I attach correspondence I have received from Mr. Madeley Evans . At this stage I am not prepared to
enter into a dialogue with him outside the Examination process as he had plenty of opportunity
yesterday to raise any points of concern yesterday and possibly can do so again on Tuesday at the
discretion of the Inspector. Can you please forward this note to the Inspector.

Dear Mr Evans,
I am not going to respond to your comments outside the Examination process as you had the
opportunity to raise specific questions yesterday. You can address any concerns to the Inspector via
the Programme Officer and I have passed your note and this reply to him so he can forward to the
Inspector. The only comment I would make is regarding flood risk. On the map we have from the
Environment Agency which is more detailed than the map you enclose a small part of the north west
corner of the site is within a C2 flood risk area. This has been verified by the Environment Agency in
the consultation process on your site. As stated by the Inspector you can make further comments on
any representations received on your site after the end of the consultation period and she can take
any comments you make into consideration.

Land at Ty Canol
I was concerned yesterday that much of the information that you presented at the hearing
yesterday, in respect of the above, differed to that which my research had established.
This included,
Flood Plain
In item 6.6 of your response to my examination statement you stated that the above site was
located in the Zone C2. The information that I had was supplied by James Morris of WAG. He had
supplied me with a map headed “TAN 15 Development& Flood Risk ’09: Development Advice Map
(SH53)”. I attach a copy of it herewith as sent to me by WAG, for your edification. Notwithstanding
the result of the SASEA perhaps you would confirm where your Map was sourced, and what year it
was produced.
Site Area
You became muddled when commenting on the area of my site. Firstly you referred to a site area of
2.4 acres and extrapolated the number of units that might be developed upon it at about 30. You
then realised your area and conceded that the site extended to 6 acres (2.4 hectares) but you did
not correct the number of units that might be built. You know that the Inspector in 1981
recommended a density of 9 units per acre, so the figure should have been around 54. Indeed as
affordable units are to be provided, the density might well increase as town houses will need to be
built to part. The Inspector will be left with remembering your initial figure with no way of knowing
that it was substantially incorrect.
Land Availability in the Harlech Area
I have made reference to the Joint Housing Land Availability Study dated 2008 and 2005 quoting 12
and 114 units respectively. We were told by a member of the attendance yesterday that another
unit at Cae Main had been commenced leaving only three left for future development. You
mentioned a figure of 25 and then 30 as being the true position so I would be obliged if you would
inform me of the precise whereabouts of these plots awaiting construction.
Valid Planning Permission
You appreciate that I believe the site enjoys extant consent for a motel and roads and sewers.
Papers have recently come to light showing the Inspector in the 1981 Appeal was aware of the
extant consent at that time. Chapter and verse of this has been forwarded to Mr Bowers for his
consideration.
I understand the Inspector is giving us a further opportunity to make any corrections on 23rd
November, so I would appreciate an early response. Obviously I fully appreciate you are under
pressure at the present time, but your co-operation would be appreciated.
