For more information, please visit www.collegeoftrades.ca ENFORCEMENT OFFICER CONTRACT FULL-TIME – 6 MONTH CONTRACT SUDBURY, ON Job Band 10: $36.82 – $48.07 36.25 Hours/Week The Ontario College of Trades (College) is currently seeking an Enforcement Officer to administer and enforce the Ontario College of Trades and Apprenticeship Act (OCTAA) and other Acts, regulations, standards in accordance with the College’s policies and procedures in various workplaces in the North Eastern region of Ontario. The successful candidate will: Conduct physical inspections at a variety of industrial, retail, and construction work locations for contraventions (e.g. compliance audits, non – membership); observe workplace operations and identify trade related issues. Identify contraventions of relevant provincial legislation and encourages self-compliance of workplace parties, as appropriate. During inspections, collect and seize evidence, interview and obtain statements from employers, workers, supervisors, and other relevant parties. Using information gathered during inspections, make decisions on such matters as: College membership, unresolved trade related/scope of practice concerns, worker education and training programs. Issue decisions and requirements. Follow-up to determine compliance with relevant legislation. Communicate standards of compliance to workplace parties regarding workplace situations such as: trade specific activities, journeyman/apprentice ratios, scope of work, etc. to facilitate compliance with relevant provincial statutes. Issue Certificates of Offence and serves Part 1 Offence Notices and Part I and Part III Summonses. Prepare comprehensive inspection reports on completed inspections for posting at workplace and internal use. Submit information and reports (e.g. inspection package) in a timely manner and in accordance with departmental procedures. Conduct meetings with workers/employers representatives and associations, conduct follow-up inspections and take action to ensure compliance; maintain professional and effective communication with workers/employers (often under stressful conditions), resolve disputes between workers and employers as prescribed under the OCTAA. Explain application, entitlements, responsibilities and rights under OCTAA, regulations and related legislation. As assigned, may conduct or assist in investigating complaints (usually without prior notice) to verify compliance with legislated standards. Complete or assist in completing investigation reports/briefs. Give evidence in court/ hearings, serve summonses; act as an agent of the College in court proceedings such as: assist in legal actions (prosecutions related contraventions and professional misconduct investigations); assist in drafting and issuing search warrants, attend first appearances in court (Part I); appear as a witness at prosecutions, give evidence. Monitor trade information and trends to remain current with industry and sector technologies, practices and issues; utilize trade/sector data and information from external sources to target workplaces for inspections; select high potential firms/locations using workplace selection methodology (including external trade/sector specific metrics and data), College referrals and stakeholder intelligence. Audit and promote the OCTAA and regulations with workplace parties covered by the OCTAA by scheduling regular compliance audits. Carry out provincial and/or regional initiatives, such as blitzes and targeted enforcement strategies, and take appropriate action. Work in partnership with external organizations, such as: the Electrical Safety Authority and Ministry of Labour (MOL), construction/industrial/commercial sector groups, sector inter-agency groups, other regulatory bodies. Respond to enquiries/complaints from public, owners, suppliers, workers, union/employer officials, and internal College/government clients, in person, on telephone and via e-mail. Identify contentious issues for Senior Management, provide facts and information for the preparation of briefing and issue/information notes, as required. Maintain knowledge and current information on matters relating to the College, its governance and other advisory bodies. Liaise with College staff and shares knowledge. Participate and represent the College on internal and external committees/meetings, as assigned by management. Prepare and deliver enforcement related presentations, as assigned by management. Identify and notify the Supervisor of any urgent or high profile issues. Work with peers on project initiatives for the development and implementation of administrative processes and systems across the division. Provide support to department co-workers in the provision of administrative services for the College, such as those associated with Provincial Offences Court and the Complaints, Discipline and Fitness to Practice Committees. Qualifications: Ability to understand, analyze, interpret and apply the OCTAA in an operational context and environment that is constantly changing and has competing priorities. Ability to work independently and with minimal supervision. Knowledge of OCTAA, pertinent regulations, standards and codes, and sections of other relevant provincial or federal statutes and regulations and understanding of relevant constitutional law, the Canada Evidence Act, the Provincial Offences Act, etc. Knowledge of relevant College Division and Department policies, roles and procedures to conduct inspections and investigations, conduct payroll/records audit for compliance with regulated trade ratio requirements, determine compliance, identify and remedy contraventions, issue reports and orders, apply and explain the intent of legislation. Detailed understanding and knowledge of College and Division quality assurance/quality control, operational and sector programs including pertinent codes of conduct and ethics. Knowledge of College and Division business plans and strategies in order to develop and maintain partnerships with internal and external sector associations/organizations. Investigative techniques to carry out inspections and investigations. Experience laying charges under the Provincial Offences Act and/or giving evidence and preparing briefs for Disciplinary Committees for self-regulated professional colleges. Knowledge of court procedures practices and processes to prepare and submit information on possible prosecutions, assist College legal representatives in legal actions, and to act as an agent of the College in court proceedings. Knowledge of trade regulations, theories, techniques, technical data, reports and drawings, processes, practices, issues, work procedures, equipment, management and operational policies and practices in the sectors under the responsibility of the OCTAA. Knowledge of trends, new developments and emerging technologies in the sectors under the responsibility of the OCTAA. Knowledge of computer information technology, College computer databases and related software packages to use sector and work planning systems, input/access information data systems, (e.g. TMS system) and prepare documents while ensuring adherence to quality assurance/control programs. Trades and/or enforcement knowledge and background would be an asset. Experience working with and applying the POA would be an asset. Experience conducting investigations would be an asset. Skills: Investigative skills, including: carrying out the physical inspection of a workplace, trade related equipment and machinery, interviewing workers, their representatives and employer representatives, reviewing operating procedures, training programs and a variety of College/Division protocols. Analytical and evaluation skills to interpret information collected (may be technical in nature) and assess whether the employer's operation is in compliance with legislation, ratio requirements, regulations, policies and standards, and determine what strategies/action(s) should be taken. Decision making, analytical and facilitation skills in order to conduct searches and/or gather information/evidence, analyze and evaluate observations/findings and assess situations to determine when to take action, such as: issuance of orders, tickets, summonses, facilitate resolutions, recommend legal action when contraventions of the legislation occur. Verbal communication skills to interview witnesses, worker and employer representatives; provide information on the application of legislation, regulations, standards, College/Division program, policies and procedures, deliver presentations, and discuss compliance issues with clients, public and other stakeholders. Appear at hearings and court proceedings as a witness. Written communication skills to document and convey information on workplace situations and operations, prepare written decisions regarding work site visits and ratio investigations, prepare reports and other information in accordance with College/Division standards. Excellent judgment in order to identify contentious issues for senior management, provide facts and information for the preparation of briefing material and issue notes. Interpersonal and dispute/conflict resolution skills to resolve issues/disputes between workplace workers, supervisors and management in highly confrontational or adversarial situations.
