Call to Order
Chairman Ostuni called the meeting to order at 7:00 PM and led those present in the Pledge of
Allegiance.
Approval of Minutes August 25, 2014
Motion was made by Tom Tartaglia and seconded by John Eallonardo to approve the minutes of August
25, 2014. Motion Passed.
Application for revised site plan - 204 Bass Street
The owner of the property Matt Wilson was not present. Eric Roberts, a lessee at the property, was
here to present the application for a new façade on the existing building.
Mr. Roberts provided some background about the 2 businesses that currently are in the building. Media
Resources, is a contractor’s marketing office for NYSERDA, Halco, Comfort, etc. There are 8 employees,
who work various shifts, between the hours of 8:00 a.m. to 8:30 p.m. weekdays and 8-4 on Saturday and
noon – 4 on Sunday. HALCO, a heating and plumbing business, has 2-3 people in their office, 2-3 days
per week with the exception of Tuesday when a weekly meeting is held and the number increases.
Mr. Roberts wants to improve the building, as lease holder, to better reflect the residential
neighborhood. He also stated that a use variance was granted in 1984 for 2 service offices and 2
apartments.
Chairman Ostuni asked the board if they had any questions for Mr. Roberts.
John Eallonardo asked about parking. Bill Reagan said it was sufficient and that the applicant was only
here for the façade. He stated it is not a consumer business and there are no visitors.
Mike Lamontagne asked if the façade would be around the entire building or just the front. Mr. Roberts
said it would just be the front and they would be painting the sides. He suggested muted colors and
trim to match the neighborhood.
John Bixby – 313 Third Street
Mr. Bixby is a neighbor who has a right-of-way to drive through. He believes the business operates 24
hours a day and complained about the dumpster, gravel, a motion light and stated there is a lot of
activity at all hours.
Bill Reagan stated that he hasn’t observed any of this activity for the past month or so. Attorney Langey
explained to Mr. Bixby that the purpose of this meeting was solely for the application in front of the
Planning Board. The Planning Board is not an enforcement agency; it is up to the Codes Enforcement
Officer to monitor.
Mr. Bixby wanted to know how many businesses were there and Chairman Ostuni stated there are 2 and
2 apartments.
Tom Tartaglia stated it was zoned residential with a use variance for commercial. He stated the roof
should be shingles and not metal. Mr. Roberts said the drainage coming off the roof is an issue and that
is why they were going with a metal roof.
Attorney Langey mentioned the Community Design Handbook and suggested the applicant demonstrate
compatibility with the existing homes in the neighborhood by supplying color samples of the paint and
materials to be used.
Jim Taft had no questions.
Mr. Roberts said he will come back with color options and also that he would like to keep a small
dumpster for metal scraps to be emptied during normal business hours.
Attorney Langey doesn’t think that fits in with the variance granted for the residential neighborhood.
Mr. Roberts stated that they have 6-7 blue bins of recycling each week.
Chairman Ostuni said per the Community Design Handbook, the applicant needs to provide samples
(colors, materials, etc.) to be compatible with the neighborhood.
A SEQR needs to be completed and Part 1 of the Environmental Assessment Form.
Mr. Bixby gave a history of the building and its occupants based on his own research. He again stated he
has a problem with a dumpster being there and his concern with the future growth of the businesses.
Mr. Roberts will return for the November meeting with color samples and the SEQR.
Old Business – 101 ½ Bass Street – Special Use Permit
The applicant has withdrawn her application
Mavis Tire – the building has been repainted
Mr. Tartaglia moved and Mr. Taft seconded the motion to adjourn. All ayes, meeting adjourned at 8:25.
