Sanctions: Lebanon The Jersey Regime includes two distinct Orders which place sanctions on Lebanon, as follows: › Documents Regime 1 › United Nations Security Council › UNSCR 1636 (2006) › Jersey Legislation › The Lebanon and Syria (United Nations Measures) (Channel Islands) Order 2006 Regime 2 › United Nations Security Council › UNSCR 1701 (2005) › European Union › Council Regulation (EC) No 1412/2006 › Jersey Legislation › Community Provisions (Restrictive Measures – Lebanon) (Jersey) Order 2007 › Overview of current sanctions measures To date, no targets have been designated under either Regime 1 or Regime 2 › Current financial sanction measures implemented by Jersey in relation to Lebanon include: › Freezing of funds and economic resources of designated individuals or entities › Ban on provision of certain services related to military activities › Jersey regime Regime 1 › In 2005, the United Nations imposed travel restrictions and an assets freeze on all individuals suspected of involvement in the planning, sponsoring, organising or perpetrating of the terrorist bombing in Beirut, Lebanon on 14 February 2005 that killed, among others, former Lebanese Prime Minister Rafiq Hariri. Please note that to date, no targets have been designated by the relevant UN Sanctions Committee. Updated: 23 February 2017 Page 1 of 3 Sanctions: Lebanon › The Lebanon and Syria (United Nations Measures) (Channel Islands) Order 2006 (Lebanon and Syria Order) (in force from 31 May 2006) was made to give effect to and implement certain measures called up by the members of the United Nations by UNSCR 1636 (2005) and prohibits any person (including the designated persons) to deal with funds or economic resources owned, held or controlled by a designated person, or make funds or economic resources available to or for the benefit of a designated person, unless authorised to do so by a license granted under Article 8 of the Lebanon and Syria Order. › For the purposes of the Lebanon and Syria Order, designated person means any person for the time being designated under paragraph 3(a) of UNSCR 1636 (2005) and registered by the Committee of the Security Council established pursuant to paragraph 3(b) of UNSCR 1636 (2005). › The Lebanon and Syria Order creates offences (Article 11) any person who: › contravenes Article 3, 4 or 6 of the Lebanon and Syria Order is guilty of an offence and liable on conviction to imprisonment for a term not exceeding 7 years or to a fine or to both, › contravenes Article 8(7) or (8) or under paragraphs 4(b) or (d) of the Schedule to the Lebanon and Syria Order is guilty of an offence and liable on conviction to imprisonment for a term not exceeding 2 years or to a fine or to both, › contravenes paragraphs 2(3) or 4(a) or 4(c) of the Schedule to the Lebanon and Syria Order is guilty of an offence and liable on conviction to imprisonment for a term not exceeding 6 months or to a fine not exceeding level 4 on the standard scale or to both. Regime 2 › In 2006, the UN passed UNSCR 1701 (2006) which was implemented in the European Community by Council Regulation (EC) No 1412/2006 of 25 September 2006 concerning restrictive measures in respect of Lebanon (EU Council Regulation). › These sanctions were imposed in an effort to assist the Government of Lebanon with its efforts to exercise full sovereignty over all Lebanese territory by restricting access to weapons. As the original EU Council Regulation has been subject of various amendments, the individual amending EU Regulations and the latest consolidated version of the original EU Council Regulation can be found here by searching for them individually. › The Community Provisions (Restrictive Measures - Lebanon) (Jersey) Order 2007 (Lebanon Order) (in force from 6 November 2007) gives effect to and applies the EU Council Regulation in Jersey. In accordance with the EU Council Regulation, the Lebanon Order prohibits unauthorised provision of technical assistance related to military activities and use of arms and related materiel of all types and any financing or financial assistance related to military activities, including, inter alia, grants, loans, export credit insurance. › The Lebanon Order creates offences (Article 8) any person who: › contravenes Article 2 of the Lebanon Order; Updated: 23 February 2017 Page 2 of 3 Sanctions: Lebanon › intentionally furnishes false information or a false explanation to the Minister or any authorised person by the Minister, which is requested using powers under Article 7 of the Lebanon Order; or › with the intent to evade furnishing information or producing documents in accordance with a request made under Article 7 of the Lebanon Order, destroys, mutilates, defaces, secretes or removes any document, is guilty of an offence and liable to imprisonment for a term of 2 years and to a fine. any person who, without reasonable excuse, › refuses or fails within the time and manner specified to comply with a request made under Article 7 of the Lebanon Order is guilty of an offence and liable to imprisonment for a term of 3 months and to a fine.
