) Any such Order amending a statutory instrument which
is a statutory rule by virtue of ttie provisions of the Subordinate
Legislation Act 1962 shall be a statutory rule within the meaning
of that Act.
7. (1) On and after the appointed day any reference in any
statutory instrument to an amount of money in the old currency
shall, unless the context is such that it would be inappropriate,
be construed as a reference to the equivalent amount of
money in the new currency calculated on the basis of the
equivalents expressed in sub-section (4) of section 8 of the
Commonwealth Currency Act.
(2) Where such a reference as is mentioned in the last preceding
sub-section is to a percentage or other proportion expressed in
terms of money the reference shall be construed as a reference
to the equivalent percentage or proportion in relation to the new
currency.
General.
8. Where in a law of the State there is a reference in terms of
money to a guinea or to guineas (including a reference in an
abbreviated form) the reference shall be construed on the basis that
a guinea is the equivalent of One pound and One shilling of the old
currency.
9. (1) The Governor in Council may at any time by Order
pubUshed in the Government Gazette give such directions and
take such actions not inconsistent with this Act as in the opinion
of

of the Governor in Council are necessary or expedient for the
administration of this Act or for the carrying out of its objects
and purposes.
(2) Without in any way limiting the generality of the provisions
of the last preceding sub-section any such Order may be made
for or with respect to—
(o) resolving doubts or difficulties arising, or which in the
opinion of the Governor in Council may arise in
respect of the correspondence (calculated on the
basis of the equivalents specified in sub-section (4)
of section 8 of the Commonwealth Currency Act)
of amounts of money (including percentages or
other proportions affecting money) when expressed
in the old currency and in the new currency ;
(6) correcting any errors or anomalies which in the opinion
of the Governor in Council have arisen in the
substitution of references to amounts of money
(including references to percentages or other
proportions affecting money) in respect of the old
currency to amounts of money in respect of the new
currency ;
(c) declaring that any reference to an amount of money
in the old currency (including any reference to
a percentage or other proportion affecting money)—
(i) which has been amended or substituted pursuant
to this Act be not so amended or substituted ;
and
(ii) which pursuant to section 4 of this Act has
not been amended by this Act be amended
to the extent expressed in the Order.
(3) The provisions of sub-sections (2) (3) (4) and (5) of section sub-sectiom
6 of this Act shall with such modifications as may be necessary St'oo^" "^
extend and apply to Orders made pursuant to this section.
'° "PP'^10. (1) Where in any document (including any register instrument
or record), not being a statutory instrument, which is made by
or under the authority of or for the purposes of a law of the
State there appears a reference to an amount of money (including
a reference to a percentage or other proportion) expressed in
the old currency the provisions of section 7 of this Act shall,
with such modifications as may be necessary, extend and apply
thereto in the same manner as to a reference in a statutory
instrument.

(2) The person in whose custody any such document is kept
may, where he deems it necessary or expedient so to do for
administrative purposes, substitute for any such reference the
appropriate reference in the new currency.
(3) Notwithstanding anything to the contrary in this section
any reference to a.n amount of money expressed in the old currency
in a document made by or under the authority of or for the
purposes of the Companies Act 1961 or any previous corresponding
enactment which is kept in the custody of the Registrar of
Companies shall on or after the appointed day be deemed to
be a reference to the equivalent amount of money expressed
in the new currency, and any copy of that document may be
altered accordingly.
11. Where a form provided for by or under the authority
of or for the purposes of a law of the State contains a reference
to an amount of money in terms of the old currency, a person
using the form on or after the appointed day may alter the
form to set forth the appropriate amount in terms of the new
currency.
12. Any instrument which on or after the appointed day
is stamped by virtue of the provisions of the Stamps Act 1958
shall, notwithstanding anything to the contrary in the said Act,
be deemed to be properly stamped for the purposes of the
Act if, on or before such day as the Governor by proclamation
pubhshed in the Government Gazette determines in respect of
instruments of the class to which the instrument belongs, there
is impressed on or affixed to that instrument the proper stamp
or stamps denoting the amount of money in the old currency
which if impressed on or affixed to the instrument immediately
prior to the appointed day would have made that instrument
a properly or duly stamped instrument for the purposes of that
Act.
13. (1) Where after the appointed day any matter or thing
relating to money is made executed entered into or done
according to the old currency, any amount payable by virtue of
or for the purposes of any law of the State in respect of such
matter or thing shall be the amount in the new currency which
would be payable if the references in the old currency in such
matter or thing had been expressed in the new currency on the
basis of the equivalents specified in sub-section (4) of section 8
of the Commonwealth Currency Act.
(2) For the purposes of this section " matter or thing " includes
payment sale security for money contract agreement deed instrument
transaction and deahng.

For item 3 in the Second Schedule to the Companies Act 1961 there shall be Act No. 6839.
substituted the following item :—
" 3. On lodging notice of increase of share capital—an amount equal to the
difference (if any) between the amount wliich would have been payable under
this Act on first registration by reference to its capital as increased and the
amount which would have been payable under this Act by reference to its
capital immediately before the increase but in the case of a company registered
before 15th November, 1956 with a share capital of less than £5,000 the fee
shall be $10 per $2,000 or any fractional part of $2,000 for any increase up to
$10,000 and thereafter an amount calculated as aforesaid."

Item D. 1. The Closer Settlement Act 1938 shall be amended as follows :—

(a) In section 12—
(i) in paragraph (b) of sub-section (3) after the words "on the
appointed day " there shall be inserted the words " together
with interest at the rate of four and a quarter per centum " ;
(ii) in sub-section (5) for the words " in the Third Schedule to this
Act" there shall be substituted the words "caused to be
prepared by the Minister in accordance with this section " ;
(6) In section 27—
(i) in paragraph (b) of sub-section (2) after the words " under the
lease " there shall be inserted the words " together with interest
at the rate of four and a quarter per centum " ;
(ii) in sub-section (3) for the words " in the Fourth Schedule to this
Act" there shall be substituted the words "caused to be
prepared by the Minister in accordance with this section " ;
(c) The Third and Fourth Schedules are hereby repealed.
2. In the Land Act 1958—
(a) sub-section (4) of section 114 ;
