The Commonwealth shall not make any law for establishing any
religion, or for imposing any religious observance, or for
prohibiting the free exercise of any religion, and no religious test
shall be required as a qualification for any office or public trust
under the Commonwealth.

1. The language of 6 (j) cannot be construed (as it was in United States v. Seeger, supra, and as it is in the
prevailing opinion) to exempt from military service all individuals who in good faith oppose all war, it
being clear from both the legislative history and textual analysis of that provision that Congress used the
words "by reason of religious training and belief" to limit religion to its theistic sense and to confine it to
formal, organized worship or shared beliefs by a recognizable and cohesive group. Pp. 348-354.
2. The question of the constitutionality of 6 (j) cannot be avoided by a construction of that provision that is
contrary to its intended meaning. Pp. 354-356.
3. Section 6 (j) contravenes the Establishment Clause of the First Amendment by exempting those whose
conscientious objection claims are founded on a theistic belief while not exempting those whose claims are
based on a secular belief. To comport with that clause an exemption must be "neutral" and include those
whose belief emanates from a purely moral, ethical, or philosophical source. Pp. 356-361.
4. In view of the broad discretion conferred by the Act's severability clause and the longstanding policy of
exempting religious conscientious objectors, the Court, rather than nullifying the exemption entirely, should
extend its coverage to those like petitioner who have been unconstitutionally excluded from its coverage.

Mr. HIGGINS (Victoria).-I want if I can to recommend the Commonwealth Bill and get it carried. But
why should we be faced with this difficulty? You have put in the preamble a religious recital which is not in
the Constitution of the United States of America, but you have not put in the safeguard against religious
intolerance which they have there. I ask honorable members how I shall face that difficulty? There is a grave
suspicion evidenced by what I said that there were 36,000 distinct signatures upon this very point. I do not
think it is too much for me to say that we ought to reassure those persons. They may be wrong. It may be
right, as my friend (Mr. Barton) says, that there is no power by implication in the Commonwealth to pass this
law. It may be right as he says, that the Commonwealth ought to have the power. But I only say that it is a
state matter, and it should be left to the states. My honorable friend (Mr. Fraser), with all respect to him,
shows the current ignorance on this matter because he will not understand that the state, if my proposal is
carried, will have the same power as it has now to stop any theatrical performances on Sunday.

Mr. BARTON.-I do not think the fact that we may be held by law to be a Christian community is any
reason for us to anticipate that there will be any longer any fear of a reign of Christian persecution-any fear
that there will be any remnant of the old ideas which have caused so much trouble in other ages. The whole
of the advancement in English-speaking communities, under English laws and English institutions, has shown
a less and less inclination to pass laws for imposing religious tests, or exacting religious observances, or to
maintain any religion. We have not done that in Australia. We have abolished state religion in all these
colonies; we have wiped out every religious test, and we propose now to establish a Government and a
Parliament which will be at least as enlightened as the Governments and Parliaments which prevail in various
states; therefore, what is the practical fear against which we are fighting? That is the difficulty I have in
relation to this proposed clause. If I thought there was any-the least-probability or possibility, taking into
consideration the advancement of liberal and tolerant ideas that is constantly going on of any of these various
communities utterly and entirely retracing its steps, I might be with the honorable member. If we, in these
communities in which we live, have no right whatever to anticipate a return of methods which were practised
under a different state or Constitution, under a less liberal measure of progress and advancement; if, as this
progress goes on, the rights of citizenship are more respected; if the divorce between Church and State
becomes more pronounced; if we have no fear of a recurrence of either the ideas or the methods of former
days with respect to these colonies, then I do suggest that in framing a Constitution for the Commonwealth of
Australia, which we expect to make at least as enlightened, and which we expect to be administered with as
much intellectuality as any of the other Constitutions, we are not going to entertain fears in respect of the
Commonwealth which we will not attempt to entertain with respect to any one of the states. Now, we have
shown that we do not intend these words to apply to our states by striking out clause 109. That might be a
provision that might be held to be too express in its terms, because there may be practices in various
religions which are believed in by persons who may enter into the Commonwealth belonging to other
races, which practices would be totally abhorrent to the ideas, not only to any Christian, but to any
civilized community; and inasmuch as the Commonwealth is armed with the power of legislation in
regard to immigration and emigration, and with regard to naturalization, and also with regard to the
making of special laws for any race, except the aboriginal races belonging to any state-inasmuch as we
have all these provisions under which it would be an advisable thing that the Commonwealth, under its
regulative power, should prevent any practices from taking place which are abhorrent to the ideas of
humanity and justice of the community; and inasmuch as it is a reasonable thing that these outrages on
humanity and justice (if they ever occur) should be prohibited by the Commonwealth, it would be a
dangerous thing, perhaps, to place in the Bill a provision which would take out [start page 1772] of their
hands the power of preventing any such practices.

The question therefore is if the Halal certification is an exercise of a religion?

In my view it is not. It is nothing more but some business enterprise that slugs people who are
not of the Islamic faith to nevertheless pay for the usage of the Halal certification.
In my view, it is unconstitutional to force upon people who are not of the Islamic faith to
nevertheless be forced to pay for the Halal certification.

In my view any Halal certified food should be sold separately and businesses should allow any
person to purchase goods without the Halal certification being applied.
While I understand that there are limitations as to what Muslims may or may not consume, and
so Halal certification assist them, then they can go to special stores and pay a premium for this
kind of special market food or whatever. After all Halal certification is now used on numerous
items nothing to do with consuming or not consuming certain foods.
Halal certification is so to say a form of taxation not by the Federal Government but by those
who claims to have the power to apply such a charge for Halal certification. By this customers
who purchase for example at a supermarket items are by this forced to fund a religion they may
in fact oppose its doctrine. It is then a violation of their “religious freedom”!
As I indicated we have embedded in the constitution “political liberty” and I held that
compulsory voting was contrary to my constitutional rights and so unconstitutional and the
County Court of Victoria exercising federal jurisdiction upheld both appeals.
Likewise to force me to contribute by the Halal certification to the Islamic religion is a violation
of my “religious liberty”.
I understand that this Halal certification is going mad to include items nothing to do with
consuming food. It is a money spinning certification on items that underlines the misuse and
abuse of it all.

One has to ask what is the purposed and justification of Halal certification and why should it be
forced upon people who may not desire to contribute financially to this Halal certification but are
forced to do so because items are too often now with halal certification.
.
Are we next going to have the absurdity that anyone enjoying rays of sunshine is bound to pay
for Halal certification?
One major Queensland meat processor, which did not want to be identified, claimed it had been quoted
$27,000 a month in Halal certification fees through another MUI-endorsed certifier - four times more than

INITIAL APPLICATION AND ASSESSMENT
Fees for the initial assessment are fixed as follows:
1. Non-refundable one-off application fee of $110.00 (GST inclusive) for the first site and $55.00 (GST
inclusive) for each additional site, regardless of outcome. This fee is payable at the time your application is

lodged. Processing will not commence until such payment is received.
2. The application processing fee stated above is separate to the costs for halal accreditation and certification.
INSPECTION
Inspection is a fundamental part of the certification and accreditation process. Inspections not only help us to
better understand your company’s unique needs, but also encourage consumer trust and confidence in the

integrity of halal certification processes.
Inspections usually occur on a yearly basis, and a standard inspection is normally up to two hours. Inspections
are charged according to standard rates (such as ATO guidelines), with travelling expenses charged at cost basis.
ACCREDITATION AND CERTIFICATION

Accreditation refers to the official recognition of a company’s suitability for preparing Halal goods on their
premises. A fixed cost applies for the first manufacturing site, with secondary sites charged at a discounted rate.
The price of accreditation varies according to the nature of the manufacturing premises, and is included in the
quotation provided to your company after assessment. This quotation is normally provided within seven days of
receipt of application.

Certification refers to the official recognition of individual products as complying with Halal requirements.
Generally, products in low to medium risk categories that have fewer ingredients (up to ten ingredients) are
charged at a minimal rate, with fees adjusted accordingly for products in higher risk categories and/or products
that have a wider and more complex range of ingredients. Exact certification fees are determined after
assessment of the nature of your products, and included in the quotation provided to your company.

In addition to maintaining their current certificate, many companies also prefer to feature our logo on their
product packaging. As Halal Australia is internationally recognised in several countries, the Halal Australia logo
helps to visibly identify your product as meeting halal requirements to both local and international consumers.

Firstly, we need to understand that halal certification has become a many tentacled octopus, reaching into
virtually every area of our lives. Farmers are being forced to pay a halal certification fee for the grass the
animals eat. Then a fee for the animals to be transported in halal certified vehicles. In many cases, even the
drivers must be muslims now, as they are the only ones who are trusted by muslims to maintain the halal
conditions. Slaughter houses pay. Packaging companies pay. Food processors pay. And finally, WE pay.
One abattoir has revealed that it has been paying $27,000 a MONTH! That amounts to a whopping $324,000
a year.
Muslims are bound by the koran to donate 1/8 of their earnings of 2.5% of their wealth to a mosque or other
islamic “charity” organizations. Mosques collect much of the money and then donate it to the charities. Police
raids in many nations have found terrorist related documents and equipment. This information was provided
by Gavin Boby, a tireless UK lawyer crusading against mosque development applications. The annual
revenue generated by halal certification around the world has been conservatively estimated at $US700
Billion dollars. In fact, some estimates say that the revenue from halal certification is likely as high as 2
Trillion dollars!

It must be clear that as a customer I am in the end forced to pay for the Halal certification that
then percentage wise goes to the building of mosques, etc. As such I am forced to financial
support a religion to which I have no desire to do so. This clearly violates my constitutional
rights of “religious liberty”.

Below I have listed some items in red colour showing how absurd it is that even dog food is
Halal certified. Also water.
In my view if Halal certification is to be justified then nit should be a program under the
Commonwealth of Australia and not some private organisation getting a lot of money.
How on earth can Halal certification be justified for dogs? Are dogs also now following a
religion?

The same with cleaning agents. Perhaps soon municipal/shire councils will have to pay for
certification for the payments and parks?
When will this extortion stop?

I some 50 years ago resided in Germany where automatically one had 10% of wages for the
Catholic Church. When I discovered this I made clear I had no intention to pay for someone else
church and well that was the end of any payments.

I accept that there might be people who desire Halal certification but let them pay for it
themselves, and not force the cost upon others!

The halal certification has in my view nothing to do with religious freedom of those following
the Islamic faith. It is a scheme that simply is used to have some people making a lot of money
and the dog food and detergents, etc, are a clear example of it.
We must not forget that only about 2.2% of the Australian population reportedly follow the
Islamic faith and yet it dictates upon about 97.8 % it shall pay towards the certification cost of
Halal. Clearly undemocratic also!

In my view the Commonwealth of Australia has the legislative powers to prevent such an
elaborate scam to continue, as much as the Framers of the Constitution referred to cruelty, etc.
What is needed to be understood is that Muslims can attend to special Halal shops if they desire
to have Halal certification items and let non-Muslims have their own items without Halal
certification.

Are we next to expect Halal certified soil, tyres, etc?

Perhaps what really might be needed is a non-Halal certification for those wishing to
purchase only Halal food. As such that those desire to be warned against non-Halal food &
other items pays for this to the grower/farmer/manufacturer to include that on its package.
Then the cost is born only by those who desire not to use non-Halal certified items.
