2. S u b j e c t t o the p r o v i s i o n s of t h i s A c t , a n d w i t h t h e e x c e p t i o n s
therein mentioned, the powers and authorities conferred and the duties
i m p o s e d b y t h e u n r e p e a l e d e n a c t m e n t s of t h e N a v i g a t i o n A c t s , 1 8 7 1 181)0, o n t h e M a r i n e B o a r d of N e w S o u t h W a l e s , o r a n y L o c a l M a r i n e
B o a r d , a r e h e r e b y c o n f e r r e d a n d i m p o s e d o n a n officer a p p o i n t e d b y
t h e G o v e r n o r t o b e c a l l e d t h e S u p e r i n t e n d e n t of t h e D e p a r t m e n t of
N a v i g a t i o n (hereinafter in this A c t referred to as t h e s u p e r i n t e n d e n t )

the Governor to discharge those duties ; a n d the powers conferred and

4. T h e G o v e r n o r shall appoint a d e p u t y s u p e r i n t e n d e n t for t h e
p o r t of N e w c a s t l e .
S u c h d e p u t y s u p e r i n t e n d e n t shall, in the absence
of t h e s u p e r i n t e n d e n t , e x e r c i s e s u c h of t h e p o w e r s a n d a u t h o r i t i e s
c o n f e r r e d a n d p e r f o r m s u c h of t h e d u t i e s i m p o s e d b y t h i s A c t o n t h e
s u p e r i n t e n d e n t as m a y be prescribed b y t h e G o v e r n o r b y
order
p u b l i s h e d in t h e G a z e t t e .

a n d a c c o r d i n g t o t h e t e r m s a n d p r o v i s i o n s of t h e D i s t r i c t C o u r t s A c t
of 1 8 5 8 a n d a n y A c t a m e n d i n g t h e s a m e (so f a r a s t h e y a r e a p p l i c a b l e ) ,
a n d of t h i s A c t ; a n d a D i s t r i c t C o u r t e x e r c i s i n g s u c h j u r i s d i c t i o n s h a l l
b e a c o u r t of r e c o r d , a n d b e c a l l e d a C o u r t of M a r i n e I n q u i r y .
7 . A n y o n e or m o r e of t h e D i s t r i c t C o u r t J u d g e s m a y s i t a s a
C o u r t of M a r i n e I n q u i r y , a n d s h a l l b e a s s i s t e d b y t w o of t h e a s s e s s o r s
appointed u n d e r this A c t ; s u c h assessors shall h a v e power to advise,
b u t not to adjudicate, on a n y m a t t e r before t h e Court.

9. ( 1 ) T h e J u d g e s of t h e D i s t r i c t C o u r t s , o r a n y t h r e e of t h e m ,

of M a r i n e I n q u i r y , a n d s u c h r u l e s s h a l l h a v e t h e s a m e f o r c e a n d
effect a s if t h e y h a d f o r m e d a p a r t of t h i s A c t , n o t w i t h s t a n d i n g t h a t
t h e y m a y c o n f l i c t w i t h t h e p r o v i s i o n s of t h e D i s t r i c t C o u r t s A c t of

m a k e i n q u i r i e s as to s h i p w r e c k s a n d o t h e r casualties affecting ships, or
a s t o c h a r g e s of i n c o m p e t e n c y o r m i s c o n d u c t o n t h e p a r t of m a s t e r s ,
m a t e s , o r e n g i n e e r s of s h i p s i n t h e f o l l o w i n g c a s e s , n a m e l y :—•
(a) W h e r e a s h i p w r e c k or c a s u a l t y occurs to a B r i t i s h s h i p o n
o r n e a r t h e c o a s t of N e w S o u t h W a l e s o r i n t h e c o u r s e of a
voyage to a port w i t h i n N e w South W a l e s .
(b) W h e r e a s h i p w r e c k o r c a s u a l t y o c c u r s i n a n y p a r t of t h e
w o r l d to a B r i t i s h s h i p r e g i s t e r e d in N e w S o u t h W a l e s .
( r ) W h e r e s o m e of t h e c r e w of a B r i t i s h s h i p w h i c h h a s b e e n
wrecked or to w h i c h a casualty has occurred a n d w h o are
c o m p e t e n t witnesses to the facts are f o u n d in N e w S o u t h
Wales.
((/) W h e r e t h e i n c o m p e t e n c y o r m i s c o n d u c t h a s o c c u r r e d o n b o a r d
a B r i t i s h s h i p o n o r n e a r t h e c o a s t s of N e w S o u t h W a l e s , o r
o n b o a r d a B r i t i s h s h i p i n t h e c o u r s e of a v o y a g e t o a p o r t
within New South Wales.

m a t t e r w h i c h h a s o n c e b e e n t h e s u b j e c t of a n i n v e s t i g a t i o n o r i n q u i r y ,
a n d h a s b e e n r e p o r t e d o n b y a c o m p e t e n t c o u r t or t r i b u n a l i n a n y p a r t
of H e r M a j e s t y ' s d o m i n i o n s , o r i n r e s p e c t of w h i c h t h e c e r t i f i c a t e of
a m a s t e r , m a t e , o r e n g i n e e r h a s b e e n c a n c e l l e d or s u s p e n d e d b y a n a v a l
court constituted under the Imperial Merchant Shipping Act, 1894.
(1) W h e r e a n i n v e s t i g a t i o n o r i n q u i r y h a s b e e n c o m m e n c e d
in the U n i t e d K i n g d o m with reference to a n y m a t t e r , an inquiry with
reference to t h e s a m e m a t t e r shall not be held u n d e r this section.
(5) T h e s a i d c o u r t , h o l d i n g a n i n q u i r y u n d e r t h i s s e c t i o n ,
s h a l l h a v e t h e s a m e p o w e r s of c a n c e l l i n g a n d s u s p e n d i n g c e r t i f i c a t e s ,
a n d shall exercise those powers in t h e s a m e m a n n e r as a c o u r t holding
a s i m i l a r i n v e s t i g a t i o n or i n q u i r y i n t h e U n i t e d K i n g d o m .
( 0 ) T i n ; s a i d c o u r t , f o r t h e p u r p o s e s of a n y i n q u i r y u n d e r
t h i s s e c t i o n , s h a l l , so f a r a s r e l a t e s t o t h e s u m m o n i n g of p a r t i e s , a n d
c o m p e l l i n g t h e a t t e n d a n c e of w i t n e s s e s , h a v e a l l t h e p o w e r s of t h e
Supreme Court.
1 1 . A C o u r t of M a r i n e I n q u i r y s h a l l , w h e n r e q u e s t e d b y t h e
C o l o n i a l T r e a s u r e r a n d m a y i n a n y c a s e w h e r e i t t h i n k s fit, m a k e a n v
inquiry u n d e r t h e last preceding section.
12. T h e G o v e r n o r m a y , w h e r e a n y s u c h i n q u i r y as aforesaid
h a s b e e n m a d e , o r d e r t h e c a s e t o b e r e h e a r d b y a C o u r t of M a r i n e
I n q u i r y , e i t h e r g e n e r a l l y or as to a n y p a r t thereof, a n d shall do s o —
(a) if n e w a n d i m p o r t a n t e v i d e n c e , w h i c h c o u l d n o t b e p r o d u c e d
at the inquiry, has been discovered ;
(b) if for a n y o t h e r r e a s o n t h e r e h a s , i n t h e o p i n i o n of t h e
G o v e r n o r , b e e n g r o u n d f o r s u s p e c t i n g t h a t a m i s c a r r i a g e of
justice has occurred.
13. T h e senior District Court J u d g e present shall preside a t a n y
s i l t i n g of a C o u r t of M a r i n e I n q u i r y .
E v e r y i n q u i r y u n d e r t h i s A c t shall b e in open c o u r t .
The
d e c i s i o n of t h e c o u r t s h a l l b e d e l i v e r e d b y t h e p r e s i d i n g j u d g e i n
open court.
I n t h e e v e n t of a n e q u a l i t y of v o t e s t h e p r e s i d i n g j u d g e
shall h a v e a c a s t i n g as well as a deliberative vote.
T h e p r e s i d i n g j u d g e s h a l l in e v e r y c a s e f o r w a r d
to t h e
G o v e r n o r a c o p y of t h e d e c i s i o n of t h e c o u r t , t o g e t h e r w i t h n o t e s
of t h e e v i d e n c e g i v e n ; a n d i t s h a l l b e c o m p e t e n t f o r a n y m e m b e r
of t h e c o u r t w h o d i s s e n t s f r o m t h e d e c i s i o n t o l i k e w i s e f o r w a r d h i s

1 4 . A m a s t e r , m a t e , o r e n g i n e e r , w h o s e c e r t i f i c a t e is c a n c e l l e d
o r s u s p e n d e d b y a C o u r t of M a r i n e I n q u i r y , s h a l l d e l i v e r h i s c e r t i f i c a t e
t o t h e s a i d c o u r t o n d e m a n d , o r if n o t so d e m a n d e d , t o t h e s u p e r i n ­
t e n d e n t , or as t h e s u p e r i n t e n d e n t directs.
I f a m a s t e r , m a t e , or e n g i n e e r fails w i t h o u t sufficient c a u s e t o
c o m p l y w i t h t h i s s e c t i o n , h e s h a l l for e a c h offence b e l i a b l e t o a
p e n a l t y n o t e x c e e d i n g fifty p o u n d s .
1 5 . (1) A C o u r t of M a r i n e I n q u i r y s h a l l h e a r a n d d e t e r m i n e
i n o p e n c o u r t a n y a p p e a l o r r e f e r e n c e i n p u r s u a n c e of t h i s A c t i n
r e s p e c t of t h e d e t e n t i o n of a s h i p a l l e g e d t o b e u n s a f e ; a n d t h e p r o ­
c e d u r e of t h a t c o u r t o n t h e h e a r i n g a n d d e t e r m i n i n g of s u c h a p p e a l o r
r e f e r e n c e s h a l l b e a s p r o v i d e d i n p u r s u a n c e of t h i s A c t i n r e s p e c t of
i n q u i r i e s as to s h i p w r e c k s .
(2) A n y j u d g e o r a s s e s s o r of t h e c o u r t m a y s u r v e y t h e
s h i p , a n d s h a l l , f o r t h e p u r p o s e s of t h i s A c t , h a v e a l l t h e p o w e r s of a n
inspector under the Navigation Acts, 1871-1890.
( 3 ) T h e p r e s i d i n g j u d g e of t h e c o u r t m a y a p p o i n t a n y
c o m p e t e n t p e r s o n or p e r s o n s to s u r v e y t h e ship a n d r e p o r t t h e r e o n to
the court.
(1) A n y j u d g e of t h e c o u r t , a n y a s s e s s o r of t h e c o u r t , a n d
a n y p e r s o n a p p o i n t e d b y t h e p r e s i d i n g j u d g e of t h e c o u r t t o s u r v e y
a ship, m a y go on hoard t h e ship a n d inspect t h e same a n d every p a r t
thereof, a n d t h e m a c h i n e r y , e q u i p m e n t s , a n d cargo, a n d m a y r e q u i r e
t h e u n l o a d i n g o r r e m o v a l of a n y c a r g o , b a l l a s t , o r t a c k l e ; a n d a n y
p e r s o n w h o wilfully i m p e d e s s u c h j u d g e , assessor, or p e r s o n i n t h e
e x e c u t i o n of t h e s u r v e y , o r f a i l s t o c o m p l y w i t h a n y r e q u i s i t i o n m a d e
by him, shall be liable to a penalty not exceeding t e n pounds.
(5) T h e c o u r t s h a l l h a v e t h e s a m e p o w e r as t h e s u p e r ­
i n t e n d e n t h a s t o o r d e r t h e s h i p t o b e r e l e a s e d or f i n a l l y d e t a i n e d , b u t
u n l e s s o n e of t h e a s s e s s o r s c o n c u r s i n a n o r d e r for t h e d e t e n t i o n of
t h e s h i p , the s h i p s h a l l b e r e l e a s e d .
( 0 ) T h e o w n e r a n d m a s t e r of t h e s h i p , a n d a n y p e r s o n
a p p o i n t e d b y t h e o w n e r or m a s t e r , a n d also a n y p e r s o n a p p o i n t e d b y
t h e Colonial Treasurer, m a y a t t e n d at a n y inspection or survey m a d e
i n p u r s u a n c e of t h i s s e c t i o n .
(7) T h e p r e s i d i n g j u d g e s h a l l s e n d t o t h e G o v e r n o r s u c h
r e p o r t as m a y be directed b y the rules, a n d each assessor shall either
s i g n the r e p o r t , o r r e p o r t t o t h e G o v e r n o r t h e r e a s o n s f o r h i s d i s s e n t .
1 6 . ( 1 ) T h e a s s e s s o r s w h o a s s i s t i n a C o u r t of M a r i n e I n q u i r y
u n d e r t h i s A c t s h a l l b e of n a u t i c a l , e n g i n e e r i n g , o r o t h e r s p e c i a l s k i l l o r
k n o w l e d g e , a n d s h a l l b e a p p o i n t e d o u t of a l i s t of p e r s o n s for t h e t i m e
b e i n g a p p r o v e d for t h e p u r p o s e b y t h e G o v e r n o r , i n s u c h a m a n n e r a n d
a c c o r d i n g t o s u c h r e g u l a t i o n s a s m a y be' p r e s c r i b e d b y r u l e s m a d e b y
the Governor with regard thereto.

(2) W h e r e a n y i n q u i r y i n v o l v e s or appeal's l i k e l y to i n v o l v e
a n y q u e s t i o n a s t o t h e c a n c e l l i n g o r s u s p e n s i o n of t h e c e r t i f i c a t e of a
m a s t e r , m a t e , or e n g i n e e r , t h e c o u r t shall hold tin; i n q u i r y w i t h t h e
a s s i s t a n c e of n o t l e s s t h a n t w o a s s e s s o r s h a v i n g e x p e r i e n c e i n t h e
m e r c h a n t service.
( 3 ) T h e l i s t of p e r s o n s a p p r o v e d a s a s s e s s o r s s h a l l h e i n
force for o n e y e a r o n l y , b u t persons w h o s e n a m e s are on a n y s u c h
list m a y b e a p p r o v e d for a n y s u b s e q u e n t list.
(4) T h e G o v e r n o r m a y a t a n y t i m e a d d or w i t h d r a w t h e
n a m e of a n y p e r s o n t o or F r o m t h e l i s t .
(5) T h e G o v e r n o r m a y m a k e rules w i t h r e g a r d to t h e
a p p o i n t m e n t a n d s u m m o n i n g of a s s e s s o r s , a n d a n y s u c h r u l e w h i l e in
f o r c e s h a l l h a v e effect a s if it w e r e e n a c t e d i n t h i s A c t .
1 7 . E v e r y a s s e s s o r s h a l l , for e v e r y d a y o r p o r t i o n of a d a y
d u r i n g w h i c h h e is e n g a g e d i n a C o u r t of . M a r i n e I n q u i r y , o r i n
a t t e n d a n c e w a i t i n g t o p e r f o r m his d u t i e s in a n y s u c h c o u r t , b e p a i d t h e
s u m of t h r e e p o u n d s o u t of a n y m o n e y s t o b e v o t e d b y P a r l i a m e n t f o r
that purpose.

t h e s a m e e f f e c t a s if i t h a d b e e n f i x e d , m a r k e d , o r g i v e n i n a c c o r d a n c e
with this Act.
( 2 ) W h e r e t h e l e g i s l a t u r e of a n y B r i t i s h p o s s e s s i o n b y a n y
e n a c t m e n t p r o v i d e s for t h e f i x i n g , m a r k i n g , a n d c e r t i f y i n g of l o a d lines on ships registered in t h a t possession, a n d it a p p e a r s to t h e
G o v e r n o r t h a t t h a t e n a c t m e n t is b a s e d o n t h e s a m e p r i n c i p l e s a s
