Acts, 1956. 504 — Chaps. 600, 601. Chap.QOO An Act relative to the retirement allowance of LIEUTENANT EMANUELE MONTIBELLO, A FORMER MEMBER OF THE FIRE DEPARTMENT OF THE CITY OF LYNN. Be it enacted, etc., as follows: Section 1. Notwithstanding any provisions of general or special law, nor any action taken by the retiring authority or board of the city of Lynn with reference to the retirement of Lieutenant Emanuele Montibello, a former member of the fire department of the city of Lynn, the appropriate retiring authority in said city shall pro\ade that said Lieutenant Emanuele Montibello be examined by a medical panel con- — sisting of three physicians, to be selected as follows one by the city of Lynn, one by the state department of public health and who shall, so far as practicable, be skilled in the particular branch of medicine or surgery as may be involved : in the case of the said Montibello, and one by the said Montibello. If the said retiring authority finds from all the evidence and the report of the medical panel that Emanuele Montibello became permanentlj'" disabled because of injuries sustained through no fault of his own while in the actual performance of his duties as a member of the fire department of said city, it shall increase his retirement allow- ance to the amount he would have received had he been reat two thirds of the highest annual compensation received by him at the time of his retirement. Section 2. This act shall take effect upon its acceptance by vote of the city council of the city of Lynn, subject to the provisions of its charter, but not otherwise. The commission shall co-operate with the United States Department of Health, Education and Welfare or its successors in the administration of Pubhc I-aw 565 (83rd Congress, 2nd Session 1954), and amendments thereto, relating to the vocational rehabilitation of handicapped persons, and may expend such state, federal or other funds as are available for the vocational rehabihtation of handicapped persons. Section 75. The commissioner of rehabihtation shall be commissioner appointed by the governor with the advice and consent of t/on^^term*e'to the council for a term of six years and until his successor is ' duly appointed and qualified.
