An Act to provide for the Exchange of certain pieces of Land
vested in the Melbourne Harbor Trust Commissioners for
certain other pieces of Land in which the Mount Lyell Mining
and Railway Company Limited the Vacuum Oil Company
Proprietary Limited and Cuming Smith and Company
Proprietary Limited are the respective registered proprietors of
an Estate in Fee Simple under the provisions of the Transfer of
Land Acts and for other purposes.
Preamble
WHEREAS the lands described in the First
Second, Third Sixth Seventh Tenth and Fifteenth
Schedules to this Act and so much of the land
described in the Eleventh and Twelfth Schedules to
this Act as are not comprised in certificates of title
Volume 2409 Folium 481753 Volume 2409
Folium 481754 and Volume 2807 Folium 561245
in the Register Book of the Office of Titles in
Victoria form or may form portions of the lands
vested in The Melbourne Harbor Trust
Commissioners (hereinafter called the
Commissioners) by the Melbourne Harbor Trust
Act 1915 for the purposes of that Act:
AND WHEREAS The Mount Lyell Mining and
Railway Company Limited a company
incorporated and having its registered office in
Victoria (hereinafter called the Mount Lyell
Company) is registered as the proprietor of an
estate in fee simple in the land described in the
Fourth and Fifth Schedules to this Act:

Preamble
AND WHEREAS The Vacuum Oil Company
Proprietary Limited a company incorporated and
having its registered office in Victoria (hereinafter
called the Vacuum Oil Company) is registered as
the proprietor of an estate in fee simple in the land
described in the Eighth Schedule to this Act:
AND WHEREAS Cuming Smith and Company
Proprietary Limited a company incorporated and
having its registered office in Victoria (hereinafter
called the Cuming Smith Company) is registered
as the proprietor of an estate in fee simple in so
much of the land described in the Eleventh
Schedule to this Act as is comprised in certificates
of title Volume 2409 Folium 481753 Volume 2409
Folium 481754 and Volume 2807 Folio 561245
entered in the Register Book of the Office of Titles
in Victoria:
AND WHEREAS the lands constituting the street
in the city of Footscray known as Comben-street
set out on Crown land will not be required for the
purposes of a public highway when the land
described in First Ninth and Second Schedules to
this Act have been proclaimed public highways in
lieu thereof:
AND WHEREAS the council of the city of
Footscray has agreed to the closing of Combenstreet as aforesaid:
AND WHEREAS it is expedient that the land
constituting Comben-street shall cease to be a
street and shall be vested as hereinafter provided
and that in lieu thereof the lands described in the
said First Ninth and Second Schedules shall as
soon as available for the purpose be dedicated to
the public as highways:
AND WHEREAS doubts as to the correct lines of
demarcation between their several properties have
arisen between the Commissioners and the
hereinbefore recited companies and agreements
have been entered into between them for the

adjustment of such lines of demarcation in the
manner hereinafter provided:
BE IT THEREFORE ENACTED by the King's Most
Excellent Majesty by and with the advice and consent of the
Legislative Council and the Legislative Assembly of Victoria
in this present Parliament assembled and by the authority of
the same as follows (that is to say):
1. Short title
This Act may be cited as the Melbourne Harbor
Trust (Exchange of Lands) Act 1922.
2. Vesting of certain lands in Melbourne Harbor Trust
Commissioners
Notwithstanding anything to the contrary in any
Act law or usage whatsoever or in any indenture
deed agreement instrument or writing whatsoever
by whomsoever made or entered into—
(a) such portions of the land described or
referred to in the First Second Fifth Eighth
Ninth Tenth Twelfth and Thirteenth
Schedules to this Act as are not already
vested in the Commissioners are hereby
without further or other conveyance or
transfer than this Act vested in the
Commissioners freed and discharged from
any easements mortgages charges or liens
heretofore affecting the same respectively
but subject however to any rights or
easements over parts thereof granted or
created by this Act;

(b) the Registrar of Titles must make any
recordings in the Register that are necessary
or expedient because of the vesting of lands
in the Commissioners in accordance with
this Act and the holders of any relevant
certificate of title must deliver it to the
Registrar of Titles;

3. Vesting of certain lands in Mount Lyell Railway and
Mining Company Limited
Notwithstanding anything in the Melbourne
Harbor Trust Act 1915 the fee simple of the land
described in the Third Sixth Fourteenth and
Fifteenth Schedules to this Act together with a
right of carriage way over the land described in
the Fifth and Tenth Schedules to this Act shall
upon payment by the Mount Lyell Company to
the Commissioners of the sum of Seven hundred
and seventy-five pounds become vested in the
Mount Lyell Company subject however to such
rights for sewerage purposes over the said land
described in the Third Schedule to this Act as may
be required by the Melbourne and Metropolitan
Board of Works and the Vacuum Oil Company or
either of them and subject also as to the land
described in the Sixth Schedule to this Act to the
rights of the Southern Cross Motor Fuels
Company Limited under the lease thereof to it
from the Commissioners subsisting at the
commencement of this Act reserving however to
the Commissioners the right to use the said land
described in the said Fifth and Tenth Schedules to
this Act for railway purposes.

4. Vesting of certain lands in Vacuum Oil Company
Proprietary Limited
Notwithstanding anything in the Melbourne
Harbor Trust Act 1915 and notwithstanding that
the Mount Lyell Company is the registered
proprietor under the Transfer of Land Acts of the
lands described in the Fourth Schedule to this Act
the fee simple of the land described in the Fourth
and Seventh Schedules to this Act together with a
right of carriage way over the land described in
the Thirteenth Schedule to this Act and together
with the right to use for sewerage purposes the
land described in the Third Schedule to this Act
shall become vested in the Vacuum Oil Company
reserving however to the Commissioners the right
to use the land described in the said Thirteenth
Schedule to this Act for railway purposes.
5. Vesting of certain land in Cuming Smith and
Company Proprietary Limited
Notwithstanding anything in the Melbourne
Harbor Trust Act 1915 the fee simple of so
much of the land described in the Eleventh
Schedule to this Act as was immediately prior to
the commencement of this Act vested in the
Commissioners shall together with a right of
carriage way in favour of the whole of the land
described in the said Eleventh Schedule to this
Act over the land described in the Twelfth
Schedule to this Act become vested in the Cuming
Smith Company reserving however to the
Commissioners the right to use the land described
in the said Twelfth Schedule to this Act for
railway purposes.

6. Closing of Comben-street Footscray
Upon the last of the respective proclamations as
public highways of the lands described in the First
Ninth and Second Schedules to this Act the lands
now constituting Comben-street Footscray shall
cease to be a public highway and all rights
easements or privileges existing or claimed as
regards the said lands constituting Comben-street
either in the public or by any body or person
whatsoever or whomsoever as incident to any past
dedication or supposed dedication thereof or by
any past user thereof or by any fiction of law shall
cease and determine and the said lands
constituting Comben-street shall vest as
hereinbefore is provided.
7. Creation of folios of the Register in respect of
certain lands
Upon applications in writing being made to the
Registrar of Titles by the Mount Lyell Company
the Vacuum Oil Company and the Cuming Smith
Company respectively under their respective
common seals to be registered as the respective
registered proprietors of the respective parcels of
land vested in them respectively by virtue of this
Act with the respective rights of easements hereby
created in favour of such parcels of land
respectively and upon payment to the Registrar of
Titles as a contribution to the assurance fund
under the Transfer of Land Acts of a contribution
at the rate of one half-penny in the pound upon the
value of the land so vested in the said respective
companies as aforesaid and upon payment to the
Registrar of Titles of the prescribed fees for new
certificates of title in relation thereto respectively
and upon payment in the case of the Mount Lyell
Company to the Comptroller of Stamps of stamp
duty as on a sale in respect of the sum of Seven
hundred and seventy-five pounds in relation to the

land in the said Third Schedule to this Act the said
Registrar of Titles shall—
(a) create a folio or folios of the Register in
which the Mount Lyell Company is recorded
as registered proprietor in respect of the land
described in the said Third Sixth Fourteenth
and Fifteenth Schedules to this Act together
with an easement of carriage way over (but
subject as to such easement of carriage way
to the diverse right in favour of the
Commissioners reserved by this Act) the
land described in the said Fifth and Tenth
Schedules to this Act;

which the Vacuum Oil Company is recorded

8. Lands vested in Commissioners under this Act
deemed to be purchased
Any lands vested in the Commissioners by virtue
of this Act shall be deemed to be lands purchased
by the Commissioners pursuant to section fortynine of the Melbourne Harbor Trust Act 1915
and may accordingly be dealt with by the
Commissioners in accordance with the provisions
of section fifty of the Melbourne Harbor Trust
Act 1915.

FIRST SCHEDULE

Land, being portion of the land vested in the Commissioners, proposed to be
proclaimed a public highway
All that piece or parcel of land situate at Yarraville, city of Footscray, and
bounded as follows:
Commencing at a point on the old bank of the River Yarra, which bears east
six hundred feet one inch from the intersection of the west side of Whitehallstreet with the north side of Francis-street; thence by lines east six hundred
and eighty-four feet seven inches and one-half of an inch, S. 37º 15' W.
eighty-two feet eleven inches, west six hundred and sixty feet seven inches
and three-quarters of an inch; thence north-easterly along the old bank of
River Yarra to the point of commencement.

SECOND SCHEDULE
Land, being portion of the land vested in the Commissioners, proposed to be
proclaimed a public highway
All that piece or parcel of land containing one acre twenty-seven perches and
seven-tenths of a perch or thereabouts situate at Yarraville, city of Footscray,
and bounded as follows:
Commencing at a point on the south side of Whitehall-street, which bears
south eight hundred and fifty-two feet four inches from the intersection of the
prolongation of the south side of Francis-street with the east side of
Whitehall-street; thence by lines east five hundred and forty-seven feet and
three-quarters of an inch; thence south-westerly one hundred and sixteen feet
nine inches in an arc of a circle whose radius is six thousand one hundred and
seventy feet, and whose chord bears S. 32º 00' W. one hundred and sixteen
feet nine inches; thence by lines west four hundred and eighty-five feet two
inches and one-half of an inch, and north by the east side of Whitehall-street
ninety-nine feet to the point of commencement.

of the land vested in the Commissioners, proposed to be sold by the
Commissioners to the Mount Lyell Company
All that piece or parcel of land containing one acre 2 roods eight perches and
four-tenths of a perch or thereabouts situate at Yarraville, city of Footscray,
and bounded as follows:
Commencing at a point on the east side of Whitehall-street, which bears
north three hundred and twenty-eight feet eight inches from the intersection
of the prolongation of the north side of Francis-street with the east side of
Whitehall-street; thence by lines bearing east one thousand four hundred and
sixty-two feet eleven inches; thence eighty-three feet nine inches in an arc of
a circle whose radius is five hundred and seventy-five feet and whose chord
bears S. 33º 05' W. eighty-three feet eight inches; thence by lines

All that piece or parcel of land containing three acres one rood thirty-six
perches and one-half of a perch or thereabouts, being part of Part 8 of
Section 8, parish of Cut-paw-paw, situate at Yarraville, city of Footscray,
and bounded as follows:
Commencing at the intersection of the prolongation of the southside of
Francis-street with the east side of Whitehall-street; thence east five hundred
and eight feet nine inches to a point on the old bank of River Yarra; thence
south-westerly four hundred and forty-six feet and three-quarters of an inch
along the old bank of River Yarra to a point which bears south two hundred

sixty-six feet from the intersection of west side of Whitehall-street with the
north side of Francis-street; thence by a line East five hundred and thirty-four
feet one inch; thence south-westerly along the old bank of River Yarra to a
point which bears east five hundred and seventy-four feet nine inches from
the intersection of the west side of Whitehall-street with the south side of

and bounded as follows:

Commencing at a point on the prolongation of the south side of Somervilleroad distant easterly one thousand two hundred and thirteen feet and one-half
of an inch from the north-west angle of Crown allotment 1 of Sec. VIII,
parish of Cut-paw-paw; thence by the prolongation of the south side of
Somerville-road easterly one hundred and fifty-seven feet four inches; thence
by lines S. 18º 50' E. seven hundred and seventy-six feet eight inches and
three-quarters of an inch S. 89º 33' W. one hundred and fifty-seven feet
N. 18º 50' W. seven hundred and seventy-seven feet eight inches to the point

THIRTEENTH SCHEDULE
Land, being portion of the land vested in the Commissioners, over which it is
proposed to grant an easement of carriage way to the Vacuum Oil
Company
All that piece or parcel of land situate at Yarraville, city of Footscray, and
bounded as follows:
Commencing at a point which bears east eleven hundred and sixty-nine feet
four and one half inches from the intersection of the prolongation of the south
side of Francis-street with the east side of Whitehall-street; thence by lines
east one hundred and eighty-seven feet two inches, S. 37º 15' W. six hundred
and thirty-one feet; thence four hundred and twenty-three feet ten inches in
an arc of a circle whose radius is six thousand and twenty-one feet and whose
chord bears S. 35º 31' W. four hundred and twenty-three feet nine inches;
thence west one hundred and eighty-seven feet eleven and one half inches;
thence five hundred and thirty-eight feet five and one quarter inches in an arc
of a circle whose radius is six thousand one hundred and seventy feet and
whose chord bears N. 35º 02' E. five hundred and thirty-eight feet one inch;
thence N. 37º 15' E. five hundred and sixteen feet eleven and one-half inches
to the point of commencement.

Land proposed to be transferred to the Mount Lyell Company
All that piece or parcel of land at Yarraville containing one rood thirty-one
perches and three-tenths of a perch or thereabouts being portion of Combenstreet closed, and bounded as follows:
Commencing at a point on the east side of Whitehall-street which bears north
two hundred and seventy-six feet ten inches from the intersection of the
prolongation of the north side of Francis-street with the east side of
Whitehall-street; thence north fourteen feet two inches east one thousand
three hundred and ninety-five feet seven inches and one-half of an inch;
thence fourteen feet one inch and one-half of an inch in an arc of a circle
whose radius is five hundred and thirty-seven feet four inches and whose
chord bears S. 36º 29' W. fourteen feet one inch and one-half of an inch;
thence S. 37º 15' W. four feet nine inches and one-half of an inch; thence
west one thousand three hundred and eighty-two feet nine inches and onehalf of an inch to the point of commencement.

perches and one-tenth of a perch or thereabouts, being portion of Combenstreet closed and bounded as follows:
Commencing at a point on the east side of Whitehall-street which bears north
three hundred and forty-two feet ten inches from the intersection of the
prolongation of the north side of Francis-street with the east side of
Whitehall-street; thence east one thousand four hundred and sixty-nine feet
eight inches and three-quarters of an inch; thence seventeen feet nine inches
and one-half of an inch in an arc of a circle whose radius is five hundred and
seventy-five feet and whose chord bears S. 25º 44' W. seventeen feet nine
inches and one-half of an inch; thence west one thousand four hundred and
sixty-two feet eleven inches; thence north fourteen feet two inches to the
point of commencement.
