There has been much discussion on the use of the Union (Yellow) label with Ecco Heating
Products Ltd. expressing a desire to continue to use the label, and the Union also wanting the
contractor to continue to use the union label.
A concern has been raised over the use of the word (Yellow) as it appears in various Articles and
Schedules of the Agreement, both parties agree to remove the word (Yellow) from the following
locations so they would now read as follows:
Article 9 Hours of Work, Overtime and Shift Work (paragraph lIon page 16) the sentence
would now read" During a regular work week season, those employees working on the optional
shortened work week shall receive a share of the Label pool equal to 80% of a full share. "
Schedule "A" Spiral Machine Operator (page 34 & 35)
The first sentence of Paragraph (1) to now read " When the spiral machine operator is employed
making Label Products, the wage and conditions of the Standard Sheet Metal Agreement shall
apply for one position per spiral machine. "
The first sentence of Paragraph (2) to now read "The difference in wages between production
rate and field rates shall be collected in the Label pool which will be shared equally amongst all
employees under the collective agreement based on hours worked and wages paid out
quarterly. "
And the second sentence of Paragraph (3) to now read " The Label pool shall be paid out
quarterly to all employees working a regular work week or a short work week during the slow
season, and an equal amount shall be paid to each employee based on the shortest work week in
effect. "

With the deletion of the word (Yellow) from these various locations, it is agreed that the intent of
both parties to continue to use the Yellow Label and the Label pool as per long standing past
practice in every way without change, and the Sheet Metal Workers' International Association
Building Trades requirement. There shall be no changes made that affect the wages and benefits
ofthe Workers ofEcco Heating Products Ltd.
This Vault Document shall remain in effect until either party has made known a desire to change
the provisions and shall provide a minimum of four (4) months' notice in advance of
negotiations to change its intent.
