RURAL MUNICIPALITY OF BRITANNIA NO. 502 MINUTES OF THE REGULAR MEETING HELD April 25, 2012 The Britannia Municipal Council convened their Regular Meeting in the Council Chambers of the Rural Municipality of Britannia Office, at 9:00 a.m. Wednesday, April 25, 2012 with Acting Reeve Karen Simons presiding. CARRIED 243-12 Water Rates CRUSH – That the Municipality conduct a study to establish water rates in surrounding communities. CARRIED 244-12 245-12 Gravel Exploration CRUSH – That prior to the next Council Meeting, the Gravel Committee conduct explorations for gravel on Winston Hougham’s land and at the Priest pit. CARRIED 251-12 252-12 Rezoning – SE 01-50-28-W3 COLLINS – That the Administrator be directed to draft the necessary Bylaw and documents to rezone all that portion of land that is located South and West of the Canadian Pacific Railway line on the SE 1-50-28-W3 from Agricultural/Resource to Industrial to match the Lloydminster Planning District Commission (LPDC). CARRIED 257-12 SE 31-52-25-W3 Notification of Wellsite SIMONS – That the Municipality acknowledges notification of a Husky Oil Operations Ltd. wellsite at A2-31-52-25-W3. CARRIED R.M. of Britannia #502 258-12 259-12 260-12 April 25, 2012 Regular Meeting 4 Right-of-Way Expansion COLLINS – That the Municipality contact adjoining municipalities to discuss if they would like to jointly form a resolution to get a more efficient process for approving right-of-way expansions and present it at the next SARM Convention. CARRIED SW 05-51-26-W3 Construct Approach FORLAND – That the Municipality have their own crew cut down the hill by 5000 cubes on Range Road #3265, west of SW 05-51-26-W3, and construct an approach into SW 05-51-26-W3 and SE 06-51-26-W3 with culverts if required. CARRIED Pipeline Crossing SE 25-50-27-W3 FORLAND – That the Municipality enter into the Agreement, attached hereto and forming a part of these minutes as Appendix ‘A’, regarding approval of the request from Husky Oil Operations Ltd. to replace a section of their crude oil pipeline located under the road allowance, Range Road #3270, between SE 2550-27-W3 and SW 30-50-26-W3. CARRIED Councillor Geall arrived at the meeting at 11:40 a.m. 261-12 262-12 SW 12-51-28-W3 Construct Approach COLLINS – That the request from Ijaz Ahmed to construct an approach off of the service road west of Lot 3/Parcel A, Plan #101886464 be denied and that Council recommends that the approach be built off of the access road. CARRIED NE 11-51-25-W3 Development and Building Permits GEALL – That the Applications for Development and Building Permits of Jason Leer & Kim Schindel to move in a 1200 sq. ft. RTM and construct a barn on NE 11-51-25-W3, be approved subject to the following conditions: - Existing approach must be utilized for access. - Approval must be obtained from K.L. Inspections Services Ltd. - Buildings must maintain the following minimum setbacks: - 7.6 metres from the internal subdivision road; - 45 metres from municipal grid roads, main farm access roads, and provincial highways or a greater distance as required by the Ministry of Highways and Infrastructure; - 3 metres from other yards abutting the property. CARRIED 263-12 SE 36-50-28-W3 Construct Access Road COLLINS – That the Municipality acknowledges notification from Whitecap Resources Inc. to construct an access road for access to C8-36-50-28-W3. CARRIED Council recessed the meeting for a lunch break at 11:50 a.m. The meeting was called back to order at 1:05 p.m. 264-12 6B5-28-2C4-28-51-25-W3 Proximity to Road Allowance SIMONS – That the request of Husky Oil Operations Ltd. (Husky) to drill within proximity to the road allowance be approved, subject to the following conditions: Husky be made aware of possible road widening (100’) in the future & to place lease accordingly; No permanent structures of any kind shall be put within 150 feet from the center of the road allowance; The R.M. of Britannia No. 502 shall have the right to backslope if necessary for road construction purposes on the surface lease and shall not incur any additional costs as a result of the surface lease occupying the said property; R.M. of Britannia #502 April 25, 2012 Regular Meeting 5 The R.M. of Britannia No. 502 shall have the right to acquire land covered by the lease to create additional right of way for road construction and/or maintenance purposes and shall not incur any additional costs in obtaining the right of way as a result of the lease occupying the said property; Husky shall agree to indemnify and save harmless the R.M. of Britannia No. 502 from and against all loss, costs, charges, damages (including the R.M. of Britannia No. 502) and expenses which the R.M. of Britannia No. 502 may suffer or sustain as a result of the operations by Husky on the demised premises. CARRIED 265-12 3C12-30-4B4-30-52-26-W3 Utilize/Construct Approaches TIPPE – That the request of Baytex Energy Ltd. CARRIED 266-12 NW/NE 01-52-28-W3 Power Line Salvage / New Inline Pole CRUSH – That the Municipality approve the request from ATCO Electric to salvage power line and install new inline pole at Sandy Beach Regional Park. CARRIED 267-12 NW 17-52-27-W3 Construct Approach/Gate CRUSH –That the request of Husky Oil Operations Ltd. CARRIED Operations Manager, Mike Matthews and Tom Gehlen, from Resource Management International, joined the meeting at 1:15 p.m. R.M. of Britannia #502 April 25, 2012 Regular Meeting 6 Ron Noeth from Baytex Energy met with Council from 1:20 – 1:40 p.m. 268-12 269-12 270-12 271-12 Wages - Gary Cooper GEALL – That the Municipality start seasonal worker Gary Cooper the same rate he was paid previously with the R.M. of Britannia which was $25.00/hr. CARRIED International Truck CRUSH – That the Municipality authorize Truck Zone to perform the required repairs to the 2007 International Truck (Unit #27) as per the repair estimate in the amount of $28,073.42 (inc. GST). CARRIED Temporary Road Closure CRUSH – That the Municipality temporarily close the “Barrett” Road, Surface Parcel #130590008, Plan #BA6080 Ext. 1, for road construction. CARRIED Road Maintenance TIPPE – That the Municipality focus on maintaining the already oiled roads as a priority over any new oiled roads. CARRIED Operations Manager, Mike Matthews and Tom Gehlen, from Resource Management International, left the meeting at 3:10 p.m. Council recessed for a coffee break from 3:10 – 3:20 p.m. 272-12 Closed to Public SIMONS – That this meeting be closed to the public for an in-camera discussion at 3:35 p.m. CARRIED 273-12 Rise & Report SIMONS – That Council resume a regular meeting (rise & report) at 4:15 p.m. CARRIED 274-12 Legal Council COLLINS – That the Municipality authorize Al Sholter, of Martinez Meunier Sholter Lawyers, to mediate a Human Resources employment issue on behalf of the R.M. and bring back to Council for ratification. CARRIED 276-12 Hillmond 4H Beef Club TIPPE – That the Municipality donate $40.00 to Hillmond 4H Beef Club. CARRIED 277-12 Bylaw 03-2012 Tax Exemption Bylaw FORLAND – That Bylaw No. 03-2012, being a Bylaw to Provide for Entering into a Tax Exemption Agreement for the Purposes of Economic Development, be read a first time. CARRIED Lloydminster Dump Road TIPPE – That the Municipality request a recommendation from Engineer Tom Gehlen of Resource Management International, for a surface treatment on the Lloydminster Dump road to protect the patching work which has been done in past years. CARRIED Landrose Battery Intersection FORLAND – That the Municipality request a recommendation from Engineer Tom Gehlen, of Resource Management International, on the Landrose Battery intersection.
